Transfer Appointment on Account of Union Duty: The Trade Union Right of Public Servants

Summary

That a public servant is a union representative is not, on its own, sufficient justification for assigning him or her to another unit. The administration may organize its staffing needs; however, this power requires a concrete and relevant explanation for measures that make it harder to perform union duties. In the Abdulkadir Akgün decision, the Constitutional Court held that a change of unit made solely on the basis of union activity violated the right to organize in a trade union. Rather than granting union officers an absolute guarantee of staying in place, the decision puts forward constitutional review of the real reason for the appointment.

When is a transfer appointment an interference with the right to organize?

Article 51 of the Constitution protects not only the establishment of and membership in trade unions, but also the ability of a union to carry out its activities through its representatives. A measure affecting union organization therefore cannot be left outside fundamental-rights review on the ground that it is merely a personnel measure. An appointment that makes the representative's task harder, or that deters participation in union activity, may be connected with the right to organize.

Not every appointment carries the same connection. The mere closeness in time between a staff member's union membership and the adoption of an appointment decision does not, on its own, produce a conclusion without assessing all features of the file. The reason given by the administration, the service need, the official's earlier work and the actual effects on union activity must be considered together. In the Abdulkadir Akgün decision, the connection became clear when the administration directly made the union position the ground for the appointment. (Constitutional Court, §§ 11, 33, 44–55.)

Can a change of unit within the same institution also be examined?

In the incident examined, the issue was not being sent to another city but an assignment to a different unit within the same institution. This feature shows that interference cannot be measured only by geographical distance. The nature of the duty, the relationship with the employees represented, the responsibilities and the reason for the appointment tied to the union position are also important.

Therefore the conclusion that "since the city did not change, there is no interference with the right to organize" cannot be drawn. Conversely, it cannot be said that every change of unit is a union sanction. Legal characterization is made through the reason and effects of the measure as much as through its name.

What happened in the Abdulkadir Akgün application?

The applicant is a personnel specialist employed with civil servant status at the Ministry of National Defense. The decision concerns a civilian public servant; it is not a decision on the conditions for unionization of military personnel. The applicant had worked for a long time in personnel affairs, was assigned to the Ankara provincial representation of SAVDES-SEN, founded in 2013, and took an active role in the union’s management.

By an act dated 12/6/2014, he was assigned from the civil-servant appointments unit to a specialist position in the financial transactions unit. A few days later, on 15/6/2014, he was elected Ankara provincial representative. The administration argued that combining his union representation with his duty in personnel records matters would raise doubts about impartiality. The idea that the applicant might look after the interests of his own union and that distrust could arise toward other unions was used as the basis for the appointment.

The Supreme Military Administrative Court (Askerî Yüksek İdare Mahkemesi, AYİM), which examined the dispute at that time, found the administration’s assessment sufficient. The Constitutional Court, on the other hand, focused on whether a concrete reason other than union activity had been demonstrated. The absence of a negative record in his long service history and the showing of his success were significant in assessing whether the mere possibility of partial conduct in the future was sufficient. (Constitutional Court, §§ 8–19, 51–55.)

How are the duty of impartiality and union duty assessed together?

Article 7 of the Civil Servants Law No. 657 (Devlet Memurları Kanunu) regulates obligations concerning impartiality in public service. Union representation does not provide general immunity for conduct contrary to the requirements of the duty. The Court stated this limit clearly:

“Being a union officer or member does not remove public servants’ obligation to act in accordance with the responsibilities that legislation places on them and with the requirements of the duties they perform.”

Direct quotation: Constitutional Court, Abdulkadir Akgün, Application No. 2015/19791, March 20, 2019, § 48. Full text of the decision.

However, accepting that a civil servant’s being a union officer is proof that he or she will necessarily act partially would also weaken the exercise of the right to organize. The Court recalled that impartiality is fundamental in other public services as well, as in units where personnel transactions are carried out. The capacity of representative alone does not show that this obligation cannot be fulfilled. (Constitutional Court, §§ 48–54.)

The difference between an abstract possibility and a concrete service justification

A concrete service justification must explain which duty is suffering and for what reason, or which organizational need has arisen. If it is claimed in a dispute that the staff member carried out partial transactions, the relevant transactions and their supporting evidence must be identified. In the decision examined, no sufficient fact justifying the appointment, apart from the applicant’s union duty, was demonstrated.

The Court’s standard of reasoning is as follows:

“However, the reasons for sanctions and measures must be set out in a relevant and sufficient manner, particularly where there is interference with constitutional rights, and a fair balance must be struck between the constitutional right interfered with and the legitimate aim pursued.”

Direct quotation: Constitutional Court, Abdulkadir Akgün, Application No. 2015/19791, March 20, 2019, § 49. Full text of the decision.

The legal assessment arising from this explanation is that expressions such as public interest or the requirements of the service are not sufficient on their own. The relevant reasons must be connected to the specific person, duty and act. It must also be assessed whether measures that would impede union activity less were possible. This does not mean that the power of appointment disappears, but that it is exercised in a manner compatible with the fundamental right.

What safeguard does Law No. 4688 provide?

Article 18 of Law No. 4688 on Public Servants’ Trade Unions and Collective Agreements (Kamu Görevlileri Sendikaları ve Toplu Sözleşme Kanunu) contains a safeguard against being treated differently because of participation in the union activities specified in the law. It also provides that the public employer cannot change the workplace of the union representatives and officers listed in the article without clearly and definitely stating the reason. Discrimination on the basis of union membership or non-membership is also prohibited.

The safeguard in this provision must be read together with the power of transfer appointment in Article 76 of Law No. 657. That the administration has discretionary power does not make the punishment of union activity lawful. On the other hand, Article 18 cannot be interpreted to mean that everyone who is a representative can in no circumstances be assigned to another duty. The clear justification for the appointment, its connection with the service and its constitutional proportionality are examined.

Fact to be assessedLegal significance
Notification of the union duty to the administrationShows the representative status and the administration’s knowledge
Appointment letter and its justificationDetermines the reason on which the act rests
Earlier duties and performance recordsMakes the alleged service problem concrete
Effects on union activityWeighs the severity of the interference
Possibility of a lighter measureExamines the balance between the right and the service need

This table does not guarantee an outcome in the applicant’s favor. Its purpose is to prevent the dispute from being reduced only to a union membership document or only to the appointment letter. For example, if a restructuring is alleged, how the units actually changed and how similar personnel were treated must also be included in the assessment.

The judgment and its limits

The Constitutional Court unanimously held that the right to organize in a trade union, guaranteed by Article 51 of the Constitution, had been violated. The grounds for the appointment were found not to be relevant and sufficient in the specific incident; it was assessed that an act based solely on union activity did not correspond to a pressing social need. The judgment is dated 20/3/2019. (Constitutional Court, §§ 55–56 and judgment.)

To remedy the consequences of the violation, the Court ordered the decision to be sent to the competent administrative judicial authority for retrial. That the file was once heard by AYİM does not mean that an application would today be made to this abolished court. In the judgment, the remittal to the competent administrative judicial authority was made on the basis of the transitional arrangement in provisional Article 21 of the Constitution.

The decision did not award non-pecuniary damages. The applicant requested a finding of the violation. The TL 2,701.90 in the judgment consists of court fees and attorney’s fee, a historical litigation cost; it cannot be called non-pecuniary damages. The Constitutional Court also did not itself establish a new personnel appointment. The finding of violation and the obligation of retrial must be fulfilled by the relevant authority in accordance with the reasoning of the decision.

The dissenting opinion in the ordinary proceedings should also be separated from the voting result of the Constitutional Court’s judgment. The Constitutional Court’s finding of violation in this application was rendered unanimously. That the earlier court’s decision contained a differing vote does not turn the Constitutional Court’s decision into a majority decision.

What path is followed against a similar appointment act?

The reason for the act and the union connection should be explained together

In an appointment dispute, the act and the notification document, the former and new job descriptions, the union appointment or election record, the notification to the administration and any concrete service justifications must be examined together. The connection between the union activity and the act should not be asserted merely as a legal label; it should be explained with events and documents.

If the financial or professional effects of the act are alleged, these also need to be documented. It is as important not to treat every possibility in the administration’s defense as an established fact as it is not to accept every claim of the applicant as proven. The Court assesses the parties’ explanations and the real effects of the act together.

This decision concerns a person with public servant status. The conditions concerning the change of workplace, representative safeguards and recourse to the labor court for workers employed under an employment contract are subject to different regulations. Until the status of the employment relationship is determined, the judicial route and time limits in this file should not be carried over unchanged to another relationship.

Time limits for suit and for stay of execution

The general time limit for filing suit in Article 7 of Law No. 2577 is, absent a special provision, sixty days beginning on the day after written notification. Within the suit period, an application under Article 11 to the superior authority, or to the authority that performed the act if there is no superior authority, stops the running period. After rejection or after the thirty-day implied rejection, the remaining period continues to run, taking the previous days into account.

Filing suit against an appointment act does not stop the act automatically. In a request for stay of execution, the conditions of manifest unlawfulness and of damage that is difficult or impossible to compensate must be explained together. The existence of the request does not mean that the court will necessarily grant it. The time limits, the form of notification and any special provisions must be determined on the file.

If an individual application is considered after ordinary effective remedies have been exhausted, the conditions in Articles 45 and 47 of Law No. 6216 and, as a rule, the thirty-day application period are assessed separately. The Constitutional Court does not entirely redo a public institution’s staff planning; it examines whether the constitutional safeguards concerning the right to organize in a trade union were observed.

Conclusion

Union duty does not remove a public servant’s duty of impartiality; but the existence of that duty is also not, on its own, proof that he or she cannot act impartially. In the Abdulkadir Akgün decision, a violation was found because of an appointment based on union position without a concrete service problem being demonstrated. In a current dispute, what is decisive is less the existence of the power of appointment than the concrete justification with which and the effects on union activity with which that power is exercised. The reason for the act, its effects and the request for redress should be set out separately.

Frequently Asked Questions

Is the assignment of a union representative to another unit always unlawful?

No. The concrete service justification and fundamental-rights safeguards are assessed together. In the decision examined, a justification based solely on union activity was not found sufficient. See the section on the conditions of interference.

Can an appointment made without a change of city affect the right to organize?

Yes. The unit, the duty and the effects on representation activities are also important. The Abdulkadir Akgün application concerns a change of unit within the institution. It is explained in the section on change of unit.

Does being a union officer remove the duty of impartiality?

No. A public servant must perform his or her duty in accordance with legislation and the duty of impartiality. However, it cannot be assumed that he or she will act partially merely because of representation. See the section on impartiality and union duty.

Did the Constitutional Court award non-pecuniary damages in this application?

No. A decision of violation and retrial was given, and litigation costs were awarded separately. The amount of costs is not non-pecuniary damages. See the section on the judgment and its limits.

Does filing suit stop the appointment act?

Not on its own. The conditions for a stay of execution are examined separately. The time limits and conditions are explained in the section on suit and stay of execution.
