Showing 1–7 of 7 questions

Which documents and reasons are examined when a residence permit application is refused?

The written reasoning of the refusal decision, the type of residence permit, the date of notification and the applicant’s concrete circumstances must be examined together.

The conditions of short-term, family, student and other residence permits differ from one another. The statutory basis of the reason for refusal, the foreigner’s entry and stay records, address and health insurance documents, income status and the accuracy of the documents submitted are investigated. The administrative or judicial avenues of recourse against the decision and the effect of those applications on staying in Türkiye must be determined separately. It should not be assumed that making an application automatically gives a right of lawful stay.

Which steps need to be considered before a residence permit period ends?

An extension application and the currency of the application conditions should be checked before the permit expiry date approaches.

The application route and timing appropriate to the type of permit are assessed through the e-İkamet system of the Presidency of Migration Management. A valid passport, address, health insurance, the reason for stay and the relevant supporting documents should be kept up to date. The e-İkamet application record and appointment documents should be kept. If the permit period has expired, consequences may arise such as the requirement to apply from outside Türkiye or a visa/residence violation; the specific status and current administrative practice should be checked.

When a residence permit application is refused, must one leave Türkiye immediately?

The outcome varies according to the type of decision, the notification and the status of lawful stay.

Refusal of a residence permit, a deportation decision and an entry ban into Türkiye are different administrative acts. The full text of the document served, the previous status of stay and the available avenues of action and interim measures should be examined without delay.

Can missing documents in a residence permit application be completed later?

It may be possible within the completion procedure and time limits recognized by the administration.

The record in the application system, the deficiency letter and the firm deadline given should be preserved. Remedying the deficiency and acceptance of the application are not the same thing; the substantive conditions of the residence permit must also be met.

Does cancellation of a residence permit and cancellation of a work permit lead to the same outcome?

No; the basis of the permits, the right of stay and the cancellation procedures are different.

The situations in which a work permit can take the place of a residence permit, and the exceptions depending on the type of permit, should be assessed in terms of Laws No. 6735 and No. 6458. The termination of the employment relationship may affect the continuation of the status.

When should a residence permit extension application be made?

The extension application should be made from the point when 60 days remain until the current residence permit expires, and in any event before the permit period expires.

Under the current practice of the Presidency of Migration Management, a residence permit extension application can be started through the e-İkamet system from the point when 60 days remain until the current permit expires, and in any event must be made before the current residence permit period expires. The validity of the passport, the address record, health insurance and the other documents specific to the type of residence permit should be checked separately. Merely starting the application in the system should be distinguished from duly completing the required documents.

How long does it take to conclude a residence permit application?

Within the statutory framework, the application is expected to be concluded within 90 days at the latest from the date the required information and documents are fully submitted to the competent authority.

Under Law No. 6458 and the practice of the Presidency of Migration Management, the 90-day period is counted not from the date the application form is first opened, but from the date the required information and documents are completed before the competent authority. If the period is extended, the foreigner must be informed. Missing documents, address and identity verification processes should also be taken into account.
