When a power of attorney is drawn up, the attorney details above are used; the authorities to be granted are determined for the specific transaction.

This is an English translation of the Turkish sample text, provided for information only. A power of attorney to be used in Türkiye is executed in Turkish: the Turkish original (PDF or Word) is the text to take to the notary or consulate, and the translation does not replace it.

WORDING IN THE TEXT

What do the authority wordings mean?

This section explains the wording found in the source; it does not add any new authority to the source text.

Collection and receipt

Covers wording on receiving a payment or a receivable. The amount to be received, from whom and by which method should be made clear.

Settlement

Wording on the authority to resolve a dispute by agreement. Whether the matter is open to settlement and the consequences of the agreement should be assessed separately.

Waiver

May be wording on giving up a right, claim or avenue of recourse mentioned in the text. It must be clearly specified what is being given up.

Release (ibra)

May cover statements ending a debt or liability. The person to be released, the subject matter and the amount should be specified.

PREPARATION BY TRANSACTION

Check before the transaction

  1. Prepare the bank or institution, account, loan, receivable or security details.

  2. Identify the debtor, the amount of the transaction and the term; distinguish between your own debt and another person's debt.

  3. Prepare your valid identity document and the attorney-in-fact's details; confirm with the notary office or consulate whether additional documents and photographs are required.

  4. If a foreign notary will be involved, clarify the sample text and the certification/translation route for the country concerned with the firm before the transaction.

Frequently asked questions

Can I use this text directly?

Assess the details and authorities in the sample against your specific transaction. The form of the notarial or consular act and the current legislation must also be checked separately.

How can I download or print the text?

Use the Print option, or download the Turkish original as a PDF or Word (RTF) file. Only the Turkish original is offered for download, because a power of attorney to be used in Türkiye is executed in Turkish. The RTF file can be edited in Word and compatible word processors.

What should I do if I will act from abroad?

First clarify the transaction and the scope of authority with our firm. Depending on whether you go through a consulate or a foreign notary, determine the preparation of documents, certification and translation.
