ENFORCEMENT AND DEBT COLLECTION / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The nature of the instrument, maturity, the capacities of the parties and the special conditions of the proceedings are checked.

  2. The payment order is served; the time limits for payment and for applications are examined separately.

  3. The objection to the signature/debt or the complaint is submitted to the competent authority on the relevant ground; its effect on the proceedings is determined.

  4. Depending on the status of the proceedings, attachment, sale and collection are carried out.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

On this route there is a five-day period for certain applications and a ten-day period for payment. The effect of an objection differs from general enforcement without a judgment; all time limits and grounds must be checked on the payment order.
