Summary

Refusal to issue a zoning status certificate, an incorrect floor area ratio or storey count, implied refusal and an action against the zoning plan. Application deadlines and verified Council of State decisions.

A zoning status certificate (imar durum belgesi) shows which use and building conditions apply to a parcel under the zoning plan in force and its plan notes. Refusal to issue the certificate, an incorrect floor area ratio or storey count, or its later withdrawal may give rise to administrative applications and lawsuits. However, a zoning status certificate is not a construction permit: construction cannot begin on the basis of this certificate alone. Resolving a dispute depends on whether the error stems from how the certificate was issued or from the underlying plan decision.

Anyone buying a property or commissioning a project should not rely only on the listing text and the municipality's map screen. The current zoning status certificate, the approved plan sheet, the plan notes and any special restrictions should be reviewed together. This review directly affects the size of the investment, whether a building permit can be obtained and the possible litigation route.

What does a zoning status certificate show?

Land-use decision and building conditions

The certificate may state the land-use decision for the parcel (housing, commercial, tourism, industrial or public service) together with the building order, number of storeys or height, setback distances and density conditions. A condition that does not appear in the certificate may be set out in a plan note or in special legislation. For that reason, a one-page certificate should not be treated as a summary of the entire legal regime.

If part of the parcel falls within a road, park or other public service area, this limits the project that can be prepared. Incomplete parcel subdivision, or a difference between the cadastral boundary and the plan boundary, is also examined separately. A land registry entry stating the surface area does not show that construction is permitted over the whole of that area.

The difference between the e-zoning screen and the official document

Municipal e-zoning screens (e-imar) are useful for preliminary review. However, the date of the screen's data, its informational-use warning and whether the document can be verified all matter. No screenshot replaces an official parcel-based zoning status certificate issued by the competent authority.

When a dispute arises, a written application with a registration number, the authority's dated reply and approved annexes provide a firmer legal basis. A screenshot may be kept as supporting record, but preserving an old screen does not ensure that the conditions of that date continue indefinitely.

How is a zoning status certificate requested?

Content of the application

Article 55 of the Planned Areas Zoning Regulation (Planlı Alanlar İmar Yönetmeliği) governs the application for parcel documents required for new construction, additions and major alterations. The building owner or authorized representative applies to the competent authority. The application sketch (aplikasyon krokisi) and a copy of the title deed record, or equivalent documents accepted under the legislation, are important. Electronic access and the authority's current service procedures should also be checked.

The application should not simply state "I want to learn my zoning status." The province, district, neighbourhood, block and parcel details should be stated clearly. The request can be framed to obtain an official zoning status certificate together with the plan sheet and plan notes. In transactions made through a proxy, the scope of the representative's authority must also be documented.

Two business days and the lawsuit period are not the same

Under Article 55(4) of the Regulation, the geological and geotechnical survey sample, the road level or level-section document specified together with the zoning status certificate and, where necessary, the alignment survey must be issued within at most two business days. The canal level record must be issued within at most five business days. This provision applies to applications and documents falling within its scope.

Expiry of this service period does not by itself create a permission to build. Moreover, the calculation of implied refusal and the period for bringing an action in administrative litigation is subject to separate rules. The two business days set for the document should not be read as the period for filing a lawsuit.

How are floor area ratio, building coverage, storey count and setback read?

Several limits apply together on the same parcel

The floor area ratio (emsal) or floor area coefficient (KAKS) relates the floor areas counted under the legislation to the relevant parcel area. The building coverage ratio (TAKS) sets the limit on the footprint. Storey count, building height, front and side setback distances, parking and other technical conditions also apply. It cannot be assumed that the entire floor area ratio can be used in every architectural layout.

For example, purely to illustrate the method, on a parcel with a base area of 1,000 square metres and a floor area ratio of 1.00, the nominal floor area under the ratio is 1,000 square metres. This result is not the net residential area that can be offered for sale. The definition of floor area counted toward the ratio, exceptions, common areas and the geometry of the parcel are also assessed separately. This example does not replace a building permit calculation for a specific parcel.

An incorrect certificate and an unfavourable plan are distinguished

If the plan floor area ratio is 1.00 but the certificate states 0.80, the certificate's conformity with the plan is in question. If the plan itself sets 0.80 and the owner claims that this decision is unlawful, the dispute also concerns the underlying plan. Asking the municipality to correct the certificate is not the same as asking for the plan to be amended.

The fact that a neighbouring parcel has more storeys does not by itself prove inequality. The neighbouring building's permit date, a different plan zone, road width, protection conditions and acquired-rights status may all differ. Comparison should be made between parcels under the same legal and technical conditions.

What to do if the certificate is not issued or the application is left unanswered?

Express refusal

If the authority does not issue the certificate, the stated reasons and legal basis should be requested. Whether reasons such as inconsistency between plans, ongoing parcel subdivision, a protective decision or missing documents are genuine and relevant is examined. Not every refusal reason produces the same type of act or the same scope of litigation.

Where no special period applies, the general period for bringing an action in the administrative court against an express refusal is 60 days from the day after written notification. The act to be annulled should be clearly identified. A dispute described only through oral discussions should not be relied on alone.

Implied refusal under Article 10 of the Administrative Procedure Law

If a request for an act that may be subject to administrative action receives no reply within thirty days, the request is deemed refused. The person concerned may use the route of application within the period for bringing an action running from that date. If the administration's reply given within the first thirty days is not final, a final reply may be awaited under the conditions set by law. This waiting period may not exceed four months from the date of application.

The effect of later replies on the period for bringing an action is also examined under the special provision of Article 10. This regime differs from an application under Article 11 to annul an act previously notified. Repeatedly asking, with the same content, about a refusal that has already become final does not always create a new period for bringing an action.

Can an action be brought against the zoning plan on the basis of a zoning status certificate?

Link to the implementing act

Article 7(4) of the Administrative Procedure Law provides for actions against a regulatory act, against the implementing act that applies it, or against both, once the regulatory act has been applied. Depending on its content, a zoning status certificate may amount to an implementing act. In such a case, review of the underlying plan decision may come into question. The route for challenging a plan amendment is described in the article Objection to and Annulment of a Zoning Plan Amendment.

However, not every information letter or document request is an implementing act. What matters is whether the certificate was actually issued, its content, whether it was later withdrawn and the subject of the action. The five-year upper limit that Article 8 of Zoning Law No. 3194 (İmar Kanunu) provides for finalised zoning and parcel subdivision plans should also be assessed together with the dates in the file for actions brought against implementing acts. This period is not a free waiting period that removes the general 60-day period.

Council of State Plenary decision of June 9, 2021

Council of State, Plenary Assembly of Administrative Litigation Chambers (İDDK), June 9, 2021, E.2021/258, K.2021/1204: In that file, a zoning status certificate was withdrawn. An action was later brought against the master zoning plan (nazım imar planı) after a subsequent information reply. The Plenary majority accepted that, on the date of the action, there was no existing implementing act that would permit an action against the underlying plans. On that basis, it quashed the decision insisting on the time-bar ground (ısrar kararı).

The decision explains the relationship between the plans, but its concrete result is not favourable to the claimant. The different views of the judge rapporteur (tetkik hâkimi) and of the dissenting opinion (karşı oy) cannot be used in place of the majority ruling. In addition, the periods for implied refusal mentioned in the older legislation quoted in the decision must not be confused with the current 30-day regime. Why should earlier decisions on the right to build be requested?

A zoning status certificate may reflect an earlier act

The current building conditions of a parcel may not stem solely from the figure on the plan sheet. A transfer recognised for conservation reasons, enforcement of a court judgment, parcel subdivision or a special council decision may be in the file. When the value stated in the certificate is questioned, the legal basis and validity of these acts are also examined. For review of a parcel subdivision act, see Objection to and Annulment of a Parcel Subdivision Act.

Council of State 6th Chamber (Danıştay 6. Dairesi), September 18, 2024, E.2022/5321, K.2024/4776 concerns the withdrawal of an earlier municipal decision on the transfer of a right to build arising from conservation status. After assessing the transfer attached to the property and the alleged manifest error, the Chamber upheld the decision to annul it. The decision does not state that every zoning status certificate creates an acquired right. It shows that the nature of the earlier act must be investigated. Stay of execution and expert review

In an action concerning the refusal to issue a certificate or the erroneous application of building conditions, a stay of execution may be requested if the conditions in Article 27 of the Administrative Procedure Law are met. Clear unlawfulness and harm that is difficult or impossible to remedy must both be explained. Stating only that an investment is intended is not sufficient in every file.

A stay of execution of a refusal does not mean that the court directly approves an architectural project or issues a construction permit. The administration must act in line with the reasoning of the court's decision. Other plan, parcel subdivision and special permit conditions may remain in force.

On technical review, the expertise of an urban planner, a surveyor or an architect may be required. The position of the plan boundaries on the parcel, the area used for the ratio calculation, road frontage and the application of plan notes should be made concrete. Rather than asking the court-appointed expert (bilirkişi) only for a legal conclusion, it is useful to set out the technical dispute through clear questions.

Which documents should be reviewed before purchase and before a project?

The current title deed record, zoning status certificate, implementing and master zoning plans, plan notes, cadastral sheet and any parcel subdivision records should be requested together. Special restrictions arising from conservation, coastal, forest, agricultural and disaster legislation are also investigated separately. The same property may be subject to more than one regime. For disputes at the building permit stage, the article Annulment of a Construction Permit may also be reviewed.

The old document submitted by the seller should be compared with the municipality's current reply. If there is a difference, a project or price calculation should not rest solely on the old certificate without first determining the act on which the change is based. Building commitments promised in the sale contract also matter for private-law liability. They do not remove the administration's planning powers.

Where compensation is claimed for expenses incurred in reliance on a certificate, the actual loss, the administration's conduct and causation are examined. Not every error in a certificate entitles the holder to recover all expected investment profit. The period and procedure for this claim are assessed separately from the request to correct or annul the certificate.

Conclusion

In zoning status certificate disputes, effective review rests on reading the certificate together with the plan, the plan notes and the technical data of the parcel. Refusal to issue a certificate, a calculation error and an unlawful underlying plan may call for different remedies. A file built on official and dated documents secures both the determination of the time limit for the action and the proper review of building conditions.

Frequently Asked Questions

Can construction begin once a zoning status certificate is obtained?

No. The certificate shows the building conditions. The project, permit and construction permit process required for a building subject to permit must also be completed separately.

Is the floor area ratio shown on an e-zoning screen a firm right?

The nature and currency of the screen must be checked. An informational screen alone does not create a permit or an unchangeable building right.

If the municipality does not issue the certificate within two business days, is the permit deemed granted?

No. The period for issuing the certificate and the regime of implied refusal and implied permit are different. An unanswered application is examined under Article 10 of the Administrative Procedure Law.

Can an action always be brought against the old plan by obtaining a new certificate?

There is no such unlimited possibility. The existence of an implementing act, its content, the period for bringing an action and the special upper limit for plans are assessed together.

If the neighbouring parcel has more storeys, is my certificate wrong?

That conclusion does not follow by itself. The plan zone, permit date, road, protection conditions and other legal differences must be investigated.
