CIVIL LAWSUITS / PROCESS GUIDE
How does it proceed, step by step?
The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.
The commercial nature of the matter, the parties, the contract, the commercial books and the competent court are determined.
The scope of mediation as a condition precedent to litigation and special routes such as an arbitration agreement, if any, are assessed.
The case is filed through the appropriate route; the petitions and preliminary examination are completed according to the written or simplified procedure that applies.
Commercial records, payment documents and, if necessary, a court-appointed expert examination are assessed.
The decision, the available legal remedy and the enforcement/collection stage are followed.
