Purpose and scope of the catalog
INTRODUCTION
The AYM website contains individual application handbooks, rights-based guides and presentations. The selection below is intended for reading on constitutional rights and the state’s duty of protection. The works listed are separate from the original Güneş & Güneş guides prepared within the scope of this work. The source survey was carried out on October 12, 2026.
Quick start: which source should you look at first?
For the current application procedure, the AYM’s individual application guide, the Rules of Procedure and the online application guide should be used together. Handbooks are useful for the conceptual framework of rights. Older training presentations, in turn, are a historical training source; they should not be used alone for today’s time limits and procedures. [Y1–Y5]
| Need | Suggested starting point | Usage note |
|---|---|---|
| Preparing an application to the AYM | Individual Application Guide | Read together with the current official form and procedure. |
| A lawyer’s electronic application | Online Application Guide | The UYAP Lawyer Portal system began on 1/10/2025. |
| The concept of positive obligation | Akandji-Kombe’s handbook | Turkish edition 2008; to be supplemented with current case law. |
| Private life and family | Guide to the Right to Respect for Private and Family Life | Provides a starting point for detailed research by right. |
| Examples of training presentations | AYAM Books and Presentations index | The selected presentations belong to the 2010 meetings. |

Individual application guide and handbooks
The Individual Application Guide is the AYM’s main access point for applications. The Individual Application Handbooks page lists works on areas such as liberty and security, expression, association and assembly, fair trial, life, property, procedure and private family life. The page is a publication index; it should not be assumed that all the books were updated in the same year. [Y1, Y2]

Making an individual application online
The Online Application Guide — PDF relates to the electronic application process for lawyers. The AYM’s announcement of the system states that applications began to be accepted through the UYAP Lawyer Portal on October 1, 2025. The general application requirements apply separately. [Y3]

Admissibility criteria
Individual Application to the Constitutional Court: Admissibility Criteria — PDF focuses on the conditions assessed before the merits of an individual application are reached. Because the content version of the file could not be re-verified against the full text in this survey, the year of publication or update has not been finalized here. It should be used together with the current law and Rules of Procedure. [Y4]

Freedom of expression
Freedom of Expression — PDF is one of the access points in the rights-based handbook series. It can be a starting source in preparing guides on statements of opinion, the press and sanctions; new decisions must be surveyed separately. [Y2]
Private life and family life
The Guide to the Right to Respect for Private and Family Life — PDF and the handbook on the right to private life — PDF are separate files. They should not be presented as the same version of a single work. They are useful sources for research in the areas of personal data, family and privacy. [Y5]

The positive obligations book supplied by the user
Jean-François Akandji-Kombe’s work Positive Obligations under the European Convention on Human Rights is the 7th book in the Council of Europe’s Human Rights Handbooks series. The work’s copyright year is 2007 and its Turkish edition is 2008. Its being hosted on the AYM website does not mean that the AYM wrote the work. [Y6]
The PDF on the AYM website returned an access error on direct download during the survey. The same work is accessible through the PDF on the server of the Ministry of Justice Directorate General for Human Rights. The book has been read; the time limits and decisions used in the new guide have been separately checked against primary sources. The full book is not redistributed in this publication package.

Are there ready-made presentations on the AYM website as well?
Yes. The AYAM Human Rights Information Bank — Books and Presentations index lists works presented at the round-table meetings of 2010. The following are examples relevant to this task. The title, speaker and meeting period are recorded as they appear in the index; the PPTX or PDF format of the files has not been verified one by one in this survey. [Y7]
AYAM Human Rights Information Bank — Books and Presentations
| Presentation | Speaker | Meeting period in the index |
|---|---|---|
| Obligations in the Context of Article 3 of the ECHR | Eric Svanidze | April 15–16, 2010 |
| Investigation of Ill-Treatment: Criteria for the Effectiveness of the Investigation in the Context of the ECHR | Eric Svanidze | April 15–16, 2010 |
| The Right to Life under Article 2 of the ECHR | Gürsel Yalvaç | April 15–16, 2010 |
| Protection of the Environment under International Law and European Law | Lorenzo Cuocolo | June 9–11, 2010 |
| Trade-Union Rights in Türkiye within the Framework of the Social Rights in the Constitution | Engin Yıldırım | November 8–10, 2010 |
| Freedom of Assembly and Association — Constitutional Court presentation | Hikmet Tülen | December 1–3, 2010 |
The historical content of these presentations does not serve the same function as a current application guide. In particular, the AYM individual application, the ECtHR time limit, electronic application and later developments in case law must be checked separately. The index link can be used to reach the relevant title in the list.
Other official research points
The Basic Texts section provides access to the Constitution and international texts. The Precedent Decisions on Violations of Fundamental Rights and Freedoms section and the Decisions Information Bank can be used to compare the explanations in the books with the full text of decisions. These have not been counted as standalone PDF books in this catalog.
Precedent Decisions on Violations of Fundamental Rights and Freedoms
The ECtHR’s index of official case-law guides is a complementary source with respect to the articles of the ECHR. The update date of a guide’s main version and the date of its Turkish translation may differ. The language and version used should be recorded.
Conclusion
The AYM and AYAM websites contain both ready-made guides and training presentations. For current practice, legislation, official procedural explanations and the full text of decisions should be used first. The two new Güneş & Güneş guides and two presentations that have been prepared are original content that explains these sources according to the reader’s needs; they are not copies of the official works or an officially approved version.
Frequently Asked Questions
FAQ
Were all the PDFs in the catalog downloaded?
No. Some AYM addresses returned errors on direct access. The titles and links were verified from official indexes and search results; the difference in accessibility is noted in the technical source record. The accessible official copy of the positive obligations book has been reviewed.
Can we use the old presentations in current training?
They can be used for historical reading, with the source and date indicated. In a current legal account, it must be separately verified that the content of the old presentation is still valid today. The right to republish or reproduce should not be inferred merely from the fact that it is accessible on the internet.
