If you think a neighbor’s construction comes too close to the boundary or exceeds the permitted height, the zoning plan and plan notes in force should first be compared with the approved project and an on-site measurement. There is no single setback distance or floor limit for every parcel. If the violation lies in the permit, an annulment action comes into play; if it lies in the work carried out on site, a request for administrative inspection and sanction comes into play. Prevention and compensation of neighborhood harm may also be assessed separately through private-law avenues.
What is a setback distance, and from which document is it learned?
The setback distance is one of the building conditions that determine the placement of a structure in relation to the parcel boundary or the relevant zoning line. Front, side and rear yard distances are not the same. The building order, the geometry of the parcel, the street frontage, plan notes and special legislation can change the result. For this reason, measuring the gap between the walls of two neighboring buildings does not by itself prove a violation of the permit.
The zoning plan and plan notes are examined first
The building lines and plan notes in the implementation zoning plan should be read together with the zoning status document and the approved site plan. Some of the distance rules of the Regulation on Zoning in Planned Areas (Planlı Alanlar İmar Yönetmeliği) apply on condition that the implementation zoning plan contains no provision to the contrary. A figure seen in the Regulation cannot be used as a definite limit for every parcel without examining the plan.
If there is a coastal, heritage, protected-area or other special status, additional rules may apply. If the parcel’s historical boundary differs from the current cadastral boundary, the data on which the measurement is based also matters. A garden wall, a fence or a path used for years is not in every case the legal parcel boundary.
How many meters are the front, side and rear yard distances?
Article 23 of the Regulation on Zoning in Planned Areas contains, for cases where the implementation zoning plan has no contrary provision, the basic rules of at least five meters for the front yard and for yards facing a road, and at least three meters for side and rear yards. These figures are not a final calculation independent of building height and other special conditions.
Do the side and rear yards change as the number of floors increases?
Under Article 23, there is a rule that, for buildings of more than four floors, counting basements that remain above the natural or leveled ground, half a meter is added to the side and rear yard distances for each floor above four. The technical provisions on floor calculation and special cases are assessed separately. Counting only the rows of windows visible on the facade is not the correct method of calculation.
For example, for a building that is six floors under the Regulation’s calculation, with no contrary provision in its plan and no other applicable exception, an addition of one meter in total, corresponding to two floors, to the basic three meters may come into play. This is a hypothetical explanation, not the permit condition of a particular parcel. The position of the basement, the leveling and the plan note may change the calculation.
How is the distance between two buildings calculated?
If there is more than one building on the same parcel, the rules on distance between buildings under Article 24 of the Regulation are also examined. The gap seen between two structures on separate parcels, on the other hand, must be assessed together with each parcel’s own building conditions. That one neighbor has left a yard does not automatically allow the other neighbor to approach the boundary without using his or her own mandatory distance.
| Subject examined | Basic document | Common mistake |
|---|---|---|
| Parcel boundary | Current cadastre and staking-out data | Treating the fence as the definite boundary |
| Placement of the building | Approved site plan and on-site measurement | Estimating distance by eye alone |
| Yard distance | Implementation plan, plan note and Regulation | Applying the same figure everywhere |
| Building height | Elevation datum, section and the project annexed to the permit | Merely counting floors or windows |
Are building height and the number of floors the same thing?
Building height, structure height, number of floors and elevation datum are related but different technical concepts. The definitions in the Regulation and the relevant calculation provisions must be taken as the basis. A visual comparison with the neighboring building alone, without assessing the features of the roof, basement, sloping land and stepping, is not sufficient.
Why is the elevation datum decisive?
The reference level from which the height calculation starts affects the permitted volume of the building. The differences between the road elevation, the natural ground and the leveled ground should be examined in the project and on site. Later filling or excavation of the land does not create a new right to a taller building outside the technical and legal conditions.
That a building stands on sloping land may cause more floors to be visible on one facade. This alone does not show that there is an illegal floor; conversely, labeling a floor a “basement” does not mean that every floor falls outside every calculation. The elevation sections, the documents approved by the municipality and the actual levels on site should be checked together.
Inspection of height is separate from the floor area ratio calculation
The floor area ratio (emsal or KAKS) concerns the calculation of building area; the building footprint ratio (TAKS) concerns the footprint area. Height and yard distances impose separate restrictions. That the floor area ratio is not exceeded does not mean that the building may be built anywhere and at any height. Likewise, compliance with distance does not by itself prove conformity in terms of floor area ratio or type of use.
Can no structure or annex be located within the yard distance?
Different provisions may exist for basements, parking, projections, stairs and technical installations. An element entering the building setback area should not be automatically characterized as a violation without investigating its type and conditions. At the same time, the existence of an exception does not grant a general permission to close off the garden entirely or to create a new independent unit.
The limit of the 2026 fire stair regulation
Article 23/9 of the Regulation on Zoning in Planned Areas, through the amendment dated 14.01.2026, contains a conditional provision on fire stairs that have become mandatory in existing buildings for certain reasons and that cannot be accommodated inside the building. Together with the relevant fire legislation and minimum design conditions, an approach limit of at least 1.50 meters from the parcel boundary in the side and rear yards and at least three meters in the front yard is provided.
This provision is not a general exception granted to all new buildings or to every kind of external stair. The existing building, the reason for the requirement, the impossibility of a solution inside the building and the suitability of the project are investigated. The statement “I am building a fire stair” alone is not sufficient. The rules in force on the date of the specific transaction and the necessary permits must be examined separately.
Which route is chosen if the neighbor builds in breach of distance or height?
The source of the violation must be determined first. If the project annexed to the permit already approves a distance or height that the plan does not allow, the lawfulness of the permit is in question. If the project is compliant but the work carried out differs, a request for on-site inspection and action under Article 32 of Law No. 3194 comes to the fore. If there is a renovation permit, its scope is also examined.
Annulment of the permit and stay of execution
A neighbor whose interest is violated may, if the conditions are met, request annulment of the permit before the administrative court. The general period is sixty days; for third parties, actual learning of the permit is important. A prior application to the municipality or a record showing that the construction was known may be used in the discussion of when the period began. Obtaining a technical report later does not in every case create a new period.
Filing an action does not stop the construction automatically. For a stay of execution, a clear unlawfulness and the conditions of damage that is difficult or impossible to remedy must be shown together. A measured site plan, an elevation section and a concrete impact analysis are more explanatory than the statement “it was built too tall” alone.
Requesting inspection from the municipality
The petition states the address and parcel, the section complained of, the allegation of violation and the supporting document. A comparative examination with the project is requested and, if a violation is found, that the statutory actions be taken. The date on which the application was received and the reply are kept. A request for a new action, an objection to the existing permit and a right-to-information application do not have the same effect on time limits.
If the municipality does not reply or rejects the request, Article 10 or Article 11 of the Administrative Procedure Law (İYUK) is considered, depending on the nature of the application. The details of these applications are dealt with in a separate article on a municipality’s failure to act on illegal construction. While waiting for the administration to inspect, the period for the permit action should not be overlooked.
How are the neighbor’s rights to view, light and safety assessed?
A change in the view, reduced sunlight and the effect on privacy may be important in a specific case. However, it cannot be said that every property owner has an absolute right to a view that prevents the neighboring parcel from being built on at all. Plan rules, private rights, neighborhood law and the intensity of the effect are examined together.
Zoning violation and private-law harm
A violation of the zoning distance is a matter for administrative inspection. A neighbor’s exposure to danger, or effects exceeding the limits of tolerance, may give rise to private-law claims under Article 730 et seq. of the Turkish Civil Code (TMK). The validity of the administrative permit does not completely close off private-law review; nor does the existence of an administrative violation automatically prove all heads of compensation.
In actions based on neighborhood rights, mandatory mediation and the rules on subject-matter and territorial jurisdiction are assessed. In an urgent situation, preservation of evidence or an interim injunction may be requested. Where the parcel boundary is in fact crossed, not only the yard distance but also the provisions on encroaching structures and ownership may come into play; these two situations are not the same.
Which documents should be in the technical review file?
Current title deed and cadastral information, the zoning status, the relevant plan and its notes, the initial and renovation permits, the approved site plan, the floor plans, the sections and the elevation documents should be collected together. The project in the municipal archive and the on-site measurement must rest on the same coordinates and references. The method and competence of the expert who made the measurement must be clear.
A photograph describes a place; however, because of perspective it may misrepresent distance or height. An approximate measurement taken with a phone should not be submitted in place of an engineering measurement. If a shadow analysis is to be prepared, the date, time, direction, surrounding buildings and the model data used should be explained. The technical work must make clear which allegation it tests.
Council of State decision: plan integrity and the scope of the claim
In the decision of the 6th Chamber of the Council of State (Danıştay 6. Dairesi) dated 21.09.2023, E.2019/15650, K.2023/6756, plan amendments and plan notes in Çankaya were examined. The Chamber upheld the annulment of the plan notes on a ground tied to the disappearance of the master plan on which they were based, and reversed the annulment decision given in respect of a use function that was not the subject of the action.
This decision shows that technical building rules should be read together with the levels of planning, and that the limits of the claim in the action should be determined correctly. The first-instance reasons in the decision should not be reported in full as if they were the independent holding of the Council of State. The decision did not introduce a single building distance or height formula for all parcels in Türkiye.
Conclusion
The correct outcome in a setback and height dispute depends on comparing the current plan and project with a reliable on-site measurement. First it must be determined whether the violation is in the permit or in the execution; while the limitation period is protected, appropriate administrative and private-law avenues should be chosen. Exceptions such as the 2026 fire stair regulation should not be generalized beyond their purpose and conditions.

Frequently Asked Questions
Is the side yard distance three meters everywhere?
No. The basic rule in the Regulation on Zoning in Planned Areas is assessed together with the plan provisions, the floor calculation and applicable special rules.
Is it enough for me to measure the distance between me and my neighbor’s wall?
It is not enough. The legal parcel boundary, the approved placement and the reference of the measurement must be determined. The existing wall may not always be the cadastral boundary.
Is a basement floor never counted in the height and distance calculation?
There is no such general rule. The position of the basement relative to the ground and the calculation under the relevant Regulation are decisive; the label in the project alone is not enough.
Can a fire stair be built in the garden?
Under certain conditions of existing building and necessity, the 2026 regulation may apply. A solution inside the building, the minimum design, the boundary distances and the necessary permits are examined together.
Can I seek private-law protection before the permit is annulled?
Private-law claims may be assessed separately with respect to concrete neighborhood harm or danger. Their conditions differ from those of a permit annulment action.
