An estate partition agreement is an agreement in which the heirs decide how they will divide the estate or specific assets of the estate. Under Article 676 of the Turkish Civil Code (TMK), the validity of the agreement depends on written form. The partition of immovable property is also covered by this rule; however, the validity of a written agreement and the completion of the entry in the land registry are separate stages. The participation of all heirs affected by the partition, accurate asset and share information, and workable delivery and payment provisions prevent disputes.
This article examines the formation of the agreement, its non-performance and claims of invalidity. Issuing a power of attorney abroad and using documents in Türkiye should be assessed separately, depending on the specific country and the representation document.
The difference between estate partition and transfer of an inheritance share
An inheritance passes to the heirs upon death; if there are several heirs, a community of heirs (miras ortaklığı) arises until the partition. In a house that belongs to the community, a specific room is not automatically set aside for each heir. The partition aims to end this community, either entirely or with respect to specific assets, by determining which asset is allocated to whom or how the sale price will be divided. [TMK Art. 599, 640, 676; Source 1]
| Transaction | Basic purpose | Points to note on form and result |
|---|---|---|
| Estate partition agreement | Allocating the assets of the estate among the heirs | Written form under TMK Article 676; the partition covering all the heirs concerned |
| Transfer of an inheritance share to one heir | One heir transferring his or her inheritance share to another heir | Written form under TMK Article 677; not the same transaction as the transfer of ownership of a specific immovable |
| Transfer of an inheritance share to a third party | Leaving the economic value of the share to a person outside the community | Execution by a notary (düzenleme); the third party does not directly become an heir or a participant in the partition |
| Agreement on an inheritance that has not yet opened | Reaching an agreement on the future inheritance of a person who is still alive | Special conditions of TMK Article 678; cannot be concluded like an ordinary partition agreement |
The real content of the transaction, not its name, is what matters. If an immovable is sold to an outside person under the heading “estate partition protocol,” the form rule granted to partitions among heirs cannot be carried over to every sale transaction. Where the community of heirs ended earlier, the immovable has turned into co-ownership in shares, or assets outside the estate have also been added to the agreement, the form to be applied should be re-examined.
Is the signature of all heirs required?
An agreement that partitions the entire estate requires the participation of all heirs. Partitioning a specific house also affects the rights of those who belong to the community of heirs in that house. If two siblings allocate the whole house to each other and leave out the third sibling, the third person’s share does not disappear. Whether there is a separate and valid transfer of a specific share is interpreted separately; not every document with incomplete participation automatically turns into a full partition agreement.
First, the current certificate of inheritance, civil registry records, the heirs of heirs who died later and, if any, appointed heirs should be identified. If an heir died before the agreement, the transaction cannot be carried out using only the name in the old certificate of inheritance. The chain of entitlement at the date of the agreement is investigated. Disclaimer of inheritance, renunciation, disinheritance, unworthiness and disputes over parentage can also change the persons who must participate.
In the file dealt with in the February 26, 2025 decision of the 7th Civil Chamber of the Court of Cassation (Yargıtay), docket (E.) 2025/492, decision (K.) 2025/1107, the participation of all heirs and proof by written document were discussed at the earlier reversal stage. In the last review, a discrepancy was found among the land registry record, identity numbers and dates of death concerning persons with the same name, and the decision was reversed because of insufficient investigation. The practical meaning of the decision is that verification must cover not only the number of signatures but also whether the signatories are in fact the rights holders in that immovable. [Source 4]
A minor, a person under guardianship or a represented heir
That an heir is a child does not mean that his or her mother or father can sign every agreement alone on the child’s behalf. If the parent is also an heir in the same estate, a conflict of interest may arise; a representative curator (kayyım) and, depending on the nature of the transaction, court permission are assessed. The partition of an inheritance by a person under guardianship is subject to the special rules on the permission of the guardianship authority. [TMK Art. 345, 426, 462; Source 1]
If the transaction is to be carried out by a power of attorney, whether the power of attorney covers the partition, the transfer of the relevant immovable, the acceptance of the price, settlement and, if necessary, other special authorities is checked separately. A general phrase such as “follow up my affairs” should not be regarded as sufficient for every disposition of property. The same attorney-in-fact representing heirs with conflicting interests also requires examination in itself.
How is written form satisfied? Is a notary mandatory?
For an estate partition agreement under TMK Article 676, the law requires written form; it does not require execution by a notary in every case. The signatures of the parties who undertake obligations and content that makes the partition determinable must be present. Although an ordinary written document may be valid, problems of proof may arise regarding identity, signature, date, annexes and the integrity of the pages. Notarial certification of signatures (imza onayı) and execution by a notary are different transactions. [Source 1–2]
An oral family meeting, an “okay” reply in a messaging app or an unsigned calculation table does not in every case take the place of the written agreement the law requires. For assets that have actually been partitioned and delivered, there is the possibility of a completed partition, which TMK Article 676 regulates separately. Its conditions are examined together with the registry and ownership rules, particularly for immovables; merely living in a place for years does not conclusively show that the entire estate has been legally partitioned.
Later amendment of the agreement is also assessed from the standpoint of form and participation. An immovable or price added later to a page is not deemed automatically accepted by the other heirs’ original signatures. It should be stated that the annexes are part of the agreement, and the pages and the parties’ signatures should be consistent. A blank sample found on the internet may not meet the burdens of the specific estate or the needs of the parties.
Which provisions should the agreement contain?
The partition text should not consist merely of the sentence “the house to A, the plot to B.” It should also determine under what conditions the allocation will be carried out:
- The identity of the decedent and of all heirs, the basis of heirship and the representation documents.
- The province, district, neighborhood, block, parcel and independent unit details of the immovables; a determinable description of vehicles, accounts and other assets.
- Who receives which asset or share, and whether the agreement covers the entire estate or specific assets.
- The valuation date and method, the equalization payment, the maturity, the payment account and the relationship between payment and registration.
- Existing mortgages, attachments, leases, usufruct and use rights, and who will bear them and how.
- Delivery of keys and possession, rental income, expenses, dues, taxes and costs, and from what date they belong to whom.
- The path to be followed for missing or later-discovered assets, debts and unperformed obligations.
The parties are not obliged to receive assets of economically equal value; however, the conditions of free will and entitlement must be preserved. A conscious acceptance of a difference in shares, a purpose of donation, and claims of mistake or exploitation (aşırı yararlanma) should not be confused with each other. General phrases such as “I waived all my rights” create a new dispute when they do not explain which rights are being settled.
An example for the price difference
Hypothetical example: A debt-free house passing to two equal heirs is worth 8 million Turkish lira (TL), and a plot of land is worth 4 million TL. If the person taking the house pays 2 million TL to the person taking the plot, each acquires a net 6 million TL. The calculation holds only if the accepted values are correct and there are no other debts or assets. If the payment maturity, the security and whether payment is made before or after registration are not written down, mathematical equivalence does not by itself secure performance.
Making the price payable in installments is possible; appropriate security and the consequences of default should be considered in return. Establishing a mortgage is separately subject to the required form at the land registry. Writing “there is a mortgage” in the agreement does not by itself create a mortgage in the register. If foreign currency, interest or a contractual penalty is to be agreed, the mandatory limitations and the type of transaction are examined separately.
How is land registry entry completed?
A valid partition agreement and the entry to be made by the land registry directorate (tapu müdürlüğü) are assessed separately. The land registry record, the inheritance documents, the capacity of the parties, the authority of representation, the form of the transaction and the special restrictions on the immovable are checked. It cannot be said that a single heir holding an ordinary written document can in every case obtain registration alone, without the intention of the others and the necessary basis for the transaction.
Article 20/1-c of the Land Registry Regulation (Tapu Sicili Tüzüğü) separately provides a route based on a contract executed by a notary that includes authority to register. In a written agreement made among heirs whose signatures have not been notarized, the application of all heirs is required; if some have been notarized, the application of the persons whose signatures have not been notarized is required. That written form suffices for the validity of the agreement therefore does not, on its own, answer the question of who must apply at the land registry. [Source 7]
The heirs may perform their obligations and take part in the land registry transaction. If there is an heir who does not take part, a claim for registration arising from a valid agreement is asserted by an action suited to the specific claim. The court examines the correct identification of the immovable and the shares, party standing, the validity of the agreement and the status of the counter-performances. Where a monetary debt and the obligation to register are linked reciprocally, whether registration can be demanded without payment or security also matters.
Agricultural land, zoning and subdivision (ifraz) requirements, condominium ownership, the acquisition of immovable property by foreigners and protection statuses cannot be set aside by an agreement among the heirs. A plot physically drawn into two does not become two independent parcels unless the requirements for administrative division are met. These limitations should be investigated before the agreement is signed. [TMK Art. 705–706; Source 1]
The special effect of a mediation agreement
In disputes concerning the partition of movable and immovable property and the dissolution of co-ownership, applying to mediation before filing an action is a procedural prerequisite. Whether claims for cancellation of the agreement, receivables or land registry entry fall within this scope is assessed according to the real nature of the claim; not every inheritance-related action is automatically bound by the same rule. [Law No. 6325 Article 18/B; Source 3]
If an agreement on the transfer of immovable property is made in mediation, obtaining an enforceability annotation is mandatory. The civil court of peace at the place where the immovable is located reviews the agreement, the limitations and the procedure. After the annotation, one of the parties may request registration from the land registry directorate; the directorate conducts its statutory review, and under the special route in Article 18/B the transaction can be carried out without an official deed being drawn up. This possibility is not valid for every family protocol signed privately.
In legal scholarship, it is emphasized that, in resolving partition disputes through mediation, the content of the agreement and the feasibility of its implementation must be addressed together. The work of Özge Yenice Ceylan examines the procedural dimensions of mediation as a procedural prerequisite in the dissolution of co-ownership. An agreement that identifies the parties or the immovable incompletely creates difficulty in implementation even if a settlement seems to have been reached. [Source 5]
What claims can be asserted if the agreement is not performed?
First, it is determined which obligation was breached: failing to take part in the transfer at the land registry, failing to pay the equalization payment, failing to deliver the asset, or the emergence of a concealed debt give rise to different claims. Specific performance, cancellation and re-registration of title, receivable, delivery, damages caused by default or, if the conditions are met, the options of rescission of the contract are assessed together. Not every dispute is filed under the name “cancellation of the estate partition agreement.”
If the claim is aimed solely at carrying out the partition, the civil court of peace is the court; for contested contractual receivables, invalidity or registration claims, the general rules on subject-matter jurisdiction apply and the civil court of first instance often comes into play. The rules of exclusive territorial jurisdiction, such as Article 12 of the Code of Civil Procedure (HMK) for claims concerning rights in rem in immovable property and HMK Article 11 for related disputes among heirs before partition, are examined according to the nature of the specific action. Filing an action only in the city where the decedent died is not sufficient. [Source 6]
The agreement, annexes, earlier drafts, payment records, bank descriptions, land registry and inheritance documents, representation documents and lawful correspondence are kept together. If the signature is denied, the original document and comparison signatures become important. The expectation of proving, by witnesses alone, the existence of an agreement for which the law requires written form may meet an evidentiary bar.
Invalidity, cancellation and time limits
Lack of form, absence of a signature or of authority, violation of a mandatory rule, and mistake, fraud and duress are not the same legal ground. When the consequences of non-compliance with form are assessed, a claim of abuse of rights is also treated within the specific relationship of performance and trust; this exception does not make written form unnecessary in general.
In mistake, fraud and duress under Article 39 of the Turkish Code of Obligations (TBK), the one-year period for declaring that one is not bound by the contract (bağlı olmama), which starts from the moment of discovery or the end of the duress as determined by law, is important. For exploitation (aşırı yararlanma), TBK Article 28 contains different starting points and one-to-five-year limits. For receivables arising from the contract, the relevant statute of limitations, the due date and the grounds of interruption are examined; the general ten years in TBK Article 146 cannot be used as the sole period limiting every claim of invalidity. [Source 2]
It should not be assumed that claims for the protection of ownership, for registration and for refund of the price are subject to the same period. If the immovable has been transferred to a third party, protection of reliance on the register and a debate on bad faith may arise. Where there is a risk of transfer, an interim injunction may be sought under the conditions of prima facie proof, proportionality and security; merely filing an action does not automatically prevent transactions at the land registry.
Estate debts and assets found later
The heirs’ saying among themselves that “all debts belong to the person who receives the house” does not automatically release the other heirs in the external relationship without the creditor’s consent. TMK Article 681 regulates the joint and several liability that continues after the partition. The expiry of the five-year period is not the same as the debt disappearing entirely; the joint liability provided by law ends. If the debt falls due later, the starting point changes accordingly. The right of recourse in the internal relationship is assessed separately. [Source 1]
For a bank account or immovable found later, the scope of the agreement is examined. That only the listed assets were partitioned does not mean that all unknown assets were also left to one heir. An additional partition agreement or an appropriate judicial route may be required. The existence of a concealed asset does not, on its own, automatically render the whole agreement void; defects of consent, accounting and restitution claims are examined separately.
Conclusion
The reliability of an estate partition agreement rests on the participation of all rights holders, the form required by law, determinable assets and prices, and land registry transactions that can be completed. Examining identity, the land registry chain and debts before signing, and regulating payment and delivery clearly, reduces later actions. If a dispute arises, the breached obligation and the desired result should be identified first, and then the right court and time limits should be chosen.

Frequently Asked Questions
Must an estate partition agreement be made before a notary?
For an estate partition agreement under TMK Article 676, written form is sufficient. However, the fact that the transaction is in reality a sale or a transfer of a share to a third party, as well as representation and land registry transactions, may require different form rules.
If one heir does not sign, can the others partition the whole house?
The right of the person who does not sign in the community of heirs cannot be eliminated. Whether the document creates a separate share transfer among those who signed is examined separately.
Can a single immovable be partitioned?
Yes, only specific assets of the estate can be partitioned. The scope of the agreement must be clear, and all heirs whose rights in those assets are affected must take part.
Does the agreement change the land registry automatically?
No. Validity and land registry entry are separate stages. The necessary land registry transactions, an appropriate court decision or the special registration route of a mediation agreement must be completed.
Can one party apply to the land registry with a mediation agreement?
For an agreement that meets the conditions of Law No. 6325 Article 18/B, one of the parties can apply after the mandatory enforceability annotation has been obtained. The land registry directorate’s statutory review continues.
Can the mother or father sign on behalf of a child heir?
Representation and conflict of interest are examined. Where the parent is also an heir, a curator (kayyım) and, depending on the transaction, court permission may be required; an ordinary parental signature is not sufficient in every file.
Can an heir who later regrets it cancel the agreement?
Regret alone is not a ground for cancellation. There must be invalidity, a defect of consent or another legal ground, together with the applicable time limit and evidentiary conditions.
What happens if the equalization payment is not made?
By examining the provisions on maturity, default, reciprocal performance and security, a claim for the receivable or for performance is asserted. Failure to pay does not in every case automatically result in the land registry returning to its former state.
After the partition, can an estate creditor turn to the other heirs?
If the creditor has not consented to the division or transfer of the debt, the joint and several liability under TMK Article 681 may continue. The heirs’ internal agreement alone is not sufficient against the creditor.
Are all inheritance partition actions heard in the civil court of peace?
No. The rules on subject-matter jurisdiction for partition and dissolution of co-ownership, and for contractual receivable, invalidity and registration actions may differ. The claimed result and the legal ground are assessed together.
