1999 FOUNDED 81 PROVINCES LEGAL SERVICES COMMUNICATION IN 4 LANGUAGES

We do not treat a residence file as limited to the application form. From entry into Türkiye onward, we evaluate together the lawful stay status, the ground for the application, the needs of family members, real estate and lease relationships, financial documents, notifications and, where necessary, litigation options. The aim is to prevent problems that are difficult to remedy later because of a wrong choice of status or an overlooked time limit.

File-specific legal assessment: Every person’s citizenship, entry history, previous applications and actual life in Türkiye are different. Instead of applying a ready-made file to another person, we proceed from the applicant’s real situation.

Regular follow-up and information: We track the submission of documents, notices of deficiency, interview summonses, administrative decisions and court proceedings on a recorded basis, and we keep the client informed about developments and what needs to be done.

Professional care and confidentiality: We provide legal services within the framework of professional rules, the duty of confidentiality and the principles of personal data protection. The evaluation of documents, written legal opinions and representation before the relevant authorities are carried out in line with the agreed scope of services.

Securing your life in Türkiye with the right legal status

FROM THE FOUNDING ATTORNEY

Attorney Umut Güneş; portrait in the “From the Founding Attorney” section of the source guide

A person’s plan to live in Türkiye for a certain period can affect family relationships, housing, education, medical treatment or commercial ties. For this reason, a residence permit application should not be treated merely as filling in a form and submitting documents. A wrong ground for application, an address that does not reflect the facts or a missed notification can change a person’s entire plan in Türkiye.

Our first step is not to assume which permit is easier to obtain, but to determine which legal status suits the person’s actual circumstances. We then bring the purpose of stay, the requested duration and the documents to be submitted into line with one another. After the application as well, we continue to follow requests for missing documents, interview summonses and notifications.

When an unfavorable decision is encountered, we do not look only at the outcome of the decision. We examine together the reasoning of the decision, the manner of service, the documents in the application file, the person’s continuing lawful stay and any other administrative decisions. Where necessary, we turn to administrative and judicial remedies with the right request and appropriate evidence.

We combine the institutional experience we have gained since 1999 with the attention that each file requires. I hope that this guide helps you assess your own situation more clearly, distinguish the documents you need to prepare and see in good time at which stage you should seek legal support.

The right to residence and the review before applying

SCOPE AND INITIAL ASSESSMENT

Scope of the short-term residence permit

A short-term residence permit is a personal administrative status that allows a foreign national to stay in Türkiye for a certain period on the basis of a ground for stay specified in the law. The ground relied on must be shown in the application and maintained throughout the permit period. Falling within a category does not by itself require that a permit be granted; the general and special conditions are assessed together.

A residence permit alone does not confer the right to work. Establishing a company or becoming a company shareholder likewise does not replace the permit or exemption required for actual work. The regimes provided for work, education, family unity, humanitarian reasons and international protection are separate from one another.

Buying real estate, opening a bank account in Türkiye or staying with a close relative also does not give rise to a residence permit on its own. Which legal ground these facts support is determined separately. A short-term residence permit does not mean that the conditions for long-term residence or citizenship are met automatically.

Critical distinction: The residence permit card, the certificate of residence (yerleşim yeri belgesi) and the residence permit application certificate are different documents. An address record does not by itself prove a foreign national’s permit status, and an application form does not by itself prove that a residence permit has been granted.

Determining the legal situation before applying

Preparation for the application begins with the passport and the most recent record of entry into Türkiye. The visa, visa exemption, and the validity of any existing residence permit or work permit are examined separately. Previous rejection decisions, violations of lawful stay, entry bans and deportation proceedings may affect the assessment of the new file.

  • With which passport and in which status did the person enter Türkiye?
  • When does the current lawful stay end?
  • What is the actual purpose of stay in Türkiye and the requested duration?
  • How are the applicant’s address and right to accommodation documented?
  • Can the source and continuity of income be explained?
  • Is the health insurance suitable for the requested period?
  • Which status is appropriate for each family member?
  • Is there a difference between previous applications and the new statements that needs to be explained?

If there is more than one real connection, the main ground for application is determined; the other connections are used as supporting grounds. A person who owns a home, is retired and has a child in Türkiye can explain all of these characteristics in the same file. However, grounds that are not compatible with one another are not combined at random in order to increase the likelihood of acceptance.

Important warning: A new passport, a new lease or a different application heading does not by itself eliminate a past violation of lawful stay or a rejection decision.

The short-term residence permit has 14 statutory grounds for application. The explanations below help you determine your actual purpose of stay. Each category has its own conditions and document list on the pages that follow.

1 Scientific research

If you have a concrete research project in Türkiye and an institutional connection that confirms it.

p. 11

2 Home ownership in Türkiye

If you use a home that you own in Türkiye as your own residence.

p. 12

3 Commercial ties and starting a business

If you will be in Türkiye for genuine commercial talks or preparations to start a business.

p. 17

7 Stay for medical treatment

If you will receive specific medical treatment in a public or private hospital in Türkiye.

p. 19

An assessment that starts with documents: For a home, the title deed and use are required; for research, the project and the institution’s letter; for medical treatment, hospital admission. A general bank or lease document does not replace the reason for stay.

Grounds for application based on special circumstances

OPTIONS BY PURPOSE OF STAY

You may have more than one genuine reason. The main ground for application is chosen so that it is consistent with your actual life and your documents. The same option is not automatically valid for a spouse and children.

8 Judicial or administrative authority decision

If the competent authority considers your stay in Türkiye necessary because of a proceeding.

p. 20

9 Transition from family residence

If, as your family residence permit ends, one of the special transition conditions in the law exists.

p. 21

10 Turkish language course

If you will attend an independent Turkish language course at an authorized institution.

p. 22

11 Program through a public institution

If you will take part in education, research, an internship or a course through a public institution.

p. 23

13 Special investor category

If you do not work in Türkiye and make an investment of the scope and amount required by the competent regulation.

p. 25

14 Citizenship of the Turkish Republic of Northern Cyprus (KKTC)

If you are a citizen of the Turkish Republic of Northern Cyprus.

p. 26

Time limits and family are assessed together: Falling within a category is not a guarantee of a permit. The special conditions, the personal document list and the current lawful stay are checked. The initial application, extension and transition are not categories but forms of procedure.

The actual reason for stay and the right application

SPECIAL SITUATIONS AND COMMONLY CONFUSED APPLICATIONS

Not every description used in everyday life is a separate type of residence. The examples below are meant to distinguish which ground for application actually exists. Retirement, renting a home, a bank account or being a company shareholder does not by itself create a new short-term residence category.

Situation or expectationCorrect assessmentFirst document to check
I am retired and want to live in TürkiyeRetirement income can explain financial sufficiency. A genuine tourism purpose, home ownership or another statutory reason for stay must also exist separately.Income document and the actual plan of stay
I rented a home or I have money in a bankThese are documents of housing and financial means. They do not replace the ground for application.A purpose document separate from the lease and income documents
I set up a company or I am a company shareholderCommercial ties, special investment and actual work are examined separately. Being a shareholder does not by itself confer authority to work.Business activity plan and job description
I have a case in TürkiyeThere must be a request or decision of the competent authority that considers staying in Türkiye necessary. Filing a lawsuit does not by itself provide this permit.Authority letter or decision
My relative is receiving treatment hereThe status of the accompanying person is determined separately. The patient’s treatment document does not automatically grant a permit to everyone.Need for accompaniment and, if any, the agreement document
I live in the KKTCThe special category is based on KKTC citizenship. Residing there or being a student there is not sufficient.Citizenship document
My residence application was rejectedThe reasoning for the rejection, the lawful stay and the time limit to file an action are examined together. A new lease or the choice of another category does not by itself resolve the earlier problem.Rejection decision, notification and the earlier application file

When determining your own option: First identify your actual reason for stay and the document that proves it. Then check the duration, the family members and the current legal status. If you do not genuinely fall within any category, do not construct a ground merely in order to be able to apply.

The status suited to the person in family and education matters

SPECIAL SITUATIONS AND COMMONLY CONFUSED APPLICATIONS

People living in the same home do not need to hold the same type of permit. A separate status check is made for the spouse, for each child and for the accompanying person. The applications of family members are prepared consistently with one another; however, one person’s document does not replace the personal conditions of another.

Special situationRoute to examine and the important distinctionDocument to prepare especially
My child is turning 18If there is a family residence permit of at least three years, a transition to category 9 may be considered. Another suitable status is also examined according to education and dependency.Birth record, previous permits and education record
I divorced my spouse who is a Turkish citizenThe three-year family residence rule and the exception for domestic violence proven by a court decision are examined. The duration of the marriage and the duration of the permit are not the same.Divorce decree, permit records and, if any, the violence decision
The sponsor of my family permit has diedFor those remaining with a family residence permit dependent on that person, a transition may be considered without a minimum period being required. The situation of each family member is handled separately.Death certificate, family relationship and the previous permit
The home is in my spouse’s nameMy own share of ownership and my family residence conditions are examined. A single title deed does not automatically provide home-ownership residence to the whole family.Title deed shares, marriage and child documents
I have been accepted to a university or a language courseFormal higher education, student exchange, university-affiliated preparatory study and an independent Turkish language course are distinguished.Institution letter showing the type of admission
I have a relative who is an investor or a KKTC citizenFor an investor, the statutory scope of spouse and children; in the KKTC category, each person’s citizenship is checked separately.Family relationship, dependency or citizenship record

Four checks: Do you have a genuine reason? Is the document that proves it ready? Is your lawful period to apply still running? Has the status of each family member been determined? If there is more than one suitable reason, the main reason is chosen according to the person’s actual life and the applicable conditions.

Permit duration and common application documents

TIME LIMITS AND BASIC CONDITIONS

Permit durations and the factors that determine the duration

A general short-term residence permit may be issued for a maximum of two years each time. For the investor category specified in the law and for KKTC citizens, permits of up to five years each may be provided. However, for some grounds for application there are shorter special limits.

Application groupBasic distinction as to duration
General short-term categoriesA maximum of two years each time; a shorter period may be granted in a specific file.
Education, research, internship or courses through public institutionsA maximum of one year; the program and special conditions are examined separately.
Application after higher education in TürkiyeApplication within six months of graduation; a maximum of one year, on a one-time basis.
Turkish language courseA maximum of two times; for a course shorter than one year, the permit does not exceed the duration of the course.
In-service training, exchange program, medical treatment or authority decisionThe duration of the relevant program, treatment or decision is taken into account; the category limit is maintained.
Statutory investor category and KKTC citizensPeriods of a maximum of five years each; the special conditions must be met.

The requested duration must be consistent with the passport, health insurance, reason for stay, program schedule and financial means. The maximum statutory period does not mean that the applicant will necessarily receive the whole of that period.

General conditions and the common document group

A foreign national seeking a short-term residence must submit information and documents supporting the purpose of stay relied on; must pass the assessment as to circumstances that bar entry into Türkiye; must have accommodation that meets health and safety standards; and must declare the address at which they will stay. Where requested, a criminal record certificate from the country of citizenship or lawful residence may also need to be submitted.

Common file documents: A signed application form, the passport or a document in lieu of it and the required page copies, entry records and, if any, visa records, a current biometric photograph, receipts for the applicable fees and document charges, valid health insurance, statements and documents showing financial means, address and accommodation documents, and the attachments specific to the ground for application. For extension and transition, the National Electronic Notification System (UETS) requirement of the relevant application list and the age-related exceptions are examined separately.

It is not assumed that every document will be requested from all applicants at the same time. Nationality, age, family situation, manner of entry and the chosen category may give rise to additional documents or exceptions. The general list is not used in place of the person-specific list obtained from the application screen.

Document check: The issuing authority, date, validity, signature or electronic signature, seal or stamp, identity details and, where necessary, certification and Turkish translation are examined. A false or altered document is not used; a deficiency and forgery are not the same legal problem.

Common documents and passport check

IDENTITY AND DOCUMENT FILE

Preparing the passport and identity details correctly

The passport or the document in lieu of a passport must be valid for at least sixty days beyond the end of the requested residence permit period. The remaining validity of the document may affect the residence period that can be requested. The identity page, the validity information, the required visa and the latest entry records must be consistent with one another in the application file.

The first name, surname, date of birth, citizenship and passport number are transferred to the application form as they appear in the document. Differences in transliteration into Latin letters, a change of surname due to marriage, multiple citizenships or old and new passport records are matched with explanatory documents. Obtaining a new passport does not erase past entry and residence records.

A change of passport must be notified to the Presidency of Migration Management within twenty business days under the relevant notification obligation. The old passport and, if any, the residence card are kept; duplicate applications that could cause the person to be entered in the records as two separate foreign nationals are avoided.

The biometric photograph must have been taken within the last six months and must meet the current technical requirements. A filtered photograph, one in which the face has been altered or one generated with artificial intelligence is not used. The number of photographs to be submitted is determined according to the current document list of the application.

Preparing the document file

The document lists on the category pages are added to the common file. Submitting only the category document is not sufficient. Attachments marked “if any,” “where necessary” and “upon request” do not mean mandatory documents for every applicant. Download the personal e-İkamet list according to the type of transaction.

  • Signed application form and the record of current lawful stay.
  • Biometric photographs in the number stated in the current list.
  • Document proving health insurance or the applicable exception.
  • Statement of financial means and, where necessary, records showing the source.
  • Valid accommodation and address documents.
  • Receipts for applicable fees and card charges.
  • For transition or extension, the previous card and the UETS document required by the relevant list.
  • For family members, marriage, birth, custody, consent or dependency documents.

For foreign documents: Depending on the country, the type of document and, if any, the agreement, the need for an apostille or another certification procedure and a Turkish translation is determined. The same chain of certification is not applied to every document. The match of name, date and passport is checked. The documents whose originals will be shown at the application are separated from the copies that will remain in the file.

Final check: In institutional letters, the person, purpose, place and date must be clear; the signature or electronic signature must be verifiable. A special permit, an institutional invitation and a residence application may require different documents. The administration may request additional documents.

Scientific research

CATEGORY 1 / 14

Who can apply?

Foreign nationals who will conduct scientific research in Türkiye can apply. An academic title alone is not sufficient. The subject, method, place, schedule and the relevant institution of the research must be clearly shown.

How is the purpose explained?

Why the research will be carried out in Türkiye and the person’s role in the project are explained. The institutional invitation, the work program and the funding information must be consistent with this account. For archaeological excavations and surface surveys, special permits are examined separately.

Duration and number of applications

The general upper limit is two years each time. The schedule of the research, the passport and other conditions are taken into account. There is no one-time or two-time usage limit set specifically for this category. In a continuation application, it is documented that the research is ongoing.

Situation of the spouse and children

The researcher’s permit does not pass automatically to the spouse and children. For each family member, a family, student or other suitable residence basis is assessed separately.

Application documents

Documents to be added to the common file

  • A letter from the competent institution showing the place and duration of the research.
  • Project summary, work schedule and, if any, the invitation or acceptance document.
  • If the research is subject to a permit, the permit document of the relevant institution. If it is not subject to a permit, an explanatory statement on the matter.
  • For a person who will come for this purpose, a scientific research visa and the entry record.
  • If any, a scholarship, the project budget or a letter from the institution that bears the expenses.

The most common mistake

Using an institutional invitation in place of a research permit or the appropriate visa. The functions of an invitation, a research permit, a visa and a residence permit are different.

Pay particular attention

The Presidency of Migration Management looks for a visa suited to this purpose for persons who will come for scientific research. This check should not be limited to archaeology files; it should be made before travel.

Compare with your own situation

The file of a person accepted to a university’s six-month field research is assessed on the basis of the project and the institution’s letter. A general academic résumé with no connection to the research does not constitute a sufficient explanation.

Source note: Law No. 6458, Art. 31(1)(a); Presidency of Migration Management; e-İkamet document list

Home ownership in Türkiye

CATEGORY 2 / 14

Who can apply?

Foreign nationals who own real estate in Türkiye that qualifies as a residence and who use this residence for the purpose of residing can apply. Acquiring a plot of land, a field, a shop or an office does not replace a residence for this category. That the real estate has a high price does not change this distinction.

How is the purpose explained?

A link must be established between the right of ownership and genuine housing. The independent unit in the land registry, the actual residence, the address and the applicant’s use must coincide with one another. Proof of acquisition by purchase, inheritance and gift should not be treated as the same. Even where no specific minimum square-meter condition is indicated, the suitability of the residence for housing in terms of health and safety is required.

Duration and number of applications

A maximum of two years each time. Being a home owner does not guarantee a two-year permit. At extension, the continuation of ownership, personal use and the other conditions is required. There is no separate numerical usage limit in this category.

Situation of the spouse and children

A spouse, a minor child and a dependent adult child who hold co-ownership in shares or joint ownership of the residence may be assessed within this scope. The suitable status of a family member who holds no share is determined separately.

Application documents

Documents to be added to the common file

  • Title deed and current ownership record. At extension, the current document confirming that the title deed continues, as requested.
  • Records showing the date and manner of acquisition.
  • An acceptable document proving the value criterion applicable to the file.
  • The clear address of the residence and, where necessary, records explaining the building numbering and actual use.
  • In a joint application, family relationship, share ownership and, if required, dependency documents.

The most common mistake

Thinking that the transfer of the title deed amounts to permit approval, or presenting a residence that has been leased to someone else as the applicant’s own residence.

Pay particular attention

The US$200,000 criterion should not be applied to all title deeds without regard to the date of acquisition and the applicable transition conditions. Which value, exchange rate and document will be used as the basis should be verified before purchase. Regional and address restrictions are examined separately.

Compare with your own situation

Even if the residence belongs to the person, the application of a person with a tenant living there is examined separately in terms of actual use of the residence. Today’s sale listing does not replace the value document applicable to a past acquisition.

Source note: Law No. 6458, Art. 31(1)(b); Presidency of Migration Management; e-İkamet document list

Purchase, joint title and change of ownership

SUPPLEMENTARY REVIEW FOR RESIDENCES

Reviewing residence eligibility before buying a home

The review of a residence to be bought for residence purposes should be made before the transfer of the title deed. A statement by the seller or an intermediary that a residence permit will be obtained does not replace the assessment of the competent authority. The purchase transaction and the residence application are linked but separate legal processes.

  • Is the designation in the land registry suitable for residential use, and do the independent unit and the actual area coincide?
  • Who are the owner and the buyer; will co-ownership in shares or joint ownership be established?
  • With which documents will the value condition applicable to the date and manner of acquisition be shown?
  • Is there a tenant, an actual user or a circumstance restricting use in the real estate?
  • Are the address, building numbering and independent unit details consistent?
  • Is there a current restriction or exception concerning the residence and address registration of foreign nationals with regard to the region or address?
  • Will the applicant actually be able to live in this residence?
  • Which permit status and which additional documents will be needed for the spouse and children?
  • Has a separate title deed review been made regarding ownership, encumbrances and authority to sell?

Some purchase and title deed transactions can be carried out by power of attorney without coming to Türkiye. However, this possibility does not remove the requirements of being in the country or attending in person in the residence application. When planning the acquisition of a residence, the entry and application schedule should be set up separately.

Joint title and the situation of family members

For a spouse, a minor child and a dependent adult child, if there is co-ownership in shares or joint ownership of the residence, a real-estate-based short-term residence assessment can be made. Together with the land registry record, documents showing the family relationship and, if required, dependency are prepared.

Being a co-owner does not by itself show that everyone will obtain a permit on the same terms. Co-owners outside the family, the share and value conditions and the manner in which the residence is used must be examined separately. It is not safe to treat the total value of the real estate and the situation of each applicant as automatically the same.

If a family residence permit is considered for the spouse and children of the person who owns the residence, the sponsor’s income, health insurance, accommodation, registration and other statutory conditions are investigated separately. One person obtaining a permit on the ground of a residence does not automatically provide a permit for the whole family.

Example: The mother may own the residence, the father may hold no share in it and the child may be a student. For this family, instead of duplicating a single file, it is determined which type of permit each person can apply for and how the applications affect one another. Living in the same residence is not equated with having the same legal status.

Sale and leasing of the real estate

If the residence that is the basis of the permit is sold or leased to someone else, the continuation of the conditions of ownership and actual use is reassessed. That the expiry date on the card has not yet arrived does not render ineffective the later disappearance of the permit conditions.

Before the sale, it should be examined whether there is another suitable ground for stay, whether a transition is needed, the change of address and the need for new documents. It cannot be said that there is a general prohibition on sale arising from residence law for the sale of every residence; special annotations and restrictions, if any, are assessed separately. However, that a sale is possible does not mean that the residence status will not be affected.

At extension, a photocopy of a title deed from a past date is not sufficient. The continuation of current ownership, the use of the residence by the applicant and the consistency of the address record must be shown. According to the applicable document list, the document confirming that the title deed continues and the other relevant records are prepared.

Commercial ties and starting a business

CATEGORY 3 / 14

Who can apply?

Foreign nationals who will establish commercial ties in Türkiye or carry out preparations to start a business can apply. The planned activity, the persons or companies to be contacted and the need to stay in Türkiye must be explained.

How is the purpose explained?

Meetings, market research, contract negotiations and preparations for establishment are made concrete. The duration of stay is tied to the activity schedule. The applicant must be able to explain the company’s activity, their own role and the commercial plan in the file.

Duration and number of applications

A maximum of two years each time. For a request exceeding three months, an invitation letter or a similar document from the person or company to be contacted may be requested. Requesting a short period alone does not remove the obligation to explain the purpose. There is no numerical usage limit specific to the category.

Situation of the spouse and children

Being a company shareholder does not create an automatic permit for the spouse and children. The family members’ personal applications and, if any, the family residence conditions are examined separately.

Application documents

Documents to be added to the common file

  • An invitation letter or a similar document from the person or company to be contacted.
  • Company documents that may be requested, such as an activity certificate, trade registry, tax and representation records.
  • Meeting schedule, commercial correspondence, records of offers or contract negotiations.
  • In a business-start file, the activity plan and, if any, the establishment documents.
  • Records explaining the financing of the activity and living expenses.

The most common mistake

Submitting only a trade registry record, or thinking that being a company shareholder gives an unlimited right to work.

Pay particular attention

Establishing a company, being a shareholder and actually working are different. The need for a work permit or exemption for company management, service provision or paid activity is investigated separately. A commercial residence permit does not make work without a permit lawful.

Compare with your own situation

The meetings and commercial ties of an investor who meets with suppliers in Türkiye may serve as the basis for this category. If it is planned that the person will actually work in Türkiye, a work status must also be established.

In-service training

CATEGORY 4 / 14

Who can apply?

Foreign nationals who will take part in an in-service training program can apply. The institution organizing the program, the content and place of the training and the participant’s situation must be specific. A general intention to train or an ordinary company invitation alone does not constitute a sufficient explanation.

How is the purpose explained?

The professional purpose of the training, the course or practice schedule, the unit providing the training and the participant’s relationship with the training are explained. The start and end dates must be consistent with the requested residence period.

Duration and number of applications

The permit is issued according to the duration of the program. The general two-year upper limit of short-term residence is maintained. An extension of the program must be explained by a new institutional letter. No numerical usage limit is provided for this category.

Situation of the spouse and children

The training acceptance letter shows the basis for the participant only. Adding the spouse and children to the training file does not by itself give them a right of residence. The suitable status is determined separately for each person.

Application documents

Documents to be added to the common file

  • An acceptance and program letter, signed or electronically signed, from the institution that will provide the training.
  • A program showing the content, start and end dates and place of the training.
  • The assignment by the institution sending the participant, or a document explaining the employment relationship, if any.
  • If an institution bears the accommodation and expenses, a letter showing this.
  • If there is a practical activity, the documents required with regard to a work permit or exemption.

The most common mistake

Applying with a company letter that contains no content or dates, or describing an actual work activity as training.

Pay particular attention

If there is production, service provision or a paid assignment during the training, the work permit or exemption dimension must be examined separately. Follow the institution’s program changes, the end of the training and the attendance record.

Compare with your own situation

A three-month technical training to be given in Türkiye to the employee of a company abroad can be explained with detailed acceptance and program documents. The training in the document and the actual activity must be the same.

Source note: Law No. 6458, Art. 31(1)(ç); Presidency of Migration Management; e-İkamet document list

Agreements and student exchange

CATEGORY 5 / 14

Who can apply?

Foreign nationals who will come for education and similar purposes within the framework of agreements to which Türkiye is a party or student exchange programs can apply. The legal and institutional basis of the program must be shown.

How is the purpose explained?

The sending and receiving institutions, the type of program, the participation schedule and the content of study or internship are linked to one another in the file. In Erasmus, Mevlana and similar programs, the person’s ordinary higher education student status should not be confused with exchange status.

Duration and number of applications

The permit cannot exceed the duration of the program. The general two-year upper limit also applies. Each new or extended program is documented with a current institutional letter. There is no separate limit on the number of times for this category.

Situation of the spouse and children

The spouse and children of a program participant cannot obtain an automatic permit with the same acceptance document. The family members’ purpose of stay and suitable residence status are examined separately.

Application documents

Documents to be added to the common file

  • The acceptance and program participation letter of the institution in Türkiye.
  • An institutional document showing the scope of the agreement or exchange program.
  • A record showing the place, content and duration of the education or internship.
  • If any, a learning agreement, assignment or scholarship document.
  • Suitable health insurance and, for a practical activity, if any, a permit or exemption record.

The most common mistake

Placing every university admission in this category, or treating student exchange and enrollment in a formal degree program as the same.

Pay particular attention

For eligible exchange students, the possibility of applying for general health insurance within three months of the date of first registration is important. If this period is missed, a requirement for private insurance may arise. The work legislation aspect of an internship is assessed separately.

Compare with your own situation

The document of a student with a one-semester exchange admission must show the program schedule. Direct enrollment in a four-year bachelor’s degree in Türkiye, by contrast, is assessed separately in terms of student residence.

Stay for tourism

CATEGORY 6 / 14

Who can apply?

Foreign nationals who will stay in Türkiye for tourist purposes can apply. At the center of the application are where, for how long and for which genuine activities the stay will take place. A lease, a bank balance or retirement income does not by itself explain a tourist purpose.

How is the purpose explained?

The planned cities and dates, the main accommodation, transportation and the financing of expenses are described together. The need for the requested duration is explained. The plan must be consistent with the person’s age, health, interests and budget.

Duration and number of applications

The general upper limit is two years each time. A shorter period may be granted, or the application may be rejected. That there is no limit on the number of times specific to the category does not mean that consecutive tourist permits will necessarily be granted.

Situation of the spouse and children

For a spouse and children traveling together, a personal application assessment is required. Visiting a relative or living in the same residence does not replace the family residence conditions.

Application documents

Documents to be added to the common file

  • A person-specific, realistic travel and stay plan. Supporting explanations requested by the administration.
  • Lease, hotel or other acceptable accommodation documents.
  • Genuine reservations, tickets, tour or event records, if any.
  • Financial records showing the source of travel and living expenses.
  • Where necessary, documents showing the family relationship and the relative’s status relevant to the context of stay.

The most common mistake

Submitting a ready-made travel plan that the person cannot explain, a fake reservation, or a few days of accommodation for a long requested period.

Pay particular attention

Work without a permit must not be carried out under a tourism declaration. A program that will not actually be carried out is not prepared. Being retired or renting a home is not by itself a separate short-term permit category.

Compare with your own situation

The plan of a person who will stay in Antalya and make cultural trips on specific dates is explained with a real budget and transportation connections. The tourist ground must accurately reflect the person’s actual life.

Source note: Law No. 6458, Art. 31(1)(e); Presidency of Migration Management; e-İkamet document list

A travel plan suited to the person

PURPOSE AND DOCUMENTS IN A TOURISM FILE

A realistic travel plan and supporting documents

The travel plan should include activities that are genuinely intended to be carried out. Instead of preparing a long list covering all of Türkiye, it is more explanatory to establish a relationship of time and place that suits the person’s interests and budget.

Example periodPossible programLink to be established in the file
AutumnAntalya, Kemer, Kaleiçi and Lycian routesSuitability of the main accommodation, transportation and the hiking or cultural program
WinterIstanbul museums, Cappadocia or BursaTravel dates, genuine reservations and budget
Springİzmir, Ephesus, the Aegean coast or PamukkaleArea of interest, transportation and length of accommodation
SummerBlack Sea nature trips or highland routesSeason, health conditions and travel possibilities

This table is only an example; it does not show that everyone must make such a program or request a one-year permit. Gastronomy and culture routes such as Gaziantep, Şanlıurfa and Mardin may also be added if they are part of the real plan.

Genuine hotel and tour reservations, transportation tickets, a car rental plan, and event or museum records may be supportive. Activities that have not yet been finalized are not presented as if a firm purchase had been made. A fake reservation, an altered ticket or a program that will not actually be carried out is not prepared. The existence of a reservation that can be canceled free of charge likewise does not by itself prove actual accommodation for the whole requested period.

Personal consistency in the travel plan

Checks that personalize the plan: For each travel period, explain why you chose this city, how many days you will stay and how you will finance the expense. Establish the link of the program to your main accommodation address. State tickets that have not yet been purchased and reservations that have not been finalized as plans. Explain any changes that occur with the current program and genuine documents. Do not prepare an intensive route that is not suitable for the person’s health and mobility. This example does not mean that a particular period of permit will be granted or that all the trips indicated are mandatory.

Stay for medical treatment

CATEGORY 7 / 14

Who can apply?

Foreign nationals who will receive medical treatment in Türkiye can apply, provided that they do not carry one of the diseases classified as a threat to public health. The hospital’s admission and the duration of the anticipated treatment must be documented.

How is the purpose explained?

The medical need, the treating institution, the treatment schedule and the financing are explained. The basis for the application is not merely a hospital appointment but a treatment file showing the need to stay. Health information is shared limited to the necessary scope.

Duration and number of applications

The permit is issued in line with the duration of the treatment. The general two-year upper limit is observed. If the treatment is prolonged, a new medical record is required. There is no numerical usage limit specific to the category. An early end of treatment or a change of institution must be tracked.

Situation of the spouse and children

The accompanying person is a separate applicant. The patient’s permit does not automatically give a right to the spouse or other relatives. If there is a health cooperation agreement, its special provisions are examined; if not, the suitable general application route is examined.

Application documents

Documents to be added to the common file

  • A letter or report from a public or private hospital showing admission and the duration of treatment.
  • Approvals of the physician and of the chief physician or responsible manager in line with the current document requirements.
  • The treatment plan and a medical statement on the length of stay needed.
  • Payment documents, a letter assuming the expenses or health insurance.
  • If there is an accompanying person, documents showing the need for accompaniment and, if any, the scope of the special agreement.

The most common mistake

Using a partial payment for treatment to mean that all expenses have been paid or that every accompanying person is exempt from insurance.

Pay particular attention

Documenting that all treatment expenses have been paid and the assumption of expenses by a public institution are different exceptions. The insurance exception for a maximum of two accompanying persons under Law No. 3359, Supplementary Article 14 is not a general exemption for all relatives of the patient.

Compare with your own situation

The duration for a patient with a three-month treatment plan is explained with the hospital document. The accompanying spouse’s basis for accompaniment and residence is assessed at the same time, but under its own conditions.

Judicial or administrative authority decision

CATEGORY 8 / 14

Who can apply?

Foreign nationals who must stay in Türkiye depending on a request or decision of a judicial or administrative authority can apply. The existence of a lawsuit, an investigation or an administrative file does not by itself provide entry into this category.

How is the purpose explained?

The proceeding because of which the person needs to be in Türkiye, the authority conducting the proceeding and the need to stay are shown. That representation by an attorney is possible and that the person’s personal presence is considered necessary are assessed separately.

Duration and number of applications

The necessary period of stay in the decision or request is taken into account. The general two-year upper limit is maintained. If the need continues, an assessment is made with a current document. There is no separate limit on the number of times for the category.

Situation of the spouse and children

A spouse and children who are not named in the authority’s request do not automatically fall within the same scope. The bases of application for family members are determined separately.

Application documents

Documents to be added to the common file

  • A request or decision document of the competent judicial or administrative authority that considers staying in Türkiye necessary.
  • A signed or electronically signed letter explaining the person’s identity, the relevant proceeding and the duration of stay.
  • If necessary, file details, the hearing or proceeding schedule and copies of notifications.
  • If the request continues, a current authority letter or a record on the validity of the decision.
  • Common application and accommodation documents consistent with the purpose of stay.

The most common mistake

Assuming that this permit will be obtained merely with a petition, a UYAP file number or capacity as a party.

Pay particular attention

Filing an action against a rejection of residence does not replace a permit application based on this category. An annulment action, a stay of execution and a short-term permit dependent on an authority’s request are different legal routes.

Compare with your own situation

A letter in which the competent authority considers it necessary for the person to stay in Türkiye throughout a particular proceeding can be examined under this category. When the proceeding ends, the basis for stay is reassessed.

Transition from family residence

CATEGORY 9 / 14

Who can apply?

Three groups are important: those who have stayed with a family residence permit for at least three years and have turned 18; those who are married to a Turkish citizen and divorced after staying with a family residence permit for at least three years; and those whose sponsor has died and who remain with a family residence permit dependent on that person. The end of every family relationship is not within this scope.

How is the purpose explained?

The previous family status and the event requiring the transition to the new situation are explained. The previous permit periods, the date of the event and the current lawful stay are calculated together. The permit does not turn into a short-term one automatically.

Duration and number of applications

A short-term permit can generally be issued for a maximum of two years. In domestic violence proven by a court decision, the three-year condition relating to divorce is not required. In the case of the sponsor’s death as well, the minimum family residence period is not required.

Situation of the spouse and children

The transition event may not produce the same result for everyone in the family. Each child’s age, dependency, custody situation and education status are examined separately. No numerical usage limit is separately provided for the new permit.

Application documents

Documents to be added to the common file

  • Previous family residence cards and records showing the permit periods.
  • In a divorce, the marriage record and the court decision and, where necessary, information on finality.
  • In the violence exception, the court decision proving the victimization.
  • In the case of the sponsor’s death, death and family relationship documents.
  • For those who have turned 18, identity, birth and records of family residence of at least three years.

The most common mistake

Treating a three-year marriage as the same as three years of family residence, or thinking that divorce gives everyone an automatic right of transition.

Pay particular attention

The 18th birthday, divorce and the sponsor’s death are events that must be tracked. A short-term, student or other suitable status should be assessed without waiting for the last day of the card.

Compare with your own situation

For a person who has stayed for two years with a family permit and whose sponsor has died, the time exception specific to death is examined. The same calculation of time is not automatically applied to a divorce file.

Turkish language course

CATEGORY 10 / 14

Who can apply?

Foreign nationals who will attend a Turkish language course can apply. The course must be run by an authorized institution. For this application, the Presidency of Migration Management takes as its basis an institution authorized by the Ministry of National Education (Milli Eğitim Bakanlığı).

How is the purpose explained?

The enrollment, the actual start and end dates of the course, the place of study and the attendance plan are shown. Preparatory study linked to university enrollment and an independent language course are subject to different legal assessments.

Duration and number of applications

A permit can be granted for this purpose a maximum of two times. For a course shorter than one year, the permit does not exceed the duration of the course. The general two-year upper limit is also maintained. The two-time limit is not an automatic right to a two-year permit.

Situation of the spouse and children

Course enrollment does not automatically provide a permit to the spouse and children on the same basis. The suitable residence route of each person is determined separately. The education status of children and the family permit conditions are examined separately.

Application documents

Documents to be added to the common file

  • An enrollment or training document from the authorized institution providing the Turkish course.
  • A letter showing the place, start and end dates and program of the course.
  • Information or a permit record verifying the institution’s authority, where necessary.
  • Previous Turkish course residence permits and current attendance information.
  • If university preparation is claimed, the relevant higher education enrollment and referral documents.

The most common mistake

Treating the presence of Turkish Language Teaching Center (TÖMER) in the institution’s name as sufficient on its own, or thinking that course enrollment directly provides student residence.

Pay particular attention

The institution has an obligation to report the start and continuation of the course. Not starting the course, not attending or dropping out may affect the basis for stay. It should be checked whether previous permits were granted under this category.

Compare with your own situation

The request of a person enrolled in an eight-month independent Turkish course is examined on this ground in line with the duration of the course. The existence of an enrollment document is not by itself a basis for a two-year permit.

Source note: Law No. 6458, Art. 31(1)(h) and Art. 31(3); Presidency of Migration Management; e-İkamet document list

Education and other programs through a public institution

CATEGORY 11 / 14

Who can apply?

Foreign nationals who will take part in education, research, an internship or a course in Türkiye through public institutions can apply. Through which public institution the program is carried out and the person’s link with this program must be clear.

How is the purpose explained?

The role of the institution, the content of the program, the place of implementation and the schedule are explained. A general private course enrollment or an intention to do research does not replace a program carried out through a public institution.

Duration and number of applications

In this category the permit can be for a maximum of one year. If the program is shorter, that period is taken into account. The law contains no one-time usage limit for this category. A continuation or a new program is assessed separately with current documents.

Situation of the spouse and children

The public institution’s acceptance of the participant does not cover the whole family. The spouse’s and children’s basis for application and their expense and insurance coverage are assessed separately.

Application documents

Documents to be added to the common file

  • The acceptance, assignment or program participation letter of the relevant public institution.
  • A document showing the place and duration of the education, research, internship or course.
  • A record explaining the content of the program and the participant’s duty.
  • If expenses are assumed, an institutional letter stating their scope.
  • For a practical activity, if required, work permit or exemption documents.

The most common mistake

Placing every internship in this category, or thinking that the institution’s assumption of the tuition fee alone is an assurance for all living expenses.

Pay particular attention

In files where accommodation, board or health expenses are assumed by the relevant public institution, the financial means and insurance exceptions are assessed under their own conditions. The scope of the expenses assumed must be clear in the letter.

Compare with your own situation

In the file of a person accepted to a public institution’s six-month research program, the institutional letter, the program schedule and the scope of expenses are submitted together. The internship activity is examined separately from the standpoint of work legislation.

Graduation after higher education in Türkiye

CATEGORY 12 / 14

Who can apply?

Foreign nationals who have completed their higher education in Türkiye and who apply within six months of the date of graduation can apply. Graduation from a university abroad alone does not form a basis for this category.

How is the purpose explained?

The date on which graduation occurred is verified. The previous student permit, the current lawful stay in Türkiye and the application schedule are examined together. A diploma ceremony or the receipt of the document may not be the same as the date of graduation in the legal sense.

Duration and number of applications

An application within six months of graduation is required. The permit may be granted on a one-time basis for a maximum of one year. Automatic extension on the same ground is not assumed. Another suitable status for the following period should be planned in good time.

Situation of the spouse and children

The post-graduation permit does not provide an automatic right to family members. The family arrangement tied to the previous student status may also be affected by the change. The status of the spouse and children is checked separately.

Application documents

Documents to be added to the common file

  • A diploma, a provisional graduation certificate or a verifiable graduation record.
  • A university letter clearly showing the date of graduation, if required.
  • The previous student residence card and current status records.
  • An application record showing that the application was made within the six-month period.
  • Common identity, health insurance, income and accommodation documents suited to the period of stay.

The most common mistake

Thinking that the six-month right to apply is a right to stay in the country for six months without any other basis.

Pay particular attention

That the student card has a distant expiry date does not show that student status will continue after graduation in every case. The date of graduation and the end of the current lawful stay are calculated separately.

Compare with your own situation

The six-month condition may be met for a person who will apply two months after graduation. Nevertheless, that their current lawful stay has ended is a matter that must be resolved separately.

Special investor category

CATEGORY 13 / 14

Who can apply?

Foreign nationals who do not work in Türkiye and will make an investment of the scope and amount determined by the competent regulation, and the foreign spouse and children listed in the law, can apply. Not every company shareholder, home owner or bank account holder falls into this group automatically.

How is the purpose explained?

The type and scope of the investment and the applicable conditions are determined. The competent institution’s eligibility assessment is matched with the applicant’s identity and the investment records. This special category is distinguished from general commercial ties and home-ownership residence.

Duration and number of applications

A permit can be issued for periods of a maximum of five years each. The whole of the five-year upper limit, or a subsequent permit, is not automatic. The law contains no separate one-time usage limit. The continuation of the investment conditions is tracked separately.

Situation of the spouse and children

The foreign spouse and the foreign minor or dependent children of the applicant or of the spouse are within the statutory scope. Kinship, age, dependency and personal application conditions must be documented.

Application documents

Documents to be added to the common file

  • The competent institution’s eligibility certificate for the chosen investment route, or the official confirmation required.
  • Records showing the type and amount of the investment and its applicable commitments.
  • Identity, passport and criminal record certificates requested according to the application.
  • In family applications, marriage, birth and, if required, dependency or custody documents.
  • Other personal and investment documents requested on the application screen for this special category.

The most common mistake

Considering every investment sufficient for this category, or equating a residence permit with a citizenship decision.

Pay particular attention

The acquisition of citizenship is subject to separate conditions and a separate decision. The residence card does not remove the investment commitment, the need for a work permit or the legal review of the investment itself.

Compare with your own situation

The residence file of a person who demonstrates a qualifying investment with a competent institution’s document can be assessed within this scope. An ordinary company shareholding record alone does not produce the same result.

KKTC citizenship

CATEGORY 14 / 14

Who can apply?

Foreign nationals who are citizens of the Turkish Republic of Northern Cyprus (KKTC) can apply for this special short-term residence category. Living in the KKTC, studying there, owning a home there or traveling from there does not replace KKTC citizenship.

How is the purpose explained?

The basis for the application is citizenship. The KKTC identity card, any other citizenship, the travel document used and the record of entry into Türkiye are matched consistently. Entering with an identity card and applying for a residence permit should not be confused with one another.

Duration and number of applications

A permit can be issued for periods of a maximum of five years each. There is no limit on the number of times specific to the category. The requested period is assessed together with the identity and travel documents and the applicable conditions. The five-year period is not an automatically acquired right.

Situation of the spouse and children

If the spouse and children are also KKTC citizens, their own applications are examined under this category. A family member who is not a KKTC citizen does not fall into the same category merely because of closeness. A family or another suitable status is assessed separately.

Application documents

Documents to be added to the common file

  • The KKTC identity document or an official record showing citizenship.
  • The passport or accepted travel document used for entry into Türkiye, and the entry record.
  • If there are multiple citizenships or different spellings, identity-matching documents.
  • Application form, photograph and applicable common documents.
  • If family members are also applying, their citizenship and family relationship records.

The most common mistake

Thinking that a residence card in the KKTC is KKTC citizenship, or not explaining in the application an entry record made with another passport.

Pay particular attention

Ease of entry, the right to work and residence status are separate matters. Special practices linked to citizenship, as well as fee and document conditions, must be checked separately in the current personal application list.

Compare with your own situation

A citizen of another country who lives in the KKTC as a student cannot apply under the 14th category solely because of this tie of life. The basis of the application is determined by the person’s actual citizenship and purpose of stay.

Source note: Law No. 6458, Art. 31(1)(k); Presidency of Migration Management; e-İkamet document list

Insurance, income documents and application costs

HEALTH COVERAGE AND FINANCIAL SUFFICIENCY

Health insurance and health coverage

Health coverage must cover the requested residence period. The relevant social security document, a record showing the right to health benefits under a bilateral social security agreement, an accepted general health insurance document or a suitable private health insurance policy is used depending on the circumstances of the file.

That a policy has been purchased is not by itself sufficient. The start and end dates, the insured person’s identity details, the scope of coverage, the validity of the policy and its compliance with the conditions sought in residence applications are checked. If more than one policy is used for a two-year request, there must be no gap between the periods, and the documents must meet the conditions accepted by the administration.

Insurance exceptions tied to age or to a special ground for application apply under their own conditions. The practice valid for persons under eighteen and over sixty-five is assessed together with the type of application; an exception in one category is not automatically carried over to another type of residence. The special provisions in treatment and accompaniment files are examined separately.

Common mistake: Thinking that short-term travel insurance taken out for a visa is health coverage that covers the whole requested residence period.

Sufficiency of income and the source of money

The applicant must be able to explain how they will support themselves throughout the time they will stay in Türkiye. The assessment is not based merely on a balance that appears in an account on one day; the source of income, its regularity, its being accessible to the person, family expenses and the length of stay are all important together. The income criterion and the type of document requested by the administration are verified according to the category and family structure on the date of application.

Depending on need, the following documents may be added to the income file:

  • Bank records showing account movements for recent months and the balance.
  • Documents showing retirement income, regular payments or lawful employment income.
  • For rental income, records verifying the ownership and the lease relationship together.
  • For company income, shareholding, distributed profit, tax and financial records.
  • Sale, inheritance or similar transaction documents explaining the source of savings.
  • Records explaining the amount of income in foreign currency and its regular accessibility.

A three-month statement of movements is a meaningful starting document in some files; the administration may request a different or longer period. A credit card limit, money borrowed temporarily from someone else or a statement of support without documents is not regarded as sufficient proof of income in every case. If reliance is placed on someone else’s support, the acceptability of the support relationship and the financial capacity of the person providing support are also investigated.

Example budget calculation: For a couple with a documentable monthly income of 90,000 TL and an actual total expense of 70,000 TL, the monthly budget difference is 20,000 TL. The continuity of the income, rent and health expenses and savings are assessed separately. These figures are a calculation example; they are not an official minimum income threshold or a guarantee of a permit.

Common mistake: Depositing a high amount into the account before applying and withdrawing it immediately, and thinking that this movement, whose source is not explained, proves sufficiency. A false or untrue document may additionally give rise to legal and criminal risk.

Fees and application expenses

The residence fee, the residence card document charge and, if required, the single-entry visa fee are different payment items. The result may vary according to citizenship, reciprocity or exemption provisions, the application period and the type of transaction. Insurance, notary, translation and attorney fees are separate from these public payments.

On the payment receipt, the name, foreign identification or tax number, the type of payment and the amount are checked. The current payment information shown on the application screen and in the authorized collection channel is taken as the basis; the amount from an old file is not copied into a new application. The originals or verifiable copies of the receipts are kept.

Paying a fee does not mean that the application has been accepted. In the event of rejection or withdrawal of the application, the possibility of a refund is assessed separately with regard to the type of payment and the relevant financial provisions; it is not assumed that all charges will be refunded automatically.

Residence, lease agreement and address notifications

ACCOMMODATION AND ADDRESS

Accommodation document and address record

Documenting where one will stay in the application and the certificate-of-residence record in the population system are not the same transaction. In a new application, which accommodation document will be submitted in place of a record that has not yet been created is determined separately; in an extension, the currency of the existing address record is determined.

Own residence: The title deed and actual use information are submitted together with the required address documents. Leased residence: A contract that correctly shows the genuine lease relationship, the parties and the independent unit is prepared; the required notarial procedure is completed. Hotel or similar facility: Actual stay and the valid accommodation documents issued by the facility are taken as the basis. An application is not built on a reservation that will not take place.

Staying with a relative: The required notarized undertaking and supporting documents are prepared; the situations in which the undertaking of the host’s spouse is also requested, where the host is married, are taken into account. Accommodation in a dormitory, hospital or public institution: Signed and, where necessary, sealed records issued by the competent institution are used. Special accommodation such as a yacht: Marina and berth records, the nature of the stay and the special documents requested by the administration are examined separately.

In address notification, the twenty-business-day registration obligation relating to obtaining a residence permit and the notification period for an address change that occurs later are tracked separately. That the address written in the application is correct does not mean that all registration procedures that must be done afterwards have been completed.

Points to check in the lease agreement

Before choosing a residence and before the contract, the following points are examined:

  • That the lessor is the owner or a person with valid authority.
  • That the block, parcel, building and independent unit details match the residence.
  • That the clear address and building numbering details are consistent with the official records.
  • The residential character of the residence and its actual suitability for living.
  • That the applicant’s name, passport details and the situation of the persons who will stay together are shown correctly.
  • That the lease term, rent and payment records are genuine.
  • Clarifying the presence of other persons registered at the address.
  • Investigating regional restrictions on the address registration of foreign nationals, according to the type of application.
  • Examining authority and acceptance conditions in a sublease or in a contract made in someone else’s name.
  • Completing the notarial procedure, delivery and the subsequent address registration separately.

Notarization is not an administrative approval that the residence is suitable for a residence application in every respect. Whether a neighborhood is closed, the exceptions and the situation of existing permit holders are assessed on the date of application. A residence is not leased on the basis of old social media lists.

Change of province and other notifications

When a permit holder moves to an address in another province, the rule on making a new residence permit application in the new province within twenty business days is taken into account. For an address change within the same province as well, there is a twenty-business-day notification obligation; a new card does not need to be issued in every case merely because of an address change.

Moving to another province may require reassessing the ground for residence and the suitability of the new residence. Even if the expiry date of the card in the former province has not yet arrived, notification of the move is not postponed. The treatment of the period already paid for the previous permit in fee collection is examined separately.

Changes in marital status, passport, first name and surname, ground for application or family relationship are also notified to the relevant institutions according to the nature of the file. The same time limit and the same electronic procedure are not assumed for every change; the migration, population and, if necessary, other records are brought into line with one another.

Source note: Explanations of the Presidency of Migration Management on changes of province and address

Children’s documents and the right application route

FAMILY DOCUMENTS AND TYPE OF PROCEDURE

Children’s applications and family documents

Separate application and document requirements are assessed for children. That a parent holds a permit does not mean that the child’s procedures are automatically completed. The passport, birth certificate, parentage, custody and the required consent documents are prepared together.

If one parent is not in Türkiye, the requirement of consent is examined; if there is a divorce, the scope of the custody decision; if one of the parents has died, the death record. Doubts that may arise because of a single-parent family or different surnames are resolved with official documents. Whether recognition or another procedure is needed for the effect a foreign court decision will have in Türkiye is determined separately.

For a child born in Türkiye, the birth record, citizenship, the travel document and the migration status are handled together. The subsequent ground for application of a child approaching eighteen is planned in advance. In files where the parents are in dispute, the best interests of the child and the authority to travel and to represent are especially taken into account.

Making foreign documents usable in Türkiye

For birth, marriage, death, custody, income or criminal record documents issued abroad, the type of document, the issuing country and the applicable agreements are examined. If the apostille regime applies, an apostille; where it does not apply, the required consular and other certification procedures are assessed. Certification exemptions arising from an agreement are also taken into account separately.

It cannot be said that an apostille is required unconditionally for every foreign document. An apostille likewise does not guarantee the material accuracy of the content of the document or the automatic enforceability in Türkiye of a foreign court decision. Translation, notarization and the legal effect of the decision are separate matters.

The name, date and family relationship details in the documents are matched with the application form. Currency, period of validity and the requirement to submit the original are checked. Illegible scans or identity differences not explained in different documents may lengthen the processing time.

Initial application, extension and transition procedures

ProcedureBasic situationPoint to check especially
Initial applicationRequesting a permit for the first time, or the existing situation requiring the initial application procedurePeriod of lawful stay and the actual ground for application
ExtensionExtending the period of an ongoing permitThe continuation of the existing ground and timely application
TransitionA change requiring a move to another type of residenceThe conditions of the new type and the effect of the end of the previous status

The conversion of one short-term ground into another short-term ground is not carried out through the same procedure in the electronic system in every case. A change of type is distinguished from a change of ground within the same type; the file’s current application method is confirmed.

Common mistake: Selecting the option that looks easy in the electronic system and assuming that this option will be corrected later with documents submitted afterwards. The application method must be chosen in line with the actual legal situation.

Electronic application, appointment and submission of documents

COMPLETING THE APPLICATION

Electronic application and representation

The application is created through the official e-İkamet system with the correct information. Opening the form or saving a draft is not the same as a completed application. The form, the appointment record, the application number and later changes are kept. The period provided for in the system for incomplete drafts does not give the person any additional right of lawful stay.

The application may be carried out by the person, their legal representative or their authorized attorney. The authority of representation is checked as to whether it covers the requested procedures, the submission of documents, notification and the filing of an action. Working with an attorney does not remove the personal attendance, biometric data or interview procedures that the administration considers necessary.

Access to the official application system and public fees are separate from one another. Commercial sites that present themselves as official institutions, or persons who offer a guarantee of results, are not to be trusted. Legally authorized methods of access and representation are used, without sharing e-Devlet, bank and personal account passwords.

In procedures where submitting the file through a notary is permitted as well, the notary is not the authority that grants the residence permit. The submission and application stage and the administrative assessment and decision stage are tracked separately.

Appointment and protecting the period of lawful stay

It is essential that the application is completed within the period of lawful stay, by the correct procedure. The effect of an appointment given for a later date is assessed together with a valid application made in time and the relevant application certificate. Merely looking for an appointment, paying an intermediary or opening a draft form does not protect the period.

If there is a system error, the error screen, the date and time, the application attempts and the official notifications made are kept. A technical problem does not by itself give rise to unlimited additional time. Before the statutory period expires, contact with the competent administration and the application route suited to the file are assessed.

Ten days in conditional entry: In an application undertaking given under a special conditional entry procedure at the border gate, a ten-day period may exist. This rule is not a general additional period applicable to all foreign nationals or to all rejection decisions. The content of the entry document given to the person is taken as the basis.

Submission of documents, notice of deficiency and interview

The statements in the application form are compared with the documents submitted. Originals, translations and the required copies are kept in order; the list of documents submitted and, where possible, proof of submission are kept. In a notice of deficiency, which document is to be submitted, by which method and by which date is specified in writing.

For a missing or supplementary document, the administration may grant a period of up to thirty days. It is not assumed in every file that an additional thirty-day period exists automatically; the content and procedure of the specific notice are examined. If obtaining the document takes time, proof of this and the request for the necessary time are submitted without delay; the granting of additional time is not assumed.

The administration may request an interview about the purpose of stay in Türkiye and the conditions of the application. The questions are answered truthfully and consistently; a memorized statement that is contrary to the facts is not prepared. The need for an interpreter is addressed in advance. If there is a justified impediment, it is documented and its effect on the appointment is notified in time.

Protecting lawful status while the application is pending

FOLLOW-UP, TRAVEL AND EXTENSION

Assessment period and follow-up of the application

In residence applications, the ninety-day assessment period is counted from the full submission of the required information and documents to the competent authority. The date on which the form was first opened and the date on which the file was completed may not be the same. Notifications about an extension of the period or additional review are kept in the file.

The expiry of ninety days does not mean automatic acceptance. In a prolonged procedure, the submission date and the completeness of the file are documented; it is asked which deficiency or review exists. The effect of the non-response to an administrative application on the time limit to file an action is calculated separately within the framework of the relationship between Article 10 of the Administrative Procedure Law No. 2577 (İYUK) and the special residence regulations. The processing time and the implied rejection period are not used in place of one another.

For general information on the procedure, the official channels of the Presidency of Migration Management and the Foreigners Communication Center (YİMER 157) can be used. Information obtained by telephone does not replace an application or an action that preserves the time limit.

The applicant follows their telephone, e-mail address, UETS account and other official notification channels. News is not awaited only from an intermediary. An electronic notification made when the paper copy of the rejection decision has not yet been obtained may also require a time-limit review.

Application certificate and leaving the country

The residence permit application certificate should not be confused with the application form or the appointment printout. It is important that the certificate has been issued or approved by the competent authority and is used together with the required fee payment documents.

For a person who leaves with an application certificate that meets the relevant conditions, returning within fifteen days at each departure is the basic condition of the ease of entry described. In cases of fee exemption,

the document to be requested is checked separately. For returns exceeding fifteen days, the general visa provisions may come into play.

This facility is not an unconditional guarantee of entry that eliminates an entry ban or another border control problem. Before travel, the nature of the document, the validity of the passport, the current status of the application and the return date are checked. After a rejection, it is not assumed that the old application certificate continues to have the same effect.

Preparing the extension application

The extension application is made starting from sixty days before the end of the permit period and in every case before the permit ends. This period is not an additional sixty-day period that can be used after the card expires. The procedure is not left to the last day.

Those who make a duly submitted extension application are given a document that is not subject to a fee. Even if the permit period ends, they may reside in Türkiye with this document until a decision is made on the application. This statutory facility is not equated with merely opening a draft form or with submitting an untrue document after the application.

The existing ground for residence must genuinely continue. In home ownership, current ownership and use; in tourism, the actual plan of stay; in medical treatment, the continuing need; and in other categories, the special conditions are demonstrated again. A previous permit does not create an acquired right to the automatic acceptance of a subsequent application.

The passport, uninterrupted health coverage, the current address record, the economic situation and, where necessary, the UETS details are checked. A document submitted in the initial application may no longer be current. If the ground has changed, the suitable new procedure is determined; the old ground is not repeated merely for the convenience of an extension.

Obligations after the permit and review of the decision

CARD DELIVERY AND UNFAVORABLE DECISION

Card delivery and obligations after the permit

After approval, the printing and delivery stage of the card is followed. The name, foreign identification number, type of permit and dates on the card received are checked. If there is an error, a correction application is made without delay. Loss of or damage to the card does not mean that the residence permit ends automatically; the loss notification and renewal procedure are carried out separately.

After the permit is granted as well, obligations such as the continuation of the ground for residence, the notification of address and identity changes and valid health coverage are observed. Use outside the purpose of the permit, a forged document or the disappearance of the required conditions may lead to cancellation or non-extension.

The residence card is not a work permit. Whether the activity the person carries out in Türkiye or from Türkiye requires a work permit or exemption is examined separately. Earning income from abroad likewise does not by itself remove tax and social security assessments.

Rejection, cancellation and non-extension decisions

Rejection is the non-acceptance of the application made. Cancellation is the later removal of a permit that was granted. Non-extension is the non-acceptance of the request for the period following the existing permit. The reasoning for these decisions and their effect on the person’s stay in the country are examined separately.

Circumstances such as the non-fulfillment or disappearance of the short-term residence conditions, use of the permit outside its purpose of issue, violation of the applicable conditions of stay, and a valid deportation or entry ban are important depending on the nature of the file. However, it must be investigated whether the reasoning consists only of abstract statements, its connection with the specific case and the documents it relies on.

In the decision, the statutory basis, the reasoning, the competent authority, the date of service, the remedies and, if any, the explanations on leaving the country are checked. The rejection of a residence application and a deportation decision are not the same act. Even if they have been issued together or in succession, each decision requires a separate legal review.

First steps when an unfavorable decision is received

When a rejection or cancellation is learned of, the first task is to obtain the whole of the decision and the notification records. A litigation strategy is not built on a screenshot that says only “rejected.” The application documents, submission records, deficiency letters, interview details, and the existing card and passport records are brought together.

In the initial assessment, the following questions are answered:

  • Exactly which act or acts were issued?
  • To whom, through which channel and when was the decision served?
  • Is there a deportation or administrative detention act separate from the residence case?
  • Is the basis for current lawful stay continuing?
  • Which is the earliest-expiring application or filing time limit?
  • Are there urgent health, family, child or other elements of damage that is difficult to remedy?
  • Which document, missing, misunderstood or newly emerged, can be submitted?

It is appropriate for this review to be made as soon as the decision is learned of. The “first-day review” is a working recommendation; it does not mean that there is a statutory twenty-four-hour period for all acts.

Time limit to file an action and grounds of unlawfulness

NOTIFICATION AND ANNULMENT ACTION

Following notification and the UETS account

Duly made notification determines the start of the time limit for many applications and actions. In electronic notification, service is deemed to have taken place at the end of the fifth day following the date on which the document reached the UETS address. That the document is opened earlier or is never opened does not substitute another date for this statutory presumption.

The record of arrival at UETS, the read information and the date on which service is deemed to have been made are kept separately. An informational SMS or e-mail and the legal electronic notification record are not the same document. Being abroad or changing one’s telephone does not make following UETS unimportant.

In a claim of irregular notification, the date of learning of the decision and the effect of Article 32 of Law No. 7201 are assessed separately. One does not wait on the assumption that “the notification was defective, the time limit never starts.” In a file run by an authorized attorney, to whom the notification must be made and the scope of the power of attorney are also checked.

Application to the administration and calculating the time limit to file an action

Where no special time limit is provided against the rejection, cancellation or non-extension of a residence permit, the general time limit to file an action before the administrative court is sixty days. The time limit, as a rule, begins to run on the day following the written notification. Elements such as holidays, the last day and irregular notification are calculated separately.

Under Article 11 of the Administrative Procedure Law, the withdrawal, revocation or amendment of an act, or the making of a new act, may be requested from the higher authority; if there is no higher authority, from the authority that made the act. This route is, in general, not a mandatory precondition. The application must be made within the time limit to file an action and must legally fall within the scope of this article.

A valid application under Article 11 suspends the running time limit to file an action. If no response is given within thirty days, the request is deemed rejected. After the rejection or implied rejection, the remaining time continues to run; the days that elapsed before the application are counted.

Example of a time limit: If an application under Article 11 is made after ten days of the sixty-day time limit to file an action have passed, the remaining time from the moment the time limit legally starts to run again is fifty days. A fresh sixty-day period does not arise. The specific last day is determined separately by the rules on notification and the calendar.

An ordinary request for information, a telephone call or a repeated petition does not suspend the time limit in every case. An application made after the time limit has been missed also does not, as a rule, recreate the right of action that has expired. This explanation cannot be applied automatically to the special seven-day time limit in a deportation decision.

Matters that can be raised in an annulment action

In an annulment action, the lawfulness of the act is examined with regard to its elements of competence, form, cause, subject matter and purpose. The court with subject-matter and territorial jurisdiction is determined according to the act challenged and the special rules; the file is not directed to just any court out of habit.

The genuine purpose of the application, the documents submitted, the possibility of remedying deficiencies, the administration’s inquiry, the notification and the reasoning of the decision are addressed together. For example, a wrong assessment of the residence or the income document, disregarding a document that was actually submitted, reasoning not tied to the person’s situation and procedural deficiencies can be made the subject of the action depending on the file.

Family life, the best interests of the child, ongoing medical treatment and ties established with Türkiye are documented to the extent that they are legally relevant. The existence of these elements does not by itself make the acceptance of every application mandatory; they may be important for the individualization and proportionality of the administrative assessment.

It is not sufficient merely to present a long personal account to the court. Each claim of unlawfulness must be matched with the relevant document and act. Duly made translations of foreign documents, application records, proof of submission and, if necessary, requests for the administrative file to be brought in are prepared.

Filing an action does not mean that the court will directly issue a card in place of the permit-granting authority. The request is for the lawfulness of the act to be reviewed and for the necessary legal protection to be provided.

Stay of execution and implementation of the decision

PROCEEDINGS AND EFFECT OF THE DECISION

Stay of execution and interim protection

Filing an annulment action against a residence act does not by itself stay the execution of the act. If a stay of execution is sought, the two basic conditions in Article 27 of the Administrative Procedure Law are shown together: that the act is clearly unlawful and that its implementation would cause damage that is difficult or impossible to remedy.

The interruption of medical treatment, the effect on family or child care arrangements and other damage are explained with concrete documents. Instead of writing the same reasoning in every file, the real effect of the implementation of the act on the applicant is shown. The court’s requests for defense, information and documents are met in time.

Against the rejection or acceptance of a request for a stay of execution, within seven days from the day following service of the decision, the applicable route of objection and the authority are examined. This objection is, as a rule, available once. The statutory limits on requests repeated on the same grounds are taken into account.

The petition of action, or a request for a stay of execution alone, is not a new residence permit. The concrete effect of a court decision that has been issued and its implementation by the administration are tracked separately. In a deportation decision, the special bar on removal provided by law is assessed separately from the general regime in an action to annul a residence.

Conduct of the litigation and remedies

The file is opened in time and with the correct request; fees, advance on costs, representation and attachments are checked. The administration’s defense and the case file it submits are examined. Replies to the defenses served and the court’s interim decisions are met within their own time limits. Filing the first petition does not mean that the duty of follow-up is complete.

The proceedings mostly progress on the written file. A hearing request, translation, additional evidence and the need for personal attendance are assessed according to the specific file. No guarantee can be given that the case will be won within a certain number of days or months.

Against a first-instance decision, subject to statutory finality and special provisions, the general time limit for appeal to the regional court is thirty days from service. Whether the route of appeal on points of law is open after a regional administrative court decision is determined separately according to the current scope and transition provisions in Article 46 of the Administrative Procedure Law. For decisions open to appeal on points of law, the general time limit is thirty days. It is not assumed that every residence case has the same chain of remedies.

Resorting to a remedy likewise does not, as a rule, stay the execution of the decision by itself. At the relevant stage, a separate assessment is made on a stay of execution or the continuation of a stay. The outcome of the decision, the available route of appeal and the final date are communicated to the applicant in an understandable way.

Steps after the court decision

The service of a favorable decision on the administration and the implementation stage are followed. Under Article 28 of the Administrative Procedure Law, the requirements of the decision are fulfilled without delay; the period in the law cannot exceed thirty days from service on the administration. This limit does not mean that the administration may wait thirty days in every case.

Depending on the reasoning of the annulment decision, a reassessment of the file, the remedying of the consequences of the unlawful act or the correction of the relevant records may come into play. How the court decision will be applied to the card, address, application record and current status of stay is monitored in concrete terms.

If the requirements of the decision are not fulfilled, an enforcement request, the preservation of evidence and the relevant legal remedies are assessed. For a claim of compensation, unlawfulness, damage, causation and the procedural conditions are examined separately; a favorable decision does not give rise to compensation automatically and in a fixed amount.

Common mistake: Regarding the news that the case has been won as sufficient and not checking that the administrative file and the records have been corrected.

Deportation, reapplication and special protection needs

LEGAL POSITION AFTER REJECTION

Deportation decision and administrative detention

If, in addition to the residence file, there is a deportation decision, the route of applying to the administrative court within seven days from service under Article 53 of Law No. 6458 is assessed. Notifying the authority that issued the decision of the application is also important. An action filed against the residence act does not replace this separate application.

If a judicial remedy has been applied for within the time limit to file an action provided by law, the rule against deportation applies until the proceedings are concluded, subject to the person’s consent. This protection does not mean that the person is automatically granted a new residence or work permit.

Administrative detention is a separate decision that affects the person’s liberty. The authority to which an application against a detention decision is made is the criminal judgeship of peace (sulh ceza hâkimliği). The five-day period provided for the judge to examine the application is not a five-day objection period granted to the foreign national. The application does not stop the detention automatically; if the conditions change or cease to exist, a request for review and any applicable alternative obligations are assessed.

Entry ban, administrative fine, deportation and detention decisions are distinguished from one another. The document, the service, the competent authority and the legal consequence of each are recorded separately.

Stay, departure and reapplication after rejection

After an unfavorable decision, it is determined whether the existing residence, visa or visa exemption status continues. It cannot be said that everyone is granted ten days of lawful stay unconditionally after all rejection decisions. The content of the decision, the previous status, whether another act exists and the relevant legislation are assessed together.

On leaving the country, the period of violation, a possible fine and an entry ban are different consequences. Payment of a fine does not automatically remove all obstacles to entry. A voluntary departure or re-entry plan is handled together with its effect on the court file and the existing documents.

For reapplication for the same purpose after rejection, the six-month practice announced by the Presidency of Migration Management is taken into account. If there is a different and genuine ground for application, the conditions of that ground and the lawful stay situation are examined separately. It is not correct to change the ground for application merely by relabeling it, or to assume that the earlier rejection record will be erased by a brief exit and re-entry.

A reapplication and an action against the rejection decision do not replace one another. While a new file is being prepared, the time limit to file an action for the earlier act may continue to run. The purpose of both routes and their effect on one another are planned together.

Situations requiring special protection

Conditions such as serious illness, ongoing treatment, pregnancy, the situation of children, domestic violence or victimization by human trafficking can change the priorities of the file. The nature of the risk is established with suitable medical, judicial or administrative documents; the person’s safety and the need for an urgent application are assessed first.

These situations cannot always be resolved under the same sub-heading of short-term residence. Different legal regimes such as humanitarian residence, residence for victims of human trafficking or international protection may be involved. The application route is determined on the basis of the actual events and the relevant statutory conditions.

Claims of a risk to life, torture or ill-treatment upon return are not treated as an ordinary lack of documents. The applicable bar on deportation and urgent judicial protection are examined separately in the specific file.

Critical legal distinctions through six examples

SITUATIONS ENCOUNTERED IN PRACTICE

01

Applicant who buys a home: A foreign national buys a home but leases it to a third party. Despite the existence of the title deed, their own accommodation and the suitability of the purpose of application are examined separately. Acquiring a home also does not by itself remedy an earlier violation of lawful stay.

02

Application after graduation: For a person who graduated two months ago, the current student status and lawful stay are about to end. Because there is a six-month category window, it is not concluded that they may remain without action for four more months; the timing of the new application is planned together with the existing status.

03

UETS notification: While the applicant is abroad, an unfavorable decision reaches the UETS address. Even if the message was opened three weeks later, the time limit is not started only from the date it was opened. The calculation is made on the basis of the records of arrival and statutory service.

04

Two decisions arriving together: A residence rejection decision and a deportation decision are served together. The general sixty-day time limit for the residence act cannot be used in place of the special seven-day time limit for deportation. In an urgent review, the shortest time limit is protected first.

05

Change of province: A person with a residence permit in Antalya moves to Istanbul. Even if the former card is valid for eight more months, they do not postpone the move procedure until the card expires; the twenty-business-day application rule in the new province is assessed.

06

Favorable court decision: A person whose rejection act has been annulled follows the service of the decision on the administration and the fulfillment of its requirements. It is not assumed that all electronic records are corrected on the same day as the news of the court decision is received.

These examples are intended to explain legal distinctions. In personal files, the outcome varies according to the documents, dates, status and the reasoning of the decision.

Frequently asked questions and the file to prepare

QUESTIONS AND THE INITIAL CONSULTATION

Frequently asked questions

Can I work with a short-term residence permit? A residence permit alone does not give the right to work. The work permit or exemption required by the activity is determined separately.

Can I apply without buying a home in Türkiye? Yes. The law provides for tourism, commercial ties, research, medical treatment and other grounds. The person must satisfy the conditions of the ground that genuinely suits them.

Is every home purchase sufficient for residence? No. The nature of the residence, the applicable value-related conditions, the date of acquisition, use, address and the applicant’s situation are assessed together.

Will my spouse and child automatically get a permit through my file? No. Each person’s legal basis is determined. An assessment based on joint title, a separate short-term application and a family residence permit are distinguished from one another.

If I request two years, will a two-year permit be granted? The requested period is not an automatic right. The statutory upper limit, the reasoning, the documents, the passport and the outcome of the administrative assessment determine it.

Can I leave the country during the application? The type of document and the stage of the file are examined. For travel with a suitable application certificate, the rule of returning within fifteen days and the other conditions of entry are taken into account.

If no answer is given for ninety days, is my application deemed accepted? No. The date on which the file was completed and the legal effect of the delay are assessed separately; silence is not an automatic permit.

Must I first object to the administration against a rejection decision? In a general residence annulment action, the route under Article 11 of the Administrative Procedure Law is, as a rule, optional. If there is a special act and time limit, it is examined separately; applying to the wrong authority may not protect the time limit.

Does filing an action prevent my deportation? Which act the action is filed against is decisive. No automatic stay is accepted for a residence action. The effect of an application made within the time limit under the special law against a deportation decision is assessed separately.

After a rejection, can I apply again immediately on another ground? The new ground must be genuine and its conditions must exist; the person’s lawful stay and the practice concerning an application for the same purpose are checked separately.

Do I need to go to the appointment if I have an attorney? It is possible for the administration to request personal attendance or an interview. Representation does not replace every personal procedure.

If I lose my residence card, does my permit end? Loss of the card and the end of the right of permit are not the same. The loss notification and the new card procedures are carried out; the validity record is checked separately.

The file to prepare for the initial consultation

In the initial legal assessment, the person’s current status and the nearest time limit are determined. That not all documents have yet been completed is not a reason to postpone the time-limit check.

Basic file: Current and previous relevant passports, entry and exit information, and, if any, visas and residence cards; current address and family information; the ground for application and the targeted duration; previous applications and the decisions on them.

Application-specific documents: Title deed or lease and accommodation documents, income and health coverage records, documents verifying education, medical treatment, work or the other ground; foreign documents and their existing certifications.

If there is an unfavorable decision: All pages of the decision, the notification envelope or UETS records, the application form, proof of submission, deficiency letters, earlier petitions and, if any, deportation, entry ban or detention documents.

In addition to the documents sent, it is useful to prepare a short summary of events in chronological order. The original documents are kept; legible and complete copies are shared. Private account passwords and unrelated sensitive information are not added to the file.

From the application to the implementation of the decision

THE PROCESS WITH GÜNEŞ & GÜNEŞ

In a short-term residence file, the starting point of our service is to determine the person’s current legal situation and the time limits that must be protected, before deciding which application will be made. The scope of the work is agreed together; which of the stages of application preparation, administrative follow-up, litigation and implementation of the decision are undertaken is clearly stated.

Initial situation and time-limit review

Entry, visa, residence, previous rejections and any other administrative acts are assessed. The priority steps and the nearest dates are explained to the applicant. Lawful stay and the time limit to file an action are tracked separately.

Determining the correct legal basis

Tourism, home ownership, commercial ties, medical treatment or another category is matched with the person’s actual purpose and documents. An unsuitable ground is not chosen merely because it gives the appearance of an easy application.

Document plan and integrity of the file

A file-specific list is prepared for identity, address, income, health coverage and special category documents. Deficiencies and the need for translation and certification are identified; records that contradict one another are addressed before the application.

Real estate and accommodation assessment

Depending on the scope of the service, the title deed, use, lease, authority, address and suitability for the application are examined. The limits of the relationship between the residence transaction and the residence permit are explained.

Application and submission follow-up

The form, the application method, the appointment and the submission stages are carried out. The procedures that require the applicant’s personal attendance are notified in advance. Submission and notification records are kept in the file.

Administrative assessment and additional documents

Deficiency letters, interview requests and notifications are tracked. The necessary explanations are submitted within the time limit. The applicant is told at which stage the procedure is and which document is expected from them.

Unfavorable decision and choice of legal route

The decision, the notification and the current status of stay are examined together. The options of an administrative application, an action, reapplication and urgent interim protection are assessed with their reasoning and time limits.

Litigation and follow-up of remedies

Within the scope undertaken, the petition of action, the request for a stay of execution, replies to defenses and suitable remedies are prepared. Residence, deportation and detention acts are followed without being confused with one another.

Implementation of the decision and post-permit procedures

The implementation of a favorable decision by the administration, the status of the card and records, notifications and the next application period are monitored. At the close of the file, the outcome and continuing obligations are explained.

Costs and communication arrangements

Attorney services are separated from fees, translation, notary, insurance and other third-party expenses. If a need for a new procedure outside the scope arises, its effect is notified. The communication channel and the method of delivering documents are determined at the beginning of the file.

The applicant must share information about themselves accurately and completely. Concealing a previous rejection, deportation, judicial proceeding or violation of lawful stay affects the legal assessment and the reliability of the application. New developments are notified without delay.

Information and documents obtained within professional confidentiality are protected. Personal data are processed within the framework of the conduct of the file and the relevant legal obligations; the necessary protection is observed for sensitive data such as health and family information. Transfers to interpreters, notaries, insurance companies or other persons and institutions are assessed limited to the necessary legal basis and the needs of the work.

An initial request for information or the sending of a document does not by itself mean that representation has been undertaken for all procedures. The scope of the service, the authority of representation and who will track time limits must be clearly determined. It is specifically stated that decisions containing urgent time limits have been sent.

The granting of a residence permit is the task of the competent administration; the decision of a dispute is the task of the court. The responsibility our firm undertakes is to carry out the agreed legal work with care, to track time limits, to explain risks and to represent the file on the basis of its documents. No guarantee of an outcome or of a particular processing time is given.

Why Güneş & Güneş

Decisions concerning the right of residence in Türkiye can affect the choice of home, family arrangements, business plans and the possibility of movement between countries. For this reason, as much as preparing the application document, it is important to see a wrong step early and to know which route will be used after an unfavorable decision.

As Güneş & Güneş Law Firm, we assess the professional experience we have built since 1999 according to each applicant’s citizenship, family situation, purpose of stay and specific documents. In our Antalya-based practice, with the ability to communicate in Turkish, English, German and Russian, we aim for the file to be understood and the document to be prepared correctly.

We take as our basis offering a realistic legal assessment before the application, clear information during the process and reasoned representation in the event of a dispute. We explain clearly to you which document is needed and why, which date matters and which procedure could change the outcome.

Our goal is not merely to arrive at a procedural result, but to help you make decisions about your stay in Türkiye knowing their consequences. We assess your file from its current stage and determine together the necessary application and protection routes.

We assess with care and represent with determination.
