What can be done if the days worked are missing in the SGK service statement?
The options of correcting the record and, where necessary, an action for determination of service can be examined.
Entry and exit documents, payroll, bank payments, workplace records and witnesses are assessed. Because special preclusive periods and exceptions may apply to the determination of service, the working periods must be examined one by one.
Does the granting of SGK income because of an occupational accident prevent a compensation action?
No; social security benefits and compensation claims against the employer or other liable parties are different.
Whether the accident qualifies as an occupational accident, fault, permanent incapacity for work and the effect of payments made by the SGK on the calculation of the loss are assessed. Attention must be paid to recourse or duplicate payment issues.
Can the refusal of a retirement request be the subject of an action?
Yes; depending on the grounds of refusal and the application route, an administrative or judicial process can be considered.
