Precautionary accrual (ihtiyati tahakkuk) is an institution that allows a provisional calculation and accrual to be made, in order to protect a public receivable, before certain taxes have yet accrued in the ordinary manner. It does not show that the tax has been finally found to be due or that it can be collected immediately. Articles 17–20 of Law No. 6183 on the Procedure for Collection of Public Receivables specifically regulate its conditions and its link with precautionary attachment.
A person against whom precautionary attachment based on precautionary accrual has been applied should examine not only the freeze on the bank account, but also the ground and amount underlying that measure. Because Article 20 of the Law refers to Article 15, the special 15-day time limit for an action is important. This period must not be confused with the general time limit for an action concerning a normal tax assessment.
How does precautionary accrual differ from normal accrual?
Normal accrual is the outcome of the process provided for in the relevant tax law. Precautionary accrual, by contrast, serves to protect a receivable that has not yet reached that stage. The tax base may be known or may be determined by provisional estimate within the framework permitted by law. The need for protection does not allow the administration to turn every amount it estimates into a debt entry without oversight.
This measure is not a conviction by a criminal court. The existence of a suspicion of tax evasion or another allegation of unlawfulness likewise does not mean that criminal liability has become final. The tax, the protective measure and the criminal proceedings must each be assessed under their own conditions.
Are precautionary accrual and precautionary attachment the same measure?
Precautionary accrual concerns the provisional calculation and accrual of the receivable to be secured; precautionary attachment concerns protection directed at assets. Although connected, they are not the same measure. Precautionary attachment also does not in every case have to rest on precautionary accrual; other grounds for attachment may exist for an existing public receivable.
This distinction matters when preparing the action. When only “lifting the freeze on my account” is requested, it may not have been explained on what ground and in what amount the precautionary accrual on which the freeze was based is unlawful. The decisions in the measure’s file must be identified separately.
Under what conditions can precautionary accrual be applied?
Law No. 6183 Art. 17 does not treat all grounds for precautionary attachment indiscriminately as grounds for precautionary accrual. The article’s express references and the two situations it lists separately are the basis. It must be possible to see in the decision and the supporting documents which statutory ground was applied.
The grounds for precautionary attachment to which the Law refers
The first paragraph of the article refers to the situations in paragraphs 1, 2, 3 and 5 of Law No. 6183 Art. 13. These are: cases requiring security under Art. 9, the absence of a known domicile, the likelihood of absconding, removing assets and resorting to fraudulent means, and certain breaches relating to the declaration of assets. Each paragraph must be made concrete through its own elements.
For example, a change of address does not, on its own, conclusively show a risk of absconding or removing assets. The enterprise’s ordinary sales must be distinguished from dispositions alleged to be aimed at preventing collection. Whatever conclusion the bank, land registry, trade registry or inspection records in the administration’s hands are relied on for must be identified.
Proceedings for obstructing collection and a sham undertaking
Commencement of proceedings under Article 110 of the Law is separately listed in Art. 17. The other ground is obtaining evidence that the undertaking is a sham and in reality belongs to another person. The fact that several companies share a common address, or that persons are related, should not be used as a fact that alone completes the assessment.
The actual control of the business, financing, the flow of collections, contracts and records are examined together. In an allegation of sham, the special provision of Law No. 6183 Art. 18 on the assets against which precautionary attachment may be directed is also important. The relationship between the formally apparent taxpayer and the person alleged to benefit from the undertaking for tax purposes must be shown with concrete evidence.
Can precautionary accrual be made for every tax and public receivable?
No. Law No. 6183 Art. 17 applies to the taxes and duties determined by the Ministry, and to the items attached to them. The relevant section of the Collection General Communiqué lists income tax and corporate tax, including provisional tax; VAT, stamp tax, special consumption tax, special communication tax, gambling tax, bank and insurance transactions tax and inheritance and transfer tax. The late-payment interest and tax-related penalties attached to the tax principal for these taxes are also covered by the regulation.
This scope does not mean that every kind of public receivable can be accrued precautionarily of its own accord. The type of tax and the regulation applicable in the relevant period must be determined. Where the principal of provisional tax is no longer sought, the scope of the items to be secured is assessed separately; the tax principal should not be demanded again merely because it appears in the old account.
Who issues the precautionary accrual decision?
The Law requires a written request from the competent tax office official and a written order from the competent authority. The statutory provisions on the tax office director, the relevant director or group director, and the head of the provincial finance office (defterdar) or the tax office chief, must be read together with the organizational and competence provisions in force on the date of the measure. The fact that an old title appears in a document because of the restructuring of institutions is not in itself a sufficient assessment.
The presence of only an account table in the file may not show that the required written request and decision exist. If a delegation of authority is claimed, its scope, date and whether it covers the relevant measure are examined. An objection on competence should rest not merely on the title of the signatory but on the legal record of authority on that date.
How are the tax base and the amount of precautionary accrual calculated?
Law No. 6183 Art. 18 distinguishes between receivables whose tax base is known and those whose tax base is not yet known. If the tax base is known, the measure is taken on the basis of the relevant account. If the tax base for previous years and for the past months of the current year is not yet known, external indicators and provisional estimates are used within the framework of the Law. An unlimited hypothetical calculation cannot be built on activities that have not yet taken place in the future.
A provisional estimate does not mean an estimate without reasons. Why the turnover, bank movements, comparables, quantities or rates used were chosen must be explained. Treating all gross bank inflows as a tax base without any distinction, and not examining refunds, borrowings or internal transfers within the business, may create a dispute over the calculation.
The Law provides that these provisional estimates are to be made by the assessment committees (takdir komisyonları) within one week at most of the date of the request. This period is not the taxpayer’s time limit for an action. In the Communiqué, the date of the written request for precautionary accrual is taken as the basis for determining late-payment interest. The items of the calculation should be separated into tax principal, penalty and interest.
| Element of the calculation | Question to ask | Document to check |
|---|---|---|
| Period | What is the relationship with past years or the past months of the current year? | Period breakdown |
| Tax base | Is it a definitive record or a provisional estimate? | Declaration, inspection and estimate documents |
| Rate | Is it appropriate for the relevant transaction and period? | Applicable tax provision |
| Accessory items | Are tax principal, penalty and interest separated? | Detailed calculation schedule |
| Earlier measure | Has the same receivable already accrued before? | Accrual and collection records |
Is the amount accrued precautionarily collected immediately?
Law No. 6183 Art. 18 provides that the tax and attached items accrued in this way are not to be collected before the statutory due date, while precautionary attachment is applied. For this reason, the existence of a freeze on an account for protective purposes is different from the definitive collection of the amount. At what stage the measure actually stands must be determined from the records obtained from the bank and the tax office.
Precautionary attachment can affect assets without waiting for the due date. A defense along the lines of “the due date has not yet arrived, so nothing can be done” is therefore not sufficient. The examination should be directed at the existence of the conditions for protection, the amount calculated and the scope of the attachment. If collection before the due date is alleged, the date and legal basis of the movement of money are investigated separately.
Within what time limit is an action filed against precautionary accrual?
Law No. 6183 Art. 20 provides that those against whom precautionary attachment is applied on the basis of precautionary accrual may object to the ground and amount of the accrual under Art. 15. In this framework, the special 15-day period before the Tax Court is taken into account. If the attachment was applied in the presence of the person concerned, the date of application is relevant; if it was carried out in the person’s absence, the date of notification is relevant, in terms of the distinction in the starting point set out in the Law.
In the case of a measure learned of through a bank freeze, the time limit should not be calculated solely on the day the account was viewed. The attachment notice, the date of application and any separate notifications should be obtained. A dispute over the starting point should not be used as a reason for postponing filing the action.
If only precautionary accrual was notified, without attachment being applied
Article 20 of the Law regulates the special route that is based on attachment being applied following precautionary accrual. Where there is only an account or a notice of precautionary accrual, the definitive and enforceable nature of the measure and whether an action can be brought against it are assessed separately. It is incorrect both to treat every letter automatically as the start of the same 15-day route and to say that no application can be made at all.
In the statement of claim, the ground and amount of the precautionary accrual and the unlawfulness of the precautionary attachment are reasoned separately. If a normal tax assessment or payment order is subsequently notified, their own time limits for an action are monitored separately. An action brought against the protective measure does not replace an application against all subsequent measures.
How are a stay of execution and lifting against security assessed?
Filing an action against these protective measures does not lift the restriction on assets of its own accord. Under Article 27 of the Administrative Procedure Law (İYUK), a stay of execution may be requested by explaining manifest unlawfulness and damage that would be difficult to compensate together. Wrong taxpayer, a tax outside the scope, an unfounded provisional tax base or lack of competence can be documented as to unlawfulness; the bank freeze and its effect on compulsory payments can be documented as to damage.
Lifting the precautionary attachment against suitable security under Law No. 6183 Art. 16 is a different route from obtaining a stay of execution from the court. The limitations on the types of security in the Law must be observed. Lifting an attachment against security does not mean that the precautionary accrual has been annulled of its own accord or that the tax debt has been paid.
How is the provisional account corrected when normal accrual is made?
Law No. 6183 Art. 19 regulates the correction of the difference between ordinary accrual and precautionary accrual in line with the normal accrual. The Law contains conditions for the examination and acceptance of the declaration and for the dispute becoming final. It provides that the declaration for the period subject to precautionary accrual is to be examined within two months at the latest from the date it is filed, and that the failure to carry out an examination does not delay the correction on that account.
If the normal accrual is lower, the reflection of the difference in the records and the scope of the related security are assessed. It should not be assumed that the bank or land registry restriction has actually been lifted merely by correcting the accounting entry. The letters sent to the relevant registry and the bank, and the latest position, are checked.
If an annulment decision is given, the scope of the decision, other grounds for protection and other measures that remain in force are examined separately. As regards litigation costs, the cost of security or claims for damage, documents and an assessment of causation are required. The possibility of appeal (istinaf) and cassation (temyiz) is likewise determined according to the type of decision and the conditions of the current appeal route.
Conclusion
Precautionary accrual is a measure aimed at protecting certain receivables that have not yet accrued in the ordinary manner, and its ground and calculation must be capable of being reviewed. An effective legal review addresses together the statutory ground, the type of tax, competence, the tax base, and the dates of attachment and notification. Correction after normal accrual and the actual lifting of the attachment are also complementary stages of the process.

Frequently Asked Questions
Does precautionary accrual mean that the tax debt has become final?
No. A provisional accrual made for protective purposes does not produce all the consequences of the ordinary tax process. See the section “How does precautionary accrual differ from normal accrual?” Related explanation
Is the time limit for an action on precautionary accrual 30 days?
Where precautionary attachment has been applied on the basis of precautionary accrual, the special 15-day period under Art. 20 and Art. 15 is important. The distinction in the starting point in the section “Within what time limit is an action filed against precautionary accrual?” should be observed. Related explanation
If the tax is not yet due, can a bank account not be frozen?
Collection before the due date and precautionary attachment are different. The Law makes the protective measure possible once its conditions are met. The section “Is the amount accrued precautionarily collected immediately?” explains this distinction. Related explanation
When security is provided, is the precautionary accrual also annulled?
No. Lifting the attachment against security and annulling or correcting the accrual are different measures. See the section “How are a stay of execution and lifting against security assessed?” Related explanation
