The questions below offer a general framework on annulment of a building permit, fines for unpermitted construction, zoning plan amendments, and demolition orders. In a specific case, the time limits, documents, and the regulations in force are assessed separately.
Showing 1–4 of 4 questions
Can a building permit issued by the municipality be annulled?
If unlawfulness is alleged, the options of an administrative application and an annulment action may be assessed.
The zoning plan, the project, the competent authority, the notification, and the claimants’ interest underlying the permit are examined. The consequences of annulling the permit for the construction and for third parties are assessed separately.
How is a fine imposed for unpermitted construction reviewed?
Under the Zoning Law No. 3194 and the rules in force on the date of the act, the basis, calculation, and procedure of the fine can be reviewed.
The stop-work record, the nature of the deviation from the permit, the building class, the area, and the reasoning for the fine calculation should be examined. A fine and a demolition order may be different acts and subjects of litigation.
If a zoning plan amendment reduced the value of an immovable, can compensation be requested directly?
Not every loss in value automatically gives rise to compensation; the lawfulness of the plan and the nature of the interference are examined.
The conditions for annulment of the plan, disproportionate restriction of the right to property, and claims of legal seizure are different. The plan notes, the public display process, the previous use of the immovable, and the administrative application records are assessed.
Does filing a lawsuit against a demolition order automatically stop the demolition?
Generally no; a request for a stay of execution should be assessed separately.
The conditions under Article 27 of the Administrative Procedure Law, the notification of the decision, the date of execution, and the possibility of damage that is difficult to remedy should be substantiated. A zoning fine and a demolition act produce separate legal consequences.
