Our Approach to This Procedure

The record and the supporting documents are compared; clerical error, parentage and address disputes are kept apart. The application or lawsuit is planned after the persons concerned are identified; finalization and registration are followed up.

Lawsuits for Correction of the Civil Registry Record

Correcting a civil registry record means bringing information entered in the family register (aile kütüğü) into line with the true situation and its legal basis. At the outset it must be determined whether the request concerns only a spelling error, an incorrectly prepared supporting document, an entry contrary to the facts, or an event that changes the person’s family ties.

The following records, in particular, may be examined in this context:

  • First name and surname
  • Date of birth and place of birth
  • Mother’s and father’s names
  • Marital status and family register information
  • Gender entry
  • Death record
  • Place of registration and family sequence information
  • Differences in identity and events between records
  • Inconsistencies between a foreign country’s document and the Turkish civil registry record

If a clear clerical error was made when the supporting document was transferred to the family register, an administrative correction route may be available. For requests that go beyond a clerical error or change the person’s personal status, a court decision may be required. Before applying, civil registry record extracts, supporting documents, archive records and the relevant institutional documents are obtained, and it is determined whether the administrative application or the lawsuit is the appropriate route.

Distinguishing Clerical Error, Record Correction and Parentage Cases

Not every inaccuracy in a civil registry record can be remedied by the same lawsuit. A wrong letter, transfer error or spelling error can be corrected administratively on the basis of the supporting document, whereas an allegation about who a person’s mother or father is may affect parentage. Filing such a request as a “civil registry record correction” can create problems with the competent court and the composition of the parties.

In the initial assessment:

  • Whether the request corrects the existing record or creates a new personal status
  • Whether the change affects ascendant, descendant or inheritance relationships
  • Whether the supporting document is correct, incomplete or contrary to the facts
  • The possibility of correction through an administrative application
  • Whether the civil court of first instance (asliye hukuk mahkemesi) or the family court is competent
  • The position of the population directorate, the public prosecutor and the persons concerned in the process
  • Whether a genetic or other technical examination is needed

are determined. The material result of the request, rather than the title of the lawsuit, is decisive.

Mother and Father Information and Records Linked to Parentage

A simple spelling error in the mother’s or father’s name is legally different from an allegation that the parent shown in the civil registry record is in fact another person. In the second case, recognition, paternity, denial of parentage, establishment of maternity, adoption or another family law request may come into play.

In this context:

  • Correction of a clerical error in the mother’s or father’s name
  • Registration of a child born within marriage
  • Registration of a child born out of wedlock in the mother’s household
  • Recognition by the father and registration of the recognition
  • Entry of a decision denying paternity or parentage in the record
  • Registration procedures arising from the parents’ subsequent marriage
  • The effect in Türkiye of a foreign court’s parentage decision
  • Entry of an adoption decision in the civil registry
  • The effect of a change in parentage on surname, citizenship, maintenance and inheritance

are addressed. Requests to establish or eliminate parentage are directed to the separate practice area “Parentage, Paternity, Recognition and Adoption”; this page summarizes only how they are applied to the civil registry record and the consistency of records.

Disputes Arising from Place of Residence and Address Records

A place of residence is the place where a person lives with the intention of staying permanently; it does not always have the same legal meaning as the address record. Address records can have consequences for the competent and authorized court, service of notifications, the electoral roll, social assistance, school, tax and other procedures.

In this context:

  • Correction or deletion of an address record contrary to the facts
  • Procedures for living together and for consent
  • Address records abroad
  • Differences between the address record and the actual place of residence
  • Residence disputes affecting service of notifications and court jurisdiction
  • Applications to the population directorate and the relevant administrations
  • Administrative sanctions arising from address declarations and the routes of objection

are examined. The address record alone may not conclusively determine the place of residence in every legal relationship; other evidence is also taken into account depending on the nature of the event.

The Effect of the Civil Registry Record on Inheritance, Land Registry and Other Official Procedures

Differences in name, surname, birth, death or family ties in civil registry records can block a certificate of inheritance, land registry transfer, bank account, social security payment, retirement, education certificate, diploma, passport and consular procedures.

In this case:

  • Which record constitutes the fundamental inaccuracy
  • Which of the civil registry record and the other institution’s record needs to be corrected
  • Whether a separate lawsuit is required for the land registry record or the certificate of inheritance
  • The evidentiary weight in Türkiye of documents from foreign countries
  • The effect of the correction decision on the rights of other persons
  • The application of the final decision to the relevant institutions

are determined. A decision correcting the civil registry record does not automatically change the land registry or asset record in every case; a separate procedure before the relevant institution or court may be required.

Evidence and Technical Examination in Civil Registry Cases

Because civil registry records are connected with public order, an agreement between the parties or an abstract statement alone may not be sufficient for a change to the record. Depending on the nature of the request, the consistency of records belonging to different periods and institutions is investigated.

The principal evidence and records are:

  • Civil registry record extracts with event history and the family register
  • Supporting documents of the civil registry record and archive records
  • Birth report, hospital and health records
  • School, vaccination, military service and social security records
  • Marriage, divorce and death certificates
  • Identity card, former civil registry identity booklet and passports
  • Foreign country civil registry and marital status documents
  • Consulate and diplomatic mission records
  • Land registry, bank, tax and employment records
  • Witness statements
  • Photographs and biometric records
  • Genetic or forensic medical examinations where necessary

The evidence plan is built according to the nature of the correction requested. If the document was obtained from a foreign country, the issuing authority, the original, the apostille or certification, and the translation requirements are checked separately.

Competent Court, Parties and Registration of the Decision

Lawsuits concerning the correction of a civil registry record are, as a rule, heard by the civil court of first instance (asliye hukuk mahkemesi) at the place of residence of the person concerned. However, if the request is based on parentage, adoption, divorce or another family law institution, the competent court may change. Special situations, such as the need to correct age in criminal proceedings, are also subject to separate rules.

Before filing the lawsuit:

  • The court with subject-matter and territorial jurisdiction
  • The person or institution that can file the lawsuit
  • The role of the population directorate and the public prosecutor in the process
  • Participation of the persons concerned in the lawsuit and the composition of the parties
  • Whether an administrative application is required
  • From which institution the evidence will be requested
  • Finalization of the decision and its transmission to the population directorate
  • Updating of the new identity card, passport and other institutional records

are planned. It is not enough that the court decision has merely been issued; its finalization and its correct application to the relevant civil registry record must be followed up.

Preparing for the Consultation and Scope of Services

Prepare the record you believe is wrong or inconsistent, the official documents on which that record is based and, if there is one, the rejection letter. Also state the dates of any notifications and procedures. Do not share unnecessary personal data before it has been assessed which documents the file actually requires.

The scope of the administrative application, lawsuit, appeal and post-decision procedures, as well as the attorney’s fee and other expenses, are agreed separately. The outcome and the end date are not guaranteed.
