CIVIL LAWSUITS / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. The ground for divorce, the claims, time limits and lawful evidence are assessed.

  2. If necessary, interim measures are requested regarding housing, support, the children and the management of property.

  3. After the pleadings and the preliminary examination, witnesses and other evidence are assessed; the necessary expert examinations concerning the children are carried out.

  4. Final statements are taken; a decision is given on the divorce and the related claims.

  5. The reasoned judgment, the available legal remedies and becoming final are followed; the enforceability of the provisions is examined item by item.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

The divorce itself cannot be concluded through mediation. The liquidation of the matrimonial property regime is not decided automatically in every divorce case.
