What Do We Assess First in Your Criminal Case?

Criminal law support is not limited to a defense at the hearing. Your capacity in the file, the stage of the proceeding, the evidence and approaching time limits shape the first assessment. Defending a suspect or defendant and pursuing a victim’s rights are separate legal needs.

DEFENSE

If you are a suspect or defendant

We identify the accusation and the stage of the file, and assess your defense rights with respect to statements, evidence and measures.

SEEKING REDRESS

If you are a victim or complainant

We examine the incident, the existing evidence and the need for protection, and identify the complaint, intervention and related requests.

AFTER THE DECISION

If you have received a judgment or a notification

We check the type of decision and the records of when it was learned and served, and distinguish the available legal remedy from the effect on enforcement.

Our Legal Services in Criminal Law

Each heading opens into an independent guide that explains the relevant procedures and the distinctions to keep in mind. The scope of services is clarified after the file review and acceptance of the matter.

Which Criminal Cases and Disputes Do We Handle?

The nature of the offense, the capacity of the person and the competent authority are determined together. Not all of the matters below are heard by a High Criminal Court; a distinction is made between criminal courts of first instance (asliye ceza), High Criminal Courts and specially authorized authorities.

A Work Plan Specific to Your File

  1. Situation and priority

Your capacity, the accusation, existing decisions, the date of the procedure and urgent needs are identified.

  2. File and evidence

The accessible records are reviewed; evidence for and against, and missing investigations, are assessed.

  3. Application and representation

The defense, evidence request or objection is prepared for the appropriate authority and according to procedure; the procedures are followed.

  4. Decision and next step

Developments and the effects of the decision are explained; the need for a legal remedy and for enforcement is assessed separately.

What becomes clear at the end of the consultation?

The current stage, the approaching procedure, missing documents and the legal routes to be assessed are identified. The scope of representation, the attorney’s fee and costs that may arise separately are explained. No commitment to a result is given; representation begins after acceptance of the matter and the necessary authorization. Opposing interests in the same dispute are not represented together.

Criminal Files Connected with Türkiye, Handled from Antalya

Güneş & Güneş Law Firm assesses legal needs in criminal investigations and cases from its base in Antalya. For files outside Antalya, the competent authority, representation and the plan of action are determined separately; the scope of the service is not assumed from the city you are in.

Communication in Turkish, English, German and Russian helps foreign clients understand the file and prepare documents. Procedures that require a court interpreter are carried out under their own rules.

Frequently Asked Questions about Criminal Defense

At what stage can a criminal defense lawyer help?

Legal support may be assessed starting before a statement and through the investigation, protective measures, the trial, legal remedies and enforcement. Stating the current stage and the approaching procedure in your inquiry makes it easier to set priorities.

I have been summoned to give a statement; what should I prepare first?

Share the summons, the capacity in which you were summoned, the unit, the file number and the date of the procedure. Preserve the existing documents. The rights and obligations of a suspect and of a witness are not the same.

Does a pretrial detention order mean the offense has been established?

No. Pretrial detention is a protective measure, not a judgment of conviction. Its statutory conditions and proportionality are examined on the basis of concrete grounds; release or acceptance of an objection cannot be guaranteed.

Is legal representation also offered to complainants?

Yes. Representation of victims and of persons harmed by the offense may be assessed within the scope of the criminal report, evidence requests, follow-up of the investigation, intervention, the need for protection and related applications.

What can I do if I cannot afford an attorney?

In criminal procedure, there are statutory conditions for the appointment of defense counsel and representatives, on request or mandatory. Information on the procedure can be obtained from the relevant judicial authority or the bar association. This appointment is not the same as representation undertaken with the firm under a private fee agreement.

Does HAGB mean acquittal?

No. HAGB differs from acquittal and from suspension of the sentence. Its conditions and the route of application are assessed in light of the current legislation, the date of the decision and the transitional provisions.

Is reconciliation applied in all criminal files?

No. Whether the offense falls within its scope, the parties and the other statutory conditions are examined. Withdrawal of the complaint, reconciliation and effective repentance (etkin pişmanlık) are not procedures that can be used in place of one another.

How long does it take to reach a decision in a criminal case?

The needs of the investigation, the evidence, experts, detention, service of documents and legal remedies affect the duration. No fixed date for a result and no success rate is given before the file is seen.

How is the attorney’s fee determined?

It is explained after assessing the stage and scope of the matter and the need for hearings and applications. The private attorney’s fee is separate from expenses such as litigation and translation costs; the procedures to be undertaken are clarified by a written scope.

How can I share documents securely?

First report the subject and stage of the file and the time-sensitive procedure. Send sensitive documents through a channel confirmed with the firm. Do not share your e-Devlet, UYAP, bank or UETS passwords; do not alter the originals of documents or the digital records.

Can I apply from outside Antalya or from abroad?

For files connected with Türkiye, a first consultation can be arranged by phone or online. Attendance at hearings and judicial procedures, and the requirements for a power of attorney and translation, are determined according to the file; a remote consultation does not mean every procedure can be carried out remotely.

An inquiry alone does not create an attorney–client relationship and does not stop time limits. The legal conditions of the specific matter are reviewed separately.
