Summary

How do the source of the down payment, the period in which instalments were paid, the remaining debt and the title share affect property division in a home bought with a loan?

In dividing a home bought with a loan, the basic question, before the existence of the debt, is in which period and from which sources the acquisition price was financed. The personal down payment, the loan payments made during the marriage, the payments made after the regime ended and the remaining debt must be shown separately. Indebtedness toward the bank and the liquidation claim between the spouses are not the same calculation.

How Should the Loan File Be Read?

The sales contract and the land registry record, the initial drawdown of the loan, the separation of principal and interest, the payment schedule, interim payments and early closing are examined together. If refinancing was made with another loan, closing the old debt should not be treated as a new acquisition of property. From whose account a loan instalment left may also fail, by itself, to show whether the money came from a personal or an acquired source.

This table is not a calculation formula; it is an arrangement of the data to be sent to the expert. Deducting the same amount both as remaining debt and, a second time, setting it aside as a personal contribution can spoil the result. [1]

Does the Result Change if the Title Is Held Half and Half?

The title share determines ownership. A payment that one spouse made toward the other’s share may require a separate claim review; however, an automatic claim cannot be derived without assessing the intent to make a gift or the parties’ financing agreement. Closing the bank debt through the sale of the joint home also does not mean that all accounts between the spouses have been liquidated.

What Should Be Considered When Assuming the Bank Debt?

If the spouses leave the debt to one of them in the protocol, this does not necessarily release the other debtor toward the bank without the bank’s acceptance. The payment obligation in the internal relationship, liability toward the bank, the lifting of the mortgage and the transfer of title should be regulated in separate clauses. Merely stating in the protocol “the home will remain with the spouse” does not resolve these matters.

How Are Immovable Property, Loans and Mixed Financing Calculated?

What Happens if Personal Property Is Sold and a New Home Is Bought?

The value replacing personal property may also be personal property; however, if the price of the new property was met from both personal and acquired sources, mixed property arises. The bank transfer chain, the dates of sale and purchase, the exchange-rate difference and the remaining loan are important.

How Is a Multi-Link Substitution Chain Traced?

Under Article 220/4 of the Turkish Civil Code, values replacing personal property may also be regarded as personal property. However, in a chain such as “the inherited home was sold, gold was bought, the gold was converted into foreign currency, and a new home was bought by adding a loan to the foreign currency,” each link must be proven separately:

  • The source and sale price of the first personal property are determined.
  • The date, amount and account by which the sale price passed to the subsequent asset are matched.
  • Money that entered a joint account in between, consumption, additional income and the new loan are separated.
  • The proportion of the personal source and the proportion of the acquired source in the acquisition price of the final property are determined.
  • Contribution, equalization and share in increased value are applied in a way that does not count the same amount twice.

Tracing matrix: Inheritance/transfer document → first official deed of sale and bank deposit → gold/foreign currency purchase document → liquidation document → sale price of the new immovable property → loan drawdown and instalments. The larger the gap in dates and amounts, the weaker the substitution claim becomes; a mere statement “it came from my family” is not sufficient.

From Which Value Is a Contribution Made in Foreign Currency or Gold Calculated?

Mechanically multiplying the Turkish lira (TL) equivalent of the contribution at today’s exchange rate is not always correct. First, the actual amount on the date of the contribution and the acquisition/improvement value of the property on that date are found; the contribution ratio is determined; then this ratio is applied to the liquidation value. If the contribution is a direct monetary claim or a loan, the rules on foreign currency debt and default are separate.

In gold and foreign currency documents, the type, amount, buying/selling rate, spread, commission and liquidation date should be shown. If there is no bank receipt, the jeweler’s document, custody record, cash movement, same-day sale/purchase and correspondence between the parties are assessed together. Adding both the exchange-rate increase and the increase in the market value of the property a second time under the name “adjusted value” is a duplicate calculation.

How Are Usufruct, the Right of Habitation and Mortgage Deducted from the Value of the Immovable Property?

The existence in the land registry of a usufruct, a right of habitation (sükna), a right of superficies or a mortgage in favor of a third party may affect the gross market value; however, the nominal mortgage limit in the registry is not mechanically deducted as if it were the actual debt balance. The genuineness of the right, its date of creation, its term, the age of the beneficiary and the scope of use, the rental yield, the debt balance and the possibility of simulation are examined. For time-limited or lifelong rights of use, real estate valuation and, where necessary, actuarial calculation are used together.

How Are Immovable Property, Loans and Mixed Financing Calculated?

Is the Whole of a Home Bought with a Loan Divided?

Although it is important that the home was acquired during the period of the property regime, it cannot be assumed that all loan payments are of the same nature. The source of the down payment, the instalments paid within the regime, the payments after the date of the divorce action, the payment made from personal property and the remaining debt are separated.

What Happens to Loan Instalments Paid After the Divorce Action?

A payment made after the cut-off date is not automatically included in the residual value calculation of the acquired property. Who made the payment, on what date and how the debt is taken into account on the liquidation liabilities side, and whether a later payment by the non-owner spouse creates an independent share in increased value, must be examined.

How Are Unlicensed Buildings, Construction in Return for a Land Share and Urban Transformation Assessed?

The absence of a permit or a title problem does not by itself destroy economic value. Ownership of the land, the actual level of construction in the building, the zoning status, the right arising from the contract, the shares transferred to the contractor and the legal/actual situation on the date of the decision are assessed together. In urban transformation, the personal or acquired character of the old immovable property, state support, the loan and additional payments are analyzed in terms of the proportions in which they were carried over to the new independent unit.

In construction in return for a land share, if on the date the regime ended the servitude of floor ownership had not yet been established or the construction had not been completed, a completed apartment is not always placed on the balance sheet. The landowner’s personal right arising from the contract against the contractor, the level of construction, default, the action for termination/adjustment, the share transferred to the contractor and the likelihood of delivery are valued. A pending action may be made a preliminary issue; where necessary, the economic value is calculated in scenarios by construction, real estate and law of obligations experts.

A Building Registration Certificate (Yapı Kayıt Belgesi) is not a title document that by itself makes a building subject to condominium ownership and fully compliant with zoning legislation. For an actual building where the land registry shows land, the municipal permit/street numbering, property tax, electricity and water subscriptions, the municipal executive committee (encümen), building registration, satellite/photograph and construction expenditure records are requested. If the sources of the land and of the building on it are separate, equalization or share in increased value is set up separately.

Frequently Asked Questions

How Is the Calculation Made for a Home Whose Loan Continues During Divorce?

The down payment, the loan payments within the regime, the payments after the regime and the remaining debt are separated. The source of financing matters as much as the date of the title. The expert should be asked for a calculation that separates principal from financing cost and shows the effect of each period. Taking an arbitrary debt balance from the current value of the home and dividing the result by two may overlook the personal source and the differences between periods.

When the Title of a Home with a Loan Is Held Half and Half, Is the Instalment Contribution Assessed Separately?

A half-and-half title shows the spouses’ ownership shares. Which spouse paid the instalments and from which source may give rise to a separate contribution or debt relationship regarding the other spouse’s share. Not every payment is automatically counted as an additional claim; the intent to make a gift and any agreement are investigated. Rights arising from co-ownership and the property regime calculation should be kept separate so that a duplicate result is avoided.

If the Title Is in My Spouse’s Name but I Paid the Entire Price, Which Claim Is Examined?

Paying the entire price does not by itself transfer the immovable property into your ownership. If the money came from your personal property, a share in increased value may be examined; if it came from marital earnings, a different property group and a participation calculation may be examined. If there is an allegation of a gift, a loan or a fiduciary transfer, its special conditions are also important. A request for the title requires a separate valid legal basis.

How Is Property Calculated When Payments Began Before 2002 and Continued After?

Payments before and after January 1, 2002 are separated; however, the calculation is not set up as if there were two separate assets according to the instalment date alone. The date of acquisition of the property, the relationship between the contract and the title, the personal source and the later financing are assessed together. The contribution share of the earlier period and the later equalization or participation effect should be separated. In cooperatives and long-term loans, the complete payment statement is important.
