Residence permits for foreigners of Turkish descent in Türkiye: who is recognized as of Turkish descent, and how is an application made?
There is no single general definition of "of Turkish descent" in one law, valid for all procedures and listing all communities. The scope depends on the legal basis of the application.
In which legal procedures does Turkish descent matter?
| Procedure | Main legal basis | Effect of Turkish descent | Is there an automatic right? |
|---|---|---|---|
| Special work permit | Law No. 2527 and the Regulation | Members of the designated communities may apply for certain professions reserved for citizens, subject to other conditions | No |
| Admission as an immigrant | Law No. 5543 on Settlement | Being of Turkish descent and attached to Turkish culture is one of the basic elements of admission as an immigrant | No |
| Admission and settlement of Ahıska Turks | Law No. 3835 | Provides a special admission, settlement and citizenship process for designated Ahıska Turks | No |
| Long-term residence | LFIP (YUKK) Arts. 42–45 and special decisions | The general rule is eight years; a special condition set by the Ministry or a historical community decision may apply | No |
| Turkish citizenship | Law No. 5901 | May be relevant to admission as an immigrant or to an exceptional assessment | No |
| Blue Card | Law No. 5901, Art. 28 | A separate status for persons who were Turkish citizens by birth and left with permission, and for the descendants named in the law | Not the same institution as Turkish descent |
Is a "foreigner of Turkish descent" the same person as an "immigrant"?
Not always. Law No. 5543 defines "immigrant" by reference to persons who are of Turkish descent and attached to Turkish culture, and who come to Türkiye in order to settle and are admitted under the law. A claim of Turkish descent does not mean that the person automatically acquires immigrant status; an admission procedure is required.
Law No. 5543 contains different categories such as free immigrant, resettled immigrant, individual immigrant and group immigrant. For an individual free-immigrant application, the reference of a first- or second-degree relative who is a Turkish citizen in Türkiye may arise, or the person may apply in person to a foreign representation. Group admission rests on a special legal basis, such as an agreement or a Presidential decision.
Are all Turkish communities in an equal position?
No. Ethnic, historical or cultural closeness alone does not give all communities the same right to residence, work or citizenship. Status may differ for the following reasons:
- There is a special law for a particular community.
- A special administrative decision has been issued containing an entry date and a final application date.
- The application is for work permit or admission as an immigrant, rather than for residence.
- The person's country of citizenship, reason for coming, and ethno-cultural position in relation to the majority in that country.
- Security, public order, diploma equivalence, professional competence or the conditions of lawful stay.
General legal map by community or situation
| Community or situation | Verifiable special legal source | Result in practice |
|---|---|---|
| Ahıska Turks | Law No. 3835; Law No. 5543; special long-term residence decisions on certain dates | A special possibility of admission and settlement exists; quota, decision, entry date and documentary conditions are examined |
| Turks from Bulgaria | Past migration and citizenship arrangements; special long-term residence decision of 2017 | The 2017 announcement had entry and final application dates; it cannot be interpreted as a permanent general right |
| Western Thrace Turks / certain persons who lost Greek citizenship | Special long-term residence decision of 2017 | The period and group of persons are limited; the current basis for application is separately confirmed |
| Uyghur Turks | Special long-term residence announcement of 2019 and file-based foreigners' law procedures | The announcement had an entry-date condition; the current possibility of application is verified through present administrative admission |
| Crimean Tatar Turks | Special long-term residence announcement of 2022 and the Determination Commission process | Lawful entry, identity and descent documents and commission review may be required; current admission status is confirmed |
| Syrian and Iraqi Turkmen | LFIP (YUKK), temporary protection / international protection or individual residence; any special decision | Turkmen identity alone does not create a direct right to long-term residence for all persons |
| Turkic-speaking citizens of Uzbekistan, Kazakhstan, Kyrgyzstan, Azerbaijan, Turkmenistan and other states | General LFIP (YUKK), work and citizenship legislation; any person- or community-specific decision | Being in a Turkic-speaking or cultural environment of the country of citizenship does not automatically create a right under Law No. 2527 or to long-term residence |
| Persons born as citizens of the Turkish Republic of Northern Cyprus (KKTC) | Special notification route in Law No. 5901 | Assessed under a separate and more specific citizenship regime, distinct from the Turkish descent debate |
| Blue Card holders | Law No. 5901, Art. 28 | A special status linked to former citizenship and descent, not Turkish descent of foreign origin |
Core conclusion: Naming a person by community is only a starting point. Legal consequences require the type of procedure, the current decision and the individual document file.
How are current, historical and repealed regulations distinguished?
| Regulation | Current status | Function in the file |
|---|---|---|
| Law No. 2527 | In force | Work and certain professional regime of foreigners of Turkish descent belonging to designated communities |
| Law No. 5543 on Settlement | In force | Regime of admission as an immigrant, free and resettled immigration, and placement |
| Law No. 3835 | In force | Special regime for persons to be admitted to Türkiye from Ahıska Turks |
| Law No. 2641 | Repealed in 2007 by Law No. 5637 | May be used in historical files relating to certain Turkish-descent immigrants from Afghanistan; it is not a current general application route |
| Law No. 2510 on Settlement | Repealed in 2006 by Law No. 5543 | May be the historical basis for earlier admission and settlement procedures |
| Community announcements of 2017, 2019 and 2022 | Administrative practices limited to persons, an entry date and an application period | Cannot be used as a permanent statutory exemption open to all Turkish descendants |
Former legislation may explain the legal basis of an admission or citizenship procedure completed in the past. However, a new and general right of application cannot be derived today from a repealed law.
What changed in Law No. 2527 in 2025?
Presidential Decision No. 10476, published in the Official Gazette of 10 October 2025, No. 33043, made a significant amendment to the Regulation on the Free Practice of Professions and Arts in Türkiye by Foreigners of Turkish Descent. The added provision provides for the designation by Presidential decision of the communities falling within Law No. 2527, and requires several conditions to be met together for the special work regime.
What are the current conditions under Law No. 2527?
For the application to be assessed under the current Regulation, the following conditions in particular are examined together:
- Being granted a residence permit by the Ministry of Interior.
- Proving professional or artistic competence with documents issued by Turkish authorities.
- Completing the necessary equivalence procedures for diplomas obtained abroad.
- Having no obstacle from the standpoint of national security.
- Being registered in the foreigners' register.
- Fulfilling the requirement of registration with a professional organization, where one exists.
- Having the necessary equivalence or competence certificate for activities of craftsman or artisan nature.
- Belonging to the community designated by Presidential decision.
- Being unable to practise one's profession or art in the country of citizenship for reasons beyond one's control, and being obliged to sustain one's life in Türkiye.
- Having an ethno-cultural identity different from the overwhelming majority of the population of the country of citizenship.
These conditions show that Law No. 2527 is not "a general freedom to practise any profession open to every foreigner who speaks Turkish". Based on the Official Gazette and official institutional publications accessible as of 1 September 2026, no publicly available consolidated Presidential decision listing all the communities covered under the new regulation could be identified. This phrase does not mean that the decision does not exist at all. Before an application, the relevant decision should be searched in the Official Gazette archive and, where necessary, written information should be requested from the International Labour General Directorate.
How does the 10 October 2025 amendment affect earlier permits and pending applications?
Presidential Decision No. 10476 contains no special transitional provision and entered into force on the date of publication. Accordingly, new applications decided after 10 October 2025 and extension applications must take account of the current conditions. The amendment does not render invalid work permits that were duly granted earlier and remain valid merely because they were granted before publication. However, extension is a separate administrative assessment; a previous admission does not create an automatically acquired right or a guarantee of extension in the new period. The grounds for cancellation and termination also apply separately.
How can "inability to practise one's profession in one's country" and "a different ethno-cultural identity" be proved?
The Regulation does not give a closed list of evidence. The following framework is not a statutory list of documents; it is an evidentiary structure that may help make the conditions concrete:
| Condition | Evidence that may be examined in the file |
|---|---|
| Inability to practise the profession or art in the country of citizenship for reasons beyond the person's control | Refusal or cancellation of a professional licence, termination records, discriminatory legislation or administrative practice, official correspondence, reliable country information and person-specific incident documents |
| Obligation to sustain one's life in Türkiye | Family unity in Türkiye, lawful status and long-term life, health, education or employment connections; personal conditions making return factually or legally impossible |
| An ethno-cultural identity different from the overwhelming majority of the population of the country | Identification or admission documents of Turkish authorities, population and family registers, earlier immigrant or settlement files, reliable historical and administrative records |
An association letter, the person's own declaration or a foreign representation document may explain the file; however, it may not on its own satisfy the requirement under the Ministry's current application of Law No. 2527 for a document from a Turkish official authority. The fact that a procedure was previously carried out under Law No. 2527 is also strong evidence; however, it should not be assumed that it automatically replaces the current community-decision condition in Articles 2/A and 3/8 of the Regulation.
How do Law No. 2527 and Law No. 6735 on International Labour Force operate together?
Law No. 2527 regulates a special possibility of practising professions reserved for citizens under certain conditions; Law No. 6735 sets out the framework of application, assessment, duration, objection and judicial review for work permits. Article 16/1-c of Law No. 6735 allows the Ministry of Interior or the Ministry of Foreign Affairs to grant exemption, in some articles, to persons notified as being of Turkish descent. The word "may be granted" does not mean an automatic exemption for everyone or a right to work without a work permit.
Domestic applications are made by the employer through the e-İzin system; applications abroad are started at a Turkish foreign representation and completed by the employer. In fields such as health and education, prior permission, equivalence or licensing under the professional legislation and the opinion of the relevant institution are also required. The usual assessment period for complete applications is thirty days. Against a refusal or cancellation of a work permit, an online objection may be made to the Ministry within thirty days from notification; after the objection is rejected, the route of administrative judicial review is open.
Is Law No. 2527 a work permit exemption?
No. The special provision of Law No. 2527 allows foreigners of Turkish descent, who meet the conditions, to carry out professions and arts that are closed to foreigners; it does not remove the obligation to hold a work permit. The application is made to the Ministry of Labour and Social Security, and the opinions of the relevant institutions may be obtained.
For the conditions and documents of a general work permit application, reference may be made to our article conditions for a work permit and the application process.
Can every profession be practised?
No. The following limitations apply together:
- Diploma, equivalence, internship, licence and chamber registration conditions in the special law governing the profession.
- Limitations concerning public service, security or the Turkish Armed Forces.
- Permission under Law No. 2527 and the Ministry's assessment.
- Approval of the competent institution for regulated professions such as health, law, engineering and similar professions.
Law No. 2527 does not confer political rights. Although registration with a professional organization may be possible, it does not produce full equality with citizens in relation to organ elections and political rights.
What additional limits apply to regulated professions and public service?
| Field | Main layer to be checked beyond Law No. 2527 |
|---|---|
| Health professions | YÖK equivalence procedures, prior permission or registration with the Ministry of Health, and the conditions in the professional law |
| Education | Prior permission from the Ministry of National Education or YÖK, equivalence and institutional legislation |
| Legal profession | Equivalence of the law diploma, internship and bar procedures; current special legislation |
| Engineering and architecture | Diploma equivalence, chamber membership and licence, and rules on authority to sign projects |
| Certified public accountancy and financial advisory | Professional law, examinations and internship, and TÜRMOB and chamber procedures |
| Tourist guiding | Professional law, Ministry and professional association conditions |
| Employment in a public institution | Vacancy announcement and post, special law, security and appointment conditions; Law No. 2527 alone does not give a right to appointment as a civil servant |
| Turkish Armed Forces and security organization | Outside the scope of Law No. 2527 |
This table is illustrative. The list of "professions reserved for Turkish citizens" and the professional legislation must be checked again on the date of application. The possibility under Law No. 2527 of registration with professional organizations does not by itself grant general assembly or election rights, or political rights.
How is Turkish descent proved?
The method of proof depends on the status applied for. It should not be assumed that there is a single uniform "Turkish descent certificate" with the same effect in all institutions.
Proof for work permits under Law No. 2527
According to the current statement of the Ministry of Labour and Social Security, Turkish descent must be demonstrated with documents obtained from Turkish official authorities. A document obtained from the embassy or consulate of a foreign state is not, on its own, the document accepted by the Ministry in its assessment of a work permit under Law No. 2527.
Depending on the type of procedure, the following sources may be examined in the file:
- A descent or community identification document issued by a competent authority or commission in Türkiye.
- Population and citizenship records, an immigrant file or archive document.
- An official record showing the scope of an earlier admission, settlement or special decision.
- Diploma, equivalence, licence and professional organization records.
- Residence permit, foreigner identity number and foreigners' register documents.
Proof in residence or immigrant admission
Where a special residence decision applies, documents expressly listed in the announcement may be requested: birth certificate, family population register extract, record of nationality or descent, passport, record of entry into Türkiye, residence card or a commission identification document. In admission as an immigrant under Law No. 5543, a different chain is formed by the foreign representation, the Ministry of Interior, the Presidential decision and the relevant admission file.
For foreign documents, an apostille or a consular legalization chain and a notarized Turkish translation may be required, depending on the country in which the document was issued. An apostille certifies the signature and official capacity, not the accuracy of the content of the document.
Is an association letter sufficient?
Letters from kinship associations or civil society organizations may be a helpful supporting document explaining the file. However, where the law or a current administrative decision requires an official authority's determination, such a letter is not, on its own, a binding admission document.
How are differences in name, surname or date of birth resolved?
Names may change because of a different alphabet, marriage, divorce, change of citizenship or transliteration. Before an application, an "identity matching table" should be prepared for all documents:
| Document | Registered name / surname | Date and place of birth | Document number | Reason for difference | Linking document |
|---|---|---|---|---|---|
| Passport | As per file | As per file | As per file | Explained where present | Relevant official document |
| Birth certificate | As per file | As per file | As per file | Explained where present | Passport / identity document |
| Former residence card | As per file | As per file | As per file | Explained where present | Former-new identity match |
Where necessary, an identity certificate of name, an apostilled marital status certificate, a court decision or an explanation from the competent authority is added to the file.
Which residence permit can a foreigner of Turkish descent apply for?
There is no general LFIP (YUKK) permit called a "Turkish-descent residence permit" in the name of a person of Turkish descent as such. The person applies for the type of residence that fits their concrete situation, or for a special decision where one exists.
General residence permit types
- Short-term residence permit.
- Family residence permit.
- Student residence permit.
- Long-term residence permit.
- Humanitarian residence permit.
- Residence permit for victims of human trafficking.
A work permit or a work permit exemption document may, as a rule, take the place of a residence permit within its period of validity. Work documents issued to persons applying for international protection, conditional refugees and persons under temporary protection are exceptions to this rule. Working and residence conditions are always checked separately in each case.
Can a foreigner of Turkish descent obtain a residence permit without waiting eight years?
General rule
Under Articles 42 to 45 of the LFIP (YUKK), a long-term residence permit may be granted indefinitely by the governorates, with the approval of the Ministry, to foreigners who have resided in Türkiye continuously for at least eight years on a residence permit or who meet the conditions set by the Ministry.
In the general application after eight years, the following conditions are required:
- No social assistance received in the last three years.
- Sufficient and regular income for the person and, if any, the family.
- Valid health insurance.
- Not posing a threat to public order or public security.
In calculating the period, half of the time spent on a student residence is counted and the whole of the time on other residence permits is counted.
Persons with the status of refugee, conditional refugee, subsidiary protection, humanitarian residence permit or temporary protection may not move directly to long-term residence.
Is there a general eight-year exemption for persons of Turkish descent?
No. The Ministry may set special conditions for certain communities and periods; however, Turkish descent alone is not a continuing and general eight-year exemption for all persons.
Why must past special decisions be used with care?
For example, in 2017, long-term residence opportunities announced for Ahıska Turks, persons from Bulgaria and certain groups linked to Western Thrace / Greek citizenship included date conditions such as entry before 1 January 2017 and applications up to 31 December 2017. The 2019 announcement on Ahıska and Uyghur Turks was also subject to a condition of entry before 1 January 2019. The announcement for Crimean Tatar Turks published in 2022 was based on a special determination process.
These announcements show the special administrative practice in the relevant period; they cannot be extended automatically to other communities or to later entries. In the current file, whether the application is still accepted should be confirmed in writing through the Provincial Migration Directorate, the Directorate General of Migration Management and the decision on which the application is based.
What rights does long-term residence give, and what does it not give?
The holder of a long-term residence permit may enjoy many of the rights granted to citizens, subject to exceptions such as military service, the right to vote and stand for election, entry into public service and the import of exempt vehicles, and the provisions of special laws. The permit is not Turkish citizenship and does not give a passport, political rights or an unconditional right to public service.
Being outside Türkiye for more than one continuous year for reasons other than health, education or compulsory public service in the country may lead to cancellation of the permit. A new application may be made after cancellation; current conditions are separately examined.
Does a long-term residence card alone give the right to work?
In current official practice, long-term residence should not be used as a document replacing a work permit. While the LFIP (YUKK) grants long-term residence holders rights close to those of citizens, Law No. 6735 provides for a separate application and assessment for an indefinite work permit; the e-İkamet explanations also state that a residence permit does not give a right to work. Some doctrinal views argue that the relationship between these two laws should be interpreted in the opposite direction. However, when a binding administrative act is involved, obtaining a work permit or a valid exemption is the safe and current route of practice.
Does being of Turkish descent make buying a home, renting or the closed-neighbourhood practice different?
Being of Turkish descent does not, on its own, provide a general exemption from the property purchase value requirement, from the other conditions of the type of residence, or from the closed-neighbourhood / address restriction.
- For a short-term residence application as a property owner, the current LFIP (YUKK) conditions and the value and housing criteria published by the administration are applied.
- Renting a home may be proof of accommodation depending on the basis of the chosen residence type; however, by itself it does not create a right to long-term residence.
- Closed areas and density policies for address registration may change through administrative announcements. A general exemption should not be assumed without an open and current special exception for the specific community.
- The right to acquire immovable property is subject to the Land Registry Law (Tapu Kanunu) and country- or person-based restrictions; Law No. 2527 does not grant a special privilege to acquire property.
How is an application made step by step?
Stage 1 — First determine the correct legal route
Before applying, the following options should be tested separately:
- Short-term, family, student or long-term residence under the LFIP (YUKK).
- A current and express special community decision.
- Free or resettled immigrant admission under Law No. 5543.
- The process specific to Ahıska Turks under Law No. 3835.
- A work permit under Law No. 2527.
- Citizenship under Law No. 5901: general, by marriage, exceptional or linked to immigrant admission.
If the wrong route is chosen, the application may be refused even if the correct documents are submitted.
Stage 2 — Prepare a status inventory for the person and the family
- Citizenship and any earlier citizenships.
- All dates of entry into and exit from Türkiye.
- Visa, residence, work, temporary protection or international protection history.
- The separate status of spouse and children.
- Restriction, entry ban, administrative fine or deportation decision.
- Differences in name, surname and birth record.
- Profession, diploma, equivalence and work history.
Stage 3 — Complete the document chain
For the general file, the following documents are assessed according to the type of application:
- Passport or travel document.
- Biometric photograph.
- Lawful stay and entry-exit records.
- Address and accommodation document.
- Income and health insurance.
- Criminal record certificate, where requested, in a properly obtained form.
- Official documents showing the descent or community link.
- Apostille or consular legalization, and a notarized translation.
- Marriage or birth certificates for spouse and children, and consent and custody documents.
- For 2527: documents concerning residence, professional competence, equivalence and the community decision.
What should persons with more than one citizenship do?
The applicant must disclose all current and former citizenships, passports and name changes. The application of the condition in the 2025 Regulation of "an ethno-cultural identity different from the overwhelming majority of the population of the country of citizenship" to a person holding more than one citizenship has not been resolved by an express special provision. For this reason, choosing only the passport that appears suitable for the application and concealing another citizenship may create a serious problem of trust. The links of the relevant countries and of the person's life and profession should be documented together; where there is doubt, a written opinion should be requested from the Ministry.
What can be done if documents cannot be obtained from the country of origin?
The fact that documents cannot be obtained because of war, occupation, risk of persecution, non-functioning state archives or statelessness does not mean that the document will not be required. The reasons for the impossibility should be documented, and an alternative proof should be built from earlier immigrant, settlement or citizenship files in Turkish authorities, family registers, earlier admission decisions and reliable country information. Because contact with the authorities of the country of origin may affect the person's protection claim in an international or temporary protection file, an individual legal risk assessment should be made before any consular contact.
Stage 4 — Complete the e-İkamet and appointment procedure
First and transitional applications are made through the official e-İkamet system of the Directorate General of Migration Management. The form should be completed in full, the appointment and application receipt should be kept, and only the official domains `goc.gov.tr` and `e-ikamet.goc.gov.tr` should be used.
The Directorate General of Migration Management states explicitly that it does not work with third parties who present themselves as official intermediaries in foreigners' procedures. Fake appointments, cards, insurance or "guaranteed residence" offers carry a risk of fraud and of personal data misuse.
Stage 5 — Manage the appointment, biometrics and missing-document process
The applicant generally attends the appointment in person. The administration may request additional information, an interview or fingerprints. If a missing document is identified, it must be completed within the period notified. According to official application statements, up to thirty days may be given to complete a missing document; if it is not completed in time, the file may be removed from processing.
A residence application is concluded no later than ninety days from the date on which the complete documents are submitted. Ninety days is not a "final approval period", but the statutory assessment period for a completed application.
Stage 6 — Comply with the exit and entry rules by means of the application document
An approved residence permit application document and fee receipts may allow exit and re-entry, on condition that the person returns within fifteen days each time. If an exit is made before the application has been approved, the general visa rules may apply. Before travel, it should be confirmed that the document has been validly issued by the Provincial Migration Directorate.
Stage 7 — Track the card, PTT and address procedures
The barcode number of the card can be learned from the YİMER 157 hotline or from the authorized provincial migration units. A card that cannot be delivered is returned to the Provincial Migration Directorate after the official retention period of PTT. Fixed expressions found on the internet, such as "if not collected in three days" or "automatic cancellation in thirty days", should not be used without a current official source.
If the address is changed during the period of residence, notification must be made to the relevant population and migration authorities within twenty working days. For holders of a humanitarian residence permit, there is also an obligation to register the address within twenty working days at the latest from the date the permit is granted.
How is access to the application and litigation file secured?
A dated list of documents and a receipt should be kept for every document submitted. In the case of refusal or cancellation, a complete and reasoned copy of the decision and the notification envelope or electronic notification record should be obtained. An application may be made under Law No. 4982 on the Right to Information and the personal data legislation; however, access may be restricted for reasons of security, third-party data or other statutory exceptions. An application for information or under the KVKK does not in itself stop the seven-, thirty- or sixty-day lawsuit or objection period.
In an annulment action, the court should be asked to obtain from the administration the procedural file and the information and documents on which the decision is based, under Article 20 of the İYUK. If the notification does not indicate the route and time limit for challenge, or if the person could not effectively learn of the decision, a dispute about the time limit may arise. Nevertheless, no automatic result should be assumed that "the time limit never starts because no translation was given"; the dates of learning and notification should be recorded separately as a precaution.
Do family members obtain the same right?
The spouse and children of a person accepted as of Turkish descent do not automatically acquire the same status in every procedure.
- If both spouses belong to the relevant community, each is assessed independently on their own evidence.
- A spouse who has no descent or community link may apply for a family residence permit, if the conditions are met.
- Adult children must in most cases show an independent basis for residence.
- For minor children, the birth certificate, custody and the consent of the other parent are important.
- Being born in Türkiye alone does not give Turkish citizenship. However, if one of the parents is a Turkish citizen at the time of the child's birth, the child may acquire Turkish citizenship by descent.
- The status transitions of family members under temporary protection or international protection and of holders of residence permits are subject to separate rules; where statuses are incompatible at the same time, an individual procedure is needed.
Acquisition of citizenship by a decision of a competent authority does not automatically give citizenship to a spouse. For minor children, custody, the consent of the other parent and the provisions on children in Law No. 5901 apply. A child who becomes an adult while an application is pending may not automatically acquire citizenship through the parent's file, and an independent application may be required. For the process and documents, the article Settling in Türkiye with a Child from a Previous Marriage may also be examined.
How is admission as an immigrant under Law No. 5543 operated?
Admission as an immigrant is not an ordinary residence application. The person must be of Turkish descent and attached to Turkish culture, must come to Türkiye to settle, and must be admitted by the competent authorities.
Who is not admitted as an immigrant?
Law No. 5543 excludes from its scope persons who are not of Turkish descent and not attached to Turkish culture; and also persons who have been deported, even if they are of Turkish descent and attached to Turkish culture, and persons whose coming to Türkiye is not considered appropriate for security reasons.
What is the difference between a free immigrant and a resettled immigrant?
A free immigrant is a person admitted without requesting state assistance for settlement. A resettled immigrant may be settled by the state under special conditions and within a decision framework. The route of application, sponsor or reference, admission document, place of settlement and citizenship procedures differ according to the category.
Is an immigrant document the same as citizenship?
No. For persons admitted under the law, immigrant documents and population procedures are carried out; citizenship is acquired by Presidential decision. Admission may be a special route leading to a citizenship decision, but citizenship does not arise automatically.
How does Law No. 3835 apply to Ahıska Turks?
Law No. 3835 establishes a special framework for admission to Türkiye of persons from Ahıska Turks living in the former Soviet republics. The annual number of admissions, priority, free or resettled immigration, settlement, household effects and citizenship processes depend on the competent decision and practice.
This law:
- Does not grant unconditional and automatic citizenship to all Ahıska Turks in the world.
- Does not remove application, admission, quota and security review.
- Does not apply automatically to other Turkish communities.
- Does not automatically change an existing residence or protection status under the LFIP (YUKK).
How is the transition to Turkish citizenship assessed?
Turkish descent may be important in the examination of citizenship; however, Law No. 5901 does not contain a rule that "anyone who says they are of Turkish descent automatically becomes a citizen".
Citizenship by the general route
Under the general route, the statutory length of residence, intention to settle, Turkish language, income or profession, good character, health and conditions of national security and public order are examined. Meeting the conditions does not give the person an absolute right to demand citizenship; the administration has statutory discretion.
Exceptional citizenship
Exceptional citizenship is not only an investment route. It requires a Presidential decision within the framework of the categories listed in the law and an examination of national security and public order. Turkish descent or a cultural bond with Türkiye may be assessed in the file, but on its own it is not a guarantee of a positive outcome.
Those admitted as immigrants
Persons admitted as immigrants under Law No. 5543 may be granted citizenship within the special provisions of Law No. 5901. It should not be forgotten that a decision to admit as an immigrant and a citizenship decision are not the same act.
Citizens of the Turkish Republic of Northern Cyprus (KKTC)
Persons who are citizens of the KKTC by birth have a special citizenship route based on notification. Persons who acquired KKTC citizenship later are assessed under the general provisions. This regime is separate from applications for 2527 or LFIP (YUKK) for foreigners of Turkish descent.
Blue Card
The Blue Card is issued for persons who were born Turkish citizens, lost their citizenship by leaving with permission, and for the descendants specified in the law. A foreign national does not acquire the right to ask for a Blue Card merely by being of Turkish descent.
Multiple citizenship, name matching and military service
The existing foreign citizenship of a person who acquires Turkish citizenship may continue if the law of the foreign state also permits it. Multiple citizenship is notified to the population registers; differences in name, surname, date and place of birth between passports must be matched with official identity documents.
For men who acquire Turkish citizenship later, military status is determined separately under the provisions of Military Service Law No. 7179 on age, earlier military service and the date of acquisition. Turkish descent, residence or a work permit alone does not create a military obligation; the obligation is assessed on the individual record after Turkish citizenship has been acquired.
What are the social, educational and work rights of foreigners of Turkish descent?
The scope of rights varies according to residence or work status:
- Those holding a valid work permit work as insured persons under the social security legislation.
- A residence permit alone does not give the right to work.
- A long-term residence permit gives rights close to those of citizens in many fields; public service, political rights, military service and special law exceptions continue to apply.
- Diploma equivalence and a work permit are different procedures. Equivalence does not replace a work permit, and a work permit does not replace a professional licence.
- The right to work of holders of a student residence is subject to the limits in the LFIP (YUKK) and the labour legislation.
- General Health Insurance and private insurance obligations are assessed separately according to the person's status, employment position and period in Türkiye.
Which legal remedy applies if the application is refused?
A refusal of a residence application, its non-extension or its cancellation is notified to the foreign national, to the legal representative or to the lawyer. The notification must state the routes of challenge and the other obligations.
Procedure, authority and time-limit map
| Procedure | First administrative or judicial route | General time limit for application | Critical note |
|---|---|---|---|
| Refusal or cancellation of a 2527/6735 work permit | Online objection to the Ministry of Labour and Social Security; administrative judicial review after refusal | 30 days from notification for the objection | The competent court, the authority that finalized the action and the rule of jurisdiction determine the forum; the possibility of Ankara in a central action is separately checked |
| Refusal, cancellation or non-extension of a residence permit | Annulment action in the administrative court against the governorate that made the action | 60 days from notification where no special period applies | Bringing an action does not automatically create a new residence right |
| Special long-term residence / community procedure | Administrative judicial review against the governorate or central authority that made the decision | As a rule 60 days | Which of the Ministry's approval and the governorate's action is final and executory is determined from the file |
| Admission or settlement procedure under Laws No. 5543 / 3835 | Administrative application or action against the competent authority that made the action | 60 days where no special provision applies | Admission, settlement and citizenship procedures must be distinguished |
| Refusal or cancellation of citizenship | Administrative judicial review against the central authority that made the decision | As a rule 60 days | The competent court is determined by the authority that issued the decision; in central actions the Ankara administrative courts often arise |
| Entry ban / restriction code | Administrative application and/or annulment action, depending on the basis of the action | As a rule 60 days; 7 days where a special procedure applies | The code, the entry ban, deportation and administrative fine can be separate actions; a lawsuit does not automatically stop them |
| Deportation decision | Competent administrative court | From notification, 7 days | Except with the consent of the foreign national, the deportation is suspended within the lawsuit period and during the trial |
| Administrative detention for deportation | Application to the criminal judgeship of peace | At any time | An application does not automatically stop the detention; if the conditions change, a fresh application may be made |
This table is general guidance. The special route stated in the notification, the authority that made the action, the place where the foreign national is located and any related decisions must be checked on the same day. Where the time limit is about to expire, information requests or other institutions' replies should not be awaited.
Is refusal of a residence application the same as a deportation decision?
No. Refusal of a person's residence application does not, on its own and without a separate and duly notified deportation decision, produce all the legal consequences of a deportation decision. However, if lawful stay ends, the risks under Article 54 of the LFIP (YUKK) may arise.
What is the time limit for an action against refusal of residence?
Where the LFIP (YUKK) provides no special shorter period for challenging refusal of residence, the general sixty-day annulment period under the İYUK applies from notification. However, if there is also a deportation decision in the same file, a special period of seven days applies to that action. Each action, the notification date and the legal route should be monitored in a separate schedule.
An application to the superior authority or to the authority that made the action under Article 11 of the İYUK may be considered in some files; the calculation of the suspension and restart of the period must be made without error. An administrative application should not be left until the end of the lawsuit period.
Does bringing an action create a right to residence?
As a rule, bringing an action against a refusal of residence does not automatically give the foreign national a new residence card or an unlimited right of lawful stay. To stay the execution, it must be shown together that the action is clearly unlawful and that its implementation would cause damage difficult or impossible to remedy. The period in which the court will issue an interim decision cannot be guaranteed in advance.
What should be done if a restriction code or entry ban exists?
A "restriction code" refers to administrative records used in the Directorate General of Migration Management and security systems to classify particular procedures or risks. Although there are many lists on the internet explaining the meaning of codes, there is no binding, publicly available and unchanging statutory list showing all codes and their current meanings. The effect of acquittals and non-prosecution decisions on the restriction record is addressed in our article Does an acquittal or non-prosecution decision remove a restriction code?.
When a record such as G-87, Ç-114, N-120 or a similar entry is encountered, the following documents should be requested:
- The concrete action and date on which the code is based.
- The notification of the entry ban or deportation decision, if any.
- The grounds of the criminal procedure, administrative fine or security assessment.
- The duration and consequences of the code.
- Documents concerning the person's family, health, education and established life in Türkiye.
A request to remove the code may be the subject of an administrative application to the Directorate General of Migration Management and/or an annulment action in administrative court, depending on the basis of the code. Where the code, the entry ban, deportation and an administrative fine are not the same action, each may have a separate subject of challenge and time limit.
How should the costs of an application be planned?
Because fees and charges change periodically, it is not safe to state a fixed "total fee" in an article. The following items should be shown separately in the file budget:
| Item | Source to verify the current amount |
|---|---|
| Residence permit fee and card cost | Current tariff of the Directorate General of Migration Management / e-İkamet and the Revenue Administration |
| Work permit fee and value-document cost | Current fee table of the Ministry of Labour and Social Security |
| Citizenship application service fee | Announcement of the Directorate General of Population and Citizenship Affairs for the relevant year |
| Health insurance | Scope of the policy, age and insurer's offer; policy conditions in line with the legislation |
| Apostille, consular legalization, notarized translation and courier | Current tariff according to the country of the document, number of pages and the authority receiving the application |
The amount, payment account and collection channel must be verified from the official page on the day of application; no payment should be made to a personal account under the name of "official fee". For all tariffs, the CMS should keep the source URL, the date of verification and the responsible lawyer's area.
On the check of 1 September 2026, the 2026 announcement of the Directorate General of Population and Citizenship Affairs showed a service fee of `957.26 Turkish lira (TL)` for general, marriage and adoption applications, `505.72 TL` for regaining citizenship, election and KKTC-linked procedures, and `135.45 TL` for exceptional citizenship applications. These are only the announced citizenship service fees; they are not the total of residence, notary, translation, apostille, insurance or other institutional costs, and they must be checked again from the official announcement on the day of payment.
How do the deportation decision and administrative detention process work?
Time limit for challenging a deportation decision
Under Article 53 of the LFIP (YUKK), a foreign national, legal representative or lawyer may apply to the administrative court against a deportation decision within seven days from its notification. The court concludes the application within fifteen days, and its decision is final.
Subject to the consent of the foreign national, the foreign national is not deported within the period for bringing the action, or until the trial is concluded if the action has been brought. This special automatic suspension rule should not be generalized to an action against refusal of residence.
Is there an appeal route?
According to the current Article 53/3 of the LFIP (YUKK) and the official statement of the Directorate General of Migration Management, the decision of the administrative court in a deportation dispute is final. For this reason, general information of the form "if the first instance rejects, one may appeal to the regional administrative court within thirty days" is not consistent with the current legislation.
Who may not be the subject of a deportation decision?
Under Article 55 of the LFIP (YUKK), protective provisions apply to persons at risk of the death penalty, torture or inhuman or degrading treatment, to persons whose travel is risky because of serious health, age or pregnancy, and to other persons specified in the article. The risk must be established not by general assertion but through country information and person-specific documents.
Administrative detention and the Removal Centre
A person against whom an administrative detention decision has been issued for the purpose of deportation may be placed in a Removal Centre. Detention generally may not exceed six months; if the procedures cannot be completed because the foreign national does not cooperate or does not give correct information or documents about their country, it may be extended by a further period of at most six months.
The governorate reviews regularly, every month, whether continued detention is necessary. The foreign national, legal representative or lawyer may apply to the criminal judgeship of peace at any time. An application does not in itself stop the administrative detention; the judge concludes the review within five days, and the decision is final. If the conditions change, a fresh application may be made.
Alternatives to administrative detention
Under Article 57/A of the LFIP (YUKK), alternative obligations may apply to certain persons, such as residence at a fixed address, notification, family-based return, return counselling, community service, a guarantee or electronic monitoring. Whether the concrete alternative is proportionate and applicable is assessed on the specific file.
When do individual application to the Constitutional Court and interim measures arise?
An individual application to the Constitutional Court is not the first remedy to replace the ordinary legal routes. It must be made after the ordinary routes have been exhausted, within thirty days from learning of the final decision. Excuse grounds in the law, such as force majeure or serious illness, are also assessed separately. Where there is a serious danger to life or to material or moral integrity, an interim measure may be requested under the Constitutional Court's Rules of Procedure.
The following may be raised together, depending on the concrete facts:
- The prohibition of ill-treatment under Article 17 of the Constitution.
- The right to respect for private and family life under Article 20 of the Constitution.
- The guarantee of effective application under Article 40 of the Constitution.
- The best interests of the child.
An interim measure is not automatic; a current, personal and grave risk must be substantiated.
What do the verified decisions show in practice?
The Council of State decisions on the Turkish-descent document
The decision of the 10th Chamber of the Council of State, E.2019/347, K.2022/1747, together with the decision of the Plenary Assembly of Administrative Litigation Chambers of the Council of State, E.2023/194, K.2024/707, shows that, under the earlier regulatory period of Law No. 2527, the administration could not by a general letter create a narrow condition of proof that was not in the law.
However, on 10 October 2025 the Regulation was expressly amended; communities are now designated by Presidential decision and detailed conditions were introduced, including proof through Turkish official authority documents. For this reason, earlier decisions should not be used after 2025 with the meaning that "every document is accepted" or "all communities are covered".
The Constitutional Court decisions on deportation and family life
The Constitutional Court's decisions in the case of K.A. (Application No. 2017/38596) and other deportation cases require that a security assessment must not be left only with a code name, and that courts must subject the person's family ties, life in Türkiye, the position of the child and the risks in the country of return to a real review.
These decisions do not mean that public order and security are unimportant, or that every restriction code will be annulled. The essential point is that a legally based, individualised and proportionate assessment must be made between the security justification and the person's fundamental rights.

What are the common mistakes?
- Assuming automatic long-term residence because of the name of a community.
- Treating an old Directorate General of Migration Management announcement as a current and unlimited right of application.
- Accepting work permit, professional equivalence and residence permit as the same procedure.
- Regarding a foreign consulate letter as a sufficient and conclusive document in a 2527 application.
- Assuming that the status of the spouse and children arises automatically.
- Confusing the time limits for refusal of residence and for deportation.
- Missing the seven-day deportation lawsuit period.
- Thinking that a residence refusal lawsuit creates automatic lawful stay.
- Accepting the meaning of G-87 or another code from an unofficial internet list as final.
- Handing passports, identity documents and all personal documents to third parties who claim to be "official intermediaries".
What legal work can Güneş & Güneş Law Firm carry out?
Depending on the circumstances of the file, the following legal work may be carried out:
- Determining the type of procedure and the special law that applies.
- Checking the community decision, the entry date and the application period.
- Legal mapping of the differences in descent, identity and family documents.
- Checking the chain of apostille, certification and translation.
- Legal preparation and monitoring of the e-İkamet application file.
- Joint assessment of the 2527 work permit, diploma equivalence and professional conditions.
- Examination of the admission file under Law No. 5543 or 3835.
- Administrative application and lawsuit strategy against refusal of residence, entry ban, restriction code and deportation.
- Application to the criminal judgeship of peace against an administrative detention decision.
- Preparation of evidence on family life, the best interests of the child and the risk of return.
- Assessment of the conditions for an individual application to the Constitutional Court and for interim measures once the ordinary routes have been exhausted.
Each file is assessed separately in terms of the person's citizenship, community, date of entry, current status, family ties, lawful stay and security records. No guarantee of outcome can be given.
Frequently asked questions
Does everyone who says they are of Turkish descent count as of Turkish descent in Turkish law?
No. Cultural or ethnic self-identification is important, but the legal result depends on the scope of the relevant law or decision and the official documents required.
Is citizenship of Azerbaijan, Kazakhstan, Kyrgyzstan, Uzbekistan or Turkmenistan enough?
No. Such citizenship alone does not create a right to a work permit under Law No. 2527 or to long-term residence for all persons. The current community decision and individual conditions are required.
Can Ahıska Turks obtain citizenship directly?
Laws No. 3835 and 5543 provide a special admission and citizenship process; however, there are application, admission, quota, security and decision stages. It is not automatic citizenship.
Can Uyghur Turks obtain indefinite residence without waiting eight years?
A special announcement with an entry-date condition was published in 2019. Whether a new application is accepted today should be confirmed from the current decision and administrative practice; Uyghur identity alone is not a permanent general exemption.
Is there a special route for Crimean Tatar Turks?
A special long-term residence and determination process was announced in 2022. An application may involve a lawful entry, descent and community documents and commission review. Current acceptance conditions should be confirmed in writing before the application.
Is being a Turkmen enough to obtain long-term residence directly?
No. Persons from Syria or Iraq, including Turkmen, are assessed on their current protection or residence status and on any express special decision.
Where can a Turkish-descent certificate be obtained?
There is no single universal authority. For a 2527 work permit, a Turkish official authority document is required; in a special residence or immigrant file, the authority or commission indicated in the relevant decision may be different.
Is an association document sufficient?
Generally not on its own. It may be a supporting document; it does not replace a binding official determination.
Can a Turkish-descent foreigner work without a work permit?
No. The Law No. 2527 regime is not a work permit exemption.
Are all professions reserved for Turkish citizens open?
No. Law No. 2527, the community decision, professional equivalence, licensing and special legal limitations apply together.
Do Turkish-descent foreigners have to be civil servants?
There is no general and automatic right to enter public service. The special law, the post, security and appointment conditions apply.
Do Turkish-descent foreigners have to buy a house?
This depends on the type of residence applied for. Turkish descent creates neither a general obligation to buy a home nor a general exemption.
Is there an exemption from the closed-neighbourhood practice?
Not without an express and current special decision. A general exemption cannot be accepted for all Turkish-descent persons.
Is the student residence fully counted in the eight-year calculation?
No. In the long-term residence calculation, half of the student residence period is counted, and the whole of the period under other residence permits is counted.
Can a person under temporary protection move directly to long-term residence?
Temporary protection status does not give a direct route to long-term residence. Whether a move to another status is possible, the conditions and the separate procedure to end the existing record are assessed separately.
Do the spouse and children obtain the same long-term residence?
No. The status and conditions are examined separately for each person. Family residence or independent application options are assessed.
Is a child born in Türkiye automatically a Turkish citizen?
As a rule, no. If one of the parents is a Turkish citizen at the time of birth, the child may be a citizen by descent; special provisions on statelessness remain reserved.
Is the Blue Card given to Turkish-descent foreigners?
No. The Blue Card is for persons who were born Turkish citizens and left with permission, and for the descendants specified in the law.
Does a work permit always replace a residence permit?
As a rule, a valid work permit or exemption document replaces a residence permit. However, the work documents issued to persons applying for international protection, conditional refugees and persons under temporary protection do not have this result. The status must be checked from the legal basis of the document issued.
Can I work on a long-term residence card without a separate work permit?
Not in current official practice. Long-term residence gives indefinite stay; for work, a work permit or a valid exemption under Law No. 6735 is required. Although there is an opposing interpretation in academic literature, official permission should not be used in practice without being obtained.
Does the 10 October 2025 amendment automatically cancel earlier work permits?
No. The amendment does not remove valid permits merely because they were published. However, new and extension applications are assessed under the current conditions; the earlier permit is not a guarantee of extension.
What should be done if no Presidential decision listing the covered communities can be found?
The application should not be built on an old announcement or an association letter alone. The Official Gazette archive should be searched; the International Labour General Directorate should be asked in writing for the date and number of the decision; and the application should show clearly which current condition of Articles 2/A and 3/8 is met by which act.
If one spouse acquires Turkish citizenship, does the other become a citizen automatically?
No. A decision by the competent authority does not automatically confer citizenship on a spouse. The spouse applies under their own legal route and conditions. For children, the rules on age, custody and consent apply separately.
What is the military status of a foreigner of Turkish descent who acquires Turkish citizenship?
Residence or Turkish descent does not create a military obligation. After citizenship is acquired, the age, the date of acquisition and the earlier military service abroad are determined individually under Law No. 7179.
Is Law No. 2641 on Turkish-descent immigrants from Afghanistan still in force?
No. Law No. 2641 was repealed in 2007 by Law No. 5637. It may serve as the historical basis of old settlement files; it does not give a new and general application right today.
Does being employed in a public institution under Law No. 2527 automatically give the right to be appointed as a civil servant?
No. The special law of the public institution, the vacancy and post, and the security and appointment conditions apply. The Turkish Armed Forces and the security organization are outside the scope of Law No. 2527.
How long does a residence application take?
There is a statutory assessment period of at most ninety days from submission of the complete documents. Additional documents and verification procedures may affect the course of the file.
How many days are given to complete a missing document?
The administration may give up to thirty days according to the official notification. The concrete final date in the notification should be followed.
Can I leave Türkiye during the residence application?
With an approved application document and fee receipts, departure may be possible on condition of returning within fifteen days each time. The approval status of the application and the validity of the document should be confirmed before departure.
Within how many days must a lawsuit be filed against refusal of residence?
Where there is no special period, the general sixty days from notification apply. If there is also a deportation decision in the same file, the seven-day special period applies to that decision.
Is there a right of appeal in a deportation lawsuit?
According to the current Article 53/3 of the LFIP (YUKK) and official Directorate General of Migration Management information, the decision of the administrative court in a deportation dispute is final; a general appeal to the regional administrative court is not available.
Does bringing a deportation lawsuit stop the procedure?
Subject to the consent of the foreign national, a deportation is not carried out within the seven-day period for bringing the action and, if the action has been brought, until the trial is concluded.
Can a person in the Removal Centre apply to the criminal judgeship of peace every month?
The governorate reviews each month of its own motion. The person or their representative may apply to the criminal judgeship of peace at any time; if the conditions change, a fresh application may be made.
How is a restriction code removed?
First, the basic action, date and consequence of the code are learned. Then an administrative application and/or annulment action is set up according to the concrete action and time limit. A single "code removal petition" template is not sufficient for all files.
Conclusion
The legal status of foreigners of Turkish descent in Türkiye cannot be described as a single bundle of automatic rights under one heading. Law No. 2527 governs work, Law No. 5543 governs admission as an immigrant, Law No. 3835 governs Ahıska Turks, the LFIP (YUKK) governs residence and deportation processes, and Law No. 5901 governs citizenship.
The legal position of communities is not equal. Special decisions often include the community, the entry date, the final application date and a document condition. For this reason, no travel, change of status or application decision should be based on an old announcement, an unofficial code list or a promise that the procedure is "open to all Turkish descendants".
The correct file examines together the legal result sought, the current norm, the community decision, identity and descent evidence, lawful stay, family situation and possible restrictions. At the refusal or deportation stage, the notification of each action, the competent forum and its special time limit are managed separately.
Final legal principle: The question "am I of Turkish descent?" is not sufficient on its own. The question that must be answered is: "For which procedure, on which current legal basis, under which community decision and with which official documents do I claim the right?"
Privacy and legal notice
Identity, passport, family and migration documents shared with Güneş & Güneş Law Firm are assessed under the rules on lawyer's professional secrecy, the duty of confidentiality and the legislation on the protection of personal data. Documents should not be shared through insecure channels, unofficial application websites or third parties who present themselves as official intermediaries.
This guide is for general legal information. Community decisions, application dates, administrative practice and restriction records may change. It does not constitute a legal opinion or a guarantee of outcome without examination of the documents of the concrete file.
