CIVIL LAWSUITS / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. Heirship, shares, records of movable and immovable property and all relevant parties are determined.

  2. In a dispute over partition or dissolution of co-ownership, mediation as a condition precedent to litigation is completed.

  3. If there is no agreement, the case is filed; the possibility of partition in kind and, when necessary, the need for a sale are examined.

  4. After the decision and the relevant legal remedy, sale procedures are carried out if required.

  5. The sale price, expenses and partition procedures are followed.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

Not every inheritance dispute is a dissolution of co-ownership. Disputes over abatement, heirship or wills are classified separately. For some sales among heirs, the 2026 amendment and a transitional provision tied to the announcement date are checked.
