ENFORCEMENT AND DEBT COLLECTION / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The underlying lease relationship, debt or eviction undertaking and the special conditions of the proceedings are determined.

  2. The appropriate payment/eviction order is served.

  3. The need to apply to the enforcement court is assessed according to the objection, payment or eviction status.

  4. Eviction, once its conditions are met, and, if any, the collection of the claim are followed separately.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

Eviction based on a rent receivable and proceedings based on an eviction undertaking involve different conditions and time limits; a single eviction timetable is not used.
