Summary

How to handle foreign death and family records, apostilles, translations, name differences and missing-document requests in estate matters in Türkiye.

A death, birth, marriage or power of attorney document issued in a foreign country may be the main evidence for an estate transaction in Türkiye. For a document to be usable, translation alone is not always sufficient. The issuing authority, the certification chain, the integrity of the document and the identity of the person must be checked together. The most frequent delay arises from bringing a document with a similar name but a different legal function instead of the correct one. [1]

First, the fact to be proved is determined

A death certificate shows the fact of death, a birth record shows parentage, and a marriage record shows the relationship between spouses. A foreign family document may not include all earlier marriages or children in another country. If the decedent changed citizenship and lived in different countries, the search for records should not be limited to a single country.

For example, if the deceased had a child from a first marriage, a family record issued with the last spouse may not show that child. This gap does not mean that the child has no right of inheritance. If there is a death in an intermediate generation, each link in the family chain must be established with a separate document. [2]

What function does an apostille serve?

An apostille facilitates the verification of a foreign official document within its scope as regards the signature, the seal and the status of the person who issued it. It does not guarantee that the content of the document is accurate or that a Turkish authority is obliged to carry out the requested transaction. It is checked whether the Apostille Convention applies between the countries concerned and whether the type of document falls within its scope. There may also be documents that are exempt from certification by virtue of a convention or an agreement. [1]

Where an apostille does not apply, the relevant certification chain and the procedures of the Turkish consulate are investigated. A document may need to be verified not in the country where the citizen is located but by the competent authority of the country that issued it. It must be clear whether the certification of a photocopy verifies the original official record or only its copy. [3]

How are translation and document integrity preserved?

The front and back of the document, its annexes, its seals, the apostille page and the finality statement should be translated together. Translating only the main page may lead to the omission of an entry that changes the legal effect of the document. With which certification the Turkish translation will be accepted is confirmed in advance with the target institution.

A translator should not change a different date of birth on the document out of a belief that “this is the correct one”. If the source document is wrong, the correction is made through the issuing authority or the relevant record procedure. Where a name is transliterated into Latin letters differently in several documents, a translation note may help; however, where necessary, an official name equivalence or change record is required.

How are name and identity differences resolved?

Change of surname and marriage

A link can be established through the marriage record between a title deed obtained under the surname held before marriage and a passport bearing the new surname. If the surname changed after a divorce, the decision and its finality are examined separately. A different procedure may be required for a foreign decision that needs to be entered in the population registry record in Türkiye; the translation in the estate file does not replace this procedure.

Different alphabets and old records

The father’s name, place of birth, date, old passport number and citizenship records are compared together. The similarity of two persons’ names does not prove that they are the same person. If there is a serious conflict between the identity of the former registered owner of the title deed and the identity of the decedent, a record correction or determination process may arise. [2] [1]

Digital documents and the electronic apostille

For an electronic document, the verification code, the signature and the official verification address should be preserved. A screenshot does not always replace the official document. It is checked whether the electronic apostille can be verified by the competent authority and in what form the target institution accepts the document. When a file is shared, the verification link and the disclosure of personal data to the public should be kept separate from one another.

To obtain a document, channels of application based on status as an heir should be preferred instead of using the deceased person’s e-Government Gateway (e-Devlet), bank or e-mail password. An authorization document and an identity check are required in the digital environment as well.

The application and objection file

A copy of the document set sent to the institution, the delivery date and the application number are kept. If additional documents are requested, it is asked in writing which document was found insufficient and on what legal ground. If the deficiency arises from certification, the certification is completed; if it arises from parentage, the record; if it is a problem of representation, the power of attorney. Reissuing all the documents may cause unnecessary expense.

It should not be forgotten that the document collection process does not by itself suspend the time limits for disclaimer, tax or legal remedies. If a time limit is approaching, the missing documents are explained and the appropriate application and protective route is assessed. Fees, translation, certification and international shipping costs should be calculated separately from one another.

The document plan should be built according to the country and the transaction to be carried out

With foreign documents, the first question is not “is there an apostille?” but which legal fact will be proved with which document. A record showing that the death took place may not show all of the deceased’s heirs. A marriage document alone may not explain that the marriage was continuing on the date of death. If a divorce decision exists, the finality of the decision and its legal effect in Türkiye may also be required. For each document, the fact it proves, the person concerned, the issuing authority and the institution where it will be used should be kept in separate columns. [1] [4]

At the bank, land registry and court stages of the same file, a different document copy or form of translation may be requested. If these needs are determined together at the outset, obtaining the same document again can be avoided. However, the conclusion “the bank accepted it, so the land registry must also accept it” cannot be drawn. The subject of review and the authority to act of the institutions differ. The file should not be enlarged with unnecessary papers before the legal ground of the additional document requested is understood.

Exemption from certification, apostille and consular certification

The same certification route does not apply in every country

Article 224 of the Code of Civil Procedure (HMK) addresses together the certification regime required for official documents prepared by foreign state authorities to have that character in Türkiye and the international conventions to which Türkiye is a party. For this reason, the state that issued the document, the type of document and the applicable convention, if any, must be determined. That a document is in a foreign language does not by itself show that an apostille is necessarily required; there may be a provision that grants an exemption from certification. [1]

If an apostille can be applied, the certification is obtained from the competent authority of the country where the document was issued. The approval of a Turkish translator, or a notary’s certification of the translation in Türkiye, does not in every case complete a missing certification of the foreign authority’s signature. For a document requiring consular certification as well, the authorities through which the chain will be built are determined from the practice of the country and mission concerned. An approval obtained from the wrong authority may fail to make the document usable even though it causes additional expense.

The original document, a certified copy and a screen printout are different

A PDF sent by e-mail may be a document with an official electronic signature, but it may also be only a scanned photocopy. That a file has a PDF extension does not resolve this distinction. The source of the document, the verification method and whether it could have been altered afterwards are investigated. If there is a QR code or a verification link, it is checked whether the institutional verification page can actually be reached. A QR code that does not open is not, by itself, proof of forgery; however, until the verification problem is resolved, the document should not be accepted as an official electronic copy.

Translation must not wrongly equate legal concepts

“Heir”, “legatee”, “estate administrator” and “executor of the will” are different statuses. Translating a function in a foreign text out of habit as “heir” creates a serious problem that alters the person’s rights and authority of representation. In the translation, the original equivalent of the status in the document should be preserved; it should be explained that its effect in Turkish law will be assessed separately. A translator provides the linguistic equivalent; a translator does not make the binding legal choice. [4]

The annexes of the document, the back page, the finality entry and the explanations of the seals should also be included in the scope of the translation. Translating only the operative part of a decision may conceal which persons are parties or which claim was decided. Where necessary, by preserving the page number and the annex linkage, it is made clear to which document the translation belongs. A second comparison of proper names, dates, share fractions and monetary amounts is particularly important; a single digit error may cause a dispute over shares and identity.

When is a name difference a clerical error and when is it an identity conflict?

A change of surname by marriage, the transliteration of a different alphabet into Latin letters, or a second name in a foreign registration system can often be explained with official linking documents. However, if the date of birth, the parent’s name and the citizenship record also fail to match one another, the problem is not merely a difference in spelling. A chain showing that it is the same person must be established. Changing the name in the translation as though it were the same in all documents does not resolve the inconsistency; it distorts the content of the original record.

In a hypothetical example, if the former surname appears in the land registry, the post-marriage surname in the passport and both surnames together in the death record, a marriage or name-change document may provide the link. By contrast, for a record containing a different date of birth and different parent information, additional archive research or a record correction may be required. Asking to change only the land registry record in Türkiye, without establishing in which country the record is wrong, may not produce the correct result. [2] [1]

How is a reply to a missing-document letter prepared?

The institution’s letter on the deficiency is obtained; opposite each request, the document submitted, the date of submission and the problem expected to be resolved are written. If a document cannot be obtained, the reply of the authority applied to and an alternative record are shown. A general reply in the form “all documents have been provided” does not explain the absence of a specific parentage link. It may be asked in writing at which stage the application has stalled and whether the requested document is mandatory.

If the court has set a firm deadline, document collection and time-limit management are carried out together. The slow work of a foreign authority does not automatically extend every time limit. Before the time limit expires, a request should be made in the proper manner by setting out the applications made, the replies received and the difficulty of obtaining the documents concretely. A submission to an institution is not regarded as suspending, by itself, the litigation time limit or the time limit for disclaiming the inheritance unless its effect on those is separately regulated. [1] [2]

How are documents kept secure and reusable?

The original document, the certified copy, the translation and the copy sent to the institution are kept separate from one another. The identity number, address and family information of the document holder are sent only to the persons who need them. The name and version of the shared file and the institution to which it was given are recorded. When a translation error is corrected, the applications in which the old copy was used are also reviewed; placing the new translation only in a personal archive does not correct the earlier transaction.

At the end of the process, it should be stated which originals were returned to the heir and which remained in the file or with the institution. A record extract of limited validity is distinguished from a historical document that can be used continuously. This method prevents the missing piece from being searched for again in a later bank or land registry application, and prevents contradictory translations from circulating.

The competent apostille authority and the applicability of the convention between the countries should be checked in the official HCCH records. A valid electronic apostille and merely a scanned copy of the document are not the same. [5]

Why can an apostilled document still be rejected?

Certification, translation and the probative value of the document are three separate reviews. A death certificate bearing an apostille may show the identity and death of the deceased; however, it may not show that the applicant is the deceased’s child. In that case, the birth record requested by the institution is not an unnecessary repetition of the same paper. By contrast, if a new apostille is requested in an unclear manner despite a complete document, the basis of the request should be made explicit. Within the framework of Articles 223–224 of the HMK, the foreign-language document submitted to the court and the nature of a foreign official document are assessed separately. [1]

The applicant’s plan of proof should be directed not at increasing the number of documents but at completing the missing legal link. The objection “there is an apostille, you are obliged to accept the application” does not produce a result where the document belongs to a different person or the authority of representation is insufficient. Likewise, it is not the right approach for an institution to regard a foreign document as worthless merely because it is foreign. In which element the usability is deficient should be determined.

What information should be obtained from the institution before preparing the document?

By stating the transaction to be carried out clearly, it should be asked whether the original or a certified copy is required, how the electronic document will be verified, in what form the translation is accepted and by which record the name link will be established. The date of the reply received and the transaction for which it was given are kept. The preliminary review reply of a bank branch does not bind the court’s assessment of evidence or the land registry directorate’s review of the legislation.

This table is not a fixed list of papers specific to one country. The application conditions are completed according to the state in which the document was issued and the transaction for which it will be used. Since translation and certification costs vary according to the page, language and the authority’s tariff, a total fee or a definite completion date cannot be given without seeing the document.

If obtaining documents is delayed while the inheritance time limit is running

Waiting for a record from a foreign authority does not automatically constitute an excuse with regard to the disclaimer of the inheritance or a firm deadline set by a court. In the disclaimer assessment where Turkish law applies, the general three-month period in Article 606 of the Turkish Civil Code (TMK) and the conditions for its start; and, if there is an important reason, the possibility of an extension of the time limit or the grant of a new period under Article 615, are examined separately. The evidence of the application made to preserve the time limit and of the delay should be kept. The mere fact that an order has been placed with a translation office does not replace the request that must be made to the court. [2]

Conclusion

Preparing foreign documents correctly is the most important delay-preventing step at the beginning of the inheritance transfer. Each document must prove a fact; the identity chain, certification and translation must be completed in line with the needs of the target institution.

Frequently Asked Questions

Does every foreign document require an apostille?

No. The type of document, the convention between the countries and exemptions from certification are checked.

Is it mandatory for the documents to be issued under the same surname?

If there is a change, it must be traceable through official records; the difference must not be left unexplained.

Is sending a scanned file sufficient?

It may serve for a preliminary review. For the transaction, the original, a certified copy or a verifiable electronic document may be requested.

Can a translator correct a record error?

No. The translation must reflect the record; a clerical error must be remedied through an appropriate record correction procedure.
