Summary

The 15-day time limit for an action against an SGK payment order, the labor court, notification, objections on the debt and the statute of limitations, and stopping enforcement.

Against a payment order sent by the Social Security Institution (SGK) under Law No. 6183, on the ground that the debt does not exist, has been partly paid or is time-barred, an action may be filed before the competent labor court within 15 days of notification. This statement, however, does not mean that the same period applies to every document received from SGK. Premium accrual, an administrative fine decision, a payment order and an attachment act are different stages.

When the payment order reaches you, the first task is not merely to look at the total amount. The type of act, the notification record, the debt period and the capacity in which the addressee is held liable must be determined together. Filing an action does not by itself stop SGK enforcement. If temporary suspension of collection is wanted, that request must be separately reasoned.

How is an SGK payment order distinguished from premium accrual and an administrative fine?

A payment order is an act aimed at the compulsory collection of a public receivable regarded as not having been paid when due. Besides the heading of the document, the law it is based on, the enforcement number, the period and the type of debt are examined. A mere letter from SGK stating a debt and a payment order issued under Law No. 6183 Article 55 do not produce the same legal result.

Ex officio premium accrual under Law No. 5510 Article 86 has its own objection and action regime. For an objection to the merits of an administrative fine under Law No. 5510 Article 102, there is first an application to the Institution and then the administrative judicial route. A payment order sent later to collect a penalty alleged to have become final must be distinguished from the penalty decision itself. It is risky to miss the time limit for an action against the penalty decision and assume that all objections on the merits will be reviewed afresh at the payment order stage.

In which court is an action filed against an SGK payment order?

Law No. 5510 Article 88 contains a special provision for disputes arising from enforcement carried out by the Institution under Law No. 6183. An action concerning a payment order is filed before the labor court, with jurisdiction assessed by the location of the SGK unit that is the creditor. Where there is no labor court, the court with general jurisdiction may sit as a labor court.

The tax court practice concerning a tax office's payment order cannot be transferred directly to SGK premium enforcement. The petition must identify the relevant SGK unit, the enforcement number and each payment order whose annulment is sought. A document issued in the company's name and one issued against the manager or partner personally are separate acts; an action filed by the company does not in every case protect the individual's own time limit.

How is the 15-day time limit for an action calculated?

The time limit starts not on the day the payment order is issued but upon legally valid notification. As a rule, the calculation begins on the day following notification. Where the last day falls on an official holiday, where notification is made electronically, or where address records have changed, these are assessed separately. In SGK electronic notification, the date on which the document reaches the electronic address must be distinguished from the date on which it is deemed notified under the legislation.

If the notification was received by the accountant or a company employee

The identity of the person who actually received the document and the capacity in which delivery was made are investigated. Notification to the company and personal notification to the manager are not the same. Taking as the basis only the day on which the accountant passed the document to the manager may cause a loss of time. The envelope, the notification receipt, and the electronic delivery and notification records should be kept together.

If improper notification is alleged, the fact of learning and the notification provisions to be applied are made concrete. A general statement such as "I was not informed" may not be sufficient. The action should be prepared without delay, also taking into account the possibility that the notification is valid.

Does filing an objection petition with SGK protect the time limit?

The special action route against a payment order and the application to the Institution under Law No. 7036 Article 4 are not the same thing. One should not proceed on the assumption that a reply from the Institution must first be awaited in a payment order action. On the other hand, there are also court decisions assessing the effect on the action period of an initial application made to the Institution within the time limit. For this reason, the absolute approach that "an administrative application produces no effect in any circumstance" is not correct either.

In a concrete review, the date of the initial application, whether the application was directed at the payment order, the notification of the rejection reply and the date of the later action are recorded separately. It should not be accepted that the period restarts continuously by submitting the same request repeatedly. The safest practice is to act on the basis of the special 15-day action period and not to postpone filing the action on the strength of administrative correspondence.

On what grounds can the annulment of a payment order be based?

The grounds in Law No. 6183 Article 58 — that the debt does not exist, has been partly paid, or is time-barred — are explained according to the documents of the dispute. The allegation that the debt does not exist may include matters such as enforcement against the wrong addressee, the person's not holding a liable capacity in the relevant period, or the absence of a collectible debt. It should not be assumed that every objection will be examined with the same breadth.

If the debt has been paid or recorded to the wrong account

A bank receipt should not be left on its own. The workplace registry number, period, collection code and amount in the receipt are matched with the SGK itemized account card (müfredat). The debt may continue to appear on screen because of different workplaces of the same company, cancellation of an incentive, late-payment items or the order of offsetting (mahsup). If there is a partial payment, which items have been paid and which part is the subject of the action are shown clearly.

If the company's debt is demanded from a manager or partner

The legal basis of personal liability must be determined. The liability of a limited liability company partner according to his or her share ratio and the same person's liability as manager under Law No. 5510 Article 88 are different. Shareholding in a joint stock company is likewise not identical to board membership. Appointment, resignation, share transfer and trade registry documents should be compared with the time the debt was payable.

If the statute of limitations is raised

The five-year period known for tax receivables does not apply automatically to an SGK receivable. Law No. 5510 Article 93 contains a special provision for premiums and other receivables; the period of the debt and the manner of its determination may affect the starting point. For older periods, the law in force and the transitional rules are examined separately. The effect on limitation of payments, attachments, notifications and other acts in the collection file must be determined from the documents.

Do attachment and collection stop when an action is filed?

Under Law No. 5510 Article 88, filing an action does not by itself stop enforcement and collection. For this reason, temporary legal protection may need to be requested alongside the annulment claim. In the labor court, the interim injunction provisions of the Code of Civil Procedure (HMK) and the nature of the dispute are assessed; the stay of execution procedure of the tax court does not apply as it is.

The request should not rest only on the statement "I would suffer harm." A bank account block, salary payments, an approaching sale, account movements needed for operations, and documents supporting the liability objection are submitted. There is a possibility that the court will require security or reject the request. It must be clear which payment order and which collection acts the injunction covers.

Filing an action against a payment order also does not mean that obligations concerning the asset declaration (mal bildirimi) disappear in every case. The provisions of Law No. 6183 Articles 58–60, the scope of the action and any court decision must be examined together. Whether the objection is to the whole debt or only to part of it affects this assessment.

With which documents should the case file be prepared?

The payment order and the notification record, the enforcement file, a detailed debt breakdown, earlier accrual and penalty decisions, collection documents and records showing the company capacity should be gathered together. The scope of the dispute is easier to understand when the period to which the debt belongs, the due date, the person's term of office, and the payment and enforcement acts are shown in a single chronology.

The petition states the amount or period whose annulment is sought, the basis of each objection and the temporary protection requested. If a document is held by the Institution, it is requested to be brought in by stating which document will explain which fact. If an expert report or decision from another file is to be used, the matching of party, period and debt is shown.

Which steps are followed after the court decision?

Taking into account the scope of the annulment decision, its finality and appeal status, and its enforceability, correction of the SGK enforcement record is requested. If there is an attachment, the sending of a lifting letter to the relevant bank or registry is followed separately. The refund of an amount that has been collected is handled according to the content of the decision and the refund provisions to be applied; annulment of the payment order does not in every case show that the underlying debt has been entirely eliminated.

For appeal (istinaf) and appeal to the Court of Cassation (temyiz), the nature of the decision, the monetary thresholds and the notification date are checked separately. Court costs, expert fees and the likelihood of the opposing party's attorney fee award should be assessed from the outset. The 10 percent surcharge for an unsuccessful claim (haksız çıkma zammı), tied to the dismissal of a payment order action in older texts, must not be used as the current rule without taking into account the legal position following the Constitutional Court's annulment.

Conclusion

An effective application against an SGK payment order depends on classifying the document correctly, protecting the 15-day time limit and matching each debt item with a concrete objection. Company liability, payment and limitation allegations should be supported by separate documents; whether a separate court decision is needed to stop collection should be assessed.

Frequently Asked Questions

Is an SGK payment order objected to in the tax court?

For a payment order dispute arising from premium enforcement conducted by SGK under Law No. 6183, the labor court has jurisdiction. The distinction between acts in the section "In which court is an action filed against an SGK payment order?" should be taken into account. Related explanation

Can I wait for a reply after filing a petition with SGK?

The effect of an administrative application on the time limit depends on the concrete circumstances. One should not wait in a way that misses the special 15-day action period. The section "Does filing an objection petition with SGK protect the time limit?" explains this distinction. Related explanation

Is a bank block lifted automatically when an action is filed?

No. Because enforcement does not stop of its own accord, temporary legal protection and the lifting of the attachment are assessed separately. See the section "Do attachment and collection stop when an action is filed?" Related explanation

Does a five-year statute of limitations apply to an SGK debt in every case?

No. Law No. 5510 Article 93 and the provisions relating to the period of the debt must be examined. The check of the period and acts in the section "If the statute of limitations is raised" is carried out. Related explanation
