Summary

What is the finality requirement for interim, child and poverty maintenance? A guide that separates the divorce ruling, the appeal and enforcement, with Court of Cassation decisions.

Whether a maintenance order can be enforced before it becomes final depends on the case in which it was issued and on the type of maintenance. For interim maintenance, there is no need to wait for the divorce to become final. For poverty and child maintenance ordered as an annex to a divorce judgment, the finality of the divorce part matters. Where the divorce ruling has become final, the fact that the maintenance section has not separately become final does not, on its own, prevent collection. [1–4]

This distinction prevents a creditor from starting enforcement too early or on the wrong basis, and prevents a debtor from believing that an appeal removes the duty to pay. The review does not stop at the heading of the decision. The operative part, interlocutory decisions, the scope of the legal remedies and the finality record are read together. This article is not a guide to calculating monetary limits for appeal; it is a guide to determining whether a decision can be enforced.

Is finality the same as enforceability?

Finality is not required for every decision

Articles 350 and 367 of the Civil Procedure Law No. 6100 (HMK) provide that an appeal or cassation petition does not, as a rule, stay the enforcement of a decision. The same articles provide that decisions on personal status, family law and rights in rem over immovable property cannot be carried out before they become final. They also expressly provide that the enforcement of maintenance orders cannot be stayed. These provisions are applied together, taking into account the nature of the decision on which the maintenance rests. [1]

For this reason, neither the statement that a decision must be final because a family court issued it, nor the statement that finality is never required because the decision orders maintenance, is sufficient. It must be determined whether the maintenance depends on the outcome of the divorce and on the date on which the debt arises. If the decision provides for payment from the date of finality, that starting condition cannot be disregarded.

A decision may be final in part only

The divorce ruling and its financial consequences may be subject to separate legal remedies. The parties may not have challenged the divorce section and may have objected only to the amount of maintenance or compensation. In such a case, the fact that the whole file is still before the higher court does not show that the divorce section is not final. The scope of finality must be established from the court records, including service records and applications. [4]

Must one wait for the divorce judgment for interim maintenance?

The purpose of interim protection covers the duration of the proceedings

While a divorce or separation action is pending, temporary measures on the maintenance of spouses and children may be ordered under Article 169 of the Turkish Civil Code (TMK). The function of interim maintenance is to provide the necessary support while the proceedings continue. For this reason, waiting for the divorce to become final before collecting may defeat the purpose of the measure. However, the amount, start date, duration and any later modification decisions are checked against the file. [2]

A later change to an interlocutory decision, or a provision in the judgment that interim maintenance continues until a specific date, affects the enforcement calculation. A creditor cannot rely on an old interlocutory decision alone and disregard later changes. Nor can a debtor argue that, because no judgment has yet been given, maintenance that accrued in the past need not be paid.

An interlocutory decision and interim maintenance written into a judgment are assessed separately

That interim maintenance may be claimed before finality does not mean that every interlocutory decision is an enforceable judgment. For an interlocutory decision issued during the proceedings that is not in itself an enforceable judgment (ilam), enforcement without an enforceable judgment (ilamsız takip) is the relevant route. Where interim maintenance is expressly included in the final judgment, the nature of the document relied on as the enforcement basis is assessed separately. Choosing the enforcement route by looking only at the word “interim” is not correct. [3–4]

In its decision of February 19, 2019, E.2018/5511, K.2019/2433, the 12th Civil Chamber of the Court of Cassation (Yargıtay 12. Hukuk Dairesi) held that enforcement was based on interim maintenance stated in the judgment. The Chamber explained that finality of the judgment was not required to collect this maintenance, and it reversed the ruling that had annulled the enforcement. The decision should not be read as meaning that all interlocutory decisions can be enforced on the basis of a judgment. What matters is both that the document is a judgment and that the claim is for interim maintenance. [3]

When can poverty and child maintenance awarded with a divorce be claimed?

The finality of the divorce judgment is decisive

Finality of the divorce judgment is required for the enforcement of poverty and child maintenance ordered as an annex to the divorce. The start date stated in the judgment, and the arrangement under which interim maintenance passes into continuing maintenance, are read together with that date. The period before finality, during which interim maintenance applied, and the later period under continuing maintenance are calculated separately. [3–4]

Claiming as a current debt child maintenance that will start in the future, while the divorce judgment has not yet become final, may be incorrect. On the other hand, treating the period in which interim maintenance continued as entirely free of debt is also not correct. The judgment, higher court decisions and any interlocutory decisions should be assessed together.

An objection to the amount does not always create a waiting period for payment

In its decision of March 30, 2021, E.2020/8421, K.2021/3758, the 12th Civil Chamber of the Court of Cassation examined the enforcement of poverty maintenance in a file where the divorce section had become final. The reasoning of the regional court of appeal, which appears in the official record and was upheld, explains that once the divorce has become final, the financial annexes do not have to await separate finality. The enforcement based on an earlier interlocutory decision and the later enforcement based on a judgment were also treated separately. [4]

The case involves different dates and different claimed differences in maintenance. It cannot therefore be said that a creditor may open as many enforcement proceedings as they wish for the same debt. The overlap of periods, the scope of the earlier file and payment records must be checked separately to rule out duplicate collection.

How are later increase and termination actions distinguished?

A payment order issued in an independent maintenance or increase action is not of the same nature as the ruling that establishes divorce status. As a rule, an appeal alone does not stop collection. However, the date from which the increased amount applies, how earlier maintenance is to be deducted, and whether the decision is clear must be examined. [1]

The effect of a decision terminating or reducing maintenance on an existing enforcement is a separate question. The expression “enforcement before finality”, which is used for increase decisions, should not be applied to a termination decision without inquiry. It should not be assumed that a termination decision that is not yet final automatically closes the enforcement file, and payments should not be stopped on that basis. The type and scope of the decision, and its application to the concrete dispute, are assessed separately.

Does an appeal or cassation petition stop maintenance payments?

An appeal alone is not a stay

Appealing on the ground that the maintenance amount is too high does not automatically make an existing and enforceable maintenance order ineffective. Articles 350 and 367 of the Civil Procedure Law No. 6100 (HMK) contain an express limitation that enforcement of maintenance orders cannot be stayed. Writing “stop the payment” in the appeal petition does not show that such a result has arisen. [1]

Eligibility for appeal and the time limit are also examined separately. The general appeal period under Article 345 of HMK is two weeks from notification. Whether the decision is open to appeal, the monetary threshold and the transitional provisions are checked against the concrete file. The ten-day or fifteen-day correction-of-decision (karar düzeltme) notes printed at the end of older Court of Cassation decisions cannot be used as the current time limit. [1]

A complaint about a wrongful enforcement act is a different matter

Starting enforcement before a divorce judgment has become final, when finality was required; going beyond the scope of the judgment; or requesting the same month twice concern the supervision of enforcement acts. Asking the higher court, through this complaint, to change the amount of maintenance is a different route. The general time limit for an enforcement complaint and its exceptions are governed by Article 16 of the Enforcement and Bankruptcy Law No. 2004 (İcra ve İflas Kanunu, İİK). The effect of the complaint on the enforcement is assessed under Article 22 of the same law. [5]

The bar on staying enforcement of maintenance orders due to legal remedies does not mean that a plainly wrong enforcement act cannot be reviewed at all. However, filing a complaint does not by itself mean that collection has been stopped. The legal basis of the request and the protection sought must be stated clearly.

How should documents be checked before enforcement?

Check itemInformation requiredError it prevents
JudgmentType of maintenance, amount, start dateClaim for the wrong period
Interlocutory decisionsDates of changes and terminationCalculation on an outdated amount
Legal remediesWhich part of the judgment was challengedAssumption that the whole judgment is not final
FinalityPartial or full scopePremature enforcement

Preparation for the creditor

The creditor must state clearly, in the enforcement request, the type of maintenance and the period claimed. Where there is a transition between interim and child maintenance, the two periods should be shown separately. If an earlier enforcement exists, the months requested there, the amounts collected and whether the new request covers only the difference should be explained. Submitting only a total figure makes review more difficult.

Preparation for the debtor

The debtor should not be satisfied with stating “I appealed the decision.” The scope of the appeal, the status of the divorce section, the payment records and the months disputed should be made concrete. If the objection to the amount, the payment defense and the objection on finality are set out under separate headings, it becomes clearer which authority will examine what.

When applying to Güneş & Güneş Law Firm, submitting the reasoned decision together with the service records and legal remedy documents helps to correctly assess whether the decision can be enforced today.

Conclusion

Whether a maintenance order can be enforced before finality cannot be reduced to a single yes or no answer. First, the type of maintenance and the nature of the basis document must be determined; then, whether the divorce section has become final and the period claimed. An appeal or cassation petition does not, by itself, stop an enforceable maintenance debt. The correct enforcement route and period calculation prevent unnecessary cost and loss of rights for both creditor and debtor.

Frequently Asked Questions

Is finality of the divorce required for interim maintenance?

No. The enforcement route is determined according to the scope of the interim measure and the nature of the basis document.

Is every interim maintenance interlocutory decision enforced on the basis of a judgment?

No. The nature of the interlocutory decision as an enforceable judgment is assessed separately; enforcement without an enforceable judgment and enforcement on the basis of a judgment must be distinguished.

Can child maintenance be claimed before the divorce becomes final?

Child maintenance ordered as an annex to the divorce requires that the divorce judgment be final. The earlier interim period is assessed separately.

Does appealing only the amount of maintenance also make the divorce non-final?

Not always. The scope of the legal remedy and the court records are decisive.

If the divorce is final, must the maintenance section also be final?

For the enforcement of annexed maintenance, separate finality of the maintenance section is not required.

Does filing an appeal petition stop payment?

No. An appeal alone does not stop enforcement; there are special provisions for maintenance.

Can a stay of enforcement against security be requested for maintenance?

Articles 350 and 367 of HMK prohibit a stay of enforcement of maintenance orders. A complaint about a wrongful enforcement act is a separate matter.

Can a new file be opened for a new decision while an earlier enforcement exists?

The type and scope of the earlier enforcement and the new judgment are examined. The same claim cannot be collected twice.

Is the appeal period the same as the one stated in every older decision?

No. The current procedure and the transitional provisions apply. The general appeal period is two weeks from notification.

Is a finality annotation alone sufficient?

The operative section to which the annotation relates and the other file records must be read together.
