The questions below offer a general framework on the effect of a red notice in Türkiye, challenging an INTERPOL record and extradition requests. In a specific case, time limits, documents and the regulations in force are assessed separately.
Showing 1–4 of 4 questions
Is an INTERPOL red notice an automatic pretrial detention order in Türkiye?
No; a red notice is an international wanted-person notice, and a decision of the national authorities is separately required.
The identity of the wanted person, the reason for the search, the conditions for extraditability and human rights risks are examined. In the process of apprehension or extradition in Türkiye, domestic law and the relevant conventions apply.
Can an INTERPOL record be challenged?
Depending on the conditions, an application to INTERPOL’s Commission for the Control of INTERPOL’s Files (CCF) may be considered.
The type of record, the decision of the country relied on, claims of a political offense or of human rights violations, and the grounds for correcting or deleting personal data are supported with documents. An application to the CCF and administrative or criminal applications in Türkiye may proceed separately.
Can a foreign national whose extradition is requested apply for asylum in Türkiye?
A request for international protection and extradition proceedings are assessed under separate conditions.
The principle of non-refoulement, the risk of torture or ill-treatment, the political nature of the accusation and the relevant court decisions must be examined together. A protection application does not in every case automatically end the extradition process.
Does an international wanted-person record cause a citizenship application to be automatically rejected?
No; a concrete link must be established between the record and the administration’s statutory assessment criteria.
The applicant’s identity, whether the record is up to date, the criminal accusation, whether there is a final judgment and the grounds of the security review are investigated. The legal remedies against an administrative rejection decision are assessed according to the specific decision.
