Work Permits and Foreign Employees

Legal support for foreign employees and employers in initial applications, extensions, exemptions, post-permit compliance and administrative disputes.

Scope of the service

Plan the employment of foreign personnel together, from the application to the start of work.

Employing foreign personnel in Türkiye is not merely a matter of entering information on an online application screen. The foreign national’s residence status in Türkiye, the work to be performed, professional restrictions, the contract, pay, the employer’s financial structure, the number of Turkish citizen employees, sector conditions, any prior authorization and the social security process are managed together. Choosing the wrong type of application, a mismatch between the job description and the actual duties, or work in breach of the endorsements on the permit may lead to refusal, cancellation of the permit, administrative fines and consequences under immigration law.

Law No. 6735 on International Labor Force and its Implementing Regulation establish the basic framework. Law No. 6458 on Foreigners and International Protection, Law No. 5510 on Social Insurance and General Health Insurance, employment law provisions, legislation specific to the profession and sector, and the social security agreements to which Türkiye is a party are applied separately depending on the file. Because the Ministry of Labor and Social Security (Çalışma ve Sosyal Güvenlik Bakanlığı) may vary the evaluation criteria according to sector, profession, job, employer and the foreign national’s status, the method used in an earlier application cannot be carried over to a new file automatically.

Which stage are you at?

If there is a notification or an upcoming permit expiry, preserve the date. For a time-limited step, do not wait for the day of the consultation or for a reply from the firm.

International Labor Force Compliance Map

The employer’s foreign personnel structure is mapped on the basis of citizenship, duties, status, workplace, type of permit, term, pay and SGK registration. A calendar of applications, notifications and renewals is prepared for existing and planned employment.

Review of the Foreign Employee’s Status and Position

The foreign national’s passport, residence status in Türkiye, educational and professional background and the position offered are assessed together. Whether the profession is open to foreign nationals and how the duties will be written into the permit endorsement are determined.

Pre-Hiring Work Permit Feasibility Review

Before the employment contract is signed or the start date is fixed, the application route, employer criteria, minimum pay, sector conditions and time risks are reviewed. The human resources plan is aligned with the legal calendar.

Employer Evaluation Criteria

The number of Turkish citizen employees, paid-in capital, net sales, exports, workplace activity and the pay to be given to the foreign national are compared with the current criteria. The general rule is distinguished from sector, status and investment exceptions.

Check of Professions Reserved for Turkish Citizens

The job title and the actual work are checked against the Ministry’s current list of professions and the special laws on which it is based. In a profession that is prohibited, a route to a permit is not created merely by using a different title.

Law No. 2527, the Blue Card (Mavi Kart) and any applicable special provisions in professional laws are examined separately. A permit exemption or an exception to the criteria does not by itself remove the requirements for practicing the profession.

Regulated Professions, Diploma Equivalence and Prior Authorization

In health, education, engineering, architecture and other regulated professions, the requirement for a diploma, equivalence, authorization, temporary membership or prior authorization is determined. The application plan shows that a work permit and the authority to practice a profession are different legal acts.

Initial applications in Türkiye and from abroad

5 areas of work

Work Permit Application in Türkiye

The possibility of applying from within Türkiye is reviewed on the basis of the foreign national’s valid residence permit and foreign identification number. The employer’s registration, electronic authorization, contract and application attachments are prepared for the e-İzin system.

On the general route for applications in Türkiye, a residence permit issued for at least six months and valid on the day of application is required. This wording does not mean that one must wait six months before applying or that six months must remain until the permit expires; special status provisions apply separately.

Work Permit and Work Visa Application from Abroad

The application to the Turkish diplomatic mission in the country of which the foreign national is a citizen or in which he or she is legally present and the employer’s application in Türkiye are carried out on a simultaneous calendar. The reference number, the validity of the passport, the employment contract, and the entry and start-of-work stages are monitored.

Diplomatic Mission Reference Number and the Employer’s Electronic Process

It is ensured that the sixteen-digit reference number given in the application from abroad is matched with the correct employer and foreign national. Completion of the electronic application within the time limit and the authorized account and e-signature procedures are coordinated.

First Fixed-Term Work Permit

The file for the first work permit is prepared for a specific employer, workplace, province and set of duties. The term of the contract, the validity of the passport and the Law’s limit of at most one year for the first permit are taken into account.

Work Visa, Entry into Türkiye and Starting Work

After the application from abroad is concluded favorably, the calendar for the fee, visa, entry into the country, address and start of work is coordinated. It is kept in mind that a foreign national’s failure to arrive in Türkiye within six months from the start of the permit may lead to cancellation of the permit.

Extension, types of permit and exemption

8 areas of work

Extension of the Work Permit Term

The existing permit and the contract, pay and SGK records are reviewed, and the extension application is made before the permit expires. The limit of at most two years for the first extension and at most three years for later extensions, and the permit endorsements, are monitored.

In an extension application made within the time limit, the possibility of working for at most 90 days from the expiry of the permit while the evaluation continues, in the same job and at the same workplace, is checked separately. This possibility is not a general permission to move to a different employer.

Change of Employer, Workplace, Province and Duties

It is determined whether the change requires a new permit, the procedure for an initial application, or a notification. A group company, a branch, a workplace in the same line of business and a remote work arrangement are reviewed together with the information on the permit document.

Indefinite Work Permit

The condition of a long-term residence permit or at least eight years of lawful work permits is examined through interruptions, records and the calculation of the statutory period. It is explained that the application is subject to an assessment of suitability and that meeting the conditions does not create an absolute right.

Independent Work Permit

An activity that the foreign national will carry out on his or her own behalf and account is reviewed in terms of education, professional experience, investment, technology, the economy and the effect on employment. It is kept in mind that company formation, license and tax procedures are different from the right to work.

Turquoise Card Application

It is determined under which of the categories of qualified labor force, investor, scientist, researcher, artist or athlete the foreign national may be assessed. The initial three-year transition period, the monitoring obligations and the process of removing the transition record are planned.

Work Permit Exemption

The exemption category is reviewed for scientific, cultural, artistic, sports, technical, educational, internship, management or cross-border service activities, or another temporary activity listed in the Regulation. If the duration of the activity exceeds the limit of the exemption, the work permit route is used instead.

Exemption Application and Time Tracking

The route for an exemption application in Türkiye or from abroad, the start of the activity, the validity of the passport and the documents specific to the category are checked. An applicable calendar is given to the employer and the foreign national so that the activity and term stated on the document are not exceeded.

From September 17, 2026, new applications are made through calismaizni.csgb.gov.tr. Applications made before that date may continue to be followed in the old e-Muafiyet system; the date of application is matched with the portal used.

Effect of the Work Permit on the Right of Residence

Whether the type of permit takes the place of a residence permit, the end of the existing residence, address registration, family members and Presidency of Migration Management (Göç İdaresi) procedures are assessed together. The special distinction in permits issued to persons under protection statuses is taken into account.

Investors and foreign nationals with special statuses

9 areas of work

Permits for Foreign Company Shareholders, Managers and Executives

For a shareholder, manager, board member or senior executive of a limited liability or joint-stock company, actual work is distinguished from merely being an investor or holding a corporate office. Share capital, the shareholding ratio, the employment requirement and company records are reviewed against the current criteria.

Under the general company shareholder criterion, the company’s paid-in capital and the foreign national’s share of the capital must each be at least 500,000 TL, and the shareholding ratio must be at least 20%. The employment of five Turkish citizens is required from the seventh month of the first permit. The exception for a capital share of at least USD 100,000 is assessed separately.

Foreign Direct Investments and Key Personnel

The applicability of the provisions on foreign direct investment with special characteristics and on key personnel is researched. Investment thresholds, which may change every year, are verified from the official source; the company, the duties and the nature of the personnel are presented within the framework of the special regulation.

Intra-Company Transfer and Temporary Assignment

A transfer from a foreign group company to a company in Türkiye, a temporary project, a management assignment or a technical assignment is analyzed in terms of its work permit, exemption, tax, social security and contractual dimensions. The continuation of the relationship with the foreign employer does not, by itself, constitute an exemption.

Foreign Personnel in Free Zones

The competent authority and the application route are determined on the basis of the free zone operating license, the zone directorate, the Ministry of Trade procedure and the duties of the personnel. The general e-İzin process and procedures specific to the free zone are not confused with each other.

Work by International Students

The conditions for associate degree and undergraduate students to complete the first year and work part-time, the situation of graduate students, the province of study, scholarship and the nature of the job are reviewed. It is explained that a student residence permit does not by itself provide a right to work.

Foreign Nationals under Temporary Protection

The temporary protection identity document, the province of registration, the period required after the date the identity document was issued, the employment quota, pay, workplace and sector conditions are assessed. It is kept in mind that a work permit does not take the place of a residence permit under this status.

International Protection Applicants and Status Holders

The right to work under the statuses of refugee, conditional refugee, subsidiary protection and applicant is distinguished. Cases in which the identity document takes the place of a work permit and cases in which a permit can be requested six months after the application are filed separately.

Persons of Turkish Descent, Citizens of the Turkish Republic of Northern Cyprus (TRNC) and Foreign Nationals with Special Statuses

The effect on the criteria of special situations such as Law No. 2527, TRNC citizenship, humanitarian residence, statelessness, family ties to a Turkish citizen and long-term lawful residence is reviewed. Those entitled to receive a Blue Card under Article 28 of Law No. 5901 do not need to obtain a work permit from the Ministry, without prejudice to obligations concerning the practice of a profession and special laws.

Athletes, Artists, Scientists and Cross-Border Service Providers

The contract, duration, consideration, organizer and public authority connection of the activity are reviewed, and the work permit, exemption or Turquoise Card routes are separated. A short-term event or a visit visa is not automatically regarded as a right to work.

Employment of foreign personnel by sector and profession

7 areas of work

Engineers, Architects and Project Personnel

The diploma, equivalence, temporary membership in the professional body, project duration and the nature of the service are reviewed. If the time limit of the professional service exemption is exceeded, the necessary permit and membership steps are coordinated.

Foreign Personnel in the Information Technology Sector

Duties specially regulated by the Ministry, such as software development, databases, mobile software, system and network security and enterprise architecture, are assessed. The employer’s sector code, the job description and the limit on the number of persons under the criteria exception are verified.

Foreign Personnel in the Health Sector

The prior authorization of the Ministry of Health, the diploma and professional qualification, the registration of the private health institution and the sequence of the work permit are planned. Health professions reserved for Turkish citizens and the responsibilities of the institution are also checked separately.

Educational Institutions and Academic Personnel

For private educational institutions, international schools, higher education institutions and academic positions, the prior authorization of the Ministry of National Education (MEB) or the Council of Higher Education (YÖK) is reviewed. It is ensured that the course, duties, institution and contract information are consistent with one another.

Tourism, Accommodation and Entertainment Sector

The tourism operation certificate, travel agency, health tourism authorization, type of workplace, employment of Turkish citizens, physical capacity and the duties of the foreign national are assessed together. For duties subject to strict conditions, such as massage and spa services, the workplace document and scope are checked.

The conditional employment exception added on March 11, 2026 and other provisions that depend on the operation certificate, the profession and capacity are reviewed separately. It is not assumed that all tourism workplaces are completely exempt from the five Turkish citizens criterion.

Foreign Workers in Domestic Services

On the basis of child, elderly or disabled care and patient attendance, the conditions of the applicant and of the need for the service are reviewed. The employer’s registration as an individual, pay, home address and SGK obligations are planned before the application.

Agriculture, Livestock and Seasonal Work

The animal inventory, the registration of the holding, the duties, the number of foreign nationals and the requirement for the opinion of the Ministry of Agriculture and Forestry are reviewed. Seasonal agriculture and livestock exemptions for persons under temporary or international protection are handled under separate systems and provincial rules.

The criteria added on August 3, 2026 for poultry farming are distinguished from the provisions on livestock in general and seasonal work. The limit on the number of employees for the exception for applications in Türkiye at small workplaces is checked separately.

Employer compliance, inspection and disputes

7 areas of work

Employment Contract, Job Description and Pay Compliance

A Turkish or bilingual contract is prepared so that it correctly reflects the actual nature of the work and the position in the permit application. Pay, benefits, place of work, term, termination and the case in which the permit is not obtained are regulated from the standpoint of employment law.

SGK Notification, Premiums and Social Security Agreements

Entry into employment, earnings subject to premiums, the start of the permit and the employer’s records are handled consistently with one another. The effect of a social security agreement to which Türkiye is a party on temporary assignment or insured status is researched by country and document.

Notification Obligations of the Employer and the Foreign National

A fifteen-day calendar for notifications to the Ministry is prepared for the start or end of work or for circumstances that require cancellation of the permit. The holder of an indefinite or independent permit also has a notification obligation of his or her own, which is shown separately.

Inspection and Employment of Foreign Nationals without a Permit

In labor inspector and social security inspections, the consistency of the employment contract, permit card, duties, workplace, pay and SGK records is reviewed. An internal urgent notification flow is set up for the record of findings (tespit tutanağı) and the time to submit a defense.

Administrative Fines and the Employer’s Liability for Costs

The sanctions, which change with the annual revaluation, are reviewed for an employer who employs a foreign national without a permit, a foreign national who works without a permit in a dependent or independent capacity, and persons who fail to notify within the time limit. Special rules on recovering from the employer the accommodation, return and health expenses incurred in the deportation process are assessed separately.

The Regulation on the recovery of costs, published on July 23, 2025, entered into force on January 23, 2026. Written service of the expenses covered, the one-month period for payment and their pursuit as a public receivable are assessed separately from the fine.

Refusal, Cancellation, Termination, Objection and Administrative Lawsuit

The basis of the refusal or cancellation decision is reviewed in terms of missing records, criteria, profession, status, public order, allegations of forged or misleading documents, and permit endorsements. The thirty-day objection to the Ministry from service of the decision, the route to the administrative courts and the time limits are planned according to the chronology of the file.

Corporate Audit, Legal Review and Foreign Personnel Policy

During a company merger, an investment, a procurement of services or an internal audit, the permit, contract, SGK, pay and notification records of foreign personnel are reviewed. For employers with many foreign employees, a matrix of duties and terms is prepared from hiring to departure.

The employment provisions added on August 3, 2026 for the manufacturing and recycling sectors apply to workplace and branch records. The additional foreign employment exception provided for until December 31, 2027 is entered into the time calendar.

Key distinctions

The differences between a work permit, residence, exemption and SGK

One document does not satisfy all the other obligations
ConceptBasic functionDistinction to note
Work permitGives the foreign national the right to work within the limits of the term, employer, workplace, province and duties stated on the documentNot every permit allows a change of employer or duties at will
Work permit exemptionProvides exemption from the obligation to obtain a work permit for the specific activities and periods listed in the RegulationIf the scope or term of the exemption is exceeded, a work permit is required
Residence permitGoverns the right to stay in TürkiyeAs a rule, does not give the right to work; a separate assessment is required for a work permit
Work visa and entry procedureHandles the diplomatic mission and entry stages in an application from abroadThe work permit decision does not entirely remove the rules on passports, visas and entry
SGK registration and premiumFulfills the employee’s social security obligationsThe existence of a permit does not replace the SGK procedure, nor does the SGK registration replace the work permit

As a rule, fixed-term, indefinite and independent work permits also take the place of a residence permit. By contrast, work permits issued to persons under temporary protection, international protection applicants and conditional refugees do not take the place of a residence permit. The effect of the identity documents of refugees and holders of subsidiary protection status on the right to work is determined by special provisions. For this reason, a general statement such as “a work permit is a residence permit” is not correct for every status and document.

An exception to the criteria and a work permit exemption are different. The non-application of the employment or financial adequacy criterion does not by itself remove the obligation to apply or the other conditions. Establishing a company or becoming a shareholder also does not, by itself, provide a right to work.

Which type of permit or document can be considered?

Types of permit by the structure of the employment relationship
Permit or documentFor whom does it come into question?Term and tie to employer
Fixed-term work permitA foreign national who will work for a specific employer in a specific jobAt most one year on the initial application, not exceeding the employment or service contract; subject to the permit endorsements
Extended fixed-term permitA foreign national who will continue working for the same employerAt most two years on the first extension, at most three years on later extensions
Indefinite work permitA foreign national who holds a long-term residence permit or at least eight years of lawful work permits and whose application is found suitableNot tied to an employer; the permit card is renewed in five-year periods
Independent work permitA foreign national who will work on his or her own behalf and account in TürkiyeIssued for a fixed term; the nature of the activity and the investment is reviewed
Turquoise CardThe groups in the Law and the Regulation, such as qualified labor force, investors, scientists, researchers, artists or athletesThe first three years are a transition period; if the conditions are met, the transition record may be removed
Work permit exemptionA foreign national carrying out the temporary or special activities listed in the RegulationValid only within the specified limits of activity and term

Moving to a different employer, working at another workplace of the same employer, or a change of job title or profession is not in every case an ordinary “information update.” Depending on the endorsements on the existing permit and the nature of the change, the initial application procedure, a new permit or a notification may be required.

Application plan

In Türkiye, from abroad or special status: choose the right application route.

Direction of application by the foreign national’s status
Application routeBasic starting pointMain step
Application in TürkiyeA foreign national in Türkiye who, on the general route, holds a residence permit issued for at least six months and valid on the day of applicationThe employer or an authorized person applies through the e-İzin system
Application from abroadA foreign national who has no suitable basis for an application in TürkiyeThe foreign national applies to the Turkish diplomatic mission in the country of which he or she is a citizen or in which he or she is legally present; the employer carries out the electronic stage with the reference number
Extension applicationContinuation of a valid work permitThe electronic application is made from sixty days before the permit expires and before the term ends
Temporary protection applicationTemporary Protection Identity Document and related special conditionsThe province of registration, term, quota and sector regulations are examined separately
International protection applicationApplicant, conditional refugee or the related status documentThe type of status, the time elapsed since the date of application and the rules on the province of stay are assessed
Exemption applicationOne of the activity and term categories in the RegulationNew applications are made through calismaizni.csgb.gov.tr from September 17, 2026; earlier files are followed in the old e-Muafiyet system. Category and term conditions apply separately.

Having a residence permit for an application in Türkiye does not by itself create a right to a favorable decision. The reference number obtained in an application from abroad is also not a work permit. Work must not actually begin before the application is completed or the decision takes effect. Special statuses, persons outside the scope, and processes carried out through public institutions may depart from the general application route.

The six-month residence criterion: What is taken as the basis is that the permit was issued for at least six months and is valid on the date of application. This condition does not mean having waited six months in Türkiye or having six months remaining until the permit expires.

Exception based on history of lawful residence

August 3, 2026

Review the official source (opens in a new tab)

In certain applications in Türkiye by persons who have had at least one year of lawful residence in the last three years under a work permit, a residence permit or international protection, the employment and financial adequacy criteria are not applied for at most three foreign nationals at the same workplace. The number of foreign nationals cannot exceed the number of Turkish citizens; the conditions for the fourth and subsequent applications are examined separately.

Manufacturing, poultry farming and recycling

August 3, 2026 · special provision until December 31, 2027

Review the official source (opens in a new tab)

In these sectors, in addition to the foreign nationals who may be employed under the general employment criterion, a conditional exception is provided for one foreign national for every five Turkish citizens employed on a branch basis. For small workplaces with fewer than five Turkish employees, the exception in Türkiye for at most two foreign nationals is regulated only under the poultry farming and recycling headings; the number of foreign nationals cannot exceed the number of Turkish employees.

Conditional facilitations in tourism and livestock

March 11, 2026

Review the official source (opens in a new tab)

In tourism, for jobs of accommodation businesses other than those requiring expertise and mastery, the employment of one additional foreign national for every five Turkish citizens on a branch basis is provided; in livestock, there is an exception to the financial adequacy criterion for businesses that meet certain animal-count requirements. The workplace document, physical capacity, duties and other conditions are retained.

The requirement to practice the profession is examined first

In fields such as the practice of law, notaries, pharmacy, dentistry, veterinary medicine, private security and tourist guiding, the citizenship requirement and the provisions of special laws are checked. Profession-specific exceptions and reciprocity arrangements, including for financial advisers (mali müşavir), are examined separately. A work permit alone or a different job title does not provide the authority to practice a profession.

Review the Ministry’s list of professions (opens in a new tab)

Sequence of prior authorization and qualification

In education, prior authorization from MEB or YÖK may come into question; in health, from the Ministry of Health. In engineering and architecture, the conditions of diploma, equivalence, professional body and temporary membership apply according to the nature of the file. The employer’s document and the duties must be consistent with the application attachments.

Source review: October 4, 2026. The criteria are not regulations of the same kind as a statute; the Ministry’s criteria on the date of application, transitional provisions and special regimes are assessed together.

Rules on starting work, notification and social security (opens in a new tab)The Ministry’s explanations on applications and objections (opens in a new tab)

An application record is not, in fact, a work permit.

Obtaining a reference number or completing the form does not give authority to start work. A fixed-term permit is checked in terms of the employer, workplace and job. An objection also does not, by itself, create a general right to work or to stay.

This table is a general framework. In free zones, a special regime applies instead of Articles 21–23 of Law No. 6735; for protection statuses and other special situations, the relevant provisions apply. The form of service, the starting day and holidays are calculated separately in the specific file.

Recovery of costs, in force in 2026

The Regulation dated July 23, 2025 entered into force on January 23, 2026, after a six-month transition. Expenses met from the public budget for a foreign national placed in the deportation process because of work without a permit, and for family members within scope, that cannot be recovered from the foreign national may be claimed from the employer or its representative.

The type of expense, the service of the notice, the one-month payment period and pursuit under Law No. 6183 are examined separately. The limit of at most three months of administrative detention costs in the Regulation is not interpreted as a single ceiling for all expense items.

Working on a refusal and sanction file

The decision, the service document, the application attachments and the institution’s records are read together. The conditions and time limits of the options of a new application that cures the deficiency, an objection to the Ministry, or the administrative courts are determined.

An administrative fine, the refusal or cancellation of a work permit, a deportation decision and the recovery of expenses are not the same act. The competent authority, the route of application and the time limit of each are assessed separately; no commitment is made as to the outcome.

Administrative fines against foreign nationals and the distinction between service of documents and translation are explained in the guide Service of Documents, Translation and Power of Attorney for Foreign Nationals; the payment order and pursuit stage under Law No. 6183 are explained on our page Public Receivables, Payment Orders and E-Attachment.

Our legal approach

How do we handle a work permit file?

  1. We determine the status and the goal

Where the foreign national is located, under which status he or she is staying, what job he or she will do for which employer, and the planned start date are clarified.

  2. We choose the application route

We determine the suitable one among the routes of application in Türkiye, from abroad, extension, exemption, special status or Turquoise Card.

  3. We review the employer and duties criteria

Employment, financial adequacy, pay, sector, professional prohibition, prior authorization and passport validity are checked.

  4. We set up the application record

The contract, job description and necessary attachments are prepared; electronic authorization and system steps are completed.

  5. We follow the evaluation and additional information process

Dates are recorded for the Ministry’s requests, payment, the diplomatic mission and the card process.

  6. We manage post-permit compliance

Entry into Türkiye, starting work, SGK, pay, notification, extension of the term and changes are followed on a separate calendar.

Human resources, finance, payroll and management responsibilities are separated at the outset. The duties, pay and start date are planned together with the permit calendar. The scope, missing information, costs and the arrangements for informing the client are clarified in writing.

Eight steps from an application from abroad to starting work

  1. The duties, pay, workplace and target start date are determined between the foreign national and the employer.
  2. The foreign national applies for a work visa at the Turkish diplomatic mission in the country of which he or she is a citizen or in which he or she is legally present.
  3. The sixteen-digit reference number obtained from the diplomatic mission is passed to the employer.
  4. The employer or the person it has authorized completes the electronic application through the e-İzin system.
  5. The Ministry’s requests for additional information or documents are submitted within the time given in the system.
  6. After a favorable decision, the fee and the valuable paper fee are paid on the basis of the current notice.
  7. The foreign national completes the work visa and entry procedures and arrives in Türkiye within the term of the permit.
  8. Notifications of starting work, to SGK, of address and to the Ministry are made within the relevant statutory time limits.

Seven steps in an extension and a change of employer

  1. An internal reminder record is opened at least 90 days before the permit expires. This is the recommended preparation calendar; the statutory application window is 60 days.
  2. Before the sixty-day application window opens, the passport, contract, pay and SGK records are checked.
  3. An extension with the same employer and the initial application procedure for a different employer are distinguished from each other.
  4. The application is completed electronically before the permit term ends.
  5. If an extension application has been made within the time limit, the conditions for working for at most 90 days from the expiry of the permit during the evaluation, without a change of job and workplace, are checked.
  6. The employer, workplace, province, duties, start and end information on the new permit card is checked.
  7. The SGK and Ministry notifications are matched for the end of the old relationship and the start of the new one.

Work permit advisory based in Antalya and service throughout Türkiye

From Antalya, throughout Türkiye

Güneş & Güneş Law Firm, founded in Kemer on March 18, 1999 by Attorney Umut Güneş, has carried on its 27 years of professional activity from its physical headquarters in Antalya since 2007. Work permit and foreign personnel matters in all 81 provinces of Türkiye may be handled through remote work, on-site procedures and coordination with fellow attorneys, depending on the needs of the file.

Pre-application review, document preparation and post-permit compliance are planned together with the necessary institutional procedures and the pursuit of litigation. The organization of service throughout Türkiye does not mean that there is a physical branch in every province.

Multilingual and cross-border coordination

Communication can be conducted in Turkish, English, German and Russian. Application statements are kept consistent with the official Turkish record. The diplomatic mission, certification of documents, translation, the foreign employer and the connection to a social security agreement are handled together.

If local representation is needed in a foreign country, the work is done with an attorney or law firm authorized in that country. The selection of the legal professional, discussions on behalf of the client, the scope and contract of the work, planning, document flow, process follow-up, information, responsibility and the coordination fee are determined separately.

Terms of engagement

Scope of service and terms of engagement

Scope of the legal service

Eligibility review, the initial application, extension, ongoing employer compliance and pursuit of disputes are treated as separate engagements. The fee is determined by contract according to the number of employees, status, volume of documents, sector, time needed and any connection to a foreign country.

A consultation request does not mean that the file has been accepted, that a representation relationship has been established, or that a time-limited step has been undertaken. No commitment is given as to obtaining a permit, a decision on a particular date, or the outcome of a lawsuit.

Post-permit follow-up and other expenses

After a favorable decision, the duties, pay, SGK, notification, workplace and permit term are monitored. Payroll, accounting, translation and professional qualification matters are coordinated with the relevant authorized persons when necessary.

Whether the expenses for fees, card fees, visas, notaries, translation, litigation, travel and representation in a foreign country are included in the attorney’s fee is explained at the outset.

Clarity before applying

Questions about work permits and foreign personnel

Can a foreign national work in Türkiye without a work permit?

As a rule, no. Cases that fall outside the scope of the Law or in which a valid work permit exemption exists are separate. A tourist or business visit, a residence permit or being a company shareholder does not, by itself, give the right to work.

Review the related explanation

Does a work permit take the place of a residence permit?

As a rule, fixed-term, indefinite and independent work permits take the place of a residence permit. This rule does not apply to work permits issued to persons under temporary protection, international protection applicants and conditional refugees.

Review the related explanation

Can a foreign national who holds a residence permit work directly?

No. As a rule, a residence permit does not provide the right to work. A residence permit issued for at least six months and valid on the date of application may form the basis for a general application in Türkiye; for the right to work, a suitable permit or a special legal basis is also required.

Review the related explanation

What is the basic condition for a work permit application in Türkiye?

On the general route, the foreign national is required to be in Türkiye and to hold a residence permit issued for at least six months and valid on the day of application. It should not be read as a requirement of having waited six months or of having six months of validity remaining. Different provisions may apply depending on the type of residence and special status.

Review the related explanation

How is a work permit application made from abroad?

The foreign national applies for a work visa to the Turkish diplomatic mission in the country of which he or she is a citizen or in which he or she is legally present. The employer in Türkiye completes the electronic application stage with the reference number obtained.

Review the related explanation

Who makes the application, the foreign national or the employer?

For dependent work permits, the electronic application is, as a rule, carried out by the employer or a person it has authorized. On the route from abroad, there is also the foreign national’s application to the diplomatic mission. For independent permits, indefinite permits, the Turquoise Card and exemptions, the applicant may differ.

Review the related explanation

For how many years is the first work permit granted?

On the initial application, a fixed-term work permit may be issued for at most one year, not exceeding the term of the employment or service contract. The validity of the passport and the Ministry’s assessment may result in a shorter term.

Review the related explanation

When is a work permit extension application made?

The application is made from sixty days before the expiry of the current permit and before the permit term ends. An application made after the term has expired is subject to the procedures and principles of an initial application.

Review the related explanation

Can the existing permit be used when changing employers?

As a rule, no. A fixed-term permit is tied to a specific employer, workplace and job. An application to work for a different employer is evaluated under the initial application procedure; work must not actually begin before a new permit comes into being.

Review the related explanation

Is a new permit required when duties or workplace change within the same company?

It may be required, depending on the scope of the change. The employer, workplace, province, duties and endorsements on the permit card are reviewed, and it is determined whether the change calls for a new application, an update or a notification.

Review the related explanation

Is it mandatory to employ five Turkish citizens for every foreign national?

This ratio is the general employment criterion for workplaces subject to balance-sheet accounting. There may be current exceptions in terms of turnover, history of lawful residence, sector, job, the foreign national’s status and special investment provisions.

Review the related explanation

Is the employer’s financial adequacy criterion applied in every application?

In general applications, the thresholds for paid-in capital, net sales or exports are reviewed. Sector, status, history of lawful residence and special investment provisions may result in the criterion not being applied or being applied differently.

Review the related explanation

How is the pay to be given to a foreign employee determined?

The gross minimum wage on the date of application and the level of the duties are taken as the basis. Different multiples apply to senior management, pilots, engineers, architects, managers, jobs requiring advanced professional competence, and other jobs.

Review the related explanation

Does a foreign company shareholder need to obtain a work permit?

Merely being a shareholder is not the same as actually working. A work permit may be required where the person manages the company, carries out activity at the workplace or provides services; the type of company, corporate office, share of capital and employment conditions are reviewed.

Review the related explanation

Can foreign students work?

A work permit must be obtained. As a rule, associate degree and undergraduate students may work part-time after completing their first year of study. Different provisions apply to graduate students; the nature of the job and scholarship status are also reviewed.

Review the related explanation

Can a foreign national under temporary protection work?

Under the time, province of registration, quota, pay, workplace and sector conditions in the special regulation, a work permit or, for certain seasonal jobs, an exemption may come into question. The identity document does not by itself give the right to work in every job.

Review the related explanation

What is the difference between a work permit exemption and a work permit?

An exemption removes the obligation to obtain a work permit only within the limits of activity and term listed in the Regulation. If the term or the scope of the activity is exceeded, a work permit is required; an exemption document is not a general and indefinite right to work.

Review the related explanation

Does an exemption document take the place of a residence permit?

A valid work permit exemption may, as a rule, take the place of a residence permit. However, there is a special distinction for documents issued to persons under temporary protection, international protection applicants and conditional refugees.

Review the related explanation

Does a foreign national who has worked for eight years automatically receive an indefinite permit?

No. At least eight years of lawful work permits or a long-term residence permit provides the possibility to apply; it does not create an absolute right to a favorable decision. The application is assessed separately.

Review the related explanation

To whom can the Turquoise Card be issued?

Qualified labor force, highly qualified investors, scientists, researchers, artists or athletes active at the international level, and other groups listed in the Law may be considered. The first three years are a transition period.

Review the related explanation

Is SGK notification required after the work permit is issued?

Yes; exceptions under an applicable social security agreement are reserved. A work permit does not take the place of SGK registration. For the employment entry declaration, the special 30-day rule that runs from the start of the permit or, if different, from the date of notice to the employer, and other social security obligations are assessed together. Starting work and notification to the Ministry are separate time limits.

Review the related explanation

Within what time limit can a work permit refusal be objected to?

An objection to the Ministry may be filed within thirty days from the date of service against the Ministry’s decision of refusal, non-extension, cancellation or termination. If the objection is rejected, the route to the administrative courts is open; the time limit for filing the lawsuit is calculated separately.

Review the related explanation

In which cases can a work permit be canceled?

The disappearance of the conditions of the permit, forged or misleading information, work in breach of the scope of the permit, failure to arrive in Türkiye within the time limit in an application from abroad, and other grounds listed in the Law may lead to cancellation. Not every delay in notification produces the same result by itself; the basis of the violation and the reasoning of the decision are reviewed.

Review the related explanation

What are the consequences of employing a foreign national without a permit?

Administrative fines that are revalued every year may be imposed on the employer and the foreign national; the fine increases in the event of repetition. Immigration procedures against the foreign national and, with respect to the employer, return and the recovery of certain public expenses may also come into question.

Review the related explanation

Through which system is an exemption application now made?

New applications from September 17, 2026 onward are made through calismaizni.csgb.gov.tr. Applications made earlier may continue to be followed through emuafiyet.csgb.gov.tr. The activity and term conditions do not disappear with this change of system.

Review the related explanation

Can work continue while waiting for the result of the extension?

In an extension application made within the time limit, work may continue for at most 90 days from the end of the permit term while the evaluation is ongoing, provided the job performed and the workplace do not change. Rights and obligations during this period continue. Refusal, a change of employer and exceeding the period are assessed separately.

Review the related explanation

Is a work permit application concluded within 30 days for certain?

The legislation provides a 30-day evaluation period for properly submitted and complete applications. If additional information and documents are requested, the period starts when they are uploaded to the system; the opinions of institutions and the conditions of the file also affect the process. This rule is not a guarantee of a favorable decision or of the start of work on a particular date.

Review the related explanation

Is being an exception to the five Turkish citizens criterion an exemption from the work permit?

No. The non-application of one of the evaluation criteria does not by itself remove the obligation to apply for a permit. The documentation of the exception, the other conditions and the Ministry’s assessment continue. A work permit exemption rests on separate provisions on activity and term.
