Whether income tax arises on the sale of immovable property cannot be determined only by looking at the sale price or at the five years recorded in the land registry. Selling a personal property acquired for consideration within five years may give rise to a gain from the increase in value. Immovables acquired by inheritance or gift, and sales made within a commercial organization, are subject to different rules. The title deed fee (tapu harcı) and income tax are separate obligations.

The gain from the increase in value is not the whole sale price. The mode of acquisition, whether the sale forms a commercial activity, the holding period and the documented cost are examined together. The five-year period does not create a general exemption that removes every property transaction from all taxes.

The five-year rule in repeated Article 80 of the Income Tax Law concerns the disposal of immovables and related rights acquired for consideration. Disposal is not limited to a classic sale: exchange, contribution as capital, or transfer for any other consideration is also examined. Calling the transaction a "transfer" does not remove it from taxation.

An immovable acquired by inheritance or gift and sold as part of personal assets does not fall under this five-year taxation rule. However, if the person's activity takes on the character of real estate trading, commercial income is examined. Numerous sales, organization, construction and marketing activities are assessed together. A single numerical count of sales should not be used as a fixed threshold for commercial activity in every file. [1; Income Tax Law, Articles 80 (repeated)–81]

When does the five-year period start?

In most files, the start date is the date of registration in the land registry. However, there are special cases in which actual delivery took place earlier and the acquisition is documented by law. Cooperative allocations, construction in return for flats (kat karşılığı inşaat), change of land classification (cins değişikliği) and acquisitions in several stages must be examined on the basis of their own documents. The acquisition date of a plot and the later status of an independent unit are not automatically treated as the same in every case.

The period is not counted in calendar years. A property acquired in December does not create a one-year acquisition period merely because the year changes. When preparing a sale, land registry records, delivery minutes, contracts and occupancy permits (yapı kullanma izni) should be reviewed together, so that the start date is documented in writing.

Is the tax calculated on the whole sale price?

No. For the gain from the increase in value, the consideration obtained is reduced by the cost permitted under the law and by the expenses, taxes and fees that remain with the seller because of the disposal, in order to reach the net gain. For the acquisition cost to be indexed with the producer price index (Yİ-ÜFE), a statutory condition applies: the index increase must be at least 10%. The calculation uses the indices for the months preceding the acquisition and disposal months.

Indexation does not replace historical cost with today's market value. Undocumented renovation costs or costs borne by the buyer cannot automatically be added to the seller's cost. A low price shown in the land registry does not prevent the real sale price, as shown by bank records and contracts, from being taken into account in a tax review.

Hypothetical example of a property sale gain

Assume that in a personal sale within five years the price is 3,000,000 Turkish lira (TL), the indexed cost satisfying the conditions is 2,300,000 TL, and the seller's deductible selling expenses are 50,000 TL. The net gain is then 650,000 TL. After the 120,000 TL exemption applicable to a 2025 sale, 530,000 TL remains as the gain from the increase in value subject to taxation, all other factors being unchanged. Under the same conditions in a 2026 sale, the exemption is 150,000 TL, so the result is 500,000 TL. This comparison is not a calculation of the tax amount; the progressive rate schedule is the next step.

In which cases the income tax exemption does not apply to a property sale gain

The annual gain exemption of 120,000 TL for 2025 and 150,000 TL for 2026 cannot be used again for each property. Gains that fall within its scope in the same year are considered together. The personal-sale exemption does not apply to sales treated as commercial gains. In addition, the scope of exemptions for sales of other assets and rights differs; the property rule should not be carried over to all investments.

Is a sale after five years completely tax-free?

This period matters for the gain from the increase in value on a personal property sale. Commercial gains, title deed fees and other transaction obligations are assessed separately. The expression "tax-free sale" should not be used without making this distinction.

Is the acquisition cost indexed for an inherited house?

First determine whether the transaction falls within the scope of the gain from the increase in value. For a personal sale that is outside that scope because the property was acquired without consideration (ivazsız edinim), creating an unnecessary cost and five-year calculation would be a wrong starting point.

Is the land registry date alone sufficient in every case?

When assessing the five-year period, the legal form of the acquisition is examined. In situations such as cooperative allocation, actual start of use, change of land classification, flats-for-land construction and acquisition of several independent units, looking only at the date of the last land registry entry may give an incomplete result. The legal nature of the acquisition must be examined together with the allocation, delivery, occupancy permit or contract documents that show it.

The sale of an immovable acquired by inheritance or gift is not the same as the five-year rule for acquisition for consideration. However, construction on land received as a gift, property development and organized sales activity may require separate assessment. The label "acquisition without consideration" does not remove from income tax every later transaction of a commercial nature.

Correct months for indexation and cost documents

For the Yİ-ÜFE calculation, the indices for the months preceding the acquisition and sale months are used. The condition that the increase be at least 10% is checked separately. Subtracting the purchase price from the sale price alone does not yield the taxable gain; the appropriate acquisition cost, disposal expenses and statutory deductions must be assessed. The basis is the real sale consideration, not the listed price.

Assume that the acquisition cost is 1,000,000 TL, the applicable index coefficient is 2 and the sale price is 2,600,000 TL. The indexed cost is then 2,000,000 TL. If the documented eligible sale expense is 100,000 TL, the gain before the exemption is 500,000 TL. Assuming that the 150,000 TL exemption applies for 2026, the remaining 350,000 TL enters the annual tax calculation. The actual index coefficient must be calculated from the transaction dates; this example makes no claim about a current index value.

Single sale and commercial organization: how are they distinguished?

The number of sales is an important indicator, but the assessment cannot be reduced to a figure alone. Continuity, commercial organization, the purpose of acquisition, development activities and the nature of the transactions are examined together. Selling a property after five years does not by itself provide a tax exemption if the activity has the character of commercial gain. Value added tax (KDV) and document obligations may also be affected by this classification.

The filing method for a non-resident taxpayer (dar mükellef) on a property sale is not in every case the same as the annual return of a resident taxpayer (tam mükellef); individual declarations and special time-limit provisions are examined separately. Waiting for the annual return month after a sale may cause loss of rights in a file subject to a special period. Paying the title deed fee does not discharge the income tax obligation; the two obligations are tracked separately.

Decision before the transaction and the file to prepare

Document the acquisition date and legal basis before the sale. If there is a possibility of commercial activity, do not rely on the five-year period alone. To calculate the cost increase, determine the gain to be declared using the correct index months and expense documents.
