Summary

In light of the 2024 and 2026 decisions: ownership and proof of wedding gold, its return, claims for value, and jewelry invested in other property.

The general statement that all gold and jewelry given at a wedding belongs to the woman in every case is not consistent with current decisions. An agreement, proven local custom and usage, to whom the item was given and to whom it is specific are evaluated separately. The existence of the item and with whom it remained are as much a matter of proof as ownership.

What distinction do the current decisions make?

The approach set out in the decision of the 2nd Civil Chamber of the Court of Cassation (Yargıtay 2. Hukuk Dairesi) dated April 4, 2024, E. 2023/5704, K. 2024/2402, was also applied in the decision dated April 9, 2026, E. 2025/8772, K. 2026/3891. First, the agreement and any local custom alleged and proven are evaluated. If there are none, a distinction is made between to whom the item was pinned or given, items specific to the opposite sex and values placed in the joint chest. [4, 5]

What does a video prove and what does it not prove by itself?

A wedding video can show the kind and number of the jewelry and to whom it was given. But it does not always explain with whom it remained later or on what condition it was cashed in. Having an expert merely calculate the total value does not resolve the ownership dispute. Depending on the claim and the defense, what was given to the woman and to the man should be listed separately.

Which question is decisive for gold that has been spent?

At whose request, for what purpose and on condition of return were the gold items given? An intention to make a gift, payment of a debt, a joint investment and taking by force are different from one another. The defense that the gold was returned and the defense that the gold was never taken in the first place do not have the same evidentiary regime. The parties’ statements and admissions may change the direction of the file.

How should the request be framed?

The items should be described by type, number, karat, grams and, if possible, with a photograph or record. If return in kind is not possible, the order of the claim for value is explained. If the jewelry (ziynet) was invested in other property, a link is made with the contribution claim; the same value is not collected twice. The time limit and interest are also evaluated separately according to the legal nature of the claim.

Documents to preserve

The original video, dated photographs, jeweler or bank records, delivery and return correspondence and eyewitness information should be preserved. The absence of a piece of jewelry in the footage does not always lead to the conclusion that it definitely did not exist, without examining the other evidence at all.

How are personal belongings and household goods recovered?

If ownership belongs to the plaintiff, return in kind may be requested, or, if that is not possible, the value. The list of items should be made specific with brand, model, serial number, photographs, invoices and distinguishing features. Jointly used items in the family residence, the trousseau (çeyiz), gifts and items for personal use are not the same legal category.

Frequently asked questions

Can I request the return of my own belongings that remain with the other spouse in the liquidation case?

Where an item that belongs to you is with the other spouse, its return may be requested. The ownership of the item, whether it exists, with whom it remained and, if return in kind is not possible, the basis of the claim for value must be explained. This request is not always the same as the participation claim, which waits for the end of the regime. The list of items, photographs, invoices, messages and the delivery record may be useful in proof.

Is a request separate from the liquidation claim needed for wedding gold?

The return of jewelry (ziynet) is based on legal and factual circumstances separate from the participation claim. To whom the item belongs, its existence, with whom it remained and, if it was spent, on what condition it was given must be explained. If the jewelry was invested in other property, the relationship between the return and the contribution calculation must be established. Payment cannot be requested twice for the same economic value; the principal or alternative claims are set out clearly.

How is it proven to whom the gold pinned at the wedding belongs and with whom it remained?

If there is an agreement, it is evaluated first; otherwise, local custom and usage that is alleged and proven is important. If there are none, the distinction as a rule examined is to whom the item was pinned or given, items specific to the opposite sex and the joint jewelry chest. The 2026 Court of Cassation decision also did not adopt the approach that treats all the jewelry automatically as belonging to the woman. The video, photographs and the list of items must prove ownership and possession separately.

Which facts does a return claim depend on for jewelry spent or cashed in during the marriage?

The cashing in of the gold does not by itself show the existence or absence of a duty to return. By whom it was taken, for what purpose it was spent, the condition of return and the intention to make a gift are investigated. The proof of the fact of existence and of not remaining in hand, and the proof of the defense “I returned it,” are not placed on the same person or in the same way. Messages, money movements and the parties’ admissions may change the direction of the specific case.

Is it necessary to wait for the divorce to end for the return of jewelry or personal belongings?

For a claim for jewelry (ziynet) and personal belongings based on ownership or an independent duty of return, it is not in every case necessary to wait for the divorce to become final. The maturity of the claim and with whom the item is are examined. It should not be treated as the same as a share-in-increased-value claim in an ongoing matrimonial property regime. At the outset, it should be stated clearly whether return in kind, value or another outcome is requested.

Do return in kind and a claim for value affect the time limit in claims for jewelry and goods?

The return in kind of an existing item based on ownership and a monetary claim for value where the item no longer exists are evaluated differently. The rules on an ownership claim and the statute of limitations of a debt receivable are not the same. For a monetary claim, the general period, maturity and the provision on suspension between spouses during the marriage are examined. The request should not be left as just “my gold”; the type of item, the quantity and the order of the claims should be stated.

Which date is used when interest is requested on the value of goods or jewelry?

For a claim for value, the dates of default, of the lawsuit and, if any, of an increase of the claim are examined; the content of the judgment framed where return in kind is not possible is also important. In every jewelry case, interest does not run automatically from the wedding or divorce date. A formal notice (ihtar) made earlier and the interest requested should be shown clearly. A double result should not be produced in the calculation of the current value, the option of return in kind and interest.

This article is for general legal information. In a specific dispute, the dates of the events, the documents, the type of claim and the time limits are evaluated together.
