Summary

Zoning plan, project, condominium ownership, application and litigation routes where an alteration permit or change of use is rejected. With 2025 Council of State decisions.

The rejection of an application for an alteration permit or for a change of use may be reviewed as to whether the grounds for rejection are consistent with the zoning plan, the permit and project, structural safety and the relevant special regulations. Not every repair requires a permit, and a change of use is not merely a matter of changing a word in the land registry. Once the legal nature of the application has been determined, the routes of completing deficiencies, administrative application and annulment action should be assessed.

How is a minor repair distinguished from a substantial alteration?

Article 21 of Zoning Law No. 3194 (İmar Kanunu) distinguishes between works that require a permit and certain maintenance and repairs that fall outside the permit requirement. The Planned Areas Zoning Regulation (Planlı Alanlar İmar Yönetmeliği) also defines a substantial alteration and regulates the permit and project aspects of changes to an existing building. It is not decisive that the contractor calls the work “decoration”; its effect on the building and on the approved project is examined.

Interference with the load-bearing system, a change to the layout of independent units, and effects on the building area or on the purpose of use are important in the permit assessment. By contrast, not every painting, covering or plumbing maintenance is a substantial alteration. The scope of the work to be carried out should be shown against the existing permit and the approved project.

If there is no physical change, does the permit issue disappear?

Not always. A change of use may be significant for zoning and permit purposes even if no wall is demolished. However, whether the type of activity is compatible with the current plan and permits, the special regulations and the concrete features of the building may call for a different assessment. For this reason, the defense “I did no construction at all” is not sufficient on its own, nor can the same permit condition automatically be applied to every change of activity.

The first review should be built on what the previous use was in law and what different requirements the new activity gives rise to. Parking, fire safety, accessibility, and health and environmental conditions may differ as the use changes.

Four records that must be kept apart

Document or regulationWhat it showsWhat it does not show on its own
Zoning plan and plan noteThe conditions of use and development of the areaAll the permits of a specific independent unit
Construction permit and approved projectThe technical and use arrangement the building is permitted to haveThat the business is licensed for every activity
Occupancy permit (yapı kullanma izin belgesi)The status of the building in terms of permission for useThat later changes have been approved
Workplace opening and operating licenseThe permission for operating a specific activityThat zoning violations have been remedied of their own accord

The land registry record and the management plan are added to this review. A notation of “workplace” in the land registry does not make the unit suitable for every activity. The approval of the unit owners likewise does not, on its own, make a use contrary to the zoning plan lawful. Conversely, a permit obtained from the municipality does not, of its own accord, remove the common-area or condominium ownership conditions required under private law.

How should the grounds for rejection be examined?

Contrariety to the zoning plan and the plan note

The application should be compared with the use decision in force. The conditions for applying provisions that allow certain non-residential services in a residential area are examined separately. This possibility does not mean that all independent units in a residential area may be opened to every kind of commercial activity. The floor, the street frontage, the connection, the nature of the activity and local decisions may be important.

Where the plan has been annulled or the property lies in an area with special status, a separate examination is also required. There may be special alteration regulations for existing buildings that hold an occupancy permit; a general conclusion such as “if there is no plan, nothing can be done” or “if there is an old permit, any change can be made” is not drawn. The current regulation on the date of application and the transitional provisions should be shown in the file.

Deficiencies in fire safety, parking and the technical project

The municipality must explain on which document, project element or provision the deficiency is based. The applicant, too, must submit the projects and technical solutions required for the requested use. Matters such as fire escape, load-bearing system and parking requirements may not be dealt with merely by a letter of undertaking.

If the deficiency can be remedied, completing the project may offer a more direct solution than bringing an action against the rejection. However, if the municipality requires a document that does not exist in the legislation or a condition unrelated to the matter, this becomes a subject of legal review. A deficiency in the application and the application not being found suitable on the merits are not the same thing.

Consent of the unit owners

Articles 19 and 24 of the Condominium Ownership Law No. 634 (Kat Mülkiyeti Kanunu) regulate different subjects. Interference with common areas or with the structure, and the use of a residence for particular types of business, are assessed separately. It cannot be said that unanimity is required for every alteration, nor that a person may make unlimited changes in his or her own independent unit.

The work to be carried out, the common areas, the nature of the independent unit in the land registry, the management plan and the type of activity should be examined together. A building owned entirely by one person is not the same as a building with many owners. The existence of a private-law dispute does not remove the municipality’s obligation to carry out correctly the zoning review within its own authority.

What do the actual Council of State decisions say?

The 2025 decision on a real estate office application

In the decision of the 4th Chamber of the Council of State (Danıştay) dated February 26, 2025, E.2024/2342, K.2025/1199, a request to open a real estate office on the first floor of a three-story residence belonging entirely to the applicant was examined. The municipality rejected the request for a business license, citing the need to obtain an alteration permit in order to convert the use into a workplace. [1]

The Council of State, assessing together the single ownership of the property, the type of activity and the relevant planned-area regulation, reversed the decision dismissing the action. This decision is directly a dispute over a workplace opening license; it is not a decision establishing a general exemption applicable to all alteration permit requests. Its concrete contribution is to show that the municipality should not assess the relationship between use and activity through an automatic precondition.

Change of use and the specificity of the report

In the decision of the 6th Chamber of the Council of State dated May 26, 2025, E.2024/7708, K.2025/2958, a change concerning hotel use and a zoning sanction were assessed. The permit dimension of the change of purpose of use and the concrete establishment of the contravention were distinguished from one another; the decision to reverse was reached because of problems in the findings and measurements in the report. [2]

This decision does not say that a change of use may be made without a permit. Moreover, a sanction being found unlawful because of an incomplete finding does not mean that the building has all of its permits. Although the permit application, the business permit and the sanction files are linked to one another, they give rise to separate legal issues. Because the two decisions concern different events, they should not be reduced to a single unlimited rule.

The rejection letter, notice of deficiency and silence

A definitive rejection of the application should be distinguished from a notice of a deficiency that can be completed. A letter stating “it will be assessed if the deficiencies are remedied” does not always amount to a definitive rejection. By contrast, if fulfilling the required condition is legally or practically impossible and the application has been concluded, the real effect of the letter is examined.

Article 22 of Law No. 3194 regulates the periods for a permit application and for notice of deficiencies. In a complete file, the thirty-day permit process, the notification of deficiencies within fifteen days and the period provided after the file is completed are important for the administration’s performing its duty on time. The lapse of these periods should not be interpreted as the construction permit arising automatically.

On what date can an action be filed?

In administrative courts, the period for a general annulment action is sixty days unless there is a special provision. An express notice of rejection, an implied rejection (zımni ret) within the scope of İYUK Art. 10 on a request for a new act, and an İYUK Art. 11 application against an existing act are calculated separately. Under İYUK Arts. 10 and 11, the general period of non-response is thirty days; the sixty-day waiting period found in older sources should not be applied directly to current applications.

The period for acting provided in the permit legislation and the judicial period for filing an action are not the same. One regulates when the administration must decide; the other regulates when the interested person may file an action. The dates of completing deficiencies and of re-applying should be recorded; it should not be assumed that continuing talks with the municipality automatically preserve the period for filing an action.

Which documents are important in an annulment action?

The case file should contain the application form and the record of delivery, the rejection letter, the land registry record, the existing construction permit and occupancy permit, the approved project, the proposed alteration project and the relevant plan notes. If available, a technical report, the fire department’s opinion, the parking calculation and the unit owners’ resolutions are also added. Consistency is sought among the documents as to the independent unit number and the description of use.

In a technical dispute, an on-site examination and an expert examination may be requested. The comparison should be made not only with the existing de facto situation but with the legally approved situation. It cannot be assumed that a place that has de facto long been used as a workplace is, for that reason, also legally permitted for the same use.

The action is generally brought against the relevant administration in the administrative court; the jurisdiction of the place where the property is located and, if any, the role of the special provincial administration are assessed. Private-law claims between the unit owners are dealt with separately. It should not be accepted that both disputes will be resolved in the same court.

Stay of execution and the effect of an annulment decision

In a request for interim protection against the rejection act, a clear unlawfulness and a damage that is difficult or impossible to remedy must be explained together. The investment schedule, rent expense or business loss may be made concrete; however, not every economic loss is regarded as sufficient on its own. A stay of execution of the negative act also does not take the place of a construction permit or a business license.

After an annulment decision, the municipality is obliged to make an assessment consistent with the court’s reasoning. If the decision removes only an incorrect document request or an insufficient examination, the other conditions of the file may continue to be examined. Where the municipality is within bound authority and all the conditions have been met, the effect of the decision may be different; in every file the ruling and the reasoning must be read together.

Starting work without a permit may give rise to the risk of a separate sealing, demolition or fine. The filing of an action does not remove the obligation to comply with the legislation in force. Compensation for damage alleged to have arisen because of the rejection is assessed separately as to the damage, causation and the appropriate application procedure.

Conclusion

In disputes over alterations and change of use, the real scope of the work to be carried out must first be determined. The plan, permit, project, land registry record and activity permit should be read together; a notice of deficiency should be distinguished from a definitive rejection. The action should rest on the unlawfulness of the concrete ground for rejection and on the technical documents, rather than on a claim of a general right to a permit.

Frequently Asked Questions

If I change the use without demolishing a wall, is an alteration permit required?

A change of use may require a permit assessment even if there is no physical interference. The features of the activity and of the existing permits should be examined separately.

Is unanimity always required to convert a residence into a workplace?

The assessment is made according to the type of activity, the nature of the land registry record, the management plan and the work to be done. The different provisions of the Condominium Ownership Law should not be confused with one another.

If the municipality does not respond within thirty days, is the permit deemed obtained?

No such general conclusion can be drawn for a construction permit. The administration’s processing period and the periods for implied rejection and for filing an action are separate rules.

If I have the rejection annulled, can I begin the alteration?

An annulment decision does not take the place of the permit. The implementation of the decision and the issuing of the necessary permits should be followed.

Does a business license remedy a contravention in the building?

It does not remedy it of its own accord. Zoning permits and operating permits have different legal functions.
