CIVIL LAWSUITS / PROCESS GUIDE

How does it proceed, step by step?

The steps may run in parallel or change depending on the nature of the matter. Also read the key distinctions below.

  1. Claims, defenses and evidence are submitted through the petition and the response.

  2. Where possible the court examines the file on the documents, and where a hearing is needed, by a hearing held in accordance with the procedure.

  3. Matters for the preliminary examination are addressed; the necessary evidence is then assessed.

  4. When the investigation phase (tahkikat) is complete, final statements are taken and a decision is given.

  5. Service of the reasoned judgment, the available legal remedy and enforcement are followed.

THIS DISTINCTION MATTERS

Do not overlook the conditions specific to your matter.

There is no reply or rejoinder stage. Simplified procedure does not mean that every case will end in a single hearing or on a fixed date.
