The questions below offer a general framework on applications in cases of environmental pollution, EIA decisions, noise pollution and environmental administrative fines. In a specific case, time limits, documents and the regulations in force are assessed separately.
Showing 1–4 of 4 questions
Which institutions can be approached with an allegation of environmental pollution?
Depending on the nature of the incident, an application to the environmental administration, the municipality and the judicial authorities can be considered.
The source of the pollution, the time of measurement, permit and inspection documents, and environmental impact documents are important. A request for an administrative sanction, remedying environmental damage and private-law compensation are separate routes.
Does a positive EIA decision make every kind of environmental intervention lawful?
No; the decision matters only with respect to the relevant procedure and does not remove other permits and environmental obligations.
The environmental impact assessment (ÇED) report, the participation and announcement processes, the actual implementation of the project and subsequently changed conditions are examined. In judicial review, scientific and technical data and procedural conditions are important.
Can a lawsuit be filed against a neighbor because of noise pollution?
If the conditions are met, claims to prevent interference with the right of ownership or claims for damages may arise.
Sound measurements, hours of use, zoning and permit conditions, witness statements and effects on health are assessed. An administrative complaint and a lawsuit arising from neighbor law are separate.
What route is followed against an environmental administrative fine?
The route of objection or lawsuit is determined according to the statutory basis of the fine and the special application regime.
The inspection report, the sampling method, the laboratory result, the authority to issue the act and the date of service should be examined. The time limit and the competent authority are not the same for every environmental fine.
