Summary

The application period, the distinction between owners and tenants, required documents and administrative litigation routes where urban transformation rent assistance is refused or discontinued.

The refusal or discontinuation of urban transformation rent assistance is an act that can be reviewed in the administrative courts. First, the program on which the assistance is based, whether the applicant is an owner, a tenant or a holder of a limited real right, and the evacuation and demolition dates must be determined. For assistance under Law No. 6306, the current Regulation provides a one-year application period from the date of evacuation or demolition. The time limit for bringing an action against the refusal is separate and, for acts under this Law, is as a rule 30 days.

Which rent assistance are we talking about?

This article addresses the transformation assistance under Law No. 6306 and Article 16 of the Implementing Regulation. A rent payment undertaken by a contractor under a contract, a separately budgeted social support program of a municipality or another disaster program is not subject to the same legal regime. Not only who makes the payment but also which regulation and decision it relies on is important.

For example, if the contractor does not pay the rent, private-law claims based on the contract come into play. By contrast, a refusal by the competent administration of rent assistance under Law No. 6306 is an administrative act. Taking the two disputes to the same court and subject to the same time limit may be a mistake. The program name in the application document, the description of the payment and the article relied on in the refusal letter help make this distinction.

The position of the owner, the tenant and the holder of a limited real right

Assistance to owners

The current Regulation provides that monthly assistance may be given to the owners of buildings evacuated by agreement from the date of evacuation or demolition. For risky buildings outside a risk area, the assistance period is 18 months. In risk areas and reserve building areas, the period is determined by the relevant institution, not to exceed 48 months. This upper limit does not mean that every applicant will automatically be paid for 48 months.

For an owner of a completed building, the residence requirement found in old guides should not be carried over directly to current applications. However, there are special conditions for buildings under construction that are inhabited: the provision applies only to the owners, tenants and holders of limited real rights relating to the inhabited parts. The approach that “I am the owner, and no other condition is required” is also incorrect.

Assistance to tenants and other right holders

For those residing as tenants or operating a business, a lump-sum assistance equal to twice the determined monthly assistance amount is provided. For those residing or operating a business as holders of a limited real right, and for building caretakers (kapıcı) residing in a caretaker’s flat, a lump-sum assistance equal to five times that amount is provided. The applicant’s status and actual use must be documented.

Applicant’s situationGeneral form of assistance
Owner of a risky building outside a risk areaMonthly assistance for 18 months, if the conditions are met
Owner of a building in a risk or reserve areaA period of up to 48 months, determined by the relevant institution
Tenant residing in or operating a business in the buildingLump-sum assistance of twice the monthly amount
Eligible holder of a limited real right or caretakerLump-sum assistance of five times the monthly amount, under the conditions in the Regulation

This table does not cover all the different special programs. The current monthly amount should be checked against the tariff of the competent institution for the province and the period to be applied. Using the amount of a previous year as if it were today’s assistance amount causes the expected total to be calculated wrongly. For this reason, an unverified list of 2026 amounts is not provided here.

By when must the application be made?

Article 16/4 of the current Regulation provides for an application within one year from the date of evacuation or demolition. That some guides remaining in old texts and on the internet state three months from demolition does not mean that these apply unchanged to current applications. The date of the act and the regulation in force on that date should be checked together.

The evacuation date and the demolition date are separate documents. The day the property was vacated, the day the subscription was closed and the date in the demolition record may not always be the same. The applicant should explain, with documents, the starting point that applies to his or her situation. It is important to make a registered application before the one-year period expires and to obtain written information on how a missing document will be completed.

The application is addressed to the relevant institution in risk or reserve areas, and to the Directorate (Müdürlük) or the administration to which authority has been delegated for risky buildings. One should not settle for oral direction to the wrong institution; the application receipt, electronic record or document number should be kept. A telephone call may not by itself replace an assistance application made within the time limit.

For what reasons may a refusal or discontinuation arise?

Expiry of the time limit, wrong assessment of the applicant’s status, inability to document evacuation or use, the property falling outside the scope, and receipt of incompatible support from the same funding source are frequently encountered subjects of review. In addition, payment problems such as a bank account or system record error are different from the removal of entitlement.

In the first case, an administrative correction of the record may be sufficient; in the second, annulment and a claim for monetary rights may be necessary. For this reason, in a complaint that “the payment did not arrive,” it should first be asked whether there is a decision to stop payment, and for which months and on what grounds payment was not made. A written copy of the decision affecting entitlement should be requested.

Can rent assistance and interest support be received together?

The Regulation provides that the same person is not given both rent assistance and interest support from the Transformation Projects Special Account. In applying this rule, it should be investigated from which account and in whose name the support was provided. A contractor’s contractual payment or a municipal support carried out from another budget cannot be treated within the same prohibition without any examination; its own program conditions are also checked separately.

Objection to the refusal and the litigation route

After obtaining the written reasons for the refusal, an application supported by specific documents requesting correction of the error can be made to the relevant administration. An application under Article 11 of the Administrative Procedure Law (İYUK) that is made within the time limit and has appropriate content affects the time limit for the action. However, merely requesting information or repeating the same application does not produce the same result. The time limit for the action must be followed separately while making the application.

The special 30-day time limit for an action in Article 6/9 of Law No. 6306 should be used as the basis. The one-year administrative application period for rent assistance is not the time limit for bringing an action after the refusal. That assistance was requested within the time limit does not mean that an action against the refusal can be brought at any time without limit.

If the administration does not respond, the current implied rejection provisions of Article 10 of the İYUK are considered. In general, if no response is given within 30 days, the result of rejection arises; non-final replies, special regulation and the possibility of later replies must be examined for each file. The 60-day waiting period for a response that appears in old decisions should not be taken as the current rule.

Which court and which requests?

For an individual refusal or discontinuation of assistance, the competent judicial authority is, as a rule, the administrative court. Jurisdiction is determined under the İYUK’s provisions on jurisdiction according to the administration that established the act and the nature of the dispute. The role of the municipality, the Directorate or the Presidency should be established from the documents. If annulment of a nationwide regulatory act is also requested, the Council of State’s first-instance jurisdiction may come onto the agenda separately.

In addition to annulment of the refusal or discontinuation, it is possible, if the conditions are met, to claim unpaid amounts and interest. The annulment and full remedy actions in Article 12 of the İYUK should be considered. It should be explained for which months and how much is requested, the earlier payments and the start of the interest claimed. An annulment decision does not in every case mean that all the months the applicant seeks will be paid automatically.

A request for a stay of execution should also be made specific. The effect on housing of discontinuing ongoing assistance, the existing rent burden and the clear unlawfulness of the administrative act can be documented. In the case of refusal of a first-time assistance application, the scope of interim protection and its effect on the establishment of a favorable act are assessed separately. The court does not exercise unlimited discretion in place of the administration.

Why should the Council of State decision be read according to its date?

In the decision of the Sixth Chamber of the Council of State (Danıştay) dated June 24, 2021, E.2020/3451, K.2021/8817, an assistance application made in 2018 and the regulations of that period were examined. The Chamber found the refusal lawful in the context of the failure to apply within the time limit and the residence requirement of that period, and rejected the requests for annulment and payment. The prosecutor’s opinion in the decision is not the same as this result; the opinion cannot be presented as if it were the ruling.

The decision also applied the general time limit because the special time limit for the action had not been indicated in the specific case. This assessment does not make it safe to disregard the 30-day period in new applications. The current assistance conditions and the content of the notification are examined separately. The old residence and application provisions in the decision cannot be used in place of the Regulation as later amended.

Which documents should be collected when preparing the file?

The title deed or lease, the document of the limited real right, the risky building record, the evacuation and demolition records, the application receipt, any additional documents requested and the refusal letter should be kept together. For a tenant or business operator, records showing actual use are important. Bank transactions serve to separate the months paid from the months missing.

A timeline should be prepared listing the risk determination, evacuation, demolition, application, completion of additional documents and notification of the refusal. If there is a dispute over the address or independent unit number, the numbering document and the link to the title deed should be explained. An error in the administrative record is not the same as a person not meeting the conditions for assistance.

Conclusion

In a rent assistance dispute, the legal basis of the program, the person’s status and the order of dates are decisive. Current application conditions should be separated from old guides; the reasons for refusal or discontinuation should be reviewed against the documents. Not confusing the one-year application period with the special 30-day time limit for bringing an action is one of the basic steps in preventing a loss of rights.

Frequently Asked Questions

Does a tenant receive monthly assistance for 18 months?

The general provision of the Regulation provides lump-sum assistance equal to two months’ amount for a tenant. The 18-month period for owners does not apply automatically to a tenant.

If the owner does not live in the building, is the assistance necessarily refused?

The old residence requirement cannot be carried over directly to a current owner application. The condition of the building and the special conditions for buildings under construction are examined separately.

Can I bring an action within one year after the refusal letter?

One year is the period for the assistance application. The special time limit for an action against a refusal under Law No. 6306 is, as a rule, 30 days.

When payment is discontinued, is the bank record alone enough?

The bank record shows the missing payment. To determine the legal reason for the discontinuation, the administrative decision and the assistance file are also needed.
