Summary

If the municipality does not act on illegal construction: the application, the 30-day implied rejection and the annulment action. Permit supervision and the demolition process are distinguished.

If the municipality does not examine an allegation that a structure was built without a permit or in violation of its permit and annexes, or does not take the necessary steps, a written application requesting a specific action can be filed. If the request is rejected, expressly or by failure to respond within the statutory period, it can be brought before the administrative court, provided the conditions are met. A complaint to CİMER (the Presidential Communication Center), a request for information from the municipality and an administrative lawsuit do not replace one another. One should not expect the construction to stop on its own, or the court to impose a fine directly in place of the municipality.

For which structures can intervention be requested from the municipality?

Article 32 of Zoning Law No. 3194 (İmar Kanunu) regulates the inspection and enforcement process for structures begun without a permit or built in violation of the permit and its annexes. However, not every minor piece of work requires a permit; statutory exceptions, the type of use, the nature of the structure and the relevant plan provisions must be examined. This is why a complaint should not be limited to the label "illegal construction."

Unpermitted structures and structures in violation of the permit

Lack of a permit means that the required permit does not exist. A violation of the permit, by contrast, means that the work goes beyond what the existing permit allows. Enclosing a garden left open in the project, adding a floor or moving outside the permitted position each require a different technical examination. An application concerning one of these does not necessarily mean that the others will be examined automatically.

If you consider the permit itself unlawful, the time limit for an action to annul the permit must be protected separately. Requesting an inspection of illegal work from the municipality does not automatically restart a litigation period that has already expired for the earlier permit. The new work identified on site and the legal review of the earlier permit can be planned together.

Emergencies concerning structural safety

In situations such as the danger of collapse, an excavation affecting the neighboring building or materials falling onto the road, it is not appropriate merely to wait for an answer to an ordinary petition. The location and nature of the danger must be reported without delay to the emergency services and the competent administration. No one should enter a place posing a risk to life safety in order to collect evidence.

The provisions of the Zoning Law on the safety of buildings and the environment, and Article 39 on structures dangerous to the point of requiring demolition, differ in several respects from the process for unpermitted structures. That a structure holds a permit does not remove the need to take measures against danger. If an application concerns both a zoning violation and a concrete safety risk, each should be explained separately.

How is a complaint about illegal construction prepared?

The purpose of the application is not merely to report a matter but to make the administration reach a decision that can be reviewed. The province, district, neighborhood, address, block and parcel (ada and parsel) details of the property, the work complained of, the date it was first seen and whether it is still continuing should be stated. The applicant should also explain the effect on their own property or use.

What requests should the petition contain?

One may request an on-site inspection, a comparison with the permit and the approved project, the application of the statutory measures by the competent authority if a violation exists, and notification of the result together with its reasoning. Rather than asking the administration to impose a fine of a particular amount, it is more appropriate to request that the authority be exercised as the established facts require.

The annexes to the application may include dated photographs, earlier petitions, replies, permit information if available, and a technical opinion. A rumor that no permit was ever issued should not be written as if it were certain information. Known facts should be separated from the matter requested to be investigated; unnecessary personal information about third parties should not be added to the file.

How do I prove that the application was received?

The record number of the incoming document, a receipt, the electronic application record or the details of a properly made submission should be kept. An oral conversation may be insufficient to show on what date the municipality received the request for action. If the application is referred to another unit, the referral and the records showing that it reached the competent unit should also be followed.

The legal effect of a notification made through CİMER is assessed according to its content and whether it reached the relevant authority. The name of the platform alone is not a guarantee that stops the litigation period. Nor is a reply to a request for information always a final decision on the request to impose zoning sanctions.

What must the municipality do once it identifies illegal construction?

Under Article 32 of the Zoning Law, when a violation is identified, the state of construction at that moment is determined; the structure is sealed and the construction is stopped immediately. The statutory notification method for the stop-work record is applied. The record should set out, in an understandable way, which part of the structure is in violation and for what reason.

Is the one-month period awaited in every case?

The law gives the owner of the structure at most one month to obtain a permit or to remedy the violation and request the removal of the seal. However, for structures determined to be incapable of being brought under a permit or of having the violation remedied, it is possible that this period is not awaited, as the law provides. The statement "in every case the municipality can do nothing for one month" is not correct.

At the end of the period, if the conditions have been met, the demolition process is carried out by decision of the relevant board. A document submitted later by the owner does not end the whole process without examining whether the document actually remedies the violation. Where an older document is relied on, its scope, validity and applicability to the existing work are investigated.

Does the structure become lawful if the fine is paid?

The zoning fine and the legal status of the structure are separate matters. Payment of the fine does not by itself turn unpermitted work into permitted work. Demolition and fine decisions are also subject to different conditions and examinations of the addressees. A complainant's learning merely whether a fine has been issued does not show that the violation has been remedied.

Under certain conditions, the law also allows the Ministry to exercise its demolition authority. The two-month and six-month thresholds in Article 32 are not periods that the complainant must necessarily wait out before filing a lawsuit. Nor can the Ministry's involvement be presented as an automatic result that will occur on the same date upon every report.

When is a lawsuit filed if the municipality does not respond?

If a request for a new administrative act or action falls under Article 10 of the Administrative Procedure Law (İYUK), failure to respond within thirty days is deemed a rejection. From that date, an application to the administrative court becomes possible within the general period for filing an action. The general period is sixty days; the nature of the application and any special provision are examined separately.

What happens if a non-definitive reply arrives?

If a non-definitive reply such as "the review is ongoing" is given within the first thirty days, the applicant may treat it as a rejection and file a lawsuit, or may wait for the definitive reply. The waiting period cannot exceed four months from the date of the application. The administration's providing information at irregular intervals does not create an unlimited right to wait.

The late-reply rule in Article 10 also matters depending on the state of the file. On the other hand, if the removal of an existing act is requested, the rules of Article 11 on suspension of the period may come into play. Applying a single "thirty plus sixty days" calculation to all applications without making this distinction may be wrong.

Does filing the petition again renew the period?

Repeating the same request on the same facts does not by itself revive a period missed against the earlier rejection. If there is genuinely new work, a new act or a changed legal situation, it may be assessed separately. Rather than multiplying petition dates, the file should show which request ended with which reply or silence.

What is requested from the court in the petition?

The annulment of the administration's act rejecting the request for intervention, expressly or implicitly, can be requested. For an annulment action, the applicant's interest must be made concrete. The effect on the use or safety of the neighboring property, or on the conditions for construction in accordance with the legislation, is explained with the documents in the application and lawsuit file.

The court's task is to review the lawfulness of the administrative act. It should not be asked to take the place of the municipal executive committee (encümen) and directly impose a zoning fine, or to issue in the first instance a demolition act that requires an administrative decision. After an annulment decision, the administration is obliged to exercise its own authority lawfully in accordance with the decision.

Can a stay of execution be requested?

It can be requested if the conditions of Article 27 of the Administrative Procedure Law are met. However, a stay of execution of the rejection act and a stay of execution of a favorable permit issued for the structure do not produce the same results. It must be explained which act the requested protection targets and how the decision could be applied in the concrete case.

For ongoing damage arising under private law, an interim injunction and the preservation of evidence before the civil court may also be considered. These requests do not replace the administrative lawsuit. If different applications are pursued for the same event, the purpose, the addressee and the time limits of each file must be tracked separately.

Council of State decision: Can the rejection of an intervention request be challenged?

In the decision of the 6th Chamber of the Council of State (Danıştay) dated February 21, 2022, E.2021/9004, K.2022/1905, the dispute concerned the implied rejection of an application requesting the imposition of demolition and a fine on a neighboring structure. After the earlier stages of the proceedings, the decision annulling the rejection act was upheld.

The process recounted in the decision shows the distinction between reviewing the rejection of an administrative request and asking the court to establish demolition and fine acts directly. This affirmance does not mean that every complaint will necessarily end in demolition. The information on legal remedies belonging to the earlier procedural stages in the text should not be carried directly over to current files.

Can compensation be claimed because of the municipality's inaction?

If there is concrete damage, an unlawful service conduct of the administration and an adequate causal link, a full remedy action may be considered. However, it cannot be said that all damage caused by a neighboring construction will automatically be recovered from the municipality. The grounds of liability of the owner of the structure, the contractor and the administration are investigated separately.

Whether the damage arises from an administrative act or from an administrative action or deficiency in carrying out the service matters for the time limits and the prior application. For damage from actions under Article 13 of the Administrative Procedure Law, the requirement of applying to the administration within one year from learning of it, and in any case within five years from the action, comes into play. These periods should not be used as a single compensation calendar applicable to every permit dispute.

Conclusion

An application against a municipality's inaction in the face of an allegation of illegal construction should clearly show the concrete violation and the inspection requested. The application record, the reply and the periods of silence must be preserved; the annulment of the rejection act, the annulment of the permit and private-law claims must be kept apart. In the case of urgent danger, safety measures and the preservation of evidence should not be left to the outcome of the ordinary petition process.

Frequently Asked Questions

Is an oral notification to the municipality sufficient?

An oral notification can be made; however, a registered written application is important for proving the content and the date of the application. An urgent danger must in addition be reported without delay.

Does a CİMER complaint stop the construction?

Not by itself. An act of the competent administration or an enforceable court decision is required; the effect of a CİMER application on the time limit is assessed separately.

If the municipality does not respond within thirty days, is demolition required directly?

No. Under Article 10 of the Administrative Procedure Law, silence concerns the litigation route, as the application is deemed rejected. The conditions for sanctions concerning the structure are examined separately.

Does payment of the illegal construction fine end the complaint?

Payment does not by itself make the structure lawful. The remedying of the violation and, if applicable, the demolition process are assessed separately.

Can the court impose a fine in place of the municipality?

In an annulment action, the court reviews the lawfulness of the administrative decision. It does not take the administration's place and issue a zoning fine in the first instance.
