Article 376 of the Law No. 213 on Tax Procedure (Vergi Usul Kanunu, VUK) reduces certain tax penalties where a statutory application is made and payment is made. The general reduction rate is 50%. For procedural-irregularity and special procedural-irregularity penalties that do not exceed 40,000 Turkish lira (TL) in 2026, the increased application provided by the law brings the reduction to 75%. This high rate does not apply to every low-amount tax penalty; tax-loss penalties (vergi ziyaı cezası) and procedural-irregularity penalties must be kept apart. [1]

Reduction of tax penalties does not remove the tax principal. It reduces the penalty subject to fulfilment of the statutory application and payment conditions; it is assessed separately from the settlement and litigation routes.

Which Tax Penalties Fall Within the Reduction Under Article 376 of the VUK?

The reduction relates to the tax penalty; it does not reduce the tax principal at the same rate. The tax principal, late-payment add-ons (fer’i) and the penalty must be calculated separately. Tax-loss penalties (vergi ziyaı), procedural-irregularity penalties and special procedural-irregularity penalties must fall within the statutory scope. Reduction may also be assessed for properly imposed procedural-irregularity penalties that are not tied to a tax principal and were imposed on their own.

A special procedural-irregularity penalty arising from failure to fulfil the specific security obligations under Article 153/A of the VUK is outside the reduction scope. Therefore, the appearance of the phrase “special procedural irregularity” in the assessment notice alone is not sufficient; the act and the legal basis are checked.

The fact that a tax-loss penalty linked to a smuggling offence (kaçakçılık) is closed to settlement does not mean that the position is the same under Article 376. A reduction may be assessed separately where the conditions exist. However, a reduction of an administrative fine does not by itself end the criminal investigation or criminal case relating to Article 359 of the VUK.

When Does the Thirty-Day Application Period Start?

The taxpayer or tax liable person must apply to the relevant tax office within 30 days from notification of the tax and penalty assessment notice (ihbarname). For electronic notification, the date on which notification is deemed to have been made by law is the basis; opening the document later does not create a new period. Where several assessment notices are notified on different days, a single common final day should not be assumed.

The application may be made in writing; the relevant penalty reduction petition in the Digital Tax Office (Dijital Vergi Dairesi) may also be used. The petition must correctly state the penalty type, the period, the assessment notice number and the scope of the request. A receipt or electronic record of the application is kept. A telephone call with the administration, or verbal instructions given to a financial adviser (mali müşavir), is not the application itself.

How Is the Reduction Rate Determined by Penalty Type and Amount?

In general practice, half of the eligible penalty is reduced. For procedural-irregularity and special procedural-irregularity penalties that do not exceed 40,000 Turkish lira (TL) in 2026, the 50% reduction rate is increased by half; the result is a 75% reduction and 25% payment. The threshold is assessed per act. Splitting a penalty into different payment items does not produce a higher reduction.

Hypothetical penaltyReductionRemaining penalty
32,000 TL procedural-irregularity penalty, no special exclusion24,000 TL8,000 TL
80,000 TL procedural-irregularity penalty, no special exclusion40,000 TL40,000 TL
32,000 TL tax-loss penalty16,000 TL16,000 TL

The third example shows why the penalty type matters even when the amount is low. The amounts in the table are penalty calculations only; the tax principal and other claims, where present, are considered separately. For penalties relating to other years, the year-specific thresholds (hadler) that apply should be checked against the relevant transitional and implementing provision.

Within What Period Must the Tax and Penalty Be Paid After the Reduction Request?

The payment condition must be fulfilled together with the application. The tax or tax difference, and the penalty remaining after the reduction, are paid when due. Where a security of the type prescribed by law is provided, a payment option within three months from the end of the due date may be assessed. This period is not calculated as three months from the application date.

Not every security document is automatically accepted; the valid types of security under Law No. 6183 and the administration’s acceptance decision are examined. Telling the tax office “I will pay later” does not create the secured period. The application acceptance record, the assessment, the normal due date, the security and the last payment day must all be kept in the same file.

If the payment condition is breached, the reduction is lost and the reduced part of the penalty also becomes subject to collection. Providing security does not remove the debt. The consequences of delay are calculated separately, taking into account the type of debt and its normal due date.

How to Choose Between a Lawsuit and Penalty Reduction?

In the reduction route, it is important that the penalty is not made the subject of a lawsuit. If a case has already been filed, a reduction may be assessed where the action is withdrawn within the 30-day period and before the court has decided. Withdrawing from the action after that period has passed does not automatically produce the same result.

Having first requested a reduction also does not wholly exclude the possibility of withdrawing the request and filing a lawsuit before the ordinary litigation period expires. However, the reduction application should not be treated as a general petition that extends the period for filing a tax lawsuit. The interaction between the choices concerning the tax principal and the penalty is examined separately according to the content of the assessment notices.

This choice cannot be made on the amount payable alone. The factual basis of the penalty, the notification, whether the act actually occurred, calculation errors and the possible outcomes of judicial review should be assessed. Accepting the reduction should not lead to missing the option of suing against a penalty considered unlawful.

Is There a Further Reduction After Settlement?

Before a settlement record (uzlaşma tutanağı) is signed, a settlement request may be withdrawn and, where the conditions exist, the reduction route under Article 376 may be resumed. By contrast, once the record is signed and settlement is reached, the Article 376 reduction is not applied separately to the penalty agreed in the settlement. Additional-reduction descriptions after settlement found in older sources should not be carried directly into a current application.

The 40,000 TL limit for 2026 is significant in this choice in two respects: procedural-irregularity penalties that do not exceed the limit may fall outside the settlement scope while being eligible for the increased penalty reduction. Tax-loss penalties do not have the same increased rate. Where the same tax file contains different types of penalties, each item must be classified separately.

What Checks Should Be Made After Payment?

The payment receipt, the correct tax office, the assessment notice and the period should be matched. The fact that money has left the bank does not alone prove that the amount was recorded against the correct penalty debt. The full reduced amount should be confirmed as closed in time, and as not offset to a wrong period, through the debt statement.

The reduction application, the acceptance record, the payment document, any security and the withdrawal from the action are kept together. If a payment order is later received, documents proving that the payment condition was actually fulfilled are needed, not only the reduction petition. Period and debt matching are therefore the final stage of the reduction process.

Which Reduction Applies to a Procedural-Irregularity Penalty of Exactly 40,000 Turkish Lira?

For the increased reduction rule for 2026, the criterion is that the procedural-irregularity or special procedural-irregularity penalty does not exceed 40,000 Turkish lira (TL). Accordingly, a penalty exactly equal to 40,000 TL falls within this amount condition; if the scope and the other conditions are met, a 75% reduction applies. This threshold does not extend to all tax-loss penalties. [1]

The reduction rate must be separated from the amount to be paid: where a 75% reduction is applied, 25% of the penalty remains; the tax principal, if there is one, is assessed separately. Filing the application within the period is an independent check from fulfilment of the payment condition, so the process is not complete merely because a petition has been filed.

Decision to Make Before Acting and the File to Prepare

Determine the date of notification of the assessment notice and the penalty type. Track separately the timely filing of the reduction application, and the payment of the tax principal and the reduced penalty. If the secured payment option is chosen, record clearly the suitability of the security and the last payment day.
