Acquiring assets by inheritance or gift leads to different filing deadlines and tax consequences. The tax arising from the transfer by succession must be kept separate from the decedent’s own tax debts, and it should not be assumed that every intra-family transfer is exempt from tax.

Heirs’ Tax Obligations: Inheritance and Transfer Tax Return, the Decedent’s Debts and Continuing the Business

After a death, tax procedures do not consist solely of the inheritance and transfer tax return. The declaration of the assets left behind, the income and business taxes of the deceased person, existing public debts and the continuation of the activity are separate files. The statutory period for disclaiming the inheritance is also different from these. Grouping these procedures under a single “inheritance deadline” may lead to a loss of rights.

A certificate of inheritance shows the heir’s status; it does not replace the inheritance and transfer tax return. The tax arising from the transfer by succession and the decedent’s own tax debts rest on different legal grounds.

A certificate of inheritance and a tax return serve different functions

A certificate of inheritance shows which persons are heirs and the share each of them holds. A tax return is the tax declaration of the assets passing by succession and of the related debts. The fact that a certificate has been obtained from a notary or a court does not replace the tax return. A joint declaration signed by the heirs is possible, but the share of each heir and his or her personal exemption position must be determined.

For the transfer of assets located in Türkiye and of Turkish citizens’ assets located abroad, citizenship, residence and the location of the asset are assessed together. Where a foreign national leaves an asset located in Türkiye to a foreign heir, the asset does not fall outside Turkish tax merely because the parties are foreign. [1; Law No. 7338 on Inheritance and Transfer Tax, Articles 1–5]

When is the inheritance and transfer tax return filed?

Place of deathPlace where the heir is locatedGeneral filing period
TürkiyeTürkiye4 months from the death
TürkiyeAbroad6 months
AbroadTürkiye6 months
AbroadCountry where the death occurred4 months
AbroadAnother foreign country8 months

Declaration of absence (gaiplik) and other special situations are assessed separately. The starting point of the period should not be taken as the day the certificate of inheritance was obtained. Where persons in the same estate are located in different countries, their positions may differ. [1; Law No. 7338, Article 9]

A return must be filed even if the value of the inherited asset falls below the exemption. The position is different where no asset passes at all. For gratuitous transfers between living persons, the rule on filing below the exemption is not the same as for inheritance.

Exemption and rate schedule for inheritance and transfer tax on assets acquired by inheritance in 2026

In 2026, the exemption for the share of each child and of the spouse, the appropriate share of the inheritance falling to each of them, is 2,907,136 Turkish lira (TL); where the spouse is the sole heir, it is 5,817,845 TL. These amounts are not a common deduction applied once to the entire estate. The heir’s status and the share falling to him or her are what matter.

The inheritance rate schedule applies as follows: 1% on the first 3 million TL of the tax base; 3% on the next 7 million TL; 5% on the next 15 million TL; 7% on the next 30 million TL; and 10% on the portion above 55 million TL. The brackets are progressive; moving into a higher bracket does not mean that the entire tax base is taxed at that higher rate. For inheritance transfers occurring within the twenty-year period determined for beneficiaries of the special foreign-income exemption under Article 20/D (repeated) of the Income Tax Law (GVK), a special 1% rate is also examined.

Tax is generally paid in six equal installments in May and November over three years from assessment. Where the asset is sold or a right in rem is created, it may be necessary to pay the entire tax or to provide adequate security. The right to pay in installments does not mean that every disposal can be carried out without any additional conditions.

Determining the taxable value of the estate and the decedent’s deductible debts

Real property, bank accounts, shares, rights and commercial enterprises are not declared using the same valuation method. The situation at the date of death, the statutory valuation measure for the asset and the documents evidencing deductible debts are the basis. The sale listing price of a property and its tax value must not be confused. The existence of the decedent’s debts and their eligibility for deduction must also be proven.

When inheritance money is withdrawn from a bank, a document evidencing payment of the tax or the statutory withholding mechanism may come into play. A certificate of inheritance alone does not complete all the tax checks at the bank.

The decedent’s own income tax and public debts

On death, a special four-month period applies to the annual income tax return. This period must not be confused with the period for the inheritance and transfer tax return, which varies according to geographic circumstances. The partial-year period for the year of death and any earlier-year return not yet filed are considered together. For other tax obligations, the three-month additional period under Article 16 of the Tax Procedure Law (VUK) applies, after checking whether a special provision exists.

For tax debts under the Tax Procedure Law (VUK), the liability of heirs who have not disclaimed the inheritance, with their shares of the estate, is separate from the rule that tax penalties lapse upon death. Tax principal, interest and penalties should not be treated as a single debt line. The effect of other public receivables on the heir is examined under the relevant laws. Special rules on the suspension of time limits for accepting or disclaiming the inheritance, and on enforcement proceedings, are also part of the file.

Continuing or ending the business

If the heirs are to continue the business, transfer on the basis of recorded values and under the statutory integrity conditions may have special consequences for income tax and value added tax (KDV). Taking over all assets selectively is not the same as continuing the business with its assets and liabilities. A current review of carried-forward input VAT and a control against double deduction are also important.

If the activity will not be continued, the closing returns, the VAT position of stock and fixed assets, and the document and device processes must be completed. The statement “I did not take over the business” does not remove the decedent’s past tax debts and the obligations passing to the heirs.

If a vehicle for disabled persons is left to a single heir, does special consumption tax arise?

Transfer by succession to all heirs is different from the transfer of other heirs’ shares to a single person. The other assets of the estate, and the period elapsed since the division and acquisition, are assessed under the conditions for special consumption tax (ÖTV).

Should the tax return be considered separately from the decision to disclaim the inheritance?

The tax calendar and the consequences of dispositions concerning the estate must be considered together with the consequences of disclaiming the inheritance. In particular, before any transaction is made over property in an estate with debts, the civil-law consequence is examined first.

Tax aspects of bank money and land registry transactions

A certificate of inheritance shows the heirs and their shares; it does not replace the declaration and the closing procedures for inheritance and transfer tax. When a bank deposit is paid out or property is transferred, the relevant tax document or statutory withholding process may come into play. It should not be assumed that every inherited asset has the same document and payment procedure.

The value of an asset included in the return is determined under the valuation rule in force on the date the inheritance opened. The price of a later sale is not automatically the inheritance base for each asset. The deduction of debts and expenses is also assessed in terms of substance and documentation; the heir’s personal debt cannot be presented as an estate debt.

Late returns and additional assets

Assets identified later, or a forgotten bank account, must not be left out on the assumption that an earlier return was sufficient. The nature of the supplementary or corrective return and the special time-limit provisions on tax loss (vergi ziyaı) are examined. The additional-period arrangement in the law for inheritance tax does not apply in the same way to all other taxes.

Voluntary disclosure (pişmanlık) and reduction of penalties are different procedures with different conditions. The prohibition on voluntary disclosure in property tax should not be generalized to inheritance tax. Even where heirs make a joint declaration, each heir’s share, exemption and personal tax position is calculated separately.

Tax consequences of continuing the inherited business and of transferring vehicles to heirs

If heirs are to continue the business, tax registration, representation, books and the order of documents should be planned from the date of death. Closing a business is not the same transaction as a business transfer that meets the statutory conditions for VAT. The transfer of stock and fixed assets to heirs is assessed together with whether the business continues.

Where a vehicle acquired with a disability tax exemption passes to heirs by joint inheritance and is then left in the name of a single heir, or later sold to a third party, different ÖTV consequences may arise. The tax exemption on the vehicle and its registration period should be monitored separately from the general tax account of the inheritance. Before a decision is taken on disclaiming the inheritance or on the estate’s debts, the civil-law consequences and the liability for public receivables must be assessed together.

Decision to make before the transaction and the file to prepare

Determine together the place of death, the country where the heir lives and the assets passing by succession. Track the decedent’s returns for the final period separately from the inheritance and transfer tax return, and assess decisions on continuing the business, on transferring a vehicle and on disclaiming the inheritance in terms of their time limits and liability consequences.

Gifts and Gratuitous Acquisition of Property: Inheritance and Transfer Tax, Exemption, Filing Period and Intra-Family Transfers

Giving someone money, real property or another asset without consideration is not merely a private-law relationship between the parties; inheritance and transfer tax may also arise. The taxpayer is, as a rule, the person who acquires the asset. The exemption, the rate and the filing period for a transfer by succession differ from those for a gratuitous transfer between living persons. In 2026, the general exemption for gratuitous transfers is 66,935 TL, while for inheritance there are other amounts and a lower rate schedule for spouse and children. [4]

Not every bank transfer is a gift, and not every gratuitous intra-family transfer is exempt from tax. Whether a payment is repayment of a loan, a contribution to shared expenses or a gratuitous transfer is determined by documents.

Is every bank transfer a gift?

A deposit into a bank account alone does not prove a gratuitous transfer. A genuine debt, repayment of a debt, a sale price, partnership capital, reimbursement of expenses and a gift are different legal relationships. The real content of the transaction, as well as its name, is examined together with the documents. Writing a different explanation on the transfer receipt afterwards, merely to change the tax result, is not sufficient.

For a gift, the giver’s assets must be reduced and the recipient must be enriched without consideration; in a loan relationship, what matters is the obligation to repay and the reality of that obligation. A transfer between family members is not tax-free by nature. It should not be assumed that education, care and ordinary family expenses are of the same nature as transfers of large amounts of assets.

How are connections with Türkiye and abroad assessed?

The transfer of assets located in Türkiye and the transfer of assets belonging to Turkish citizens are assessed within the scope provisions of the law. Citizenship, the place where the asset is located, the situation of the giver and the recipient, and the special exemptions in the law are examined together. Using a foreign bank account does not by itself take the transfer outside Turkish tax law.

Where tax has been paid abroad on the same acquisition, the relevant deduction and document provisions are examined separately. The scope of this tax is not exactly the same as the rules on full and limited liability in income tax. Before a conclusion is drawn from the statement “I live abroad,” the parties to the concrete acquisition and the nature of the asset must be determined.

Inheritance and gift exemptions differ

In 2026 there is an exemption of 2,907,136 TL for the share of each child, including adopted children, and of the spouse; where the spouse is the sole heir, the exemption is 5,817,845 TL. The general exemption for gratuitous transfers between living persons is 66,935 TL. The multi-million-lira exemption granted to a child in inheritance does not apply to a gift that a mother makes to her child during her lifetime.

Exemptions listed separately in the law, such as customary gifts, personal effects, family keepsakes and charitable alms (sadaka), are assessed on their own conditions. Real estate is excluded from the customary-gift exemption. A house given as a wedding present is not wholly tax-free merely because it is called a “gift.”

Where the value of an asset acquired by inheritance falls below the exemption, a return must still be filed. In the case of a gratuitous transfer, no return is filed for an amount below the exemption. Having no inherited asset at all and having an inherited asset below the exemption are different situations; where there is no asset, it is not necessary to submit a petition stating that no return will be filed.

2026 rate schedule and the half rate for close family

Tax base bracketInheritanceGratuitous transfer
First 3,000,000 TL1%10%
Next 7,000,000 TL3%15%
Next 15,000,000 TL5%20%
Next 30,000,000 TL7%25%
Portion above 55,000,000 TL10%30%

Rates apply in brackets; moving into a higher bracket does not mean that the entire base is taxed at the higher rate. For gratuitous transfers from parents, spouses and children, the rates in the gratuitous-transfer schedule are halved, without prejudice to the adopted-child exemption in the law. A close family relationship does not mean that the tax disappears entirely.

For example, if in 2026 a cash gift of 1,000,000 TL is made from a mother to a child, and no other exemption or special situation applies, then after deducting 66,935 TL a tax base of 933,065 TL remains. Half of the 10% rate for the first bracket is 5%, so the tax is 46,653.25 TL. Acquiring the same amount by inheritance does not produce the same result, because the exemption and the tariff differ.

Special 1% rate for inheritance transfers under Article 20/D (repeated) of the Income Tax Law (GVK) applies to persons who have benefited from the twenty-year foreign-income exemption, for inheritance transfers within that period. This provision is not a general 1% rate for all gifts. The document evidencing entitlement, the period and the inheritance nature of the transfer must be checked.

When does the filing period start?

For gratuitous transfers such as gifts, the return is filed within one month of the date on which the asset was legally acquired. For real property, the legal acquisition and the appearance of money in an account are not the same type of event; the acquisition date must be determined for each asset. A declaration later signed by the parties does not automatically change the date of an acquisition already completed in the past.

In inheritance, the period is four, six or eight months depending on where the death occurred and where the heir is located. Where the death occurred in Türkiye, the period is four months for an heir located in Türkiye and six months for an heir located abroad. Where the death occurred abroad, the period is six months for an heir in Türkiye, four months for an heir in the country where the death occurred, and eight months for an heir in another foreign country. In the case of a declaration of absence, a special one-month period applies from the date the decision is recorded in the civil registry of death.

Withholding on competition and lottery prizes, and the responsibility for declaration and payment, are subject to the special provisions governing the organizer (düzenleyen). The one-month general period for gift returns does not apply to these transactions in the same way; the exemption and the special 20% rate for prizes are considered separately.

Return, valuation and supporting documents for gratuitous acquisitions

The return is filed with the competent tax office: for inheritance, the office where the decedent was domiciled; for other transfers, the office where the person making the disposal is domiciled. Special rules apply to residence abroad and to the last domicile in Türkiye. Heirs may file separately or jointly; a joint return requires the signature of every taxpayer. Unless it has been verified that the electronic service covers the type of transaction, it should not be assumed that all gifts can be declared through the same online channel.

A certificate of inheritance, the will, schedules of assets and receivables, the municipal property tax value, vehicle registration, bank letters, company financial statements and the documents evidencing deductible debts and expenses are prepared according to the nature of the acquisition. The declared value is not a freely chosen market estimate for each asset; the statutory valuation measure applies. A bank account or asset discovered later is not excluded from tax review merely because an initial return was filed.

On which dates is tax on gifts and gratuitous acquisitions paid?

In general practice, the assessed tax is paid in six equal installments in May and November over three years. Tax withheld from prizes is paid within the relevant filing period. The filing period and the due date of the first installment must be kept distinct. The tax connection, the documents required in bank or land registry transactions and the conditions for special withholding are examined separately.

After payment, the correct taxpayer and the assessment and installment record are checked. In an intra-family transfer, documenting the legal basis and the date from the outset makes it easier to explain what the transaction was when a bank review takes place years later.

Decision to make before the transaction and the file to prepare

Keep the records that explain the legal basis, the parties and the value of the transfer. Do not confuse the exemption and filing period applicable to gifts with the inheritance rules, and do not read the reduced rate for close family as the complete removal of the tax.
