Summary

The five-day calculation in tax e-notification, SMS and e-mail problems, Communiqué No. 596, company accounts and what to watch for in the time limit to sue.

In a tax office’s electronic notification, the basic date is not the date on which the SMS arrived or the document was read. Under VUK Article 107/A, notification is deemed made at the end of the fifth day following the date on which the document reaches the addressee’s electronic address. The time limit to sue begins to run on the following day. Not opening the document does not hold the period in abeyance; on the other hand, the wrong addressee, the legal basis for being included in the system and the delivery records may be disputed separately where necessary.

What did the 2026 regulation change in e-notification?

The statutory framework of electronic tax notification is set out in VUK Article 107/A, as amended by Law No. 7587. The implementation rules were renewed by VUK General Communiqué Serial No. 596, published in Official Gazette (Resmî Gazete) No. 33397 of October 11, 2026. The Communiqué entered into force on the date of its publication; the earlier Communiqué Serial No. 456 was repealed. Explanations based only on the old Communiqué are therefore not sufficient for current events.

Under the transitional provision, those who joined the system before July 1, 2026 continue to use the system with their existing user codes and passwords, without a new application. The new regulation does not mean that all earlier notifications are invalid or that everyone must register again. In a past dispute, the legislation in force on the date of notification is determined separately.

Who is required to use electronic notification?

The current regulation covers corporate income taxpayers, income taxpayers taxed under the actual-profit method for commercial, agricultural and professional income, and general and ordinary limited partnerships. There are also relevant rules for persons and entities in whose name registration is made on the first acquisition of goods subject to recording and registration listed in List II attached to the Special Consumption Tax Law. Exceptions and registration times should be assessed under the relevant article of the Communiqué by determining the group to which the person belongs.

Voluntary participation outside the mandatory scope is also a separate legal basis. Merely having a record at the tax office is not the same fact as duly joining the electronic system. In an objection file, the notice of request, the registration date, the event that gave rise to the obligation and any exemption documents are compared. Ceasing activity does not in every case result in the electronic address being closed immediately; the exit conditions apply separately.

How is the five-day period calculated?

The day of arrival in the system is not counted. The five days following it are counted, and notification takes place at the end of the fifth day. This is not a “five business days” rule. The document’s appearing in the system, its being opened, its being downloaded and its being deemed notified by law may be separate timestamps.

A hypothetical example: if the document reaches the electronic address on October 1, 2026, the following days are October 2, 3, 4, 5 and 6. Notification takes place at the end of October 6; the time limit to sue begins on October 7. On the assumption that there is no special extension or other legal factor, the end of the 15-day payment order period is October 21, and the end of the 30-day notice of assessment period is November 5. Holidays in between are included in the calculation of the period; the rule on the last day falling on a holiday is applied separately.

RecordLegal functionDate not to be confused with it
Arrival at the electronic addressThe event that starts the five-day calculationThe date the document was issued
End of the fifth dayThe statutory time of notificationThe SMS or e-mail notice
The following dayThe first day of the time limit to sueThe day the document was first read
Last day of the time limit to sueDecisive for whether the application was made in timeThe date of any petition given to the administration

Does reading the document early or never opening it change the result?

The law’s special presumption of notification is the basis. Reading the electronic document before the five days have passed is not the same as the statutory date of notification coming into existence. On the other hand, never logging in or waiting for the accountant to see the document does not postpone notification to an indefinite future either. This distinction requires separating user behavior from the official system record.

Does not receiving an SMS or e-mail invalidate the notification?

The information service under Article 10 of Communiqué Serial No. 596 and the electronic notification act are different. The addressee may request that a warning be sent to the telephone number or e-mail address he or she has provided. The failure of such a warning to arrive does not, by itself, result in a conclusion that a document that duly reached the electronic address was not notified. A change of telephone number or an e-mail landing in the spam folder is also not the same problem as the official delivery record.

However, a real technical problem may lie behind the explanation that “the notice did not arrive.” An account opened for the wrong person, an inaccessible document, a corrupted file or an inconsistency in the system’s delivery record should be examined separately. The litigation strategy should not rest solely on the telephone warning; the facts of arrival at the official electronic address and access to the content should be made concrete.

Are the Revenue Administration’s e-notification and UETS the same system?

No. Electronic notification by the tax administration under the VUK and notifications made by judicial authorities or other institutions through UETS may have different legal and technical frameworks. Regularly checking one portal does not show that a notification in the other has also been seen. The institution that sent the document, the system used and the legal basis of the notification should be recorded together.

How should access and representation be managed in companies?

The company’s electronic address and the personal electronic address of a manager or partner are separate. An act made in the name of the company and an act relating to the representative’s personal liability for a public debt cannot be regarded as sent to the same account. The addressee’s name, the tax number, the type of act and the capacity of liability are checked together.

Leaving the password with the former person when an accountant or employee changes can create a serious problem in tracking time limits. Internal division of duties does not remove the company’s official duty to monitor notifications. The authorized access definitions should be reviewed; the person responsible for the daily check, the substitute during leave and the method of forwarding an incoming document to legal review should be determined. Passwords should not be put in articles or petition attachments.

With what evidence is an allegation of a technical problem supported?

All pages of the downloaded document, the document number, the electronic signature details and the arrival and reading records should be preserved. Error screens showing the date and time, the system support request number and the administration’s reply can show when the technical problem occurred. A screenshot does not replace the official delivery record on its own; it gains meaning together with the records.

The administration may be asked for the notification evidence record, the basis on which the electronic address was created and the delivery details of the relevant document. Seeing only the first page of the document may lead to missing the assessment or debt statement in the attachments. The originals of the files should be preserved; altered copies should not be submitted as evidence in place of the originals.

What steps should be taken before the time limit expires?

First, it is determined whether the document is a notice of assessment, a payment order, an attachment or another act. The general 30-day period for a notice of assessment and the special 15-day period for a payment order are tracked separately. A separate calendar is prepared for each document; documents arriving on the same day are not assumed to be a single act.

A technical support request or a petition requesting information does not automatically stop the time limit to sue. The effect of an application for removal or amendment, made in time and to the right authority under İYUK Article 11, is assessed separately. The existing period must not be left unused while waiting for the problem in the system to be resolved. If the dispute concerns a payment order or an attachment, the need for a stay of execution is examined separately so that collection is stopped.

Before requesting the annulment of the e-notification, it must be determined on what unlawfulness the main administrative act will be challenged. A notification defect may matter in showing that the lawsuit is within time or that the conditions for collection have not arisen. The substantive objections concerning the tax base, the penalty or the representative’s liability must also be built on their own documents.

Conclusion

Safe tracking of time limits in electronic tax notification starts from the official delivery record. The five-day notification calculation and the time limit to sue are two different stages that are added together. The SMS, the e-mail and the reading date should not be substituted for these records; real technical or addressee errors should be examined with their evidence. For current acts, Communiqué Serial No. 596 and the amended VUK Article 107/A should be the basis.

Frequently Asked Questions

If I do not open the e-notification, does the time limit not start?

It may start. The statutory notification rule in the section “How is the five-day period calculated?” does not depend on the person’s opening the document. Related explanation

Does not receiving an SMS extend the time limit to sue?

It does not extend it by itself. The distinction between the information service and official delivery in the section “Does not receiving an SMS or e-mail invalidate the notification?” must be made. Related explanation

Is re-registration required because of Communiqué No. 596?

Under the transitional provision stated in the section “What did the 2026 regulation change in e-notification?”, those who joined the system before July 1, 2026 continue with their existing user details. Related explanation

Is the accountant’s late forwarding of the document an excuse?

A delay in internal communication does not by itself change the date of notification. The arrangement of duties and access in the section “How should access and representation be managed in companies?” is therefore important. Related explanation
