CIVIL LAWSUITS / PROCESS GUIDE
How does it proceed, step by step?
The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.
Employment, wage, termination and payment records are collected; the claim and time limits are determined.
If the matter falls within the scope of mediation as a condition precedent to litigation, mediation is applied for; the result, whether agreement or no agreement, is documented.
The case is filed; the petitions, preliminary examination and investigation phase (tahkikat) are conducted under simplified procedure.
When necessary, witnesses, workplace records and the expert’s calculation are examined; objections to the report are submitted.
The decision, the available legal remedy and collection steps are followed.
THIS DISTINCTION MATTERS
Do not overlook the conditions specific to your matter.
For claims for pecuniary and non-pecuniary damages arising from work accidents and occupational diseases, and the related determination, objection and recourse actions, the exception in Law No. 7036 Art. 3/3 is assessed separately.
