Summary

Having the right to a tax advantage is not the same as using that right correctly.

Having the right to use a tax advantage is not the same as using that right correctly. A taxpayer who meets the age, activity or income condition may still fail to obtain the expected result because a collection was routed to the wrong account, the document is not suitable, the amount for the wrong period was used, or a later obligation was breached. Sound tax planning must determine not only how much tax will decrease, but also through which transactions and documents the right will arise and how it will be protected.

The review proposed here does not add a single common condition to different statutory provisions. The provision of each exemption and deduction is the starting point. The common method is to combine, in one assessment, personal eligibility, the scope of the transaction, the calculation method, the supporting documents and the conditions of later periods.

An earnings exemption removes the part of a specific income that the law provides for from taxation. A tax base deduction allows an amount that meets the required conditions to be deducted from the income on which tax is calculated. A deduction from the calculated tax is applied to the tax itself. An offset means that tax already paid or withheld is taken into account in the relevant account. These similar-sounding expressions belong to different stages of the calculation. [Income Tax Law] [Corporate Tax Law]

For example, the deduction for education and health expenses does not mean that the entire eligible expense is refunded to the person. The deduction for tax-compliant taxpayers is also not a business expense deducted from income. The young entrepreneur earnings exemption does not mean that the business is exempt from every type of tax. If the wrong legal type is chosen, the calculation may be wrong even if the right rate is used. [6] [4] [1]

Eligibility of the person and the activity must be reviewed before the transaction

The fact that an exemption is granted to a natural person does not show that the same right passes to a capital company founded by that person. Carrying on the activity through a company, the position of the partners and the transfer of the business may have separate consequences. For this reason, when deciding the legal structure of a business, one should not look only at the setup cost or a single incentive amount. [Income Tax Law] [Corporate Tax Law]

For the young entrepreneur exemption, the age, the start date of first taxpayer status, personal performance or management of the activity, and the partnership and transfer conditions are examined together. The effect of starting work in the last days of the year on three taxation periods should also be part of the decision to set up. The statutory scope of the exemption is determined for commercial, agricultural and professional earnings, and other income is not accepted within the same scope. [1]

There is no single exemption for income earned over the internet either. Selling a product made at home, social content production, mobile application revenue and goods bought online and resold are not the same activity. The fact that the payer or the platform is foreign does not by itself make the income exempt. The real nature of the service or sale must be determined first. [18] [20]

The contract, the invoice and the payment flow must describe the same transaction

Writing “donation”, “sponsorship”, “royalty” or “advance” in a contract does not, by itself, determine the tax outcome. What the parties actually did, the performance for which payment was made, and whether the documents issued confirm that relationship are examined. In taxation, the real nature of the transaction is what counts. [Tax Procedure Law]

Where a payment described as sponsorship is made in return for specific advertising services, all of the performances in the contract must be assessed. For a donation, the legal status of the recipient organization, the purpose of the donation, whether it is made in cash or in kind, and the statutory deduction limit matter. It cannot be said that every payment serving the public interest carries an unlimited deduction. [8]

If the payment document lacks the recipient or a description of the transaction, the link should be established through the invoice and the contract. Issuing an invoice does not, on its own, fulfil the obligation to make the collection and payment through the financial institution that the law requires. Conversely, the existence of a bank receipt does not by itself remove the obligation to issue an invoice or another mandatory document. [12] [15]

The year of filing and the year the income was earned must be kept apart

Monetary limits and exemption amounts are set for particular income or accounting periods. Applying the amount for the year in which the return is filed to income of a previous year is not always correct. The same problem also arises in the depreciation limit that depends on the year of acquisition, and in transitional provisions for property acquired before a certain date. [16] [10]

For this reason, a review file that only says “2026 transaction” is not enough. The period in which the income was earned, the acquisition date of the asset, the date of sale or service, the collection date and the return period should each be shown separately. Differences between these dates can change not only the calculation but also the provision that applies.

The period in which the right can be used and the application period are also not the same. An income type being exempt in certain periods does not mean that a document or notification can be submitted at any time. The nature of the time condition, and whether a deficiency can be completed, should be examined under the relevant provision.

Not every eligible expense may be fully deducted, and the same amount cannot be used twice

The fact that an expense is related to the business does not necessarily mean that the full amount is deductible without limit. The rent for a passenger car, its running costs, the taxes paid on purchase and the depreciation may be subject to different limits. Applying a single percentage to all expense items overlooks the different legal nature of each one. [16]

For insurance premiums or education expenses, whether the expense belongs to the taxpayer, the nature of the document, the payment period and the limits applied together are examined separately. A deduction already used in the payroll cannot be used again for the same amount in the annual return. A deduction appearing in more than one place does not mean the amount was actually paid more than once. [7] [6] For details, see the article Refund of Tax Paid in Excess or Without Basis.

Setting off an income-related expense against other taxable income, or carrying forward an amount that cannot be used to the next year, is not a right common to all provisions. The specific consequence under the law must be determined for each income and each deduction. This distinction is especially important for persons with more than one activity. [Income Tax Law] [Corporate Tax Law]

Approval of the return does not show that all conditions for the right have been met

Under some provisions, the collection period, the protection of a special fund account, the submission of documents, or the offset period for an unused deduction continues to be monitored after the return is filed. Acceptance of a return does not show that a condition to be met in the future has been satisfied. [10] [4] For details, see the article Filing a Return with Reservation of Rights.

Consider a company that applies the exemption on the sale of a suitable immovable property or participation share. If the review is limited to the calculation made on the day of sale, the collection schedule of the price and the condition that the gain be kept in a special fund may be overlooked. If transferring the fund to another account or withdrawing it from the business is considered later, the effect of that step on the exemption should be assessed in advance. [10]

For the tax-compliant taxpayer discount as well, eligibility on the day the return is filed and monitoring of any offset later used are separate tasks. Calculating an amount does not mean that it can be used indefinitely, in cash, or against any debt. [4]

A missing document and a missing substantive condition cannot be remedied with the same defense

The fact that the receipt for a payment in the file has not been submitted is different from the payment never having been made. In the first case, proof of an event that did occur is at issue; in the second, the existence of the substantive condition for the right is at issue. Obtaining a document later does not turn a transaction that did not take place into one that did.

When a deficiency is found, first determine whether it is a calculation error, a gap in documentation, a breach of a time limit, or a case where the condition for the benefit does not exist at all. Correction, explanation, application or lawsuit options are considered after this distinction. It should not be assumed that every adverse result can be remedied simply by a new petition.

Review stageQuestion to askRecord or document to keep
Before the transactionAre the person and the activity eligible under this provision?Taxpayer status, partnership, activity and contract information
During the transactionDo the performance and the payment meet the legal conditions?Delivery, invoice, bank and other transaction records
During filingWere the correct period, amount and order of deductions used?Calculation worksheet and return
After filingIs there a continuing obligation regarding collection, funds or documents?Payment schedule, fund movements and report submission records

The economic value of an exemption or deduction is not limited to the tax saving calculated at the outset; the right must also be explainable during a review and verifiable with documents. Tax planning therefore cannot be carried out independently of the contract, the correct choice of taxpayer status and the transaction records.

The appropriate approach is to set out, for each advantage, its legal basis, the person who will benefit, the transaction it covers, the period in which it applies, the calculation limit and the subsequent obligation. In such a file the aim is not merely to file the return. The aim is that the reasons for the choice made can be shown later, and that the right is not lost through avoidable errors.
