Mediation and Settlement Process
Mediation allows the parties to assess the possibility of an agreement in suitable private law disputes. Even where the application is a condition of suit, there is no obligation to reach an agreement.

How do mediation and the settlement process proceed?
The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.
Scope and suitability
Whether the dispute is suitable for mediation, whether it is a condition of suit or voluntary in nature, and any special exceptions are determined.
Application, appointment and representation
The appropriate application is made; the mediator is determined. The identity, representation and any necessary special authority of the parties and representatives are checked.
Meetings and assessment of options
The parties’ claims, documents and options for a solution are discussed. The confidentiality rules and the legal consequences of participation are explained.
Agreement or no agreement
The outcome is recorded in minutes. If there is an agreement, its scope, obligations, due dates and the sharing of expenses are written clearly; the scope of a partial agreement is set apart.
Implementation or the appropriate next route
The enforceability of the agreement and, where necessary, the court’s annotation are assessed. If there is no agreement, the available lawsuit/application route and time limits are followed.
THIS DISTINCTION MATTERS
Do not overlook the conditions specific to your matter.
Mediation is not a court that decides. Signing an agreement is not mandatory; the statutory consequences of attending the first meeting are assessed separately. Enforceability of an agreement is not secured by the same route for every document.
