Summary

Funeral procedures for foreign nationals in Türkiye: death certificate, Formül C, apostille, burial, repatriation, required documents and application steps.

When a foreign national dies in Türkiye, the death must first be documented by the competent authority and the necessary notifications must be made. The burial in Türkiye or the repatriation of the body is then planned. The death certificate, Formül C (a multilingual population record extract) and the body transfer permits serve different purposes. The route to follow depends on whether the death was natural or forensic, the country of arrival, the means of transport and the health conditions. This guide explains the process that relatives follow from the first application to the burial or handover stage.

What should be done first when a foreign national dies in Türkiye?

The first application is made according to the place where the death occurred and the nature of the event. In a death occurring in a healthcare facility, the hospital must be contacted; in a death occurring at home, in a hotel or elsewhere, the competent health unit and the municipal funeral services must be contacted. If there is doubt about signs of life, an emergency or a suspicious death, 112 should be called; the scene and the body must not be altered except on the instructions of the officials. [1, 2]

  1. Establishing and documenting the death: An authorized physician or the official authorized to issue the death certificate starts the process. In forensic events, prosecutorial procedures are carried out separately.
  2. Preparing identity and contact information: The deceased's passport or identity document, the foreign identity number if any, the relative's identity and contact details are prepared. The consistency of names and dates in the documents is checked.
  3. Clarifying the burial or transfer decision: The known wishes of the deceased, the requests of relatives, religious preferences and the rules of the relevant country are considered together. If there is a dispute within the family, the legal position is clarified before any irreversible steps are taken.
  4. Coordinating with the consulate and insurance: Early contact is made with the relevant foreign representation and, where applicable, the travel insurer or funeral assistance organization. The insurance policy may require prior approval or the use of a specific service provider.
  5. Completing the documents, permits and handover plan: For burial in Türkiye, the cemetery unit is coordinated with; for international transfer, coordination is made with health units, the carrier and the person or organization that will receive the body in the destination country.

Procedures for handing over the body and inheritance procedures may be planned together; however, obtaining a certificate of inheritance is not a precondition for every funeral procedure. [1, 6]

Where and how is a death certificate obtained?

In determining the authority that issues the death certificate, the place and cause of death are as important as the foreign nationality of the deceased. The core regulation is Articles 16–23 of the Regulation on the Construction of Cemeteries and on Procedures for the Transfer and Burial of Bodies. [1]

Natural death in a hospital

Where the death occurs in an official healthcare institution, or where the body is brought to such an institution, the certificate is issued by the healthcare institution and the attestation procedure of the Regulation applies. In a private healthcare facility, the certificate issued by the physician who treated the person for the illness that caused the death requires the approval of an authorized physician as provided by the Regulation; attestation may also be carried out electronically. A family obtaining only a medical report from the hospital does not mean that all burial and transfer permits have been completed. [1, Art. 16]

Death at home, in a hotel or outside a healthcare institution

For a death outside a healthcare institution, the municipal physician of the place where the body is located has the first authority. Where there is no municipal physician, the physician of the community health centre applies; where there is none, the family physician and the other officials named in the Regulation become involved. Services outside working hours are provided according to the on-duty arrangements of the relevant place. The family should obtain guidance from the municipality or the competent health unit. [1, Arts. 16–20]

If the passport or identity document has been lost, this must be stated clearly in the application. The competent authority determines the method for investigating identity and issuing the document. The simplifications for identity declarations of Turkish citizens cannot be interpreted as meaning that a foreign national is exempt from all international transfer documents. Existing document samples, the foreign identity number and consular information may help in establishing identity.

Suspicious death, traffic accident and autopsy

Where there is a suspicion that the death was not natural, or where the identity cannot be established, the judicial authorities are informed. Under Article 159 of the Code of Criminal Procedure No. 5271 (CMK), the burial of bodies within its scope is subject to the written permission of the public prosecutor. Examination of the body and, where necessary, an autopsy form part of the judicial process. [2, Arts. 86–87 and 159]

The death certificate, the autopsy report and the prosecutor's burial permission are not the same document. The decision of the prosecution office on handing over the body and the complete conclusion of the investigation must also be kept separate. In a file requiring an autopsy or examination, the exact transport date should be planned only after the competent authority has clarified the situation.

Issues of autopsy and transfer of bodies in cases involving patients who came to Türkiye for medical treatment are addressed separately in our article on death of a foreign patient receiving treatment in Türkiye.

Differences between death notification, Formül C and apostille

Notification to the population directorate and the consulate

The Regulation requires that the death be notified by the competent unit to the population directorate within 10 days of its occurrence; the deaths of foreign nationals are also notified. This period does not mean that the body may be held for 10 days. It is useful for relatives to follow up that the notification has been made and that the registration details are correct. [1, Arts. 22–23]

Article 37(a) of the Vienna Convention on Consular Relations (24 April 1963) requires the competent authorities, on learning of the death of a foreign national, to notify the relevant consulate without delay. For relatives, it is important to contact the foreign representation to reach family members, arrange admission to the country, obtain documents and arrange the handover of the body. This communication does not remove the official notification obligation. [3]

What is Formül C, and does it replace the death certificate?

Formül C is a multilingual extract of the population register showing the registration of the death. After the registration of the death has been completed, a person authorized to obtain the document may request it from the population directorate. Kinship, power of representation and identity information are assessed in the application. Formül C may be used in foreign population, insurance, banking and inheritance procedures. [4]

Formül C is not a medical death report, an autopsy report or a body transfer permit. A foreign institution or carrier that requires a report on the cause of death may need a separate appropriate medical document. Before receiving the documents, the consistency of the spelling of names, dates of birth and death, nationality and registration details should be checked. [4, 5, 11]

Is an apostille always required for Formül C?

No. Article 8 of the Convention No. 16 on the Issuance of Multilingual Civil Registry Extracts provides for the acceptance, without additional certification, of extracts issued in accordance with the Convention in states bound by it. For this reason, it cannot be said that every Formül C must automatically be apostilled. [4]

Whether the apostille regime applies depends on the country where the document will be used, the treaties in force with that country, the type of document and the procedure for which it is used. Where no exemption applies, the apostille regime's applicability is examined; if that regime does not apply either, consular certification and translation requirements are investigated. The convenience available for a multilingual Formül C is not automatically applied to other medical or judicial documents in the file. [4, 12]

Documents required for funeral procedures for foreign nationals

The table below is for application preparation. The definitive list is drawn up according to the burial or transfer route and the conditions that the competent authorities notify for the specific file. Each row does not mean that a separate document is required in every file. [1, 4, 5]

Document or informationFunctionPoint to note
Death certificateOfficial documentation of the death; the start of the burial and transfer processMust be issued by the competent authority; identity and date information must be checked.
Passport or identity informationIdentification of the body and linking it to the consulateIf no document exists, the situation is reported; identity investigation and alternative documents are assessed.
Formül CMultilingual extract of the death registrationNot a substitute for a medical report or transfer permit; required according to the country's requirements.
Funeral road permitDocumentation of transfer outside the provinceObtained from the municipal health services unit or the competent authority specified in the legislation.
Funeral transit permit and related transfer papersInternational transferAgreement countries, transit route and conditions of the destination country are checked together.
Consular document or letter of acceptanceCompletion of steps required by the destination countryNo assumption is made that a document of the same name and scope exists for every country.
Embalming and suitable coffining documentsDemonstration of preservation and transport conditionsRequirements and form of document are determined by health authority, country and carrier conditions.
Prosecutor's permit and forensic reports where requiredBurial and handover process in forensic deathsPermits in the investigation file and reports requested by the carrier are checked separately.
Transport document and details of the person receiving the bodyCarrying out air cargo or other transportReservation, place of handover, recipient and, if required, accompanying person details are verified.

Following the document list through a single responsible person reduces the preparation of the same papers in different versions, unnecessary translation or certification costs, and missing-document problems at the airport.

How is a body transferred abroad from Türkiye?

The destination country and transit route are determined

The transfer file is prepared on the basis of the country to which the body will be sent and any transit countries. Articles 34–35 of the Regulation and the applicable international agreements are considered together. For transfers to contracting states, the system of transit documents is significant; for transfers to other countries, the documents required by that country are important. Document facilities under international agreements should not be ignored by applying the same additional list to everyone. [1, 13]

For transfers by sea, air and rail abroad, the Regulation requires a funeral road permit and a transit permit from the relevant health unit, and submission of documents to the border and coastal health officers at the point of transfer. The competent health unit and the current document procedure should be confirmed in advance at the place of transfer. [1, Art. 34]

Embalming, coffin and health conditions are completed

Embalming is a procedure applied to preserve the body. Which files require it and how it must be documented should be determined together with the conditions of the country and the carrier. It should not be assumed that every international transfer has the same embalming requirement. Medical preparation and technical coffining must be carried out by the competent units and suitable service providers. [5, 11]

For bodies to be transferred abroad, the Regulation provides for airtight inner and outer coffins and technical sealing conditions. The carrier may also have acceptance and packaging conditions. An ordinary coffin or a simple cover is not sufficient for international transport. [1, Art. 28; 5]

Where the death is due to an infectious disease, the instructions of the health authorities are decisive. Article 36 of the Regulation contains a specific prohibition on transferring to another settlement, within one year, the bodies of persons who died of cholera, plague, smallpox, anthrax, leprosy and rabies. For other infectious diseases, the specific disease and current health measures are assessed separately. [1]

Air, road and customs procedures are planned

For air transport of a body, the carrier's special cargo acceptance rules apply. The flight, cargo reservation and, where necessary, agency arrangements should be planned after it has been clarified that the body can be handed over from the forensic and health perspective. Under the conditions published by Turkish Cargo, for international shipments there are consular and documentary steps, suitable packaging, and in some forensic death cases an autopsy report. These are the practice of a specific carrier and should not be taken as a fixed list for all companies. [5]

Whether an accompanying person will travel, the method of receipt and the funeral service at arrival must be agreed in advance. A ticket for an accompanying person alone does not create a funeral reservation. For road transport, the vehicle suitable for transporting a body, road permits, border crossings and the conditions of transit countries are considered together. [1, 5]

Customs procedures must also be completed. The declaration procedure to be applied and the documents to be added should be confirmed with the customs office of departure and the transfer organization. In procedures where the oral declaration method is applied, records and document procedures are still carried out by the official; an oral declaration does not mean transport without documents. [14]

Can a foreign national be buried in Türkiye?

Municipal application and allocation of a grave plot

Burial of foreign nationals in Türkiye is possible. After the death certificate has been obtained and any forensic and health obstacles have been removed, an application is made to the municipality or the relevant cemetery unit where the burial will take place. The suitability of the grave plot, the right of use, the required documents and the scope of the service are assessed by that unit. [1, 7]

It should not be concluded that every burial of a foreign national requires a governorate approval with the same content across the country. The civil administration, consular or other authority documents required in the specific case should be ascertained in writing from the relevant local unit. A burial cannot take place until the death certificate and the cemetery's admission conditions have been completed. [1, Art. 39]

Allocation of a grave plot is not the same as acquiring private ownership of land. If a previously allocated place is to be used, the right of use and the necessary records are checked. Taking account of the Regulation's provisions on transactions based on records, the original of an earlier document should not be treated as necessarily required in every case. [1, Art. 8]

Religious ceremony and preparation of the body

Relatives should inform the cemetery and funeral service unit of the religious or belief-based preferences of the deceased. Washing, shrouding, coffining and the order of the ceremony are planned within this framework and in accordance with health rules. It cannot be said that Islamic funeral practices are mandatory for a non-Muslim person. The existence of a suitable cemetery or section should be investigated locally. [1, Arts. 8 and 26; 7]

In the legal assessment of funeral services, respect for the memory of the deceased and the mourning of relatives is an important framework. In legal scholarship, the funeral procedures of foreign nationals are also examined together with public service and the principle of non-discrimination. [15]

Construction of a grave and later transfer to another place

The cemetery's permit and technical conditions for the grave superstructure, stone and similar works should be ascertained. In some local practices there may be a waiting or licensing period; the rule of “application after three months, construction within one month” should not be presented as a general period valid for the whole of Türkiye.

A transfer of the body to another cemetery or to another country after burial is a new permit process. Article 41 of the Regulation sets out the health opinion and the permission of the competent authority of the municipality or village for exhumation and transfer. Exhumation for judicial purposes is subject to a separate procedure. If there is a possibility of a later transfer when the first burial is carried out, this should be assessed in advance. [1, Arts. 41–42]

What rules apply to bodies brought into Türkiye from abroad?

Transfer document and health inspection

For a body to be brought into Türkiye, a body transfer document issued by the competent authority of the departure country, showing that the transfer is health-compliant, is required. The identity, death, route and permit information in the document must be complete. Entry of the body into Türkiye is not the same stage as burial and population procedures there. [1, Art. 37]

According to the statement of the General Directorate of Border and Coastal Health, bodies from countries accepted as risk-free that meet the international transfer conditions are processed at customs for entry. For bodies from risky countries, the competent health officers participate in the process. The risk status of countries should not be assessed on the assumption of a fixed list; it must be confirmed on the date of transfer. [8]

Missing documents, infectious disease and forensic death

If the transfer document is missing, or the cause of death and forensic examination information have not been clarified, the deficiencies are remedied with the sending authority and the relevant foreign representation. That the body has reached the border gate does not mean that entry permission will be granted automatically. In a forensic death, the autopsy and other reports must be obtained in advance; whether a health and police assessment is required should be discussed with the entry point. [8, 9]

Even where the person died of an infectious disease in a risk-free country, the coffin of a person who died of an infectious disease may not be opened until the local health authority has approved the burial, under the relevant regulation. Health controls at entry and public health measures at the place of burial are separate areas of responsibility. [9, Art. 5]

Cremation and bringing cremated remains to Türkiye

Cremated remains are not subject to the same transfer regime as a body. Article 38 of the Regulation prohibits the transfer to Türkiye of the ashes of persons who are not Turkish citizens and whose first-degree relatives are not Turkish citizens; within the scope permitted, it regulates examination by an accredited laboratory and the storage conditions in a suitable cemetery. The fact that an urn can be carried by air does not on its own show that its entry into Türkiye is legally permitted. [1]

Cremation in Türkiye should not be treated merely as an ordinary municipal service that can be carried out simply at the family's request. Facilities and permit conditions are set out in Articles 224–225 of the Public Hygiene Law No. 1593 (Umumi Hıfzıssıhha Kanunu). Whether the service exists in practice, and in which country and under which permits the request may be met, should be investigated with the competent authorities. [10]

How long do funeral procedures take, and how are costs determined?

There is no single completion period or fixed transfer fee for all funeral procedures for foreign nationals in Türkiye. The timetable for a natural death file differs from that of a file requiring forensic examination. Obtaining documents, consulate working days, flight capacity, transit permits and the handover organization in the destination country affect the time required. No firm date commitment should be given before the permits are clarified. [5, 11]

A written fee proposal may be asked to show the following items separately:

  • Morgue and storage services, preparation of the body and embalming where necessary.
  • Coffin, packaging and local or intercity vehicle service.
  • Translation, certification and official procedural costs specific to the file.
  • Air cargo fee, agency service and the accompanying person's ticket where applicable.
  • Reception, funeral service and burial costs in the destination country.
  • Grave allocation and additional services requested, where burial in Türkiye has been chosen.

Free services provided by the municipality should be separated from paid grave plots or special services. Article 25 of the Regulation contains a provision for the free removal and burial of bodies of poor or abandoned persons; this provision does not mean that all private international transfer costs will be covered by the public authorities. Coverage under insurance and aid funds is determined by the policy or the membership conditions. [1, 11]

Keeping cost documents is important for later insurance or compensation claims. In the Constitutional Court (AYM) decision in Mehmet Tetik, B. No: 2019/21755, February 7, 2024, an application concerning the rejection of a claim for funeral and burial expenses was found inadmissible. In the proceedings described in that decision, the absence of documents concerning the municipality's free services and other expenses was considered. The practical lesson from this case is that the expenses incurred and the legal basis of the claim must be documented; the decision cannot be generalized as meaning that all funeral expenses are free or can never be recovered. [16, §§2–6, 10–15]

Inheritance, bank accounts and other rights after death

Which law applies to a foreign national's estate?

Dying in Türkiye does not by itself make the whole estate subject to Turkish law. The basic rule in Article 20 of Law No. 5718 on Private International and Procedural Law (MÖHUK) is that the estate is governed by the national law of the deceased; Turkish law applies to immovable property located in Türkiye. The special connecting rules in the same article on the opening, acquisition and division of the estate, and applicable international agreements, are assessed separately. [6]

The certificate of inheritance, the use of foreign documents in Türkiye, the transfer of real estate and the protection of the estate are procedures separate from the transfer of the body. Where a file has a foreign element, it should not be assumed that every certificate of inheritance can be obtained from a notary, or that a foreign document will be sufficient in itself, before the jurisdiction of the court and the required documents have been determined.

The applicable law, the competent court and the procedures for transferring title can be found in our article Estates of Persons Living Abroad in Türkiye, and the way a certificate of inheritance is obtained in our article on the certificate of inheritance.

Personal effects, bank accounts, debts and wills

Delivery of personal effects from the morgue, hospital or hotel is not the same procedure as the division among heirs of estate property that is subject to ownership. The handover of items that are evidence in a criminal file may depend on the decision of the competent authority. Keeping a record and inventory of the items received helps prevent disputes.

To carry out transactions on bank accounts, the person must establish their status as heir or authority to represent, and the bank must complete the necessary documentation and tax procedures in accordance with the regulations. It should not be assumed that transactions can be made using the deceased's card, password or former power of attorney. Representation by a lawyer may be helpful; however, retaining a lawyer for every bank or funeral transaction is not a general requirement.

The law applicable to debts of the estate and the conditions for disclaimer of inheritance should be examined. Where Turkish law applies, the general period for disclaimer under Article 606 of the Turkish Civil Code No. 4721 (TMK) is three months; the starting point, the type of heirship and other provisions are assessed according to the concrete case. Certain transactions on the estate may affect the right to disclaim, so the investigation of debts should not be postponed. The validity of a will is also not determined solely by reference to the Turkish Civil Code; Articles 7 and 20 of Law No. 5718 and applicable agreements are taken into account. [6, 17]

Residence permit, pension and death notice

The residence registration of the deceased and the right of residence of the surviving family members are separate matters. The death notification should be reflected in the relevant records; family members should contact the Provincial Directorate of Migration Management for the existing permit bases and possible transition conditions. It should not be assumed that family members' permits automatically produce the same result.

A death or survivor's pension that may be granted to those entitled, as distinct from a pension payable in the name of the deceased, is different. The conditions for application should be investigated through the SGK, the relevant foreign social security institution and any social security agreement. It should not be assumed that every payment made into an account after death may be used by the heirs.

A death notice published in a newspaper, municipality or another channel does not replace the official death notification. The need for a notice is assessed according to the family's choice and any special legal procedures in the relevant country.

For residence permit problems of the family members left behind, you may consult our service page Residence Permit Applications, Refusals and Cancellation Actions.

At which stages is legal support useful?

Forensic deaths, disputes among family members over the burial place, problems with foreign documents or identity, obstacles to admission into a country, and cross-border estate files may require legal assessment. The scope of legal representation must be clearly defined for applications to institutions, following permits and documents, monitoring the forensic file, or inheritance procedures. The physical preparation and transport of the body is the responsibility of the authorized service providers.

When contacting Güneş & Güneş Law Firm through Contact, it is helpful at the first stage to state the place of death, the nationality of the deceased, whether the death was natural or forensic, and the burial or transfer preference. If representation is needed, information on drafting a power of attorney is available. Passports, health reports and personal information about relatives should not be shared on public comment fields; the appropriate channel for transmitting documents and the personal data protection notice (KVKK) should be observed.

Conclusion

Funeral procedures for foreign nationals in Türkiye are built on the documentation of the death, the necessary notifications, the decision on burial or transfer, and the completion of the relevant permits. It helps the process run correctly to keep the functions of the death certificate, Formül C and the transfer documents separate; to determine the need for apostille and translation according to the country; and to clarify the forensic and health conditions before booking transport.

Burial in Türkiye, transfer from Türkiye abroad and entry into Türkiye from abroad are different procedures. Cremated remains, exhumation and the inheritance process must be assessed separately. This article is for general information; the list of documents and permits to be applied must be confirmed with the competent authorities for the concrete case.

Frequently Asked Questions

My mother or father died in Türkiye. Where should I apply first?

In a death in a hospital, the hospital unit should be contacted; in a death at home or in a hotel, the competent health unit and the municipal funeral services should be contacted. In an emergency or suspicious death, 112 should be called. The priority is the establishment of the death and the necessary forensic or health procedures.

How can we send the body to our own country?

The death certificate and any forensic permits specific to the file are completed; the transfer documents are prepared with the consulate, the competent health units and the carrier. The conditions of the arrival and transit countries are checked, and suitable coffining, reservation and handover arrangements are made.

Does the consulate issue the death certificate?

The establishment of the death in Türkiye and the issuance of the death certificate are carried out by the authorities competent under Turkish legislation, according to the place and nature of the death. The consulate may take part in notification to its own country and in the documents required by that country. Formül C is a multilingual extract of the death registration.

Can Formül C be used without an apostille?

Yes. Multilingual registry extracts under Convention No. 16 are accepted without additional certification in states bound by that Convention. In other cases, the apostille, certification and translation requirements are investigated according to the country, the type of document and the procedure for which it will be used.

Can a foreign national be buried in a cemetery in Türkiye?

Yes. The death certificate, any forensic and health permits, and the conditions for allocation or use of a grave plot must be completed. The relevant municipality or cemetery unit provides guidance on local procedures and suitable cemeteries.

How are the religious preferences of a non-Muslim person accommodated?

The belief, the known wishes and the ceremony requested should be notified to the relevant cemetery and funeral unit. A suitable cemetery or section is investigated; preparation and ceremony are planned in accordance with health, administrative and other rules.

Is it mandatory for a relative to accompany an international transfer of a body?

No single requirement for an accompanying person can be assumed for every international transfer. The acceptance conditions of the carrier and the destination country should be confirmed. The identity of the person or organization that will receive the body should in every case be clarified in advance.

Is the estate of a foreign national who died in Türkiye entirely subject to Turkish law?

No. Under Article 20 of Law No. 5718 (MÖHUK), the basic rule is the national law of the deceased; Turkish law applies to immovable property in Türkiye. Other connecting rules and applicable international agreements are also taken into account.

How can I collect the personal effects of a relative who has died?

Arrange with the hospital, hotel, institution or judicial authority that holds the effects to learn the conditions of handover. Show your kinship or power of representation. Forensic evidence, personal effects and property subject to division of the estate may not be handed over under the same procedure.

Is it mandatory to hire a lawyer to close bank accounts?

There is no general requirement. The bank reviews the status of heir or representative and the other relevant documents. The heirs may carry out the transactions themselves, meeting the conditions, or use a representative with valid authorization.

How can information be obtained about assets and a business in Türkiye?

Apply to the relevant institutions, demonstrating inheritance status or appropriate authority to represent. Where necessary, a court may be asked to determine and preserve the estate. It should not be assumed that every relative has an automatic right of access to all bank and asset information of the deceased.

What happens to the residence permit and the family members left behind?

The records of the deceased are updated in line with the death notification. The residence rights of family members are assessed separately. If the supporting person has died, apply in good time to the Provincial Directorate of Migration Management for the current permit type and transition options.

Are a death registration, a grave record and a death notice the same thing?

No. A death registration is an official civil registry procedure; a grave record is the local record showing the place of burial and related use information; a death notice is a separate announcement. Publishing a notice does not fulfil official notification obligations.

Is a will prepared in a foreign country valid in Türkiye?

It may be. Form, capacity, the applicable law and the procedure for using the document in Türkiye should be examined together. Not every foreign will requires the same procedure; it cannot be said that a will is valid or invalid merely because of the country where it was drawn up.

Does a pension continue to be paid to heirs in the same form?

No. The pension of the deceased and the death or survivor's pension that may be claimed by entitled persons are different. The application should be made under the rules of the relevant social security institution and, where applicable, the agreement between the countries.

Do debts pass to the heirs, and can the inheritance be disclaimed?

The applicable estate law and the concrete estate must be examined. Where Turkish law applies, disclaimer of inheritance is possible; the general three-month period and the starting conditions are assessed separately. Investigating the debts and the time limits before dealing with the estate is important.

Is a certificate of inheritance required before funeral procedures?

Not in every case. Documenting the death, handover of the body, burial or transfer permits, and the certificate of inheritance and transfer of assets are different processes. The documents the relevant institution requires to establish kinship or representation should be determined according to the specific file.

Is it free to bring cremated remains into Türkiye?

It is not unrestricted. Article 38 of the Regulation sets out the citizenship connection, accredited laboratory examination and conditions for storage in a cemetery. Before a ticket or transport confirmation is obtained from the carrier, it should be confirmed that entry is legally possible.
