Summary

The correct route of challenge against business sealing and closure decisions, the limitation period, stay of execution and the conditions for resuming operations.

The route of challenge against a municipality’s sealing of a business is determined by the legal basis of the closure decision. Closure for unlicensed operation, enforcement of a license cancellation and a ban on operating for a fixed period are not the same measure. An annulment action and a stay of execution may come into play before the administrative court, whereas some misdemeanor sanctions require an application to the criminal judgeship of peace (sulh ceza hâkimliği). Filing a lawsuit does not, by itself, give the authority to reopen the business or remove the seal.

This article addresses how an operator should assess an existing closure measure. The rejection of an initial license application, the halting of construction by a stop-work record and seizure measures in a criminal investigation are subject to different legal regimes. The analysis is based on the legislation and decisions accessed on October 14, 2026.

The nature of the closure decision must be determined before the sealing record

The seal is the means by which a measure that prevents operation is carried out. If the claim of unlawfulness is built only on the document affixed to the door, the actual decision in the case file may be overlooked. The decision of the municipal executive committee (encümen), the license cancellation, the directorate’s letter, the inspection record and the physical sealing are related to one another, yet each does not have the same legal function.

In the first stage, the date, number, addressee, field of activity, address and legal basis of the decision must be identified. Does the measure stop the whole business, the part used outside the license, or only the music broadcast? Has a fixed-term ban been imposed, or is operation blocked until the required permit is obtained? These questions change the competent court, the subject of the lawsuit and the request for interim protection.

Unlicensed operation and a deficiency in a licensed business are assessed differently

Article 6 of the Regulation on Workplace Opening and Operating Licenses prohibits opening and operating a business without a license obtained in due form. A tax registration, trade registry entry, chamber registration or a document obtained from another institution does not, as a rule, replace the business license. Having filed a license application is not in itself a permit to operate. [1]

By contrast, the later inspection of a business that has been granted a license is assessed separately. Article 13 of the Regulation, concerning sanitary businesses, provides for a one-time period of fifteen days to remedy the deficiencies and violations identified during inspection. This provision does not grant every unlicensed business an unconditional fifteen-day right to operate. The class of the business, special provisions and any concrete danger requiring immediate intervention must also be examined. [2]

The special rule for establishments open to the public must not be overlooked

Article 32 of the Regulation provides that places of rest and entertainment open to the public that are opened without permission are closed ex officio by the relevant unit of the competent authority, by sealing, with the reason established in a record. It therefore cannot be concluded in every case that “if there is no executive committee decision, the sealing is necessarily invalid.” The assessment of authority must be made on the basis of the type of business and the provision applied. [3]

Which court should be approached, and which time limit applies?

The expression “municipal act” alone does not identify the competent court. A petition template should not be chosen without examining the set of documents that determines the substance of the measure and any other sanctions applied together with it.

Nature of the measureApproach to the applicationCritical distinction
Administrative closure based on lack of a license or on license cancellationAs a rule, an annulment action before the administrative courtUnless there is a special period, the general limitation period is 60 days.
Fixed-term ban and fine under Law No. 1608The misdemeanor regime and the approach of the Court of Jurisdictional Disputes (Uyuşmazlık Mahkemesi) are examinedNot every ban decision belongs to the administrative judiciary.
Administrative sanction under the Environmental LawA special action before the administrative courtThe 30-day period in Article 25 of the Law is taken into account.
Suspension of work for occupational health and safety reasonsThe special route of application under Law No. 6331It is not the same lawsuit as a municipal license dispute.

The general administrative limitation period is calculated from the day following written notification. Electronic notification, defective notification, learning of the measure and direct enforcement of the measure are assessed separately. Not every petition to the administration suspends the limitation period. An application under Article 11 of the İYUK, made within the time limit and in compliance with its conditions, suspends the period in disputes where it is applicable; after thirty days of silence or after a rejection, the remaining period continues to run. It should not be assumed that a new application automatically restarts a limitation period that has already run. [4]

The 2026 jurisdiction decision on a one-day closure

In its decision of February 16, 2026, E.2026/25, K.2026/47, the Court of Jurisdictional Disputes (Uyuşmazlık Mahkemesi) considered together a fine imposed under Law No. 1608 for failing to comply with the occupancy limit and a one-day ban on operating. Relying on the nature of the fixed-term sanction, the Court found the ordinary judiciary competent. The decision did not establish that the closure was lawful on the merits; it resolved the question of which branch of the judiciary has jurisdiction. [5]

This example shows that, wherever a closure accompanies a fine, one cannot go to the administrative court by applying Article 27/8 of the Misdemeanors Law as a matter of course. It must be investigated whether there is in fact a separate decision falling within the jurisdiction of the administrative judiciary. In a first application under Article 27 of the Misdemeanors Law, the fifteen-day period is important; it must not be confused with the later period for objecting to the judgeship’s decision. [6]

How is the lawfulness of a closure decision reviewed?

Review of authority and procedure

It is established which body took the decision, who holds signing authority, the status of the business within municipal boundaries and, if any, the authority of a special administration. The enforcement officers’ duty to record and carry out measures is not confused with the authority to decide on a sanction; whether a special regulation directly grants authority to the relevant unit is also examined separately.

Where a period for remedying deficiencies must be given, it must be clear which violation the notification points to and what the operator is asked to correct. An abstract statement such as “there is a violation of the legislation” may not be suitable for remedying a technical deficiency. However, seeking the annulment of a closure by relying on a time-limit rule that does not apply to the operator does not make a strong defense either.

Factual situation, field of activity and proportionality

The difference between the activity stated in the license and the activity that was inspected must be made concrete. Holding occasional meetings in a restaurant is not the same fact as regularly operating a wedding hall. The layout of the venue, advertisements, reservations, the sound system, ticket or event records and inspection dates are assessed together.

The existence of a remediable violation in only one part of the business matters when considering whether the entire activity needs to be stopped. Conversely, if a fire, health or safety risk affects the whole business, a claim of economic loss alone does not make the closure measure unlawful. A proportionality defense should explain the scope of the risk and the more limited measure that is legally possible.

The license cancellation action and the sealing action must be followed together

If the basis of the closure is a license cancellation, objecting only to the sealing measure may be incomplete. The date of notification of the underlying measure, whether a lawsuit has been filed, any stay of execution decision and the outcomes of later appeals must be tracked in the same case schedule. Filing a lawsuit does not automatically stop the enforcement of a license cancellation.

In its decision of March 19, 2025, E.2024/2786, K.2025/1849, the Council of State (Danıştay) 4th Chamber examined the sealing of a business whose license had been cancelled for hosting weddings outside its restaurant license. After the judicial decision on the underlying license cancellation was reversed in another file, the decision was set aside so that the new legal situation arising in the sealing dispute could be assessed. This result does not directly mean that a license will be granted or that the closure is definitively annulled. [7]

The practical consequence is this: developments in linked files should be submitted to the court in good time. One should not rely on a decision taken in one file being reflected in the other automatically and in full.

With which documents is a request for a stay of execution supported?

In administrative justice, Article 27 of the İYUK requires both a clear unlawfulness and damage that is difficult or impossible to remedy. The application must explain both the defect of the measure and the concrete consequence of delay. Merely stating loss of turnover, or merely quoting legislation, is not adequate case preparation. [4]

Documents showing the conformity of the license and the activity, records of remedying deficiencies, technical conformity reports and the inspection record serve the review of unlawfulness; records on perishable stock, staff obligations, events that would be cancelled and the continuity of the business serve the review of damage. Trade secrets or customer information must be submitted without disclosing unnecessary personal data.

For measures whose effect will be exhausted once they are carried out, the possibility of a temporary stay without obtaining the defense is assessed within the statutory conditions. The court is not obliged to accept this request. Under the general regime, the period for objecting to a decision granting a stay of execution is seven days; special procedural exceptions are checked separately. The Article 27 regime of the İYUK cannot be transposed as it stands to a dispute for which the criminal judgeship of peace (sulh ceza hâkimliği) is competent. [4]

When is the seal removed, and how is the business reopened?

The lawsuit petition, a license application or the remedying of the technical deficiency does not remove the seal automatically. A written act and, where necessary, an on-site inspection must be requested from the competent authority. If there is a court decision, the operative part, the reasoning and the scope of enforcement are assessed together.

Under Article 28 of the İYUK, the requirements of an annulment or stay of execution decision must be carried out without delay and within the maximum period set by law. The thirty-day upper limit does not give the administration freedom to wait in every case. However, if there is a different valid ground for closure or an independent sanction, that too may need to be resolved. [4]

Removing the seal or acting contrary to the purpose for which it was placed may separately give rise to criminal liability under Article 203 of the Turkish Criminal Code (TCK). Objecting to an administrative act is different from continuing to operate in a sealed business. If perishable goods must be taken out, a security check carried out or essential maintenance performed, the limits of the measure should be set in writing with the competent authority. [8]

Which documents should the application file contain?

  • All closure and sealing documents and the decisions on which they are based.
  • Notification envelopes, electronic notification records and documents showing the date of learning.
  • The license, applications to change the activity and the administration’s replies.
  • Inspection records, dated photographs and technical conformity documents.
  • Records showing that the deficiency was remedied within the period given.
  • Linked license, fine and court files.
  • Documents of concrete damage for interim protection and, if any, compensation.

The petition must clearly identify the act whose removal or annulment is sought, and keep the distinction between the whole activity and a specific part of it. In an administrative case, the opposing party is the relevant administration that issued the act; it should not be assumed that the enforcement officers’ directorate is a separate legal entity. Court fees, postage, expert and attorney fee risks vary according to the route taken. Compensation for losses arising from the closure is not an automatic result of the annulment request and requires a separate claim and proof.

Conclusion

The most effective preparation for reopening a business is to identify, at the same time and correctly, the reason for closure, the competent judiciary and the underlying acts. Unlicensed operation, license cancellation and a fixed-term misdemeanor sanction should not be confused. An application made within the time limit, the remedying of technical violations and the follow-up of the proper enforcement of the court decision must be carried out together.

Frequently Asked Questions

Do I always go to the administrative court against a municipal sealing decision?

No. The competent court may vary according to the basis of the measure. In particular, where a fixed-term ban and a fine under Law No. 1608 have been applied together, the misdemeanor regime must be examined.

I have applied for a license; can I open my business?

Filing an application does not in itself create a permit to operate. The license regime to which the business is subject and any permit granted must be examined.

I have remedied the deficiencies; can I remove the seal myself?

No. The inspection and decision process of the competent authority must be followed. Removing the seal, or operating contrary to its purpose, may separately lead to a criminal investigation.

If the closure lasts one day, does a lawsuit become pointless?

The expiry of the period may not eliminate all legal effects. The measure should be examined with regard to repetition, damage and legal interest; the function of interim protection over time must also be assessed separately.

Does winning the license cancellation action remove all sanctions?

The basis of each sanction and the scope of the court decision are examined separately. A fine or another closure decision resting on an independent ground may not disappear automatically.
