The core issue in an allegation that the title deed fee (tapu harcı) was underpaid is whether the actual transfer price of the property differs from the amount used as the basis for the fee at the land registry. A declaration made on the property tax value (emlak vergisi değeri) is not sufficient on its own if the actual sale price is higher. Conversely, a bank appraisal value or a market value determined later cannot in every case be treated as conclusive proof of the actual sale price either.
The additional fee, the tax loss penalty and the interest must be reviewed separately. In particular, after the amendment dated December 19, 2025, applying the 25 percent penalty figure found in older sources directly to current transactions is wrong. The date of the transaction and of the act, the provision on entry into force, and the principle that a heavier penalty is not applied retroactively must be examined together.
On which amount is the title deed fee calculated?
Under Article 63 of the Fees Law No. 492 (Harçlar Kanunu) and the relevant tariff, in an ordinary sale of immovable property the fee is calculated on the actual transfer and acquisition price, which may not be lower than the property tax value. The general rate is 20 per thousand (2 percent) separately for the buyer and for the seller. The total burden in an ordinary sale is therefore 4 percent. If there is a special exemption or a different type of transaction, a separate assessment is required.
The property tax value is the value obtained from the municipality and serves as a lower limit. It is not the same concept as the actual sale price. If it is known that the sale took place above this value, paying the fee only on the municipal value does not remove the problem of under-declaration.
Does an agreement between the buyer and the seller bind the administration?
A contract may state that the buyer will pay all land registry costs. However, the parties’ own allocation of the economic burden between themselves does not by itself change the fee liability determined by statute. The debt owed toward the administration must be distinguished from the contractual claims of the parties against each other.
In a sale subject to VAT, it should also be checked whether the rule that the price is taken exclusive of VAT has been applied for title deed fee purposes. Transferring the total amount on the invoice to the fee base without any distinction may lead to an incorrect calculation. If it is claimed that genuine services, goods or other payments are not included in the sale price, separate and reliable documents for them must exist.
With which documents is the actual sale price determined?
The sale contract, land registry transaction documents, bank transfers, the home loan file, payments made to the seller and the statements of the parties are assessed together. It is possible for the earnest money (kapora) and the remaining price to be paid on different dates. Where a transfer was made in a lump sum for several properties or for another debt, the part that belongs to the sale must be separated out.
If payment was made not to the seller but to a third party designated by the seller, the basis of that relationship must be explained. The wording in the bank description matters; however, if it is alleged that the description is untrue or incomplete, it is assessed together with the other records. Where cash payment is claimed, consistent documents are required on the source and delivery of the money.
Is the bank appraisal value the sale price?
An appraisal report reflects the lender’s assessment of collateral. It may provide important data on the characteristics of the property; however, the appraisal value and the sale price actually realized are not necessarily equal. The valuation date, the physical and legal condition of the property, the bargaining terms and the manner in which the loan was used must be examined.
The transfer of the loan amount directly to the seller may create a more concrete link to the actual payment. Even so, if it is claimed that part of the loan used was allocated for another purpose, this must be explained with the loan agreement and the money movements. Saying in the abstract that “the appraisal had been set high” may not be a sufficient defense.
How are the additional fee and the tax loss penalty reviewed?
If under-declaration is found, an additional fee may be assessed on the difference, either on a supplementary or an ex officio basis (ikmalen veya re’sen). A fee previously paid in due form must be taken into account. The difference in fee, the penalty and the interest are not the same item; the basis, period and calculation of each are checked separately. The notices to the buyer and to the seller are also separate acts.
What did the December 2025 amendment bring?
Article 6 of Law No. 7566 changed the figure of 25 percent in the special penalty provision of Article 63 of the Fees Law to one times the amount. The amendment entered into force on December 19, 2025. In cases where the new provision applies, the tax loss penalty for an underpaid fee is imposed at one times the fee difference.
The examination in 2026 of a transaction from an earlier date does not justify the automatic application of the new, heavier penalty. The date of the act and the penalty provision to be applied must be determined separately in the file. Where there is a later declaration or a different act, the whole penalty discussion cannot be settled by looking only at the date of the deed.
Hypothetical calculation example
Take an ordinary sale with no special exemption, to which the new provision applies, where the actual price is TL 5,000,000 and the declared price is TL 3,000,000. On the assumption that there is no separate issue regarding the property tax value, the difference is TL 2,000,000. At 20 per thousand for each party, the additional fee is TL 40,000. When a penalty of one times the amount is applied, a further TL 40,000 in penalty may arise for each party.
This example does not include interest, reductions, voluntary disclosure or other special conditions. It is not a calculation of an actual debt. Benefiting from a penalty reduction or another statutory facility depends on the required conditions and on the timing of the application. Instead of recalculating the fee and the penalty on the whole price, what matters is finding the correct difference.
How is a letter from the tax office answered?
First the legal nature of the letter is determined. A request for information, a request for an explanation, an invitation to explain under Article 370 of the Tax Procedure Law (VUK) and a tax or penalty notice (ihbarname) are not the same thing. The time limit for responding or applying for each document is assessed according to its own regulation. Both suing over an explanatory letter as if it were an assessment that has not yet arisen, and waiting on a notice (ihbarname) as if it were an ordinary letter, can lead to a loss of rights.
| Point in dispute | Record to be examined | Purpose of the explanation |
|---|---|---|
| Sale price | Contract and statement of total payments | To show the price actually agreed |
| Loan and appraisal | Loan allocation and valuation file | To separate collateral value from payment |
| Transfer that appears excessive | Documents on other debts or goods | To explain the amount outside the sale |
| Underpaid fee calculation | Initial accrual and payment receipt | To ensure the amount already paid is deducted |
In the response, the block/parcel (ada/parsel) or independent unit details of the property, the date of sale, the parties, the declared price and the actual payment plan are shown consistently. If damage, an impediment to use or another circumstance is put forward as justifying the low price, reliance must be placed on documents from the time of the sale. A later market fluctuation should not be carried back.
Can voluntary disclosure or correction be used at every stage?
Voluntary disclosure (pişmanlık) under Article 371 of the VUK depends on self-notification and on the other statutory conditions being met. The state of the examination, of any report or of the relevant findings may affect the possibility of applying. Just as it cannot be accepted that every tax office letter produces the same result, it also cannot be said that voluntary disclosure is necessarily open on the ground that “no penalty has come yet”.
If there is an erroneous calculation, a duplicate accrual or another situation that the law treats as a tax error, the correction route may be considered. A legal dispute over the evidence by which the actual price is to be established, however, is not always a simple tax error. It should not be assumed that a correction petition will restart the time limit for filing a lawsuit.
How is a lawsuit filed against an additional title deed fee and its penalty?
Unless there is a special provision, the general time limit for filing a lawsuit against a tax and penalty notice is 30 days from the day following notification. The competent branch of the judiciary is the tax courts. Jurisdiction is determined by the administration that made the assessment and the provisions of the Administrative Procedure Law (İYUK). The notices whose annulment is sought, the amounts and the period must be clearly stated in the petition.
In the defense, rather than merely saying “the price is correct”, it is useful to answer each finding of the administration with documents. The distinction between appraisal and actual payment, duplicate calculation, wrong rate, the entry-into-force problem, limitation and notification objections are addressed separately depending on the file. In assessing limitation, special circumstances affecting the period are also examined alongside the general period.
The effect of a tax lawsuit on collection is determined by the type of act under Article 27 of the İYUK. A lawsuit against the assessment and a lawsuit against a payment order issued later are not subject to the same procedure. In a payment order, the special 15-day period under Article 58 of Law No. 6183 and the limited grounds of objection are of separate importance; waiting for that stage to raise objections to the assessment is not appropriate.

Conclusion
In a title deed fee dispute, the actual sale price should be determined with concrete payment records; the property tax value, the appraisal value and the sale price should be kept apart. The calculation of the additional fee, the penalty and the interest should be reviewed separately, and in particular the temporal application of the December 2025 amendment should be checked. The explanation and the lawsuit process can be planned together by examining the notifications and the transaction documents.
Frequently Asked Questions
Is it enough to declare the municipal value?
As stated in the section “On which amount is the title deed fee calculated?”, the municipal value is a lower limit. If the actual sale price is higher, relying only on this value is not sufficient. Related explanation
If the appraisal value is high, does a penalty necessarily follow?
As in the section “With which documents is the actual sale price determined?”, the appraisal is assessed together with the other records. On its own it does not in every case mean the definitive sale price. Related explanation
Is the penalty for an underpaid title deed fee still 25 percent?
Under the December 2025 amendment in the section “How are the additional fee and the tax loss penalty reviewed?”, the new provision is a penalty of one times the amount. For earlier acts, the temporal application is examined separately. Related explanation
What is the time limit for a lawsuit against a notice (ihbarname)?
The general period explained in the section “How is a lawsuit filed against an additional title deed fee and its penalty?” is 30 days. A payment order, by contrast, is a different act and is subject to the special 15-day period. Related explanation
