Summary

How are the escape offense, the two-day period, service and the warning notice examined when a person does not surrender after being returned to prison? A legal assessment in light of a Criminal General Assembly decision.

Violating a supervised release obligation and failing to surrender after a decision to return the person to a penal execution institution are not the same legal event. A violation may lead the enforcement judgeship to issue a return decision. Failing to surrender within the time limit despite the return decision may, in addition, give rise to criminal liability under Article 105/A/8 of Law No. 5275 and Articles 292–293 of the Turkish Penal Code. When assessing whether the escape offense has been committed, the notification of the decision, the time limit for surrender, the authority of surrender, the warning notice and intent must be examined together.

This review is limited to the special provision on returning to the institution from enforcement under supervised release. The conditions of different events, such as physically escaping from a prison, being late returning from leave, or the escape of a person in pretrial detention, should not be treated as the same.

Is Every Supervised Release Violation an Escape Offense?

The stages of violation, return and failure to surrender

When a signing day is missed, the relevant obligation and the excuse must first be assessed. If the conditions of persistence under Articles 44 and 87 of the Regulation are met, the process of returning the person to an open institution may be set in motion. The directorate’s request for return is not by itself a return decision. The decision of the enforcement judgeship and the acts that follow it are separate stages. [1]

From the standpoint of criminal liability, the sequence of events is decisive: the valid obligation, the assessment of the violation, the return decision, the notification and the conduct of not surrendering. Each deficiency in this chain does not lead to the same legal result. For example, being unable to attend signing because of illness concerns the basis of the return decision, whereas a missing warning notice in the return decision may concern the criminal assessment of the later failure to surrender.

Failing to make the initial application is a separate situation

Article 105/A/8 of Law No. 5275 separately regulates those who have also not applied to the supervised release directorate within two days following the end of the initial application period, and those who do not surrender to the nearest chief public prosecutor’s office within two days after the return decision. The initial application to the directorate and the surrender period after return should not be confused. The applicable period is determined according to the stage at which the person is. [2]

Why Do Service of the Return Decision and the Warning Notice Matter?

Knowing of the decision versus learning its consequences

A convict merely knowing that supervised release has ended is not the same as being informed where and within what time to surrender and what the criminal consequences of not surrendering are. When preparing the defense, the text of the decision and the service envelope should be examined together. Merely seeing that a decision exists in UYAP does not show that all notification conditions have been fulfilled.

In the content of the warning notice, the authority of surrender, the time limit and the legal consequences of not surrendering within the time limit should be looked for in particular. Where these appear in the decision or in the service document should be shown concretely. When making a defense of deficient notification, when and to what extent the person learned of it by another route should also be stated honestly.

How is the start of the two-day period examined?

The provision in the text of the law running the period from the return decision does not make it unnecessary, for purposes of criminal liability, to investigate notification and intent. In decisions given in absentia in particular, the date of the decision, the date of service and the date of actual learning must be determined separately. Without examining these data in the specific file, the same last day for surrender cannot be given for everyone.

As to the authority of surrender, the provision of Article 105/A/8 on surrender to the nearest chief public prosecutor’s office is important. It should not be assumed that the procedure is complete because the person applied to another institution on his or her own; the surrender record and the direction given by the relevant authority should be documented. Filing an application against the return decision does not by itself stop the obligation to surrender either.

The 2025 Decision of the Criminal General Assembly of the Court of Cassation

Which deficiencies were examined in the decision?

In the decision of the Criminal General Assembly (Ceza Genel Kurulu) dated 24.12.2025, E. 2023/232, K. 2025/607, the fact that action was taken at the MERNIS (central civil registry) address without serving notice at the last known address, and the absence of a warning notice to surrender, were discussed. Although it was assessed that the defective service became valid upon learning, the Assembly reached the conclusion that intent could not be accepted because of the absence of a warning notice explaining the time limit, the authority and the consequences of surrender. The conviction was reversed because it had not been taken into account that the elements of the offense had not been met. The decision was given by majority, with seven members dissenting. [5]

This reasoning shows the distinction between service being treated as formally valid and all elements of criminal liability being realized. However, it cannot be said that every notification deficiency will produce the same result in every file; actual knowledge, the content of the notification and the other features of the event must be examined.

How should the reference to a closed institution in the earlier decision be read?

The decision refers to return to a closed institution because of the historical event. Following the amendment made to the relevant provision by Law No. 7242, the concept of an open institution is used. The legislation applicable to the old event must be distinguished from the provision applicable to a current application; the historical wording of the decision should not be reported as a current operating instruction. [2]

How Is a Defense Based on Defective Service Prepared?

The last known address and the MERNIS address

Within the framework of Articles 10 and 21/2 of the Law on Notification No. 7201, it should be investigated to which address and at which stage service was issued. In particular, if an address was clearly stated in a petition previously submitted to the directorate, it matters why that address was not used even though it was in the file. Not every MERNIS service is defective; the concrete sequence of acts is assessed. [3]

In the review, the front and back of the service receipt, the return envelope, earlier address notifications and the dated petitions in the file should be obtained. Merely saying “my address was different” does not suffice to explain which address was known to the relevant authority.

Distinguishing the date of learning from the deficient warning notice

Under Article 32 of the Law on Notification, defective service may become valid under certain conditions when the addressee learns of it. For this reason, a defense should not be made as if there had been no service at all while concealing the actual date of learning. On the other hand, learning does not mean that all explanations that the notification did not contain are deemed to have been made. The formal service problem and the deficiency in the warning notice should be assessed under separate headings. [3]

Our article on defective service and restoration of the prior status is complementary for legal-remedy problems linked to service. Restoration of the prior status, however, is not a result that can be applied automatically in every event; its special conditions and time limits must be investigated separately.

Which Documents Should Be Gathered for the Defense?

The enforcement file and the criminal investigation should be examined together

DocumentPurpose of review
Full text of the return decisionBasis of the decision, content of the surrender and warning notice
Service receipt and envelopesAddress, method, date and statements
Earlier address petitionsDetermining the last known address
Directorate warnings and supervision planHow the return process arose
Records of learning or surrenderActual knowledge and the chronology of conduct
Health, detention or other obstacle documentsAssessing why surrender did not take place

The defense should link each document to an allegation. If the warning in the decision exists, it cannot be asserted as if it did not; how it was communicated to the person and what it means in the specific event can be argued. If an excuse is claimed, it should be explained whether it covers not only the signing day but also the period in which surrender was required.

The application against the return decision and the escape defense proceed separately

The application against the return decision under enforcement law and the criminal investigation conducted under Article 292 of the Turkish Penal Code are not the same file. While the unlawfulness of the return decision is raised within the time limit, a defense on the elements of the offense must be made in the separate criminal file. Filing a petition in one does not remove the time limits and obligations of the other.

Against an enforcement judgeship decision, Article 6 of Law No. 4675 provides for an objection within two weeks of notification. It should be borne in mind that the application does not provide an automatic stay; if necessary, a stay request should be made separately with concrete reasons. [4] The general framework of the application routes is covered in our article on application and objection to the enforcement judgeship.

Does an Acquittal Automatically Remove the Disciplinary Penalty?

The relationship between criminal liability and the disciplinary act

An acquittal of the escape offense or the reversal of a conviction does not mean that the disciplinary act is automatically deleted from the system. The basis of the disciplinary decision, the reasons for the acquittal and the finality status should be examined together, and the competent authorities should be asked to reassess. It must be shown what significance the criminal court’s findings on the material facts have in the disciplinary file.

Especially where it has been accepted that the necessary notification was not made, a reassessment of the grounds for the disciplinary sanction applied for the same conduct may be requested. This should not be presented as a settled general rule that every acquittal gives rise to an automatic annulment of discipline. This suggestion is a separate legal assessment; it should not be confused with the operative result of the Criminal General Assembly decision.

The enforcement consequences should be followed separately

A disciplinary sanction may affect the assessment of staying in an open institution and of conditional release. However, the effect depends on the type of sanction, its enforcement, its removal and the status of the personal file. The conclusion that “the right to conditional release is completely lost” cannot be drawn in every return event. For the related procedures, our review of disciplinary penalties in prison and objections may be read.

Conclusion

In an allegation of failing to surrender after return from supervised release, looking only at how many days have passed is not enough. The notification of the decision, the content of the warning notice, actual learning and the conduct of surrender must be investigated together. The approach of the Criminal General Assembly shows the importance of this review. The application against the return decision, the defense to the escape offense and any disciplinary acts should be followed separately; it should not be assumed that the outcome in one file automatically removes all other acts.

Frequently Asked Questions

Does a signing violation directly constitute the escape offense?

Not every signing violation is an escape. The conditions for return and the elements of conduct that may give rise to separate criminal liability under Article 105/A/8 must be examined.

If the return decision contains no warning notice, is acquittal certain?

The stated decision of the Criminal General Assembly is a strong basis for review. However, in each file the decision, the service and actual knowledge are assessed together; no assurance of the outcome can be given in advance.

Does learning of defective service cure a missing warning notice?

Defective service being treated as valid upon learning and information about the authority, time limit and consequences of surrender are different issues. The stated General Assembly decision draws this distinction.

Can I choose not to surrender because I have filed an objection?

An objection does not provide an automatic stay. The content of the decisions and of any stay order should be taken as the basis; it should not be assumed that the obligation to surrender is lifted merely because an application was made.

Does an acquittal in the escape file bring supervised release back?

It does not bring it back automatically. The legal status of the return decision and, if any, discipline and the enforcement calculation must be assessed separately.
