Detention in custody or arrest
Prepare the person’s name, the unit where the person is held, the known time of the procedure and the file number, if any. Report any health and language needs separately.
Arrest, detention in custody, pretrial detention and judicial control are not the same procedure. The decision to be reviewed, the authority to apply to and the legal request differ at each stage. At the first consultation, we identify the stage of the file, where the person is held and the approaching procedure.
Prepare the person’s name, the unit where the person is held, the known time of the procedure and the file number, if any. Report any health and language needs separately.
Keep the entire decision, the interrogation record and the record of learning of the decision or its notification. Let us review the existing evidence and earlier applications together.
Document the place and frequency of signing, and your travel, work, education or health needs. Let us make your request concrete with a workable change.
Review of the basis of the procedure, its duration and the records; identification of the appropriate route of application.
About arrest and detention in custodyThe allegation, access to the file, consultation with defense counsel, the statement and preparation of favorable evidence.
About defense counsel at statements and interrogationsA file-specific objection based on the concrete grounds of the decision, the evidence and proportionality.
About objection to pretrial detentionAssessment of changed circumstances, new documents and alternative measures.
About release and review of pretrial detentionRequests concerning signing, the ban on leaving the country, not leaving the residence and other obligations.
About modification of judicial controlSeparate review of the effects of the measure, compensation and the possibility of an individual application.
About rights violations and related routesBy opening the relevant heading, you can review the stage your file has reached. If a time-limited procedure is involved, do not wait on the basis of general information; ask for an assessment together with the decision and records.
First, the judicial basis of the procedure, its starting time, the place of holding, the responsible unit and the existing documents are identified. Arrest on a warrant is distinguished from direct arrest, and judicial detention in custody from administrative detention. The period is calculated according to the offense and the type of procedure; a single period of detention in custody is not assumed for every file.
An application under Article 91/5 of the Code of Criminal Procedure (CMK) concerning arrest, detention in custody and extension procedures differs from the general objection to a pretrial detention order. The person, his or her defense counsel and the relatives listed in the law may apply.
The capacity in which you are summoned and what the allegation is are clarified. Giving a statement as a suspect and being heard as a witness are not the same legal position. In the meeting with defense counsel, work is done on the sequence of events, the existing documents, requests for investigation in your favor and the accurate entry of the statement in the record.
In access to the file, any restriction order and the nature of the document are reviewed. As a rule, a power of attorney is not required for a meeting with defense counsel; the special restriction conditions in the law are reserved. The need for the appointment of defense counsel and the provisions on mandatory defense counsel are also assessed.
Instead of guessing about a point you do not remember, it is important to state the limits of your knowledge. Keep copies of the records and of correction requests. Do not resort to deleting or altering evidence or creating an unlawful record.
Pretrial detention is not a judgment of conviction. The evidence indicating strong suspicion, the ground for pretrial detention, proportionality and why judicial control is insufficient are examined separately. No automatic conclusion is drawn merely from the name of the offense or its inclusion in the offense catalog.
The general time limit for objection under CMK Article 268 is two weeks from the time the decision is learned of, unless there is a special provision; the transitional provisions for older decisions are examined separately. The authority that examines an objection to a pretrial detention or judicial control decision of the criminal judgeship of peace (sulh ceza hâkimliği) is, as a rule, the judge of the criminal court of first instance within its jurisdiction. The application is submitted to the authority that issued the decision.
Objecting to a specific decision is different from asking for the end of ongoing pretrial detention. New evidence, a completed investigation, a changed state of health or a proposal for a lighter measure is assessed at the stage the file has reached. Instead of an application that merely repeats the earlier petition, a concrete explanation linked to the reasoning of the decision is prepared.
The regular review of the continuation of pretrial detention, the maximum period of pretrial detention and the assessment of reasonable time are separate headings. The fact that the statutory upper limit has not been reached does not by itself justify the continuation of pretrial detention. The assessment is made on the basis of the stage of the file, the offense, age and the relevant exceptions.
If an objection or a request for release is rejected, the reasoning of the decision, the possibility of a new application and other legal remedies are examined. No petition guarantees the outcome of release.
The request is made concrete as complete lifting, a change in the scope of the obligation, or a temporary exemption for a specific need. The operative part of the decision and the enforcement records are reviewed together. Merely having applied does not stop the existing obligation.
Document how the place, frequency and time of signing affect work or education. A work schedule, a change of residence and transport conditions can be used to substantiate the request. Do not change the signing arrangement yourself without a decision of the competent authority.
The purpose of travel, the date range, work or treatment documents and the return plan are assessed. Buying a ticket does not mean permission will be granted. The ban in the criminal file is separated from other obstacles arising from passport or immigration legislation.
The effect of the measure on daily life, the medical report and the nature of the necessary visits are explained. If there is electronic monitoring, the notifications from the system are kept. A hospital appointment or a work need does not by itself lift the measure; a request for a suitable change or exemption is prepared.
Report the excuse and its documents without delay. The conditions of the violation are examined separately; deliberate non-compliance may lead to a risk of pretrial detention. Do not leave the follow-up of the obligation and the application to verbal information alone.
For children, age and capacity in the file are addressed separately; for foreign nationals, language, interpreter and communication with the consulate. A judicial procedure is not confused with administrative detention or a deportation process. If there is a health, disability, pregnancy or care need, a request is prepared on the basis of concrete documents and the relevant procedure; no promise of automatic release is made.
The family’s need for information is considered together with the person’s will and the confidentiality of the file. With whom and through which channel sensitive information may be shared is clarified at the outset.
The basis of the procedure, the decisions, the periods of detention and the documents showing the loss are preserved. Compensation, an ordinary legal remedy and an individual application have different purposes and conditions. The appropriate authority, the right to apply, the time limit and the remedies that must be exhausted are determined separately; no release or acquittal by itself secures the acceptance of all requests.
We assess not only the lifting of the procedure but also its continuing legal effect. The scope of the application is clarified separately according to the file and the service agreement.
The procedure, the current position, the approaching date and the need for representation are identified.
The records, the reasoning of the decision, the accessible file records and documents in the person’s favor are reviewed.
A concrete application is prepared for the appropriate authority; developments in the decision and its implementation are followed.
The outcome of the decision, the obligations in force and the next steps are explained.
Which of the consultation, attendance at the statement or interrogation, objection and ongoing file follow-up will be undertaken is explained at the outset. The attorney’s fee and the transport, translation and other expenses are assessed separately. Representation is not presumed to have begun without acceptance of the matter and the necessary authorization.
No. It is a protective measure. The defense on the merits of the charge and the lawfulness of the measure are examined separately.
Depending on the circumstances of the file, these routes are assessed together. The existence of one does not justify disregarding the time limit or procedure of the other.
No. Making an application does not by itself lift the obligation. The scope and implementation of a decision to modify or lift it must be confirmed.
No. First of all, the person’s name, the unit where the person is held, the known time of the procedure and contact information provide a sufficient start. Send the existing documents separately.
Report your excuse and documents such as a medical report without delay. Do not assume that you will automatically be considered excused; the concrete violation and notification conditions must be examined.
Not always. How the decision is reflected in practice, and any restrictions arising from a passport, an entry ban or a separate file, are checked separately.
The work to be undertaken and the scope of follow-up are explained in the consultation. Release is not a result that can be bought or guaranteed; the decision belongs to the judicial authority.
For files connected with Türkiye, a first consultation by telephone or online can be arranged. The requirements for attending judicial procedures and for representation are determined separately according to the file.
