Annual income tax on freelance professional income is calculated by deducting legally deductible expenses from the income collected in return for professional activity. However, the collection basis does not tie all consequences of value added tax or the document system to the same date. In particular for advance fees, attorney’s fees payable by the opposing party and collections subject to withholding, the contract, the receipt and the bank record must be reviewed together.
Legal Nature of the Practice and How It Differs from Other Obligations
The collection basis for freelance professional income does not carry the same meaning as the taxable event in VAT. A professional fee, money held in trust for a client and a documented expense advance are not the same income item.
Separating Independent Professional Activity from Wages
Freelance professional activity rests more on personal work, professional knowledge and expertise than on capital. It is carried out in the person’s own name and for their own account, without being subordinate to an employer. The same professional may also carry out independent activity while receiving wages from an employer. Sharing the same diploma or professional title does not require all income to be placed in a single category.
Writing “consultancy” in the contract alone does not produce a freelance outcome. Actual dependence, working arrangements, instructions and the way the service is organised are examined. How an activity carried out within a company is taxed is determined separately, depending on the type of company. [1; Income Tax Law (GVK) Articles 65–68]
Payments, Advances and Amounts Credited to an Account That Count as Collections
Whether a professional fee has been collected depends not only on its being paid into a bank account, but also on its being placed at the taxpayer’s disposal or set off against a debt owed to them. An unpaid professional fee is not automatically treated as gross receipts for income tax purposes, in the sense of the accrual approach used for business income. On the other hand, the nature of a collected advance and its connection with the professional relationship are checked.
An expense advance taken on behalf of a client must be separated from the professional fee. Trust amounts taken for payments made in a person’s name and professional expense advances may not have the same legal result. The explanation on the transfer slip matters, but so does how the money was actually used.
Electronic Professional Receipts and Transaction and Document Dates for VAT
Where a professional receipt is issued in return for a collection, it is fulfilled for persons within the electronic application through the electronic professional receipt (e-SMM). Taking payment by POS device does not mean that the professional document is unnecessary. The document must correctly reflect the gross amount of the collection and, where applicable, the distinction between withholding and VAT.
For VAT, the performance of the service and the taxable event are assessed separately. The generalisation “I did not receive the fee, so no tax obligation arose” is therefore misleading. For long-term service contracts, the completion of the work, interim services and the dates on which documents are issued should be examined together.
How Income Tax Withheld from Freelance Fees Is Offset Against the Annual Tax
Persons obliged to withhold generally have to make the relevant withholding on freelance payments. The guide sets out a rate of 17% for payments within Article 18 of the Income Tax Law, and a rate of generally 20% for other freelance payments. Not everyone who makes a payment is a withholding agent; the position of an individual client is distinguished from that of a company.
The withholding may be a payment that can be set off in the annual income tax calculation. Treating the net amount paid into the bank as gross income leads to an incomplete declaration. For example, where a withholding of 20,000 TL is made on a gross professional fee of 100,000 TL exclusive of VAT, the net payment of 80,000 TL does not mean that the income is 80,000 TL. The VAT amount is also recorded separately, without being mixed up with income tax receipts.
For attorneys, the documentation of the attorney’s fee charged to the opposing party and of its collection through enforcement proceedings is also important. The fact that the money comes from an enforcement account does not remove the professional nature of the income.
Professional Expenses and Exemptions That May Apply to Freelance Income
Expenses that are incurred to earn and maintain professional income and that meet the legal conditions are deductible. Personal expenses, undocumented payments and the limits on car expenses are checked separately. Where part of a home is used as a workplace, the same ratio should not be assumed for rent, shared expenses and depreciation; the specific rule for each item must be applied.
The exemption for works and activities in Article 18 of the Income Tax Law does not cover all freelance professionals. The annual income limit is examined together with the nature of the work and the activity. The guide sets the relevant limit at 4,300,000 TL for 2025 and 5,300,000 TL for 2026. It should not be assumed that when the limit is exceeded only the excess is taxed. The young entrepreneur exemption is a separate arrangement with different conditions.
Comparing Collection, Receipt, Expense and Withholding Records for the Freelance Tax Return
Contracts, collection breakdowns, e-SMM records, withholding certificates, expense invoices and provisional tax payments should be reconciled together. Where there is a difference between the bank movements and the receipts, advances, trust money, refunds and withholdings must first be distinguished. An unexplained difference should not be cleared by booking it as a general expense merely to close the year.
Is No Return Required if There Were No Collections at All?
For freelance activity continuing under the actual accounts method (gerçek usul), the annual declaration obligation continues separately. A loss or a period without receipts does not mean that the taxpayer status has ended automatically.
Does the Same Expense Affect Two Different Taxes?
Income tax expense and deductible VAT follow different rules. The fact that an expense is accepted for income tax does not by itself show that all the conditions for VAT are also met.
Professional Advances, Trust Money and Attorney’s Fees Payable by the Opposing Party
Advances received against a professional service fee are assessed under the collection basis. By contrast, genuine trust amounts for court fees and similar expenses incurred on behalf of a client must be separated using usage and refund documents. Treating every amount that reaches the account as earnings is wrong, just as leaving every advance out as trust money is wrong.
For attorneys, the contractual fee received from the client and the attorney’s fee charged to the opposing party are examined together in terms of documentation and the withholding chain. Whether the payer is the withholding agent, who the parties to the payment or enforcement file are, and to whom the payment was made are all examined. The paper receipt, tariff and deadlines in the former attorney tax guide cannot be used in place of the current e-SMM application.
When Home Is Also Used as a Workplace
Where part of a residence is used as a workplace, the special distinction in Article 68 of the Income Tax Law is taken into account for rent, heating, lighting and depreciation expenses. Charging the rent for the whole of a rented home to the expense account and apportioning other shared expenses are not subject to the same rule. Where the property belongs to the professional, a separate assessment is made for depreciation.
The presence of a computer in a room does not by itself turn all personal living expenses into professional expenses. Actual use, the lease, the workplace notification and the documents must be consistent with one another. For the rent of a workplace, the bank or PTT evidence and the withholding responsibility are also checked independently of the expense account.
Professional Loss, Provisional Tax and Annual Deductions
The legal offsetting conditions apply to the relationship of a freelance loss with other income and with later years. A loss is not a deduction that may be freely postponed to a year of choice. Likewise, education, health and personal insurance expenses that are not professional activity expenses are assessed as deductions in the annual return, subject to their own conditions; they are not used twice.
The exemption for copyright and patent certificates, the young entrepreneur exemption and the tax-compliant taxpayer discount each require different tests. For this reason, before filing, the total collections, e-SMM records, withholdings, VAT and provisional tax should be matched separately. Simply totalling the net inflows in the bank may understate the gross amount of professional income subject to withholding.
Decision to Make Before Acting and the File to Prepare
Reconcile the contract, the completion of the service, the collection and the electronic professional receipt records. Calculate separately the move from the net payment to the gross fee and the annual offsetting of the income tax withheld. Do not mix the client’s money with the professional income records.
