Operational Compliance Is Not Done Only at Opening

Opening for the season, a change in capacity, a new ancillary business or a change of supplier can affect obligations. The consistency of the license and contract file with the actual activity should be checked regularly. Who will renew which document and who will follow up on official notifications is clearly determined.

Restaurants, food and beverage, entertainment and ancillary service businesses

  • Lease and operating agreements for restaurants, bars, cafes, nightlife venues, spas, sports, shops and other ancillary businesses
  • Legal follow-up of the business license, food, hygiene, tobacco, serving alcoholic beverages, music broadcasting, working hours and related permits
  • Disputes over menu and price information, scope of service, consumer complaints, allergens and food safety
  • Brand, quality, inspection, insurance and indemnification responsibilities between the main facility and an independent operator
  • Applications and lawsuits against administrative inspections, fines, suspension of the activity and cancellation of the license

Labor and social security law in the tourism sector

  • Preparing fixed-term, indefinite-term, seasonal, part-time and on-call employment contracts
  • Arrangements on overtime, weekly rest, national and public holidays, bonuses, tips, staff housing and fringe benefits
  • Subcontractors, service procurement, transfer of the workplace, collective labor relations and personnel transition processes
  • Disputes over occupational health and safety, work accidents, occupational diseases, mobbing, discipline and termination
  • Assessing the work permits of foreign employees and their social security obligations in Türkiye

Sustainable tourism, environment and climate compliance

  • The legal and contractual aspects of obligations under the Türkiye Environmental and Cultural Sustainability Program
  • Certification, audits, deficiencies, renewals and certificate disputes with authorized bodies
  • Legal support in environmental impact assessment, environmental permits, waste, water, energy, emissions, noise and coastal protection processes
  • Reviewing environmental statements, sustainability claims and marketing texts so that they are not misleading
  • Legal coordination while technical reports are prepared with environmental and other subject-matter experts; applications and lawsuits against administrative sanctions

Supply, procurement and operating agreements

  • Food, beverage, energy, cleaning, security, laundry, technology, reservation, maintenance and other supply contracts
  • Provisions on service level, quality, delivery, price adjustment, audit, data, confidentiality, insurance, indemnification and termination
  • Renovation, technical maintenance, energy performance, equipment rental and managed service contracts
  • Disputes over supply interruption, defective products or services, price differences, contractual penalty, security and receivables
  • Preparing business continuity, backup source and crisis provisions for critical suppliers

Seasonal Personnel and Foreign Employees

Seasonal work, by itself, does not justify concluding every contract for a fixed term. The nature of the work, interruptions, earlier seasons and the actual working pattern are examined. Timesheet, shift, overtime, tip, staff housing and fringe benefit records should be consistent with the payroll and the contract.

The work permit of foreign employees, or the exemption that may apply, is assessed on the basis of the duties and status. A tourist residence permit does not by itself confer authorization to work. Concluding a contract with a company that supplies personnel does not automatically remove occupational health and safety and employer obligations either.

Sustainability and the Limit of Technical Expertise

Under Circular 2026/2 dated 16.04.2026, Stage 2 Documents and Stage 3 Certificates are valid for three years from the date they are issued; the renewal process should be started before the term expires. For operating certificate applications and certificate change procedures of four- and five-star hotels, holiday villages, boutique hotels and special accommodation facilities, the Stage 3 requirement is taken into account; for other accommodation facilities, the Stage 2 requirement. The type of the existing certificate and the date of the transaction are checked separately. Legal services do not replace the audit of the certifying body, an engineering report or a technical conformity certificate.

Environmental statements must be verifiable. Marketing statements about water, waste, energy or carbon that have no basis can create consumer, advertising and contract risk. Technical findings are obtained from the relevant experts; legal obligations and contractual effects are assessed separately.

Business Continuity in Critical Supply

In food, energy, cleaning, security, software and maintenance services, the quality criterion, delivery, audit, data access and the remedy in case of interruption must be clear. Price adjustment and force majeure provisions are tied to concrete risks. A backup supplier, insurance and an indemnification arrangement are planned together to reduce the impact of an interruption of operations.

Our Approach to Your File

From the inventory of activities, personnel and supply, we build a workable checklist. We separate the tasks of technical and financial experts, and clarify with the business the contract amendments, the persons responsible for notifications and the renewal calendar.
