An attachment may be placed on a house, land or vehicle for a tax debt; however, attaching every asset under every condition is not lawful. The pursuit being directed at the right person, the payment order stage, the provisions on assets exempt from attachment, and the proportionality between the debt and the attachment are examined together. Having a single residence, or using a vehicle for work, does not on its own provide absolute immunity from attachment.
Against an ordinary attachment applied to collect a tax receivable, where no special period is provided, a suit is generally filed in the tax court within 30 days. Different special periods apply to precautionary attachment (ihtiyati haciz) and to the payment order. The time limit should not be calculated before the nature of the entry in the land registry or vehicle record has been determined.
How does the tax office place an attachment on a house, land or vehicle?
Article 62 of Law No. 6183 regulates the attachment of the debtor’s property, receivables and rights to the extent sufficient to collect the public receivable. An attachment on real estate is notified to the land registry; for a vehicle, the relevant registry records and, where necessary, actual custody measures come into play. The entry of an attachment in the registry does not mean the asset is sold immediately. It can, however, affect the ability to dispose of the asset and to obtain financing.
In ordinary pursuit, the debt becoming payable, a proper payment order and the conditions of pursuit are investigated. Precautionary attachment, by contrast, is a different protective route. When requesting from the tax office the “attachment notice and the underlying payment order and service records,” it should also be asked whether a precautionary attachment order exists. A deficiency in the name of a document or a general expression used by the bank does not by itself convert the act into another legal type.
If the attachment has been applied to a house or vehicle registered in a person’s name for a company’s debt, the basis of personal liability is examined first. A limited company shareholder, a joint-stock company shareholder and a statutory representative are not subject to the same regime. A statement showing the company’s debt does not, on its own, constitute a sufficient explanation for proceeding against all of a natural person’s assets.
Can a single house be attached for tax debt?
What does protection of a residence appropriate to the debtor’s circumstances (hâline münasip ev) mean?
Article 70, paragraph 11 of Law No. 6183 protects a residence appropriate to the debtor’s circumstances. The protection is not determined only by how many residences are recorded in the land registry. The housing needs of the debtor and the family, living conditions, and the nature and value of the residence are assessed concretely. A person who argues that the attached residence should be protected must explain this need with documents.
Where the value exceeds the need for an appropriate residence, the law provides that an amount enough to obtain a suitable place for the debtor be left from the sale price. Both the value of the attached house and the amount needed for a suitable alternative residence therefore matter. Calling a house “luxury” is not a sufficient assessment on its own; likewise, a person saying “I have no other house” does not end the investigation.
Address records, family registry information, documents showing health or accessibility needs, land registry records and valuations may be submitted together. If necessary, an on-site examination and expert review are requested in the petition. Rather than stating the claim only as a conclusion, it should be shown which protection is sought on the basis of which fact.
Does a family residence annotation automatically prevent a tax attachment?
A family residence annotation and exemption from attachment for a public debt are different institutions. The existence of the annotation does not automatically invalidate all public attachments. For housing protection, the conditions under Article 70 of Law No. 6183 must be shown separately. The existence of a mortgage on the residence, earlier transactions and the scope of the protection invoked are also assessed according to the file.
Therefore, not only the “annotations” section of the land registry record but all of its sections on ownership, shares, mortgages and attachments should be examined. If there are records of more than one administration or private creditor, obtaining a lifting decision in one file does not automatically remove the other records.
Which distinctions matter in the attachment of building land and agricultural land?
An empty plot is not treated as equivalent to existing residence protection merely because a house is contemplated for the future. However, where the debtor is a farmer, the special protections in Article 70 of Law No. 6183 are investigated for the land and other assets necessary for the livelihood of the debtor and the family. The actual use and the livelihood relationship matter as much as the nature of the property in the land registry.
Farming records, crop sale documents, agricultural income, the size of the land and the way the family earns its living help in this review. It cannot be said that all agricultural land may be attached without limit, nor can it be assumed that every property recorded as “field” in the land registry is an indispensable means of livelihood.
In co-owned real estate, the debtor’s share and the shares of the other owners are separated. If an act on the public debtor’s share has been constructed in a way that exceeds the independent ownership of other persons, this is raised separately. Disputes about to whom ownership belongs (istihkak) may give rise to different routes and time limits under Articles 66–68 of Law No. 6183; the general explanation of annulment of an attachment does not replace this special procedure.
In what circumstances can an attachment on a vehicle be lifted?
A vehicle that makes daily life easier is different from a vocational vehicle that is indispensable for a livelihood. Article 70 of Law No. 6183 contains provisions on farming and on the means of livelihood of owners of certain small vehicles. For the protection to apply, the person’s activity, the vehicle’s necessity in that activity and whether alternatives exist are examined.
Not every vehicle in a company fleet is automatically outside the attachment on the ground that it is “used for work.” A vehicle for personal use and a vehicle indispensable for carrying on a profession should not be assessed in the same way. The registration, the document of activity, income records, contracts relating to transport work and the manner in which the vehicle is used have meaning together.
A registry attachment on a vehicle, seizure or actual custody measures, and the sale stage can have separate consequences. The petition should state which act it is directed at; when lifting of the attachment is granted, the correspondence required by the registry entry and by any custody measure should also be followed up.
How is it shown that an attachment exceeding the debt has been placed?
The attachment must be to an extent sufficient to collect the public receivable. However, comparing the advertised price of a property with the tax debt is not always sufficient. Earlier mortgages, other attachments, sale costs and the realistic sale value affect the amount that can be collected. Value and order of priority must therefore be shown together.
For example, where an attachment has been applied to a residence, a plot and a vehicle for the same debt, the current amount of the debt, the approximate net collectible value of each asset and the existing security can be gathered in a table. The claim that there is sufficient security should be linked to the specific attachment whose lifting is sought. The administration may argue that the sale of an asset is uncertain or insufficient because of earlier pledges; the application should address this possibility too.
| Area of review | Record needed | Contribution to the request |
|---|---|---|
| Current debt | Statement of collections and debt | Determines the remaining amount of pursuit |
| Value of the asset | Valuation and comparable documents | Shows the collection capacity |
| Earlier rights | Land registry and vehicle encumbrances | Affects the net value |
| Essential need | Family, health or occupation documents | Supports the claim of exemption from attachment |
| Multiple attachments | List of all files | Shows the extent of the total interference |
Time limit and stay of execution in an action to annul an attachment
Against an ordinary attachment act relating to a tax receivable, where there is no special period, the 30-day time limit for suing applies under Article 7 of the Administrative Procedure Law (İYUK). Proper notification and the question of when the person learned of it are important. For an attachment noticed during a land registry transaction, the date of learning should be recorded; the attachment document, its date and number should be obtained. Waiting indefinitely on the assumption that no official notification was made is risky.
An action to annul an attachment does not completely reopen an assessment or payment order action that was missed in the past. The attachment’s own unlawful aspects and the effect of the legal position of the underlying acts are separated. Claims such as the payment order never having been served, the wrong debtor being targeted or the debt having been paid are assessed with the relevant documents.
Filing a suit does not by itself stop the collection act. Under İYUK Article 27, manifest unlawfulness and damage that is difficult to compensate are shown together in a request for a stay of execution. An imminent sale, an essential housing need or the interruption of a professional activity is explained with concrete evidence. If a new act relating to the sale has been established, its route and time limit are examined separately; it is not assumed that the earlier suit automatically covers every new act.
What should be done if the attachment continues even though the debt has been paid?
It should be checked to which debt and period the payment was applied. The existence of another tax office file, an ancillary receivable or a pursuit expense may cause the visible record to continue. The existence of a payment receipt and the ending of the entire pursuit debt are not the same fact. An account reconciliation should be done first, and then the lifting of specific attachments should be requested in writing.
The application includes the block, parcel and independent unit details of the property or the vehicle’s plate number; the date and amount of the attachment and the underlying file. It is checked whether the lifting letter has been sent to the relevant registry and whether the record has actually been deleted. Entering an installment request or plan also does not automatically lift all attachments in every case; the scope of the decision must be read.
The requirements of an annulment or stay of execution decision given by the court must be fulfilled within the framework of İYUK Article 28. The notification of the decision to the administration, the acts carried out and the remaining records are documented. The subject of a new application for a record that has not been lifted is compared with the operative part of the earlier decision.
Conclusion
An effective review in the attachment of a house, land and vehicle concentrates on the basis of the pursuit, the legal nature of the asset, exemption from attachment and proportionality. Protection of a residence or vocational vehicle should be explained with concrete evidence, and the time limits of ordinary attachment and precautionary attachment must not be confused. After the debt has ended or after a court decision, the lifting entry in the registry should also be verified.

Frequently Asked Questions
Does having a single home definitely lift the attachment?
No. The appropriateness of the residence to the debtor’s circumstances and its value are examined; for a residence of excess value, the law has a provision that an amount for a suitable residence be left from the sale price. See the section “Can a single house be attached for tax debt?” Related explanation
Is the vehicle I commute to work in exempt from attachment?
Use for getting to work is not sufficient on its own. The conditions of the statutory protection for livelihood and vocational vehicles are investigated. The section “In what circumstances can an attachment on a vehicle be lifted?” explains this distinction. Related explanation
I learned of the attachment through e-Devlet; what should I do?
You need to keep the date of learning and the record, and to request the underlying acts. The time limit for suing is assessed according to the type of document and the state of service. The distinctions in the time limit section should be applied. Related explanation
Is the land registry record deleted immediately when I pay my tax debt?
It should be checked that the payment has been applied to the file and that the lifting letter has reached the registry. Other debts or attachments are assessed separately. See the section “What should be done if the attachment continues even though the debt has been paid?” Related explanation
