CLARITY ON FEES AND EXPENSES

Let us first clarify the scope, then the cost.

Let us evaluate together which legal service you will receive, the attorney’s fee and the expenses that may arise separately. The fee and payment terms are explained in writing together with the scope of the work to be undertaken.

The calculations on this page are not an attorney’s fee. They are examples of court and procedural costs. The exact cost of your file can be determined only after the type, stage and needs of the matter have been reviewed.

Attorney’s fee

Payment for legal advisory, contract, application or follow-up services. It is determined according to the scope of the work undertaken; the fee proposal is explained to you separately.

Court fees

Amounts paid to the relevant public authority on account of a lawsuit or an official procedure. They are calculated according to the type, value and stage of the procedure and any exemptions that apply.

Expense advance and other expenses

An expense advance is paid to our office for expenses. Expenditures are shown in the expense advance account with receipts and supporting documents. The advance on costs deposited with the court is a separate item.

The attorney’s fee is determined taking into account the scope of the work, its legal nature and the work required. The stages included in the service, taxes, payment plan and advance on costs are explained separately.

What do we state expressly in a fee proposal?

Review the service scope, fee and payment terms.Show details

In determining the fee, the legal and technical scope of the work, the volume of documents, the effort and time required, the value of the dispute, the follow-up stages and any need for procedures outside Türkiye are assessed. We clarify your questions about the proposal before the agreement.

  • Which legal services and stages are included in the scope
  • The amount of the attorney’s fee or the method of calculation
  • Whether VAT is included or excluded and the tax withholdings that will apply
  • The payment schedule and, if any, the down payment or installment terms
  • The expense advance to be taken for fees and expenses, and other foreseeable costs
  • The method of notification to be followed if new work or additional costs arise

When is the consultation fee announced?

If the appointment is confirmed, the consultation fee is announced; the scope and payment terms are clarified before the consultation begins. Whether the consultation or document review fee will be deducted from a later service is also decided separately.

2026 case and application costs

First select the section in which your case or application falls. The amounts in the frameworks are an example starting budget for the items listed; they are not the exact total to be paid throughout the entire proceedings.

The examples assume that there is no exemption or legal aid and that representation by an attorney requires one fee for a copy of the power of attorney and one power-of-attorney stamp. For physical notifications, the calculation uses 265 TL, VAT included, which is the ordinary domestic notification fee up to 100 grams in PTT’s February 4, 2026 tariff. The date of the procedure, the type of notification and the court’s calculation may change the total.

FIXED-FEE AND PROPORTIONAL-FEE CASE DISTINCTION

Ordinary courts · Civil cases

The starting items for civil courts of first instance (asliye hukuk), commercial courts of first instance (asliye ticaret) and civil courts of peace (sulh hukuk) are listed separately below. The fixed-fee and proportional-fee scenarios are alternatives to each other; the two decision fees are not added together.

Common example: a two-party file, unit fee for ordinary domestic notification up to 100 grams 265 TL; advance on costs = 2 × 5 × 265 + 530 = 3,180 TL. In the proportional scenario, the claim value is assumed to be 100,000 TL, the general rate 68.31 per thousand and the up-front rate 1/4.

Ordinary courts · Criminal investigation and prosecutionShow the sample calculation and expenses

Ordinary courts · Criminal investigation and prosecution

A criminal complaint to the public prosecutor’s office is not evaluated with the calculation for opening a fixed-fee or proportional-fee case in a civil court. The total of a standard civil-case filing fee and HMK advance on costs is not stated. Costs such as private attorney services, documents or special expert examination may arise separately; who will bear the litigation costs is determined according to the provisions of the Code of Criminal Procedure (CMK) and the outcome of the decision.

“No filing fee is charged” and “no costs arise in the process” are not the same thing. The complaint, defense, intervention and legal remedy stages are assessed separately.

FROM OPENING TO THE END OF THE FILE

Do not limit the budget to the opening of the case

We show the opening budget, the costs that may arise during the process and the items after the decision separately. A single amount or range cannot be applied to all files before the type of judiciary, the value and the number of parties are determined.

At opening

Filing and the applicable decision/up-front fee, postage or advance on costs, and costs linked to the power of attorney if required. The attorney’s fee and the expense advance are shown separately.

During the process

New notifications, expert or panel, on-site examination, witnesses, translation, additional fees linked to an increase in the claim and, when necessary, security. Only the items for which a need arises are added. The advance deposited and the expenditures made from that advance are not counted twice.

After the decision

Residual fee balance, allocation of costs and attorney fee depending on acceptance or rejection, possible legal remedies and enforcement procedures. Refund of the unused advance and actual collection from the opposing party are calculated separately.

To prepare a calculation specific to your file

At the first review, we clarify the following information. You need not fill in unknowns with guesses; we complete them in the review of documents and scope.

  • The subject of the dispute and the legal service requested
  • The type and stage of the case/proceeding and, if known, the court
  • The claim amount or the value that may be the basis for the fee
  • Number of parties, addresses and any need for notification abroad
  • The possibility of an expert, on-site examination, witnesses or translation
  • Exemption/legal aid status and any approaching procedural deadline

A fee exemption does not mean that all litigation costs are also covered. The scope and conditions of legal aid are assessed separately. The consequences of a shortfall in the fee, the advance on costs and the evidence advance are not the same; the relevant notice, deadline and applicable procedural provision are the basis.

EXPENSE ADVANCE · RECEIPT · ACCOUNT

How do payment and expense tracking work?

  1. An expense advance is taken for expenses

The attorney’s fee and the expense advance taken for expenses are shown separately. The amount and payment time of the expense advance are determined according to the procedures to be carried out. A file or service reference is used for payment.

  2. An account of the expense advance is provided with receipts

The expenditures made are presented to the client in the expense advance account together with receipts, bank receipts and other supporting documents. The total advance received, the expenditure items and the remaining balance are shown separately. If an additional advance is needed, its purpose and amount are notified.

  3. The remaining balance and refund are clarified

The expense advance account is closed taking into account the expenses incurred and the needs of continuing procedures; the refund of any unused amount is explained. The unused portion of the HMK advance on costs deposited with the court, on the other hand, is as a rule refunded after the judgment becomes final.

The relevant professional document is issued separately for the collection of the attorney’s fee. Confirm payment details through our verified communication channels. In case of a notification of a change of account, call our main line; when sharing a bank receipt, do not send unnecessary account movements or card details.

What other costs can the court request during the process?

Expert, on-site examination, notification and other additional costs.Show details

Not every item arises in every file. After the case is opened, an additional payment may be requested by an interim decision because of evidence, the number of parties and new procedures. In addition to expert costs, the main items are:

On-site examination fee, vehicle and travel

The 2026 tariff contains a 5,188 TL fee for an on-site examination to be carried out by courts. This amount is not the whole cost of the examination. Necessary vehicle, travel, expert and other applicable on-site examination costs may be calculated separately; the same cost is not entered twice.

Witness fee and transportation

In civil cases, under the tariff in force dated October 28, 2025, a witness is paid a fee of 130–200 TL proportionate to the time lost. If necessary, travel, accommodation and meal costs are covered separately. The summons notification is a different item. The criminal witness tariff is regulated separately.

New notification, documents and translation

Address research, notification to a new party or abroad, obtaining documents, announcement, translation, certification and notarial procedures connected with the case may give rise to additional costs. The amount depends on the number of procedures, documents, languages and notifications.

Increase of claim and completion of fees

Amendment (ıslah) or an increase of the claim, a change in the value on which the fee is based, and the decision stage may require an additional fee or a residual fee. Taking into account the amount already paid and any exemption, only the portion that needs to be completed is explained.

Interim protection and security

Applicable fees and costs may arise for an interim injunction, precautionary attachment or preservation of evidence. Security that may also be requested is an amount held as assurance; it is not automatically counted as a litigation cost already spent. The conditions for refund or release are followed separately according to the relevant decision and the law.

Legal remedies, mediation and enforcement

In an appeal or further appeal, the filing and applicable decision fee, notification and file-forwarding costs may arise. Whether mediation costs are charged to the parties is subject to its own rules. If the decision must be enforced, the costs of proceedings, attachment, safekeeping, sale and collection are assessed at a separate stage.

How do we proceed if an additional advance is requested?

  1. The interim decision is reviewed

The purpose of the requested procedure, the amount, which party will pay, the payment period and the consequence of non-payment are identified.

  2. The existing balance is checked

The court advance and the office expense advance are calculated separately. The additional need is explained taking into account the balance usable for the relevant procedure.

  3. Payment and document records are made

A payment made within the period is recorded with a receipt or bank receipt. The advance received, the expenditure made and the remaining amount are shown in the account.

The listing of these amounts in a criminal file does not mean that the complainant will deposit all of them up front. This table does not automatically apply to individual applications to the Constitutional Court.

A panel and specialization change the cost

If more than one expert is appointed, the fee set for each is taken into account. The fee may be increased because of the scope of the file, specialization, effort and time; a reduction may also be made under the conditions in the tariff. Documented examination, transportation, accommodation and other appropriate expenses may be paid separately.

Not every supplementary report creates an additional fee

No separate fee is paid for a supplementary report obtained to remedy a deficiency or ambiguity in the report or to complete questions that were asked at the outset but not answered. For new questions beyond the initial appointment, the authority may set an additional fee. The appointment of a new expert or a new panel is assessed separately.

How do fixed (maktu), proportional (nispi) and up-front (peşin) court fees differ?

The distinction between fixed, proportional and up-front fees; calculation examples.Show details

Fixed: the flat amount stated in the tariff

A flat fee is charged for the relevant procedure. The filing fee and the decision and judgment fee are separate items; whether each applies to the file is checked.

Proportional: an amount tied to the value on which the fee is based

In cases that can be measured in money and to which the general rate applies, the proportional decision and judgment fee is 68.31 per thousand (6.831%). No fixed decision fee is added to this amount for the same decision fee. Minimum limits, special rates and exemptions are reserved.

Up-front: the portion of the decision fee collected at the outset

Under the general rule, one quarter of the proportional decision and judgment fee is collected at the opening. The initial calculation is made on the case value; the final calculation is determined according to the decision and the provisions to be applied, and the up-front payment is credited.

Proportional and up-front fee calculation — show details
General example: case value × 0.06831 × 1/4

This formula does not apply to all disputes. For example, in material and non-material damages cases brought because of death and bodily injury, the up-front rate is 1/20. In dissolution of co-ownership, maintenance, tax, arbitration and enforcement procedures, special provisions are taken into account.

Calculation of the advance on costs — show details

How is the advance on costs determined in civil cases?

According to the HMK Advance on Costs Tariff reviewed, the calculation is made by adding 530 TL to notification fees for a number of notifications equal to five times the number of parties. For a two-party file, this means 10 notification fees + 530 TL.

265 TL is the verified fee for the stated weight bracket of ordinary physical notification; the tariff for electronic and express notification is separate. The type of notification to be applied to the file and the tariff on the date of the procedure are checked. The evidence advance for experts, on-site examination and witnesses is assessed separately. This formula does not apply to postage costs in the administrative judiciary.

What are litigation costs?

Items the law treats as costs, and the distinction of advances.Show details

Litigation costs are payments, recognized as costs by law, made to initiate a case, examine evidence and bring it to a conclusion. They do not consist solely of the court fee and postage advance deposited when the case is filed. In civil cases, the basic scope is regulated in Article 323 of the Code of Civil Procedure (HMK).

Fees and notifications

Filing fees, decision fees and judgment fees; notification, postage, file and document costs incurred because of the case.

Examination of evidence

Expert fees and documented costs, on-site examination costs, witness fees and necessary travel, accommodation and meal costs.

Documents and interim protection

Costs of obtaining official documents; costs of formal notices, notifications, protests, preparing a power of attorney and interim legal protection measures connected with the case.

Other items the court determines at its discretion

If the statutory conditions are met, a party’s travel, per diem and accommodation costs; the awarded attorney fee and other costs deemed necessary during the proceedings.

Can litigation costs be recovered from the opposing party?

The different outcomes of acceptance, rejection, refund and actual collection.Show details

As a rule, yes. In civil cases, except for exceptions in the law, litigation costs are charged to the party against whom judgment is given. If both sides partly prevail, the court takes the rate of acceptance and rejection into account. For this reason, the person who makes the up-front payment and the person who ultimately bears the cost may differ.

If the claim is accepted in full

The court may order that the costs you covered, which the court treats as litigation costs and charges to the opposing party, be paid in your favor. Not every expenditure that is unrelated to the case or unnecessary falls within this scope.

If the claim is partly accepted

Costs are, as a rule, apportioned according to the parties’ rate of success. Part of your own costs may remain with you; you may also be liable for the opposing party’s costs and for the opposing party’s attorney fee award linked to the rejected portion.

If the case is dismissed

The costs you incurred may remain with you. In addition, the opposing party’s litigation costs accepted by the court and, where there is representation by an attorney, the awarded attorney fee may be charged against you.

If the case ends in another way

In cases of settlement, waiver, acknowledgment of the claim or the claim becoming moot, their own rules apply. A party that causes unnecessary costs or delay may bear certain costs even if it wins the case. The allocation of costs and fees should be regulated expressly in the settlement text.

In the administrative and tax judiciary, the reference of Article 31 of the Administrative Procedure Law (İYUK) to litigation costs and the relevant special rules are assessed together. Individual applications to the Constitutional Court, criminal proceedings and enforcement proceedings are subject to their own provisions; the civil-case allocation example here is not automatically carried over to these processes.

The court decision, refund and actual collection are separate stages

The court shows in its decision the type and amount of the cost and to which party and to what extent it is charged. If the amount awarded in your favor is not paid voluntarily, collection is pursued by assessing the nature of the decision, the applicable payment procedure and, where necessary, the condition of finality. It is not assumed that every decision carries a finality condition. The opposing party’s assets, ability to pay and, if any, a stay of enforcement may affect the time of collection; being awarded does not mean that the money reaches the account on the same day.

Refund of the unused portion of the advance deposited with the court differs from collecting costs from the opposing party. Under HMK Art. 333, as a rule, a refund of the unused advance is ordered after the judgment becomes final. The account of the office’s expense advance is closed separately with receipts and supporting documents; the remaining amount is refunded according to the settlement of accounts.

The opposing party’s attorney fee award is separate from the contractual fee

The attorney fee that the court charges to the opposing party under the law and the tariff belongs to the attorney under Article 164 of the Attorneyship Law (Avukatlık Kanunu). The whole of the contractual fee you pay your attorney is not automatically charged to the opposing party merely because you win the case. The provisions in the contract and special statutory situations are assessed separately; the attorney fee award in favor of or against you is shown separately in the file budget.

ABOUT FEES AND EXPENSES

Frequently Asked Questions

Is the first consultation free?

An appointment request is not a commitment to free legal advice. If the appointment is confirmed, the consultation fee is announced; the service scope and payment terms are explained before the consultation. An arrangement made for the consultation does not cover pursuing the case unless that is separately undertaken.

Is the amount in the tariff the exact price of my file?

No. The Antalya Bar Association tariff is a recommendation. The fee for your file is discussed taking into account the scope of the work, the work required and the legal limits. The expense advance taken for fees and expenses is shown separately.

Is the postage cost the same in all courts?

No. In PTT’s February 4, 2026 tariff, an ordinary domestic notification up to 100 grams is 265 TL, VAT included. This fee does not apply to electronic or express notifications. The number of parties, the address, the weight and the type of judiciary affects the total. The 2,650 TL postage advance in the administrative/tax examples was taken from the relevant official list; it is not a single mandatory amount for all courts. The tariff on the day of the procedure and the relevant authority’s calculation are checked.

Are expert and on-site examination fees included in the starting calculation?

They are not included in the opening budgets. A separate expert table and expanded scenarios have been added. The evidence advance the court requests, the number of panel members and the on-site examination to be carried out change the budget. The on-site examination fee is not a single package price covering vehicle, travel and expert costs.

If I increase the value of the case, will there be an additional payment?

An increase in the claim or the value on which the fee is based may require an additional fee. Procedures such as an undetermined claim, a partial claim and amendment (ıslah) have their own procedural conditions. The current value, the amount previously deposited and the rate to be applied are reviewed together; if there is a fee shortfall, the amount to be completed is explained.

If I win the case, do I get back all my payments?

As a rule, the litigation costs accepted by the court are charged to the party against whom judgment is given. In partial acceptance, the rate of success and special rules are assessed. Not every expenditure is covered; the entire attorney’s fee in the contract is not automatically passed on to the opposing party. Refund of the unused advance and actual collection from the opposing party are separate procedures.

What does the opposing party’s attorney fee award mean?

It is the attorney’s fee that the court charges to the opposing party under the rules and tariff to be applied. It belongs to the attorney under the Attorneyship Law. Its relationship to the fee you agree with your attorney is expressly regulated in the contract. If judgment is given against you, an attorney fee award of this kind and litigation costs may arise in favor of the opposing party.

Is a new fee paid for appeal, further appeal or enforcement?

The scope of the task undertaken, the contract and the legislation to be applied are assessed together. Not every legal remedy procedure automatically means a new fee. If separate follow-up, a hearing or new legal assistance outside the scope is required, the terms are explained; agreement is reached separately on the work to be done. Professional obligations that have already arisen are reserved.

What happens if costs increase or payment is delayed?

A new notification, expert, an increase in the claim or another procedure may increase costs. The amount and purpose of the additional need and, if any, the payment period are notified through the expense advance account. If you will be unable to pay on time, tell us immediately. Delay in work already undertaken does not mean that the engagement ends automatically; existing obligations are assessed separately.

If I give up filing a case or reach a settlement, is the fee refunded?

A refund cannot be assumed to be automatically full or zero. The work done, the contract, the stage of the process and the applicable law are reviewed together. Costs already spent, the unused advance, the attorney’s fee and fees paid to the public authorities are assessed separately.

If my ability to pay is insufficient, can I request legal aid?

If the conditions are met, the appointment of an attorney by the bar and a legal aid request to the court for litigation costs may be considered. These are separate application and assessment processes; one does not automatically provide the other. The economic situation and the legal conditions of the application are examined; acceptance is not guaranteed.

Are there other costs for an application from abroad?

Depending on the procedure, translation, notary, consulate, apostille/certification, international notification or local legal services in a foreign country may be required. A single total cannot be given without knowing the country, documents and type of procedure concerned. The payment currency and transfer costs are clarified separately at the proposal stage.

Is a fee charged again for every additional expert report?

No. No separate fee is paid for a supplementary report to remedy a deficiency or ambiguity in the report or to complete a question that was asked but not answered at the outset. For new questions outside the appointment, the authority may set an additional fee; a new expert or panel is assessed separately.

If I do not deposit the additional advance, is my case dismissed immediately?

The consequence of each advance is not the same. In a civil case, if a shortfall in the advance on costs, which is a procedural prerequisite, is not remedied within a firm deadline properly given, dismissal on procedural grounds may come into question. Failure to deposit an advance for a specific piece of evidence may, as a rule, lead to the evidence being deemed waived. The type of interim decision, the deadline, the warning and special provisions are examined together.

If the court charges costs to the opposing party, will I be paid immediately?

A decision being given and collection are not the same thing. Voluntary payment, the conditions for the decision to be enforced, any finality requirement and the opposing party’s ability to pay are assessed. If necessary, the relevant collection or enforcement procedure is pursued; the collection date cannot be guaranteed.

Is security deposited for an interim injunction or attachment an expense?

Security is an amount held as assurance that may be requested for possible risks; it is not counted as a litigation cost already spent at the moment it is deposited. It is tracked separately from fees and procedural costs. The possibility of refund, release or becoming the subject of another claim depends on the terms of the decision and the law.
