Enforcement of Administrative Court Decisions

Annulment and stay-of-execution decisions are binding on the administration. The administration is obliged to issue acts in accordance with the requirements of the court decision and to ensure that the decision is enforced. Failure to enforce the decision at all, delaying it, enforcing it only in form, or issuing a new act that produces the same result may give rise to new disputes.

At the stage of enforcing the decision:

  • Whether finality is a requirement
  • The date the decision was served on the administration
  • The scope of the reasons for annulment
  • The administration’s power to issue a new act
  • Reinstatement, permit, payment or record-correction acts
  • The effect of the decision on the past and on third parties
  • New annulment and full remedy claims arising from non-enforcement
  • Consequences that may arise for the public officials responsible

These points are examined.

Enforcement of a court decision does not consist merely of sending a copy of the decision to the institution. By following the reasons for the annulment decision and its legal consequences, the consistency of the new act the administration issues with the decision should be reviewed.

Appeal, Cassation, Constitutional Court and International Applications

The route of application against decisions of administrative and tax courts is determined according to the type of decision, the subject of the dispute, statutory limits and special provisions. Appeal before the regional administrative court and, for decisions meeting the conditions, the stages of cassation before the Council of State must be assessed together with the first-instance petitions and the procedural acts in the file.

In legal remedies:

  • The date of service of the decision and the time limit for application
  • Whether the decision is final
  • The scope of the appeal or cassation review
  • Incomplete examination, procedural violation and legal characterization
  • Requests for a stay of execution or concerning enforcement of the decision
  • The effect of not holding a hearing or an on-site examination
  • The process after a decision of reversal or setting aside
  • The conditions of the existing extraordinary routes in place of a request for correction of the decision

These points are examined.

An individual application to the Constitutional Court is not a new stage of appeal in an administrative case. It is based on the allegation that a fundamental right within the common protection field of the Constitution and the European Convention on Human Rights has been violated by public authority; the ordinary administrative and judicial routes must have been exhausted properly and in time. An application to the European Court of Human Rights is likewise handled by separately assessing domestic remedies and admissibility conditions.

Appeal and cassation

Law No. 7589 amended provisions connected with İYUK Art. 45 and Art. 46. Whether an appeal to the Court of Cassation lies should not be determined only by the old monetary threshold table; the type of dispute, the nature of the regional administrative court’s decision and the transitional provisions must be examined together. For the amendments to Art. 46, regional administrative court decisions issued after the entry into force are the basis.

Enforcement of the decision

Under İYUK Art. 28, the administration is obliged to carry out the requirements of a decision on the merits and on a stay of execution without delay; the general maximum period is 30 days from service of the decision on the administration. However, the finality exception introduced by Law No. 7588 for certain security personnel, dismissal from public service and reinstatement disputes connected with a security investigation must be checked separately. This exception cannot be generalized to all personnel cases.

Individual application and international protection

An application to the Constitutional Court or the European Court of Human Rights is not an automatic continuation of the ordinary legal remedy. The alleged violation, the effective remedies to be exhausted, the final decision and the special time limit for application are assessed. An application does not by itself stop enforcement of the decision.
