Summary

How does a divorce abroad affect inheritance in Türkiye? Examine finality and the date of death, Article 27/A registration, recognition and the former spouse’s rights.

When the effect of a divorce judgment given abroad on inheritance in Türkiye is assessed, the date on which the judgment became final is first compared with the date of death. Then recognition of the judgment in Türkiye through the courts, or its administrative registration in the population registry if the statutory conditions are met, is examined. When Turkish inheritance law applies, divorced spouses are not each other’s statutory heirs. Still appearing as married in the population records does not, in every case, remove the effect of a foreign divorce that became final before death. [1, 2, 3]

In practice, the problem may arise when a person who divorced abroad years ago did not update their record in Türkiye. Upon death, the former spouse may be shown in the certificate of inheritance; the children or a later spouse may object to that entry. Sometimes the foreign judgment was given before death but became final only after death. It cannot be assumed that these two events will be resolved in the same way. Relying only on the judgment date at the top of the document may cause an error that directly affects the calculation of inheritance.

Which three dates should be established first?

The day the foreign judgment was given, the day it became final under foreign law and the spouse’s date of death should be shown separately in the file. MÖHUK Art. 59 provides that the res judicata or conclusive-evidence effect of a foreign judgment takes effect from the moment the foreign judgment becomes final. That an action for recognition is filed in Türkiye years later does not mean that the effect will always start from the date of that action. [2, 4]

For example, if the judgment became final in 2020, the spouse died in 2024 and recognition in Türkiye is requested in 2026, the examination is not made only according to the date 2026. By contrast, if the judgment was given in 2024, the death occurred later and finality emerged only after death, there is a different problem. The foreign procedural law of the specific case, the effect of death on the action and the provision whose recognition is sought must be assessed together.

When does Turkish inheritance law apply?

The recognition of a divorce and the question of which country’s law governs the inheritance are separate matters. MÖHUK Art. 20 subjects inheritance, as a rule, to the national law of the deceased; for immovable property located in Türkiye, it provides for Turkish law. It would therefore not be correct to calculate a foreign person’s worldwide estate solely on the basis of the spouse’s share under the Turkish Civil Code. The recognized family status is assessed within the inheritance law to be applied. [2]

If Turkish law applies, divorced spouses cannot be each other’s statutory heirs under TMK Art. 181. In addition, rights granted by dispositions mortis causa made before the divorce are lost, unless the disposition indicates otherwise. Therefore, not only the statutory spouse’s share but also the right left to the divorced spouse in an old will must be examined. On the other hand, a benefit expressly granted after the divorce is not disregarded merely because the person is a former spouse; the relevant disposition and the rules of inheritance are assessed. [1]

Is registration in the population registry possible without going to court?

Article 27/A of the Population Services Law No. 5490 provides a special registration route for divorce and the other marriage-related decisions listed in the article given by foreign judicial or administrative authorities. The decision must have been issued by the competent authority under the law of the country where it was given and have become final procedurally, must not be found manifestly contrary to Turkish public policy, and the conditions of application must be met. A separation document signed privately by the parties alone does not meet these conditions on its own. [3]

The application is, as a rule, made jointly by the parties, in person or through their representatives. The article also makes it possible, where one of the parties has died or is a foreigner, for the other party who is a Turkish citizen, or that party’s representative, to apply alone. This provision does not mean that every heir can register any kind of foreign judgment through the same unilateral administrative route. The applicant’s capacity, citizenship, the situation of the other party and the current application documents are checked together. [3]

This registration, carried out through the competent foreign mission abroad or the designated population directorate (nüfus müdürlüğü) in Türkiye, does not automatically make every monetary, property or custody provision in the foreign judgment enforceable. Entering the divorce in the population registry and collecting maintenance or transferring an asset are different requests. For these parts of the judgment, the relevant convention, recognition or enforcement route is assessed separately. [2, 3]

If the application is rejected on the ground that the registration conditions are not present, recognition under MÖHUK comes into play pursuant to Art. 27/A/3. The rejection of the application is not a final inheritance ruling that a foreign divorce cannot be taken into account in any way. The reason for rejection should be obtained, and it should be understood whether the deficiency relates to the document or to the route of application. [3]

Which conditions are examined in recognition through the courts?

Recognition concerns the acceptance of the foreign judgment in Türkiye as res judicata or conclusive evidence. Enforcement (tenfiz), on the other hand, matters for the compulsory execution of provisions that need to be enforced. Under MÖHUK Art. 58, the requirement of reciprocity is not sought for recognition. It is therefore not correct to regard every recognition request as futile from the start on the ground that there is no reciprocal practice with the country concerned. [2, 4]

The finality of the judgment, the absence of a manifest contradiction with Turkish public policy, the relevant jurisdictional limits and the conditions concerning the right of defense are examined. An action for recognition is not an ordinary divorce action that retries the events of the divorce from the beginning and re-determines which spouse is more at fault. However, objections such as not having been duly summoned or represented may affect the outcome within the framework of the statute. [2]

A request for recognition in family law is assessed in the family court; where there is no family court, in the civil court of first instance acting in that capacity. As to venue, the other party’s place of residence or habitual residence in Türkiye under MÖHUK Art. 51, the options of Ankara, Istanbul or Izmir if there is none, and the special provisions relating to the specific case are examined. The citizenship of the parties and the nature of the action do not change that subject-matter jurisdiction and venue are not the same question. [2, 4]

Can recognition be requested after the former spouse has died?

Death does not, by itself, remove all legal interest in recognition. Legal interest may continue because of inheritance, the clarification of the earlier marital bond and personal status records. The legal interest criterion in MÖHUK Art. 52 should not be narrowed by looking only at the original parties to the foreign divorce action. Heirs, too, can demonstrate the need for recognition by explaining their concrete rights and interests. [2, 5]

In the decision of the 2nd Civil Chamber of the Court of Cassation (Yargıtay 2. Hukuk Dairesi) dated 04.06.2015, E.2015/787, K.2015/11676, a case was assessed in which the divorce had become final abroad on 17.07.2001 and the former spouse had died on 18.12.2013. The rejection decision given on the ground of lack of legal interest was reversed. The importance of the decision is that a final foreign divorce may give rise to a legal interest in recognition even after the former spouse’s death; with this decision the Court of Cassation did not declare that all the conditions of recognition are automatically met. [5]

Determining the heirs of the deceased party and ensuring the proper composition of the parties (taraf teşkili) in the action are also important. The participation of one known child in the action does not always show that the procedural rights of all other interested persons have been ensured. Foreign inheritance records, population information in Türkiye and any different certificates of inheritance should be compared.

What happens if the divorce judgment became final after death?

In this scenario, the difference between the judgment date and the finality date becomes decisive. In the decision of the 2nd Civil Chamber of the Court of Cassation dated 12.05.2015, E.2015/1379, K.2015/9921, the foreign divorce judgment was given on 17.09.2007, the spouse died on 28.05.2008 and the judgment became final on 23.01.2009. The Court of Cassation reversed the decision, stating first of all that all heirs of the deceased had to take part in the action. [6]

The decision also stated, depending on the manner of acceptance, that because finality came after death, the marriage ended by death and the request for recognition of the divorce should be dealt with within that framework. This secondary assessment should be read together with the decision’s main ground concerning the composition of the parties. It should not be assumed that the status of spouse definitively ended at the moment of death merely because it is said that “there was a divorce judgment.” [6]

In Turkish law, in a divorce action pending at the time of death, the continuation of the action by one of the heirs under the conditions of TMK Art. 181/2 and proof of the other spouse’s fault may affect inheritance. This is a different examination from the recognition of a final foreign judgment. It also cannot be accepted that every action pending abroad will automatically continue in Türkiye under the same procedure; jurisdiction, venue and the applicable law are assessed separately. [1, 2]

Which documents should be prepared?

DocumentPurpose of useFrequently encountered deficiency
A duly issued copy of the foreign divorce judgmentTo show the scope of the rulingSubmitting only the first page of the judgment
Certificate of finalityTo determine when the ruling became finalConfusing the judgment date with the finality date
Translation and necessary certificationTo make the document usableThe finality section being left outside the translation
Death and family status recordsTo establish the date sequence and the circle of heirsOutdated or incomplete population information
Certificate of inheritance and records of transactionsTo identify erroneous shares and subsequent transactionsBelieving that recognition automatically corrects all earlier transactions

The apostille relates to the certification of a foreign official document where it can be applied; it should not be thought to replace finality and the conditions of recognition. An exemption from certification or a different route of approval may exist for the country and type of document concerned. The court decision, the certificate of finality and the translation must be checked as a whole. Differences in names, surnames or dates must be explained separately. [2]

If the addresses for service abroad and all heirs of the deceased party are identified at the outset, remedying procedural deficiencies becomes easier. If the action is to be continued through a representative, it must be verified that the power of attorney covers the specific act. If the interests of a minor heir and the person representing the minor conflict, the representation problem is resolved separately; a statement that there is agreement within the family is not sufficient in every case.

How is the certificate of inheritance handled after recognition or registration?

Obtaining a recognition judgment or completing the population registration is an important stage, but it does not automatically erase all transactions previously carried out in bank and land registry records. First the current personal status record and the basis for recognition or registration are obtained. Then the conformity of the certificate of inheritance with the present situation is examined. If there is a wrong certificate, cancellation or a new certificate is considered by the appropriate route; TMK Art. 598 makes it possible to assert the invalidity of a certificate of inheritance. [1]

If payments have been made to the former spouse, immovable property has been transferred or shares have been distributed, each transaction is handled separately. A restitution claim, the land registry, a third party’s good faith, time limits and the applicable law may lead to different results. The retroactive effect of a recognition judgment does not mean that all transactions will be eliminated against every third party in the same action. The file should not be closed merely by writing the new heirs’ proportions.

A divorced person’s loss of statutory spousal inheritance does not mean that all of their claims are also extinguished. Liquidation of the matrimonial property regime, an accrued maintenance claim, co-ownership or rights arising from a contract may exist separately. The conclusion “not an heir” should not be confused with the conclusion “can have no claim at all against the estate.” The time limits of these claims are also not automatically protected by waiting for the correction of the certificate of inheritance. [1]

Conclusion

In the effect of a foreign divorce on inheritance, the most critical distinction is between the giving of the judgment and its finality. If finality occurred before death, using recognition or the appropriate administrative registration route afterwards may remain important. Finality after death, a pending divorce action and the composition of the parties require different assessments. At the next stage, the certificate of inheritance and the asset transactions must be corrected separately.

Frequently Asked Questions

If I divorced abroad but still appear as married in the population records, am I definitely an heir?

No. The finality of the foreign judgment, its effect in Türkiye and the inheritance law to be applied must be examined. The population record alone does not conclude the whole legal assessment. [1, 2]

Can a divorce judgment be recognized after the former spouse has died?

A legal interest may exist. Especially for a foreign judgment that became final before death, death does not automatically make the recognition request meaningless. [5]

Can a former spouse who is a Turkish citizen apply alone to the population registry?

Law No. 5490, Art. 27/A, regulates this possibility where the other party has died or is a foreigner. The other conditions of the judgment and the application must also be met. [3]

Can heirs file an action for recognition?

It is possible for persons with a concrete legal interest. The capacity as heir, the expected legal result and the persons who must take part in the action should be determined. [2]

Can a divorce judgment from a country without reciprocity not be recognized?

The requirement of reciprocity is not sought for recognition. The other MÖHUK conditions continue to be examined. [2]

Is it enough that the divorce judgment was given before death?

It is not sufficient on its own. When finality occurred and the effect of death on the marriage or the action are examined separately. [6]

Does a recognition judgment change the old certificate of inheritance automatically?

The appropriate procedure for correcting or cancelling the certificate must be pursued separately. The results of transactions carried out at institutions such as banks and the land registry are also checked separately. [1]

If the former spouse is no longer an heir, do they also lose the claim under the matrimonial property regime?

This result is not automatic. Inheritance and the matrimonial property regime, co-ownership or other personal claims rest on different legal bases. [1]
