Summary

Under what conditions can a change of custody be sought? New living arrangements, care, evidence, the court process and legal remedies, with Court of Cassation decisions.

A lawsuit to modify custody (velayetin değiştirilmesi davası) arises when the existing care arrangement has ceased to serve the child’s best interests, or when new circumstances make a different arrangement necessary. Remarrying, moving or earning a higher income does not, on its own, change custody. The court weighs together what has happened since the earlier decision, the child’s present needs and the proposed care plan.

This article focuses on modifying an existing custody decision in favor of the other parent. The custody arrangement in the original divorce judgment, the application of Article 337 of the Turkish Civil Code (TMK) to a child born outside marriage, and the removal of custody as a serious protective measure are different legal questions. Preparing only with the aim of “getting the child back” without determining which route is required may leave necessary evidence and requests incomplete.

Under what conditions can a custody decision be modified?

Article 183 of the Turkish Civil Code provides that the judge takes the necessary measures where new facts such as remarriage, relocation or death require it. TMK Article 349 explains that remarriage alone does not require the removal of custody. TMK Article 351/1 provides for adapting protective measures to changed circumstances. Read together, these provisions require attention to the real effect on the child rather than to the label of the event. [1]

The parent seeking a change must explain why the earlier decision no longer provides a suitable arrangement. For example, if school absences, interrupted treatment or care constantly left to other people are alleged, the dates, duration and consequences of the events must be shown. The other side’s explanation also matters: receiving family support because of a temporary illness is not the same as leaving the child wholly neglected.

The existence of an earlier decision does not entirely prevent a new examination; but the new case should not be run as a repetition of the earlier divorce file either. Newly arisen facts, or facts that explain the child’s present safety, must be separated from past disputes between the former spouses. If the need for protection continues, the court’s current assessment is what counts.

The difference between modification and removal

Modification concerns giving custody from one parent to the other. Removal depends on the more serious conditions of TMK Article 348 and may produce consequences that also affect other children. This distinction must be maintained in the petition and in the operative part of the judgment.

In its decision of February 24, 2016, E.2016/1902, K.2016/3287, the 2nd Civil Chamber of the Court of Cassation (Yargıtay 2. Hukuk Dairesi) examined school attendance, the handling of care and the obstruction of contact with the mother. The Chamber stated that the concrete evidence was sufficient for modifying custody, but that issuing a ruling of removal was not appropriate. The joint assessment of the siblings’ situation is also significant in the decision. This decision shows that not every lapse in care leads to removal under TMK Article 348. [3]

Which new living circumstances matter?

Remarriage and a new family setup

The remarriage of the custodial parent is not an automatic ground for loss of custody. The new spouse’s relationship with the child, safety and privacy at home, daily care and sibling relationships are investigated. Instead of moral judgments about the second marriage, observable changes in the child’s life should be explained.

The other side may show that the new marriage gives the child a more orderly life and support. In that case, presenting only the date of the marriage is not enough. The child’s account, an expert assessment and school records can show the concrete effect of the allegation. Whether the new spouse’s income is high or low does not, on its own, determine the result either.

Relocation, change of school and distance

A change of city may affect the child’s education, social circle and contact with the other parent. However, not every move made for work, health or family support amounts to abducting the child. The reason for the move, the conditions of the new home, the burden of travel and how the contact arrangement can be maintained should be examined.

In some files, rearranging the personal contact schedule may be enough instead of modifying custody. As distance increases, holiday periods, travel costs and remote communication may be addressed separately. In a move abroad, rules on international jurisdiction, habitual residence (mutat mesken) and the return of the child also exist, so the domestic-law explanations in this article are not sufficient on their own.

Neglect, violence and leaving care to others

Receiving help from relatives must be distinguished from abandoning parental responsibility. Support from a grandmother, or the use of a nursery or a babysitter, does not by itself require a change of custody. The parent’s interest in the child, following of decisions, the safety of care and the continuity of support are assessed.

Where violence or serious neglect is alleged, however, one cannot focus only on the future outcome of the case. An appropriate protection application should be made for the child’s immediate safety; incident records, relevant health documents and existing protective measures should be submitted to the court. An accusation of an offense and a final conviction are not the same thing; the family court examines the concrete risk within its own remit.

Obstruction of personal contact

The continuous obstruction of the child’s safe relationship with the other parent without a justified reason is significant. However, a single delay, illness or transport disruption cannot automatically be treated as a ground for changing custody. It must be shown on which date, in breach of which decision and why the contact did not take place.

The conduct of a parent who seeks protection because of a risk of violence should not be assessed merely under the label “obstructing contact” either. The consistency of existing protective orders with the personal contact provision is examined. Where the child does not want contact, the reason must be investigated; manipulation cannot be presumed.

Are better income or the child’s preference enough on their own?

In its decision of July 14, 2009, E.2009/8906, K.2009/14025, the 2nd Civil Chamber of the Court of Cassation found that the mother had not been proven to have neglected her duty of care, and that the children were happy with her and wanted to stay with her. The father’s better financial position was not considered sufficient for a change. The importance of the decision is that economic superiority does not replace an examination of actual care. [4]

This result does not mean that income is unimportant. Housing, nutrition and education opportunities are investigated; but an income gap can also be addressed through maintenance and social support. Disrupting the child’s healthy relationships merely because of a higher income is not in the child’s interest in every case.

The child’s views are given weight in proportion to age and maturity. It cannot be said that on reaching a fixed age the child gains a right of choice that binds the court. The reasons for the preference, the possibility of pressure and the safety of the chosen arrangement are examined. The child should not be made the person who bears the whole responsibility of choosing one of the parents.

How should evidence be prepared and the social investigation assessed?

A well-prepared file matches each allegation with its evidence. For school absence, not only messages between the parents but also attendance records and the school’s statement; for interrupted health follow-up, the relevant appointment and treatment documents may matter. Although the court may investigate ex officio on grounds of public policy, it is not pointless for the party to provide concrete information.

AllegationDocuments or investigation that can be preparedGeneralization to avoid
Daily care has changedSchool, school-bus, health and regular care recordsA single photograph proves continuous care
The child is being neglectedDated incidents, a witness with direct observation, expert examinationReceiving family support is neglect
Contact is being obstructedThe decision, handover records, dated correspondenceEvery delay changes custody
The new home is unsuitableCurrent living conditions and social investigationA small home is always unsuitable
The child wants to stay with the other parentExpert or court assessment in a suitable settingThe child’s preference is binding on its own

It should be checked on which date’s conditions the social investigation report describes. After a move, a change of school or treatment, an old report may not be sufficient. In objecting to the report, instead of merely saying “I do not accept the report,” one should point to an unvisited home, wrong working hours or a health need that was not assessed.

Evidence must be obtained lawfully. Unauthorized access to another person’s phone or account, circulating the child’s private images and coached statements are not safe ways of strengthening the file. Under HMK Article 189/2, unlawfully obtained evidence cannot be considered. It is possible to have the necessary records requested from the relevant institution through the court. [2]

In which court is the case filed and what is requested in the petition?

The competent court is the family court; where there is none, the civil court of first instance designated for the purpose acts as a family court. An independent custody modification is a non-contentious (çekişmesiz yargı) matter under HMK Article 382/2-b-13. The family court’s jurisdiction arises from a special statute; describing the matter as “non-contentious” does not automatically mean that the civil court of peace is competent. On territorial jurisdiction, HMK Article 384 and the features of the concrete application must be considered. [2, 6]

The petition should contain the court that issued the existing custody decision, its file and decision numbers, finality information, the identity of the children, the dates of the changed events and the proposed new arrangement. Alongside the custody request, the consequences for personal contact and maintenance should also be explained. If necessary for the child’s safety, an interim measure should be requested separately and with reasons.

Even if the child has actually begun living with the other parent, a private agreement does not take the place of a court decision. A notarial document does not by itself constitute a transfer of custody either. The court must examine the child’s best interests; the parents’ agreement is information that can be put before that examination.

Duration of the case and costs

There is no fixed waiting period that applies in every case before custody can be modified. If a new need for protection has arisen, the application should not be postponed. How many months it takes to reach a decision, on the other hand, depends on service of notices, the investigation and the gathering of evidence. Court fees, the advance on costs, expert and service costs, and attorney fees are separate items. If payment is difficult, the conditions for legal aid are assessed.

Appeal to the regional court of appeal and appeal to the Court of Cassation are not the same

In non-contentious decisions, the appeal (istinaf) and time-limit rules of HMK Article 387 must be taken into account. The date of learning and notification for the person concerned should be examined from the file; the time limit should not be calculated by looking only at the provisions for ordinary cases. The time limits should be checked on the file without delay. [2]

In its decision of December 16, 2024, E.2024/7850, K.2024/10025, the 2nd Civil Chamber of the Court of Cassation stated that a decision of the regional court of appeal (bölge adliye mahkemesi) on an independent custody modification cannot be appealed to the Court of Cassation under HMK Article 362/1-ç. This result should not be carried over without distinction to the initial custody arrangement within a divorce judgment or to every file containing different requests. The statements on rectification of decision (karar düzeltme) at the end of older decisions should not be used as the current route of application either. [5]

How does the new decision affect maintenance and the handover arrangement?

A change of custody does not mean that the existing maintenance decision automatically falls away for all past periods. Actual care, interim payments, the start of new maintenance and old installments must be assessed separately. On this subject, our article on custody change and maintenance gives a detailed complementary explanation.

The enforcement of the new judgment, its finality and any interim decision are examined together. In carrying out child handover and personal contact decisions, the current judicial support and victim services system should be used. A parent taking the child by force on his or her own is not an appropriate way of enforcement. [7]

Conclusion

What is decisive in modifying custody is not one adult’s superiority over the other but the child’s current care and developmental needs. The file should be prepared around the existing decision, the new events, their effect on the child and a workable new care plan. For situations that call for serious protective intervention, the articles on removal and restoration of custody, and for situations involving death or an obstacle to care, on arranging the child’s care in a parent’s absence, can be considered together.

Frequently Asked Questions

Does a mother or father who remarries lose custody?

Remarriage alone is not enough. The effect of the new family setup on the child’s safety, care and development is examined.

If the child has started living with me, is a separate decision needed?

Actual care is important evidence; it does not by itself change the existing custody judgment. An appropriate request must be put before the court.

Can custody granted in an uncontested divorce be changed?

Yes. The earlier agreement does not prevent an examination of new circumstances that affect the child’s interests.

Is not allowing the child to see the other parent always a ground for changing custody?

The continuity of the conduct, its justification, the safety conditions and the effect on the child are assessed. No automatic conclusion is drawn from a single incident.

Can I stop paying maintenance once I file a custody modification case?

Filing the case does not by itself lift the existing maintenance ruling. The relevant payment and start-date requests must be arranged separately.
